2021/04/05 RESOLUTION OF THE HCBOC DECLARING PERSONAL PROPERTY AS SURPLUS & AUTHORIZING THE DISPOSITION OF PERSONAL PROPERTY BY DONATION RESOLUTION OF THE HARNETT COUNTY BOARD OF COMMISSIONERS
DECLARING PERSONAL PROPERTY AS SURPLUS AND AUTHORIZING THE
DISPOSITION OF PERSONAL PROPERTY BY DONATION
WHEREAS, the Harnett County Public Library Main Branch(hereinafter referred
to as the"Library")relocated to the new Harnett County Resource Center and Library at
455 McKinney Parkway, Lillington,North Carolina 27546; and
WHEREAS, the County of Harnett(hereinafter referred to as the"County")
purchased new furniture for the Library; and
WHEREAS, the remaining furniture and fixtures located at the Library's old
facility at 601 S. Main Street, Lillington,North Carolina 27546, identified on the attached
Exhibit A, is surplus to the needs of the County; and
WHEREAS,pursuant to North Carolina General Statute § 153A-176 and § 160A-
274, the County may donate to any other governmental unit any interest in real or
personal property; and
WHEREAS,the Harnett County Board of Commissioners desires to donate the
surplus property to the Town of Erwin,North Carolina to be used in its library to assist
with the provision of library services to the public.
NOW, THEREFORE BE IT RESOLVED by the Harnett County Board of
Commissioners as follows:
1. That the furniture and fixtures identified in Exhibit A are hereby declared
surplus property.
2. That the County Manager is authorized to transfer and execute any documents
necessary to transfer the property to the Town of Erwin,North Carolina
3. That the County of Harnett makes no express or implied warranties of
merchantability of any surplus property, or part thereof, or its fitness for a
particular purpose regardless of any oral statements that may be made
concerning the surplus property or any part thereof.
4. That this resolution shall be effective upon its adoption.
