The public is hereby notified that the City Council of the City of Dunn will hold their regular
meeting on Tuesday, July 14, 2020 at 7:00 p.m. in the Council Chambers of the Dunn Municipal
Building, 401 E. Broad Street, Dunn, NC. Some members of the Council may participate
electronically.
SPECIAL NOTICE REGARDING MEETING ACCESS DUE TO STATE OF EMERGENCY
In an effort to reduce the spread of Covid-19, in -person access to the Council meeting is limited to a
total of25 people (less than 14% of occupancy) to include Council and needed staff.
The Council Meeting will be available for live public viewing on Facebook - The City of Dunn, NC
page or the Public can call in to listen - contact the City Clerk at 910-230-3501 or
twilliams@dunn-nc.org prior to Monday, July 13, 2020, 1:00 p.m. for instructions.
Audio will be available while waiting outside Council Chambers, if maximum occupancy is
reached.
Public Comment Period - Comments can be called in or emailed in to the Clerk by Monday, July
13, 2020, 1:00 p.m, to be read at the meeting. The person must abide by all rules related to the
Public Comment Period, provide name and address and abide by the 3-minute time limit. The
person may also call into the meeting to give their comments but they must call the City Cleric to
sign up and receive instructions by the above stated time.
Public Hearing - Comments can be called in or emailed to the Cleric by Monday, July 13, 2020,
1:00 p.m. and they will be read at the meeting during the Public Hearing. The call and email

PURPOSE:
Acknowledgement of the hard work and dedication put forth by Lieutenant Cary Jackson in her achievement
of earning her Master Degree in Criminal Justice with a Concentration in Public Administration from Liberty
University in May 2019. Lieutenant Jackson also completed the Administrative Officers Management Program
through North Carolina State University in April 2020, This is a major accomplishment especially with her
current workload and family life.
BACKGROUND:
Cary Jackson has been a law enforcement officer for over 22 years and has previously worked in the
narcotics and patrol divisions at the police department, She was recently transferred to an administrative
position as the Training and Recruitment Coordinator. In this role, Lt. Jackson will assist officers with their
career development and continuing education as well as recruit new officers for the department. In addition,
Lt. Jackson will supervise the Community Enhancement Team and be involved in community service projects
throughout the city.

Mayor Elmore read the Proclamation to be presented to retired Chief West. Mayor Elmore further commended
Interim Chief Clark White on how the peaceful walls was handled in the City with around 300 people participating.

Fiscal Year 2020-2021 Budget
Public Hearing regarding the Proposed Budget. The Public Hearing was duly advertised on May 29, 2020 and
promoted on the City's Website and Facebook page and the Budget was made available for public inspection.
Mayor Elmore opened the Public Hearing at 7:11 p.m. With no written or oral comments, the Public Hearing was
closed.
Motion by Council Member Tart and second by Council Member Bradham to adopt the Fiscal Year 2020-2021
Budget as presented to include the Budget Ordinance and Fee Schedule. Motion unanimously approved. A copy
of the Budget Ordinance and Fee Schedule (02020-09) is incorporated into these minutes as Attachment #5.
Ordinance to Demolish House -100 Poppy Street
Public Hearing regarding the consideration of Ordinance to Demolish House at 100 Poppy St. The Public Hearing
was duly advertised on May 29 and June 2, 2020. Mayor Elmore opened the Public Hearing at 7:12 p.m.
Chief Building Inspector King has conducted inspections at 100 Poppy Stand based upon his observations, the
structure is unsafe and has been condemned in accordance with G.S. §160A-426. The property was also found
dangerous or prejudicial to the public health or public safety and is,a nuisance in violation,of G.S. §160A-193. The
owner of the property has failed to comply with the Building Inspector's order. King has received no contact from
the property owner and he said that several notices were sent oii't to various addresses received from the County.

