Stewart presiding. Others present were Dallas H. Pope. County Manager; Tony Wilder, Special Project Coordinator; and Vanessa W. Young, Finance Officer and Clerk to the Board. Chairman Stewart reconvened the meeting of May 28, 1991, at 1 p.m. on May 29. 1991. CONTINUATION OF Dallas H. (to May 28, 1991 Meeting) .--- Resolution Awarding Contract (Welsh Sporting Goods Industrial Development Project) THAT WHEREAS, the Board of Commissioners of the County of Harnett (hereinafter sometimes referred to as the "Board" ) by resolution adopted at its meeting on April l5, 1991 authorized the advertisement for bids for a contract to construct and install water and sewer facilities to provide the indicated utility services to Welsh Sporting Goods; and WHEREAS, pursuant to such authorization, Advertisements for Bids for the contract described were duly published and otherwise advertised as required by law, with the bid opening to be held at 3:00 o'clock p.m. on May l6, 1991; and ~.. WHEREAS, as of the time and date of said bid opening and at the place designated for the same, only two bids were received; and WHEREAS, N.C.Gen.Stat. S l43-132 provides that no contract may be awarded for the work unless at least three competitive bids have been received; and WHEREAS, because only two bids were received, and no contract could be awarded, no bids were opened; and WHEREAS, said N.C.Gen.Stat. S 143-132 authorizes in such instances the second advertisement for bids; and WHEREAS, pursuant to such authorization, Re-Advertisements for Bids for the Contract were duly published and otherwise advertised as required by law, with the bid opening to be held at 2:00 o'clock p.m. on May 28, 1991 in the Water Plant, Lillington, North , Carolina; and WHEREAS, at the time and date, and place designated therefor, two bids for the contract were received and publicly opened and read aloud, the results of said opening being as follows: B).dder .Base Bid Ray Johnson Construction Co. Inc. $58,035.62 Sandhills Utility Company $78,160.80 and, WHEREAS, the Board has now received from Marziano & Minier, the engineers for the Project, the Discussion of Bids which has recommended award of the contract to the lowest responsible bidder which has presented a legally sufficient bid based on acceptance of the proposal that will result in the best pricing available to the County; and WHEREAS, the Board considers it in the best interest of the County of Harnett to proceed with acceptance of the lowest contract proposal, to award said contract and to make provisions for execution of such documents as are required related thereto. NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of the County of Harnett that: ------- -------------- -- - - - 283 Section 3. Upon review and approval of said Contract Documents by the Harnett County Public Utilities Attorney, the Chairman of and Clerk to the Board of Commissioners are hereby III authorized and directed to execute the same for and in behalf of the County of Harnett. Section 4. The Harnett County Manager is authorized to execute a Notice of Award and such other documentation as is necessary to commence work on the contract. The contract for the construction and installation pf,..-water and sewer facilities to provide services to Welsh Sporting Goods shall be and is hereby awarded to Ray Johnson Construction Co. Inc. for the unit price amount of $58,035.62, subject to adjustment as provided in the Contract Documents. Section 2. RESOLUrION REGARDING PROCUREMERr OF ENGIREERING SERVICES (SOUTBEASr WArER AND S~j~lI\oA DISTRICT) THAT WHEREAS, the Board of Commissioners of the County of Harnett sitting in its capacity as the governing body of the Southeast Water and Sewer District of Harnett County (the "Board") desires to procure an engineering firm to design and develop a cost effective set of plans and specifications for its Phase I water facilities project (the "project"); and WHEREAS, the Board desires to employ an engineering firm which is competent and qualified to provide such services, but finds that in order to obtain the best pricing available and to hold costs at a minimum, it is of the utmost importance to consider the expense of obtaining the same; and WHEREAS, the Board is aware of the declaration of public policy regarding selection of engineers as expressed in N.C.Gen.Stat. S 143-64.3l et. seq. ; and WHEREAS, such procedures as outlined in said statutes are not clear and may require the expenditure of unnecessary monies in order to comply therewith; and WHEREAS, N.C.Gen.Stat. S 143-64.32 authorizes units of local government to exempt particular projects from the provisions of N.C.Gen.Stat. S 143-64.3l in the sole discretion of the unit of local government, stating the reasons therefor and the circumstances attendant thereto; and WHEREAS, the Board desires to exempt the above described project from said provisions as hereafter provided; and WHEREAS, it is the further desire of the Board to provide instruction to the appropriate representatives of the District with respect to the selection process for the engineering firm to provide the services desired. NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of the County of Harnett, sitting as the governing body of the Southeast Water and Sewer District of Harnett County that: 1. Pursuant to N.C.Gen.Stat. S l43-64.32, the District's water facilities project, phase I and all matters associated therewith shall be and hereby is declared exempt from the provisions of Article 3D, Chapter l43 of the General Statutes of North Carolina (N.C.Gen.Stat. S l43-64.31 et.seq.). 2. The following reasons therefor and the circumstances attendant thereto are stated: a. Due to the desire of the Board to obtain the best pricing available and to hold costs at a minimum, the Board finds that it is vital that the expense of the engineering services desired be studied in the District's evaluation process. b. The Board is uncertain as to what procedures it must follow under the statutes cited above and therefore desires to eliminate any difficulties it may incur related thereto. c. The Board desires to procure the appropriate services as described pursuant to the least costly procedure available. ------ -------------------- 285 3. The Director of the Public Utilities Department, in conjunction with the County Manager and County Utilities Attorney, is instructed to issue Requests for Proposals with respect to the identity of an engineering firm suitable to provide the professional services desired, taking into account the demonstrated competence and qualifications for the type of professional services required and the fee to be charged therefor, and to thereafter negotiate with the best qualified firm for a proposed fair and reasonable fee. 4. Upon identification of a recommended firm and the establishment of a proposed fair and reasonable fee for the services desired, the said representatives of the District shall I report their findings and recommendations to the Board for approval. 5. The appropriate officers, agents and representatives of the District are hereby directed to take such actions as are required to effect the intent of this Resolution.
