080916wsmHARNETT COUNTY BOARD OF COMMISSIONERS Minutes of Work Session August 9, 2016 The Harnett County Board of Commissioners met in work session on Tuesday, August 9, 2016, in the County Manager's Conference Room, County Administration Building, 102 East Front Street, Lillington, North Carolina. Members present: Gordon Springle, Vice Chairman Abe Elmore, Commissioner Barbara McKoy, Commissioner Joe Miller, Commissioner Member absent: Jim Burgin, Chairman Staff present: Paula Stewart, Deputy County Manager Dwight Snow, County Attorney Kimberly Honeycutt, Finance Officer Margaret Regina Wheeler, Clerk Vice Chairman Springle called the meeting to order at 9:00 am. Commissioner Elmore led the pledge of allegiance and invocation. The following agenda was before commissioners: ➢ Harnett County Health Director requests approval to establish the Engineered Option Permit Fee $225 ➢ Emergency Services requests permission to receive satellite equipment upgrades to one of Harnett County's mobile towers ➢ Staff Recommendations for the bid awards of service contracts for Fire Extinguisher Maintenance, Pest Control and HVAC ➢ Development Services: 1) Problem Property (60 Gladiola Drive) Voluntary property conveyance as a method of compliance; 2) Problem Property (365 Betts Road) Code official requesting Ordinance to perform demolition; 3) Problem Property (218 Smith Prince Road) Update concerning property abatement; and 4) Update concerning a Proposed Panhandling Ordinance. ➢ County Manager's Report: 1) Relay for Life, May 19, 2017 2) Boone Trail Update 3) Update regarding Atlantic Coast Pipeline 4) August 15, 2016 Regular Meeting agenda review ➢ Closed session August 9, 2016, Work Session Minutes Harnett County Board of Commissioners Page 1 of 4 Harnett County Health Director John Rouse requested approval to establish the Engineered Option Permit Fee at $225. Mr. Rouse reported a new law was passed during the 2015 General Assembly; which became effective July 1, 2016, that allows engineers to be able to go in and do septic permits. He noted citizens can now hire an engineer to do their septic tank and reviewed the process this would involve. Mr. Rouse reported the new regulations allow counties to set a fee that is 30% of their existing fee which is now $750 in Harnett County. He noted the Board of Health recently recommended setting the Engineered Option Permit Fee at $225. Commissioners will consider approval of the new fee during their upcoming regular meeting. Emergency Services Director Jimmy Riddle and Larry Smith requested approval to receive satellite equipment upgrades to one of Harnett County's mobile towers via a Department of Homeland Security/DPR grant. Mr. Smith said the state will take care of everything and no County funds are required. Staff noted this equipment will give us backup communication capabilities. Commissioners will consider the request during their upcoming regular meeting. Mrs. Stewart presented staff recommendations for the award of bids for the following service contracts: 1. Fire extinguisher service bid for July 1, 2016 - June 30, 2019 be awarded to Allied Fire & Safety in the amount of $12,030.00. 2. Pest and fire ant control service bid for July 1, 2016 - June 30, 2019 be awarded to State Pest Control in the amount of $52,110.00. 3. HVAC bid for July 1, 2016 to June 30, 2019 be awarded to Johnson Controls in the amount of $626,331.00. Mrs. Stewart noted we are not legally required to put service contracts out for bid however staff wanted to make the Board aware that the County only received one bid each for Extinguisher Maintenance, Pest Control and HVAC service contracts which have all increased. Chris Johnson, Public Buildings Manager, responded to questions. Public Building's staff Beth Blinson was also in attendance. Commissioners will consider approval of the award of bids as presented during their upcoming regular meeting. Commissioner Springle talked about Boone Trail and storage in the Agricultural building. Development Services staff Mark Locklear and Randy Baker briefed the Board on the following: 1) Problem Property (60 Gladiola Drive) Voluntary property conveyance as a method of compliance; 2) Problem Property (365 Betts Road) Code official requesting Ordinance to perform demolition; 3) Problem Property (218 Smith Prince Road) Update concerning property abatement; and 4) Update concerning a Proposed Panhandling Ordinance. Mr. Locklear asked the Board if they would be willing to accept 60 Gladiola Drive as voluntary property conveyance as a method of compliance. The conveyance is requested in order to expedite the abatement process of a condemned structure and dismiss any August 9, 2016, Work Session Minutes Harnett County Board of Commissioners Page 2 of 4 further enforcement actions against Mr. & Mrs. Henson. Mr. Baker estimates it will cost less than $10,000 to obtain this property valued at $15,000. It was the consensus of the Board for staff to proceed. Mr. Locklear mentioned that the lot might be a good possible donation to Habitat. Discussions continued. Regarding the problem property at 365 Betts Road, Mr. Baker said they are looking at approximately $10,000 cost to abate the property that is valued at $20,000. Staff reviewed the condemnation process. Mr. Baker mentioned the County could arrange a payment plan with the individual as they are basically forcefully tearing this house down, however the individual wants to try to sell property once the County has cleaned it up. Development Services will request that an ordinance be adopted directing the Code Administrator to remove or demolish the building(s) located at 365 Betts Road Holly Springs, NC (PIN # 0646-40-0252.000) described as "Unfit for Human Habitation". The Board will hold a public hearing regarding the condition and abatement status of the condemn structure. Mr. Baker noted the owner had cleaned the problem property at 4126 Nursery Road. Regarding the problem property at 218 Smith Prince Road, Mr. Baker said there was an estimated cost of over $10,000 in tipping fees to the County. Mr. Locklear and Mr. Baker recapped the circumstances, saying this hoarding situation became a County success story. Commissioners and staff expressed their appreciation to Mr. Ricky Temple and other volunteers. Staff distributed a draft Panhandling Ordinance.as requested by the Board. They noted the proposed ordinance had yet to be reviewed by the Staff Attorney or the Sheriff. Discussions continued and it was the consensus of the Board for staff to proceed. Mrs. Stewart provided updates on the upcoming Relay for Life event, old Boone Trail school facility and Atlantic Coast Pipeline. She also Mrs. Stewart reviewed the proposed August 15, 2016 regular meeting agenda. Commissioner Miller moved that the Board go into closed session for the following purposes: 1) To discuss certain personnel matters; and 2) To discuss matters relating to the location or expansion of industries or other businesses in Harnett County; and 3) To instruct the County staff concerning the position to be taken by the County in negotiating a contract for the acquisition of real property; and 4) Consultation with the County's legal staff in order to preserve the attorney-client privilege concerning the handling of certain claims and litigation including the following case: "Estate of John David Livingston, II, et als, vs Harnett County Sheriffs Department", Harnett County File No 16 CVS 1165. This motion is made pursuant to N.C. General Statute Section 143-318.11(a)(6),(4),(5)&(3). Commissioner Elmore seconded the motion which passed 4 — 0.