purchased by Lloyd Tom Hamilton prior to the initial Public Hearing held in February, 2020. The Ordinance was
tabled by City Council at the February Council meeting until the April 14, 2020 Council meeting (approximately
sixty days) to allow Hamilton time to make repairs and improvements to the dwelling. Item was tabled again at
the April 2020 Council meeting to allow for an additional sixty days. King shared with Council that the owner has
continued to make improvements, he feels that the progress and repairs will continue and recommends an
additional extension. Discussion followed on voting against the ordinance. Attorney Pope informed Council that if
the ordinance was voted against and the progress stopped, King would have to begin the process all over again.
Motion by Council Member Tart and second by Council Member Bradham to table the Ordinance to Demolish - 911
Fairground Rd for an additional sixty days to allow Mr. Hamilton additional time to make repairs. Motion
unanimously approved.
Ordinance to Demolish - 610 E Pope St
Chief Building Inspector King told Council that the Public Hearing was held at the May 12, 2020 Council Meeting
and the Ordinance to Demolish was tabled until the June meeting. He has conducted inspections at 610 E Pope St
and based upon his observations, the structure is unsafe and has been condemned in accordance with G.S. §160A-
426. He also found the dwelling dangerous or prejudicial to the public health or public safety and the owner of the
property has failed to comply with the Building Inspector's order. King stated that his only contact has been with
Leon Davis, who was planning to attend tonight's meeting. Council Member McLean said the property owner has
been sick and was unable to attend but she wanted additional time to sell the property as is.
After further discussion, motion by Council Member Tart and second by Council Member Sills to adopt the
ordinance directing the Building Inspector to proceed with the demolition of the dwelling located at 610 E Pope St,
PIN#: 1516-74-1768.000. Motion carried 5-1 with Council Member McLean opposed. A copy of the Ordinance
(02020-12) is incorporated into these minutes as Attachment #8.
Ordinance to Demolish - 700 Lincoln
Chief Building Inspector King told Council that Ordinance to Demolish (02019-17)`was adopted by the City Council
on November 12, 2019 with motion allowing the new owner, Jada S. Wiggins, 90 days,to bring the property up to
code. Icing reported that the property owner started out strong and thenslowed. Progress `has picked up since he
contacted the owner in March and they have passed a couple.of inspections. Council Member Bradham asked
Frank Taylor, who was there representing the owner, how much time was needed to finish the,repairs and his
response was possibly 60 days. King is looking direction from the Council on which way to proceed,"
After discussion, motion by Council Member McLean and second by Mayor Pro Tern Turnage to table for 60 days
and to bring back before the Council for review., Motion carried unanimously.
Tyler to Tart Park Pedestrian Trail
Planning Director Adler presented the Pedestrian Route<as proposed by staff The trail is 1.7 miles and touches
four areas of interest to include the Rail Trail, Tyler Park, Downtown and Tart Park and also goes by the Library.
This proposed trail incorporates a portion of the City's:Pedestrian Plan We,are currently working on applying for
an additional grant to update the Bicycle and Pedestrian Plan. He is looking for a consensus on this proposed trail
and will then begin working on a detailed cost analysis fnr`signage, marlkngs and sidewalk improvements to make
the trail continuous and pedestrian friendly. Mayor Pro Tern Turnage mentioned concerns crossing Cumberland at
Wilson with the existing traffic light pattern and suggested, NCDOT be contacted to see if a crosswalk could be
incorporated there. line to traffic concerns, Council Member;Tart recommended a temporary route staying on
Wilson until sidewalks are put in on Clinton: He proposed totontinue on Wilson to E Godwin and then crossover
Clinton at Dominos. Gity,Manager Neuschafer added that'the City is hoping to use a state program to assist with
the funding of the sidewalks on Clinton by incorporating that as part of the trail. Council Member Bradham asked
when the trail can be usable:.Neuschaferaaid that the trail can be marked with signage and markings and be a
usable trail, by the fall with 'improvements, to, be made when possible. Consensus from Council was to move
forward with the proposed route
Landscape Maintenance Contract Reject Bid and Approve Extension of Current Contract
Assistant City Manager Boone told Council that the City advertised its Landscape Maintenance Contract through an
RFP process, in which only one bid was received. The cost to maintain our current scope of work, while also adding
various new sites, increased the;cost higher than originally budgeted. The scope of work has been revised and
reduced to extend the current contract with Old Mill Stream for one year, with various areas of maintenance to be
handled by our Public Works Department. Old Mill Stream will continue to maintain a large portion of the
landscape services currently provided, including cemeteries. The current Covid-19 pandemic most likely hindered
our ability to receive an adequate amount of responses. The RFP will be advertised in early 2021 in hopes of
receiving a larger turnout. The cost to extend the contract is covered in the FY2020-2021 Budget.
Motion by Mayor Pro Tem Turnage and second by Council Member Bradham to reject the current Landscape RFP
bid and approve a one year extension of Old Mill Stream's current contract at a reduced scope to the amount of
$182,000 beginning July 1, 2020 and ending on June 30, 2021. Motion carried unanimously.
Advisory Board Appointments
Mayor Elmore announced that he was appointing Sadie McLamb to the Dunn Housing Authority for an additional
term ending June 30, 2021.
Discussion followed concerning the appointment to the ABC Board including Mayor Elmore's suggestion to
increase the number of board members from 3 to S.
After much discussion and after Attorney Pope confirmed that no active motion is on the floor, motion by Council
Member Sills and second by Mayor Pro Tem Turnage to table the appointment to the ABC Board until the July
Council meeting. Motion carried unanimously.
Motion by Mayor Pro Tem Turnage and second by Council Member McLean to appoint Claudell Brown to another
term ending June 30, 2023 on the Planning Board. Motion carried unanimously.
Motion by Mayor Pro Tem Turnage and second by Council Member Bradham to appoint Dava Anderson and Ogo
Okpala to the Library Board of Trustees with term ending June 30, 2023. Motion carried unanimously.
Motion by Council Member Tart and second by Council Member Gaulden to appoint Mary Ann Fairley to the
Cemetery Advisory Board for term ending June 30, 2023. Motion carried unanimously.
Mayor Elmore acknowledged that there are openings on the Cemetery and Parks and Recreation Advisory Boards
and encouraged Council to reach out in the community to assist in filling these positions.
Council Goals/Reports
City Manager Neuschafer reviewed the Goals and Objectives Reports provided by the staff. He further updated
Council on the Dog Park. He told Council that a visual and bids on fencing should be available by the next meeting.
Sunflowers have been planted and water tap has been provided by''RLT Construction as a donation to the City.
Mayor Pro Tem Turnage asked if there could be'naming rights for the Dog Park. City Manager Neuschafer said that
naming rights could be incorporated into the project like.at Tyler Park. Hb'also. said ,that a lot of the work for the
Dog Park is still going to be done by the City staff -'Public Works, department.
Formation of Beautification Committee
Council Member Sills shared that in an effort to get more „citizens involved in the City, he is proposing that the City
establish a Beautification Committee. He is asking that the City staff put together a document to establish this
committee and bring to the eCouncil at the, July meeting for review and consideration. Mayor Pro Tem Turnage
suggested the committee have;a well-defined purpose. Council was in consensus to research and bring information
to the July meeting.
Formation of IT.Committee
Council Member Sills fur hm:, recommended a committee made up of IT specialists to assist staff with the City's IT
needs. Consensus of the Council was thatfhis committee was not needed at this time.
Administrative Reports
City Manager Neuschafer updated Council on City's response to Covid-19. Library is looking at opening the end of
the month and it will probably be after the fourth of July before the remainder of municipal offices are open
depending on conditions at that time. He also reported that plans for the renovations to City Hall -Police Locker
Rooms are currently being reviewed by the Planning Department.
Finance Director Roberts provided the following Financial Report for the period ending May 31, 2020
• General Fund, as of May 31, 2020, is at $3,807,431 and $2,360,862 in the (NCCMT Term Account) Water -Sewer
Fund. Through May of 2019, $3,827,533 was available in the General Fund and $2,315,884 in the Water and
Sewer Fund.
• Taxes for the 2019 year are for all intents and purposes complete. To -date, $4,183,387 in property taxes, or
approximately 99% of our expected tax income, has been collected.
• Sales Tax Revenue through March is $1,823,469 or 82.4% of our total expected income.
• Utilities Sales Taxes are reported quarterly with total received to -date at $525,935.
• Building Permit Fees for the month of May were $6,506 for a total collected for the year of $119,459 or 149%
of budget.
• Water and Sewer Revenues for the month of April were $446,866, with total collected $5,208,758 or 93.13%
of budget. Year to -date in 2019 was $4,336,763.
• Expenditures are at $10,246,598 or 88.4% of budget in the General Fund. Expenditures for the Water and
Sewer are at $5,298,708 or 84.9% of budget. The benchmark for this period is 92% of budget.
Mayor Elmore acknowledged receipt of the Administrative Reports included: Communications/Public
Information, Planning and Inspections Report, Public Works Report, Public Utilities Report, Parks and Recreation
Report, Library Report and Police Report.
Announcements/Information
Mayor Elmore announced upcoming events and activities.
Motion by Council Member Bradham and second by Mayor Pro Tern Turnage to enter a Closed Session for the
purpose to instruct the staff concerning the negotiation of purchasing real property[1$C.G.S. 143-318.11(a)(5)].
Motion unanimously approved.
Mayor Elmore recessed the meeting at 8:42 p.m. for the Closed Session.

