091806m HARNETT COUNTY BOARD OF COMMISSIONERS Minutes of Regular Meeting September 18, 2006 The Harnett County Board of Commissioners met in regular session on Monday, September 18, 2006, in Courtroom 6, Harnett County Courthouse, 301 West Cornelius Harnett Boulevard, Lillington, North Carolina. Members present: Teddy J. Byrd, Chairman Beatrice B. Hill, Vice Chairman Dan B. Andrews Walt Titchener Tim McNeill Staff present: Neil Emory, County Manager Wm. A. (Tony) Wilder, Assistant County Manager Dwight W. Snow, County Attorney Kay S. Blanchard, Clerk to the Board Chairman Byrd called the meeting to order at 7:00 p.m. and Vice Chairman Hill led the pledge of allegiance and prayer. Commissioner Titchener moved to approve the agenda as published with the following additions: - to the consent agenda, a proposed amendment to administration services contract regarding Lockhart/Shawtown Revitalization Project - to the regular agenda a proposed resolution to adopt an administrative plan for Section 8 Housing and a proposed resolution to revise Section 8 Housing utility schedule. Commissioner Andrews seconded the motion and it passed unanimously. Upon motion by Commissioner McNeill and seconded by Commissioner Titchener, the Board unanimously approved the following items on the consent agenda: 1. Tax refunds and releases (Attachment 1) 4. Increasing change order in the amount of $84,039.65 to Barnhill Contracting Company for runway extension paving and lighting at the Harnett County Airport. No new funds are required. This is the final change order for this project. 5. Summary report on recent airport property litigation settlement terms (Attachment 2) 6. Water line extension for William T. Jackson, Bennett Road, Coats – the requested extension has been budgeted for in Public Utilities’ operating budget and meets the 50 point threshold for Board consideration. 7. Authorization for Bunnlevel Volunteer Fire Department to purchase a 100 Kw Caterpillar generator, all necessary materials to connect the equipment to the station, a 5’ x 10” x 6” concrete pad for the generator and fuel tank to set on, a transfer switch to convert from Progress Energy service to generator, permits and other necessary papers to allow installation and use. The approximate cost of the project is $40,000.00. This expenditure was not included in the FY 2006-2007 Budget. 8. Authorization to accept North Carolina Department of Environmental and Natural Resources (DENR) Recreation Trails Program Grant. The amount of the grant is $25,638.00 and the local match of $6,410.00 will be an “in-kind” contribution. The funds will be used for maintenance for erosion control (repair and prevention) on the Dunn-Erwin Rail Trail as well as seeding, mulching and planting of flowers and shrubbery along the trail. 9. Mid-Carolina Area Agency on Aging county services summary and provider services summaries. 10. Increasing change order in the amount of $12,791.25 for Park Construct Contract A2. This change order is needed to adjust the quantities of construction materials needed for a portion of the Harnett Fuquay Wastewater project. The materials include 36” 150 DIP, 8- 1C’ and concrete anchors for 36” DIP. 11. Cost amendment to engineering services contract with Marziano & Minier associated with the Erwin Wastewater project. The amount of the increase is $23,745.00 and is needed because of additional collection system evaluation work to be done in Erwin. This will be paid from contingency in the project budget. 12. Increasing change order in the amount of $186,701.50 for Temple Grading due to the upsizing of the Dry Creek interceptor from 18” to 21”. The increase is being funded by the Town of Angier as it was necessitated by its coming into the project. 13. Increasing change order in the amount of $296,307.65 for Hobby Construction associated with the Titan Extension Waste Water project. This increase is due to additional repairs and services in order to complete the construction of the gravity waste water line on Hwy 401 South. The increase will be funded from contingency in the project budget but Public Utilities hopes to recover much of this funding from the continuing negotiations with the bonding company representing the former contractor, Sandhills Contracting. 14. Amendment to agreement for administration services for the Community Development Program – Lockhart/Shawtown Revitalization Project. The amendment is to compensate The Wooten Company for additional time required for project activities due to unforeseen circumstances (estate and zoning issues, uncooperative owners, etc.). The additional activities shall be completed within seven months and the amended compensation is $14,049.00. Mark Locklear, Manager of Planning Services, introduced a proposed Flood Damage Prevention Ordinance for the Board’s consideration. Christi Barthelme, Long Range Planner, presented an overview of the proposed Ordinance and stated the purpose of the Flood Damage Prevention Ordinance is to promote public health, safety, and general welfare and to minimize public and private losses due to flood conditions within flood prone areas of the County. The Planning Board recommended adoption of the proposed Ordinance. Chairman Byrd called to order a public hearing and opened the meeting for comments from the public. No comments were offered and Chairman Byrd closed the public hearing. Commissioner McNeill moved for adoption of the Flood Damage Prevention Ordinance as presented. Commissioner Andrews seconded the motion and it passed unanimously. The Ordinance is copied into Ordinance Book 2, page___. Joseph Jeffries, Planning Director, presented for the Board’s consideration, a proposed Resolution Adopting the Revised Agency Determination Areas of the Administrative Plan for the Harnett County Section 8 Housing Program. Commissioner Andrews moved to adopt the resolution. Vice Chairman Hill seconded the motion and it passed unanimously. (Attachment 3) Joseph Jeffries, Planning Director, presented for the Board’s consideration, a proposed Resolution Adopting a Revised Utility Allowance Schedule for the Harnett County Section 8 Housing Program. Commissioner Andrews moved to adopt the resolution. Vice Chairman Hill seconded the motion and it passed unanimously. (Attachment 4) Mr. Emory presented for the Board’s consideration, a request from Central Carolina Community College for an appropriation of $152,380.00 to assist with funding of the West Harnett Center project due to bids far exceeding the available funds. The college plans to pursue a grant to fund a portion of the overrun, but would also need the additional monies requested from the County. Commissioner Titchener moved to approve the $152,380.00 appropriation contingent upon the college receiving the pursued grant. Vice Chairman Hill seconded the motion and it passed unanimously. Mr. Emory noted that the Town of Coats has requested the waiver of solid waste fees at the landfill for waste generated from the demolition of abandoned homes and buildings in the Town. This request would apply to buildings demolished as a result of the enforcement of Town ordinances. Commissioner Andrews moved to authorize waiver of 50% of the fees for waste being disposed of in the C&D landfill as the result of enforcement of a municipal ordinance regarding demolition of abandoned homes and buildings. Other items requiring transport to a sanitary landfill would continue to be charged at normal rates. This policy will apply to all towns in Harnett County. Commissioner Titchener seconded the motion and it passed unanimously. Mr. Emory reported that a Base Relocation And Closing (BRAC) Fair was recently held in Atlanta. It was very successful, and included participation by Harnett County representatives. After a discussion regarding cost of housing County EMS units at fire departments, Commissioner McNeill moved to standardize the amount paid to fire departments to offset costs for EMS units being based at their facilities. The County will pay $400.00 per month to the following departments: Flat Branch, Angier, Spout Springs, and Northwest. Vice Chairman Hill seconded the motion and it passed unanimously. There being no further business, Commissioner Titchener moved to recess this meeting to reconvene Wednesday, September 20, at 9:00 a.m. in the County Administration Building. The Board will consider agreements regarding proposed water and wastewater service to Fort Bragg.