PURPOSE: To provide corrected documentation related to Budget Amendment #11 due to a clerical error.
BACKGROUND: This document includes Budget Amendment #11, which includes the corrected
adjustments needed to cover the property purchase of three pieces, including the Skinner, Turner, Weeks &
Stephenson property. This land purchase was previously approved by the council on May 14, 2019. The
clerical error did not separate the funds correctly for the total amount of the purchases. The land was
purchased and this adjustment is to correctly record those purchases and increase the City's budget to match
the approvals of the land purchase using Fund Balance to complete the transactions.
BUDGET IMPACT: The budget will increase due to funds moved between the General Fund Balance and
the Water and Sewer Fund Balance. The total amount of budget adjustments will be $162,665.46. The
previous documentation was for Budget Adjustments in the amount of $105,732.55, That is a total increase
of $56,932.31. This amount will be divided between the Water/Sewer fund ($19,926.52) taken from
Water/Sewer fund balance and the General Fund ($37,006.39) taken from the General Fund Balance.
RECOMMENDATION/ACTION REQUESTED:
Motion to approve Corrected Budget Amendment #11 due to a clerical error, adjusting the City's
FY2019/2020 budget by $56,932.31.

STATE OF EMERGENCY — COVID-19
AMENDMENT 2
WHEREAS, a State of Emergency was declared for the City of Dunn in connection with the
State of Emergency declarations, both nationwide and statewide, in response to COVID-19;
and
WHEREAS, the Governor of North Carolina, by Executive Order is requiring face coverings
statewide effective June 29, 2020; and
WHEREAS, growing evidence supports that face coverings, when worn consistently, can
decrease the spread of COVID-19, especially among people who are not yet showing
symptoms of the virus; and
WHEREAS, this is a precautionary measure to help prevent the spread of Covid-19 and to
protect the City's employees and residents while they are present in municipal buildings.
NOW, THEREFORE, pursuant to the authority vested in me as the Mayor of the City of Dunn
under Article 1A of Chapter 166A of the North Carolina General Statutes and the City of Dunn
Code of Ordinances, I hereby proclaim and declare the following:
Section 1. Wearing of Face Coverings. All members of the public who are present in any City
of Dunn building or facility are required to wear a clean face covering. While wearing the
face covering, it is essential to maintain social distance insofar as possible.
A face covering is a material that covers the nose and mouth. It can be secured to the head
with ties or straps or simply wrapped around the lower face. It can be made of a variety of
materials such as cotton, sills, or linen. A cloth covering may be factory -made or sewn by
hand or can be improvised from household items such as scarfs, T-shirts, sweatshirts, or
towels. Social distance, as referenced within this order, shall mean the current parameters
established by the Governor by Executive Order and by the North Carolina Department of
Health and Human Services, including as such parameters may be amended in the future.
Section 2. Exceptions. Face coverings are not required:
• For people whose religious beliefs prevent them from wearing a face covering.
• For those who cannot wear a face covering due to a medical or behavioral condition.
• For children under 12 years old.
• While consuming food or beverage.
• In private, individual offices.
• When complying with directions of law enforcement officers.
• In settings where it is not practical or feasible to wear a face covering.
Anyone who declines to wear a face covering for these reasons shall not be required to
produce documentation or any other proof of a condition.
Section 3. Applicability. The requirements established in this order shall supplement and be
in addition to the other requirements associated with the COVID-19 State of Emergency
within the City, including, but not limited to, any requirements established by the State of
North Carolina. If an individual states that an exemption applies, City staff may choose to
offer a reasonable measure to deliver City services to avoid unnecessary exposure.
Section 4. Implementation. Any individual who willfully disregards or fails to comply with
this Order shall be asked to exit the building or facility.
Section S. Effective Date and Time. This Order shall take affect at 4:00 p.m., July 7, 2020 and
shall remain in effect until modified or rescinded.

PIN #: 1516-87-4980.000. The Public Hearing was advertised on July 2nd and July 7th, 2020,
Purpose: Chief Building Inspector Steven King has conducted an inspection at 503 E. Carr St. and
based upon his observations, the structures are unsafe and have been condemned in accordance with
G.S. §160A-426. The Chief Building Inspector also found the structures dangerous or prejudicial to the
public health or public safety and is a nuisance in violation of G.S. §160A-193.
The owner of the property has failed to comply with the Building Inspector's order and according to
N.C.G.S. § 160A-432, the City Council has the power to proceed with the demolition of this property.

AN ORDINANCE DIRECTING THE BUILDING INSPECTOR TO REMOVE OR DEMOLISH
THE PROPERTY HEREIN DESCRIBED AS AN UNSAFE BUILDING CONDEMNED
PURSUANT TO N.C.G.S. §160A-426, ET SEQ.
WHEREAS, that on March 201h, 2020, the Chief Building Inspector for the City of
Dunn sent a notice to Johnny Smith and James Bell, the owner(s) of record of structures located
at 503 E. Carr St. noting that the three (3) structures were in a condition that constitutes a fire
and safety hazard, and is dangerous to life, health and property and were thereby condemned,
pursuant to North Carolina General Statute §160A-426, and noticed the property owner of a
hearing on March 301h, 2020 at the office of the Chief Building Inspector located at 102 North
Powell Ave., Dunn, North Carolina pursuant to North Carolina General Statute §160A-428; and
WHEREAS, on March 30th, 2020 a hearing was conducted by the Chief Building
Inspector Steven King, following the completion of the hearing, the Chief Building Inspector
entered an Order, pursuant to North Carolina General Statute §160-429, declaring that the
structure referenced above is in a condition that constitutes a fire or safety hazard and is
dangerous to life, health or other property and ordering the property owner to repair or
demolish the structure on the property within sixty (60) days of the date of such Order, being
April 91h, 2020; and

WHEREAS, the owner of the above described structure did not appeal the Order of the
Building Inspector within the ten (10) day time period prescribed in North Carolina General Statute
§ 160A-430 and such Order is therefore a final Order; and
WHEREAS, on July 2"d, 2020 and July 7t", 2020, the City of Dunn published legal
notices that a public hearing would be held before the Dunn City Council on July 10, 2020 to
consider the adoption of this Ordinance, directing that the Building Inspector proceed with the
demolition of the structure described hereby, and that all costs incurred shall be a lien against such
property, pursuant to North Carolina General Statute § 160A-432; and
WHEREAS, the City Council of the City of Dunn, NC finds that the structure described
herein is dangerous or prejudicial to the public health or public safety and is a nuisance in violation of
North Carolina General Statute 160A-193; and
WHEREAS, this structure should be removed or demolished, as directed by the Chief
Building Inspector, and is an unsafe building condemned as set forth in North Carolina General Statute
§ 160A-426 and constitutes a fire and safety hazard; and
WHEREAS, the owner of this structure has been given a reasonable opportunity to
repair or demolish the structure pursuant to an Order issued by the Building Inspector on April 91h,
2020 and the owner has failed to comply with this order;
NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Dunn,
North Carolina that:
Section 1. The Building Inspector is hereby authorized and directed to place a placard on the
exterior of the structure described herein, containing the legend:
"This building is unfit for human habitation and is a public nuisance; the use or occupation of this
building for human habitation is prohibited and unlawful."

Section 2. The Building Inspector is hereby authorized and directed to proceed to remove or
demolish the above described structures in accordance with his Order to the owner thereof dated the
9"' day of April, 2020 and in accordance with North Carolina General Statute § 160A-432, based on the
owner's failure to comply with such Order.
Section 3. (a) The cost of removal or demolition shall constitute a lien against the real property upon
which the cost was incurred. The lien shall be filed in the office of the City Tax Collector, and shall
have the same priority and be collected in the sanle manner as the lien for special assessments in
Article 10 of Chapter 160A of the North Carolina General Statutes, and such costs shall also be lien
against any other real property owned by the owner of the property within the City of Dunn, North
Carolina, or within one (1) mile of the City of Dumi city limits, except for the property owner's
primary residence.
(b) Upon completion of the required removal or demolition, the Building Inspector shall sell the
useable materials of the structure and any personal property, fixtures, or appurtenances found in the
building and credit the proceeds against the cost of removal or demolition. The Building Inspector
shall certify the remaining balance to the Tax Collector. If a surplus remains after sale of the materials
and satisfaction of the cost of removal or demolition, the Building Inspector shall deposit the surplus
with the Harnett County Cleric of Superior Court where it shall be secured in the manner provided by
North Carolina General Statute § 160A-432.
Section 4. It shall be unlawful for any person to remove or cause to be removed the placard from
any building to which it is affixed. It shall likewise be unlawful for any person to occupy or to permit
the occupancy of any building therein declared to be unfit for human habitation.
Section 5. This ordinance shall become effective upon its adoption

a) Public Hearing: Consideration of Ordinance to Demolish Structures — 505 E. Carr St.
PIN #: 1516-87-5842.000. The Public Hearing was advertised on July 2nd and July Th, 2020.
Purpose: Chief Building Inspector Steven King has conducted an inspection at 505 E. Carr St. and
based upon his observations, the structures are unsafe and have been condemned in accordance with
G.S. §160A-426. The Chief Building Inspector also found the structures dangerous or prejudicial to the
public health or public safety and is a nuisance in violation of G,S. §160A-193.
The owner of the property has failed to comply with the Building Inspector's order and according to
N.C.G.S. § 160A-432, the City Council has the power to proceed with the demolition of this property.
b) Decision: Should Council decide to proceed with the demolition of the structures at 505 E. Carr St, an
ordinance (which is attached) would need approval directing the Chief Building Inspector to remove or

AN ORDINANCE DIRECTING THE BUILDING INSPECTOR TO REMOVE OR DEMOLISH
THE PROPERTY HEREIN DESCRIBED AS AN UNSAFE BUILDING CONDEMNED
PURSUANT TO N.C.G.S. §160A-426, ET SEQ.
WHEREAS, that on March 24111, 2020, the Building Inspector for the City of Dunn
sent a notice to James D. Campbell, the owner(s) of record of structures located at 505 E. Carr
St. noting that the structures (2 storage buildings) were in a condition that constitutes a fire and
safety hazard, and is dangerous to life, health and property and were thereby condemned,
pursuant to North Carolina General Statute §160A-426, and noticed the property owner of a
hearing on March 27th, 2020 at the office of the Chief Building Inspector located at 102 North
Powell Ave., Dunn, North Carolina pursuant to North Carolina General Statute §160A-428; and
WHEREAS, on April 1st, 2020 a hearing was conducted by the Chief Building
Inspector Steven King, following the completion of the hearing, the Chief Building Inspector
entered an Order, pursuant to North Carolina General Statute §160-429, declaring that the
structure referenced above is in a condition that constitutes a fire or safety hazard and is
dangerous to life, health or other property and ordering the property owner to repair or
demolish the structure on the property within thirty (30) days of the date of such Order, being

WHEREAS, the owner of the above described structure did not appeal the Order of the
Building Inspector within the ten (10) day time period prescribed in North Carolina General Statute
§ 160A-430 and such Order is therefore a final Order; and
WHEREAS, on July 2" d, 2020 and July 71h, 2020, the City of Dunn published legal
notices that a public hearing would be held before the Dunn City Council on July 14"', 2020 to
consider the adoption of this Ordinance, directing that the Building Inspector proceed with the
demolition of the structure described hereby, and that all costs incurred shall be a lien against such
property, pursuant to North Carolina General Statute §160A-432; and
WHEREAS, the City Council of the City of Dunn, NC finds that the structure described
herein is dangerous or prejudicial to the public health or public safety and is a nuisance in violation of
North Carolina General Statute 160A-193; and
WHEREAS, this structure should be removed or demolished, as directed by the Chief
Building Inspector, and is an unsafe building condemned as set forth in North Carolina General Statute
§ 160A-426 and constitutes a fire and safety hazard; and
WHEREAS, the owner of this structure has been given a reasonable opportunity to
repair or demolish the structure pursuant to an Order issued by the Building Inspector on May 13"'
2020 and the owner has failed to comply with this order;
NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Dunn,
North Carolina that:
Section 1. The Building Inspector is hereby authorized and directed to place a placard on the
exterior of the structure described herein, containing the legend:
"This building is unfit for human habitation and is a public nuisance; the use or occupation of this
building for human habitation is prohibited and unlawful."

Section 2. The Building Inspector is hereby authorized and directed to proceed to remove or
demolish the above described structure in accordance with his Order to the owner thereof dated the
13"' day of May, 2020 and in accordance with North Carolina General Statute § 160A-432, based on
the owner's failure to comply with such Order.
Section 3. (a) The cost of removal or demolition shall constitute a lien against the real property upon
which the cost was incurred. The lien shall be filed in the office of the City Tax Collector, and shall
have the same priority and be collected in the same manner as the lien for special assessments in
Article 10 of Chapter 160A of the North Carolina General Statutes, and such costs shall also be lien
against any other real property owned by the owner of the property within the City of Dunn, North
Carolina, or within one (1) mile of the City of Dunn city limits, except for the property owner's
primary residence.
(b) Upon completion of the required removal or demolition, the Building Inspector shall sell the
useable materials of the structure and any personal property, fixtures, or appurtenances found in the
building and credit the proceeds against the cost of removal or demolition. The Building Inspector
shall certify the remaining balance to the Tax Collector. If a surplus remains after sale of the materials
and satisfaction of the cost of removal or demolition, the Building Inspector shall deposit the surplus
with the Harnett County Clerk of Superior Court where it shall be secured in the manner provided by
North Carolina General Statute § 160A-432.
Section 4. It shall be unlawful for any person to remove or cause to be removed the placard from
any building to which it is affixed. It shall likewise be unlawful for any person to occupy or to permit
the occupancy of any building therein declared to be unfit for human habitation.
Section 5. This ordinance shall become effective upon its adoption.

AN ORDINANCE DIRECTING THE BUILDING INSPECTOR TO REMOVE OR DEMOLISH
THE PROPERTY HEREIN DESCRIBED AS AN UNSAFE BUILDING CONDEMNED
PURSUANT TO N.C.G.S. §160A-426, ET SEQ.
WHEREAS, that on March 251h, 2020, the Chief Building Inspector for the City of
Dunn sent a notice to Kelly Randall West, the owner(s) of record of the structure located at 116
Spring Branch Rd. noting that the structure was in a condition that constitutes a fire and safety
hazard, and is dangerous to life, health and property and were thereby condemned, pursuant to
North Carolina General Statute §160A-426, and noticed the property owner of a hearing on April
1st, 2020 at the office of the Chief Building Inspector located at 102 North Powell Ave., Dunn,
North Carolina pursuant to North Carolina General Statute §160A-428; and
WHEREAS, on April 1st, 2020 a hearing was conducted by the Chief Building
Inspector Steven King, following the completion of the hearing, the Chief Building Inspector
entered an Order, pursuant to North Carolina General Statute §160-429, declaring that the
structure referenced above is in a condition that constitutes a fire or safety hazard and is
dangerous to life, health or other property and ordering the property owner to repair or
demolish the structure on the property within sixty (60) days of the date of such Order, being
April 6th, 2020; and

WHEREAS, the owner of the above described structure did not appeal the Order of the
Building Inspector within the ten (10) day time period prescribed in North Carolina General Statute
§ 160A-430 and such Order is therefore a final Order; and
WHEREAS, on July 2nd, 2020 and July 7d1, 2020, the City of Dunn published legal
notices that a public hearing would be held before the Dunn City Council on July 14rh, 2020 to
consider the adoption of this Ordinance, directing that the Building Inspector proceed with the
demolition of the structure described hereby, and that all costs incurred shall be a lien against such
property, pursuant to North Carolina General Statute § 160A-432; and
WHEREAS, the City Council of the City of Dunn, NC finds that the structure described
herein is dangerous or prejudicial to the public health or public safety and is a nuisance in violation of
North Carolina General Statute 160A-193; and
WHEREAS, this structure should be removed or demolished, as directed by the Chief
Building Inspector, and is an unsafe building condenmed as set forth in North Carolina General Statute
§ 160A-426 and constitutes a fire and safety hazard; and
WHEREAS, the owner of this structure has been given a reasonable opportunity to
repair or demolish the structure pursuant to an Order issued by the Building Inspector on April 6",
2020 and the owner has failed to comply with this order;
NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Dunn,
North Carolina that:
Section 1. The Building Inspector is hereby authorized and directed to place a placard on the
exterior of the structure described herein, containing the legend:
"This building is unfit for human habitation and is a public nuisance; the use or occupation of this
building for human habitation is prohibited and unlawful."

Section 2. The Building Inspector is hereby authorized and directed to proceed to remove or
demolish the above described structure in accordance with his Order to the owner thereof dated the 61'
day of April, 2020 and in accordance with North Carolina General Statute §160A-432, based on the
owner's failure to comply with such Order.
Section 3. (a) The cost of removal or demolition shall constitute a lien against the real properly upon
which the cost was incurred. The lien shall be filed in the office of the City Tax Collector, and shall
have the same priority and be collected in the same manner as the lien for special assessments in
Article 10 of Chapter 160A of the North Carolina General Statutes, and such costs shall also be lien
against any other real property owned by the owner of the property within the City of Dunn, North
Carolina, or within one (1) mile of the City of Dunn city limits, except for the property owner's
primary residence.
(b) Upon completion of the required removal or demolition, the Building Inspector shall sell the
useable materials of the structure and any personal property, fixtures, or appurtenances found in the
building and credit the proceeds against the cost of removal or demolition. The Building Inspector
shall certify the remaining balance to the Tax Collector. If a surplus remains after sale of the materials
and satisfaction of the cost of removal or demolition, the Building Inspector shall deposit the surplus
with the Harnett County Clerk of Superior Court where it shall be secured in the manner provided by
North Carolina General Statute § 160A-432.
Section 4. It shall be unlawful for any person to remove or cause to be removed the placard from
any building to which it is affixed. It shall likewise be unlawful for any person to occupy or to permit
the occupancy of any building therein declared to be unfit for human habitation.
Section 5. This ordinance shall become effective upon its adoption

a) Public Hearing: Consideration of Ordinance to Demolish House —902 N. Wilson Ave,
PIN #: 1516-89-3510, The Public Hearing was advertised on July 2nd and July 7th, 2020.
Purpose: Chief Building Inspector Steven King has conducted an inspection at 902 N. Wilson Ave, and
based upon his observations, the structure is unsafe and has been condemned in accordance with G.S.
§160A-426. The Chief Building Inspector also found the dwelling dangerous or prejudicial to the public
health or public safety and is a nuisance in violation of G.S. §160A-193.
The owner of the property has failed to comply with the Building Inspector's order and according to
N.C.G.S. § 160A-432, the City Council has the power to proceed with the demolition of this property.
b) Decision: Should Council decide to proceed with the demolition of the dwelling at 902 N. Wilson Ave. an
ordinance (which is attached) would need approval directing the Chief Building Inspector to remove or

Greetings Mr. King, please allow me to introduce myself. I am Calvin R. Connelly Sr. from
Spring Lake, North Carolina. My wife and I are interested in purchasing the property located at
902 N. Wilson Avenue there in Dunn. The property was, condemned on March 25th, 2020. We
would like to make an offer to the owner, however before we can make any offer, we need to
know the condition of the property and exactly what areas need to be addressed according to the
city's condemnation report. I have been given Power -of -Attorney by the owner to act on his
behalf concerning the condition of the property, please see enclosures. We would also like to
know if any changes in city, county, or state policies have been implemented that would require
upgrades or repairs to the property (that the house and lot was not subject to prior to the
condemnation) to bring it into compliance. We would like a copy of the city's condemnation
report and any additional information required by your office in terms of repairs and or upgrades
that will have to be completed to bring. the house and property into city, county, and state
compliance. I have attached some photos of the interior of the house that caught my attention,
and (I consider may be of interest) may warrant additional scrutiny or attention in terms of
modifications, upgrades, changes in code, or grandfather clauses. Will the following areas need
upgrading or modification to bring the house up to code; 1) electrical outlets ungrounded, 2)
kitchen panel box dated possibly out of compliance, 3) main panel box located in
chimney? Please refer to the attached photos. I would also like to know if we do purchase the
property, how much time will we be allowed to restore the property and get it back to code?

Johnson. Mr. McKeithan stated he did not want to fix the property and wanted to sell it.
May 2611, 2020 — Order after Condemned Hearing notice allowing thirty (30) days for repairs or
demolition of structures sent to owner. Appeal letter sent with this notice informing owners of the appeal
process if they desired to do so.
June 511, 2020 — Ten (10) day time period for appeal expires.
June 8t11, 2020 — Contacted by a potential buyer, Calvin R. Connelly, Sr., of the property who wanted to
set up a time to do a walk-thru of the property to see what all would need to be done to repair the
dwelling. Meeting was scheduled for June 181h, 2020 at 1:30 pm.
June 18tb, 2020 — Walk-thru performed by Slater Johnson with potential buyer, Mr. Connelly, to discuss

WHEREAS, the Dunn ABC Board was established in 1962 with the passage of a referendum election
held on February 6, 1962, with the first retail sale occurring in Dunn on May 1, 1962; and
WHEREAS, North Carolina General Statute §18B-700 gives authority of appointing members of the
local ABC Board to the local governing body and further authorizes the local governing body to
increase the size of the local ABC Board to a five -member board; and
WHEREAS, according to NCGS §18B-700(a) that the terms of the additional new members will be for
a term of three years; and
WHEREAS, the Dunn ABC Board is currently a three -member board consisting of J. Dal Snipes,
Chairman and Milton Lynn Jernigan with one vacant seat as of June 30, 2020; and
WHEREAS, it is the desire of the Mayor and Dunn City Council to increase the size of the Dunn ABC
Board to a five -member board to allow for more participation and community engagement in the
City of Dunn.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Dunn, North Carolina, that
the Dunn ABC Board will be increased to a five -member board effective July 14, 2020 with terms to
end June 30, 2023 for the two new board members.

Local ABC Boards.
§ 18B-700. Appointment and organization of local ABC boards.
(a) Membership. - A local ABC board shall consist of three or five members appointed for three-
year terms unless the board is a board for a merged ABC system under G.S. 1813-703 and a different size
membership has been provided for as part of the negotiated merger. If the board is a three -member board,
one member of the initial board of a newly created ABC system shall be appointed for a three-year tern,
one member for a two-year term, and one member for a one-year term. If the board is a five -member
board, one member of the initial board of a newly created ABC system shall be appointed for a tree -year
tern, two members for two-year terns, and two members for one-year terns. As the terms of initial
board members expire, their successors shall each be appointed for tbree-year terms. If a board is initially
a three -member board and the appointing authority determines a five -member board is preferable, the
terns of the two new members shall be for three years. If a local board has five members and the
appointing authority determines a three -member board is preferable, the appointing authority shall not
reduce the size of the board except upon the expiration of a member's term and only with the approval of
the Commission. The appointing authority shall designate one member of the local board as chairman.
(al) Mission. - The mission of local ABC boards and their employees shall be to serve their
localities responsibly by controlling the sale of spirituous liquor and promoting customer -friendly,
modern, and efficient stores.
(b) City Boards. - City ABC board members shall be appointed by the city governing body,
unless a different method of appointment is provided in a local act enacted before the effective date of
this Chapter.
(c) County Boards. - County ABC board members shall be appointed by the board of county
commissioners, unless a different method of appointment is provided in a local act enacted before the
effective date of this Chapter.
(cl) Limit on Creation of New Boards. - Notwithstanding any provision of law to the contrary, no
new local board may be created in any county where a local board operates an ABC store. If a
jurisdiction holds an ABC store election under G.S. 1813-602(g), the establishment of ABC stores is
approved, and the jurisdiction is located in a county where a local board is already in operation, the
jurisdiction that held the election shall enter into an agreement with an existing local board to create a
merged local board in accordance with G.S. 1813-703. Nothing in this subsection shall be construed as
prohibiting a local board from serving multiple cities, counties, or cities and counties.
(d) Qualifications. - The appointing authority shall appoint members of a local board on the basis
of the appointees' interest in public affairs, good judgment, knowledge, ability, and good moral character.
(e) Vacancy. - A vacancy on a local board shall be filled by the appointing authority for the
remainder of the unexpired term. If the chairman's seat becomes vacant, the appointing authority may
designate either the new member or an existing member of the local board to complete the chairman's
tern.
(f) Removal. - A member of a local board may be removed for cause at any time by the
appointing authority. Local board members are subject to the removal provisions of G.S. 1813-202.
(g) Compensation of Board Members. - A local board member shall receive compensation in an
amount not to exceed one hundred fifty dollars ($150.00) per board meeting unless a different level of
monetary compensation is approved by the appointing authority. If a different level is approved by the
appointing authority, the appointing authority shall notify the Commission of the approved level of
compensation in writing. Any change in compensation approved by the appointing authority shall be
reported to the Commission in writing within 30 days of the effective date of the change. No local board
member shall receive any nonmonetary compensation or benefits unless specifically authorized by this
section.
(gl) (See Editor's note for applicability) Compensation of General Managers of Local Boards. -
The salary authorized for the general manager, as defined in G.S. 1813-101, of a local board shall not
exceed the salary authorized by the General Assembly for the clerk of superior court of the county in
which the appointing authority was originally incorporated unless such compensation is otherwise
approved by the appointing authority. The local board shall provide the appointing authority's written
confirmation of such approval to the Cormnission. Any change in compensation approved by the
appointing authority shall be reported to the Commission in writing within 30 days of the effective date
of the change. The general manager of a local board may receive any other benefits to which all
employees of the local board are entitled. The salary authorized for other employees of a local board may
not exceed that of the general manager.
(g2) Travel Allowance and Per Diem Rates. - Approved travel on official business by the members
and employees of local boards shall be reimbursed pursuant to G.S. 138-6 unless the local board adopts a
travel policy that conforms to the travel policy of the appointing authority and such policy is approved by
the appointing authority. The local board shall annually provide the appointing authority's written
confirmation of such approval to the Commission and a copy of the travel policy authorized by the
appointing authority. Any excess expenses not covered by the local board's travel policy shall only be
paid with the written authorization of the appointing authority's finance officer. A copy of the written
authorization for excess expenses shall be submitted to the Commission by the local board within 30 days
of approval.
(h) Conflict of Interest. - The provisions of G.S. 1813-201 shall apply to local board members and
employees.
(i) Bond. - Each local board member and the employees designated as the general manager and
finance officer of the local board shall be bonded in an amount not less than fifty thousand dollars
($50,000) secured by a corporate surety, for the faithful performance of his duties. A public employees'
blanket position bond in the required amount satisfies the requirements of this subsection. The bond shall
be payable to the local board and shall be approved by the appointing authority for the local board. The
appointing authority may increase the amount of the bond required for any member or employee who
handles board funds.
0) Limited Liability. - A person serving as a member of a local ABC board shall be immune
individually from civil liability for monetary damages, except to the extent covered by insurance, for any
act or failure to act arising out of this service, except where the person:
(1) Was not acting within the scope of his official duties;
(2) Was not acting in good faith;
(3) Committed gross negligence or willful or wanton misconduct that resulted in the
damage or injury;
(4) Derived an improper personal financial benefit from the transaction; or
(5) Incurred the liability from the operation of a motor vehicle.
The immunity in this subsection is personal to the members of local ABC boards, and does not immunize
the local ABC board for liability for the acts or omissions of the members of the local ABC board.
(k) (See Editor's note for applicability) Nepotism. - Members of an immediate family shall not
be employed within the local board if such employment will result in one member of the immediate
family supervising another member of the irmmediate family, or if one member of the immediate family
will occupy a position which has influence over another member's employment, promotion, salary
administration, or other related management or personnel considerations. This subsection applies to local
board members and employees.
For the purpose of this subsection, the term "immediate family" includes wife, husband, mother,
father, brother, sister, son, daughter, grandmother, grandfather, grandson, and granddaughter. Also
included are the step-, half-, and in-law relationships. It also includes other people living in the same
household, who share a relationship comparable to immediate family members, if either occupies a
position which requires influence over the other's employment, promotion, salary administration, or other
related management or personnel considerations.

At the June 9, 2020 Council Meeting staff was tasked to investigate the formation of a Beautification
Committee upon recommendation by Council Member Sills.

Proposal for a Community Appearance
Committee for the City of Dunn
At the June 9, 2020 Council Meeting, a recommendation was made by Council Member J. Wesley
Sills for the staff to investigate the formation of a Beautification Committee for the City of Dunn.
The Council was in agreement to move forward with staff providing research and document to
establish this committee. After discussions with Council Member Sills and Mayor Elmore and after
reviewing other committees in other NC municipalities, we offer the following proposal:
1 — To have an Ordinance Amendment to eliminate the Cemetery Advisory Committee. The
Cemetery committee oversees the appearance of the cemeteries only and it is the recommendation
that the Cemetery committee be combined with the Beautification Committee for the overall
appearance of the City of Dunn.
2 — To establish the Beautification Committee by Resolution with clear guidelines. This will allow
for more flexibility of the development and duties of the committee in future years by the City
Council without having to make changes to the City of Dunn Code of Ordinances.
3- Proposed Duties and Organization of the Committee
The Beautification Commnittee will serve as an advisory board to the City Council in providing
leadership and guidance on programs and projects to improve the City's overall appearance and
image.
Duties:
- to initiate, promote, and assist in the implementation and development of City-wide
beautification programs to include community participation;
- to seek to coordinate the activities of individuals, agencies and organizations, public and
private, whose plans, activities and programs impact the appearance of the City;
- to study and make recommendations to the Council on improving the overall appearance of
the City to include, but not limited to: cemeteries, parks and open spaces;
- to provide input and assistance to staff in the planting and maintenance of trees and other
vegetation as these plantings are incorporated into the City's budget; and
- to provide input, guidance and assistance in the development of projects related to the
appearance of the City, as needed and requested by Council and Management.
Committee Organization: Up to I 1 members as follows:
1 — Chamber of Commerce representative
2 — Officer/Mernber from local Garden Club
3 — City of Dunn staff person assigned by the City Manager
4 — 8 additional members
This committee will serve at the discretion of the City Council and meet as needed. All
appointments will be for one-year. After the committee has been established and working for
a period of one year, this committee will be reevaluated by the Council to determine its
effectiveness and if there needs to be any changes.

RESOLUTION TO ESTABLISH A
CITY OF DUNN COMMUNITY APPEARANCE COMMITTEE
WHEREAS, pursuant to North Carolina General Statute § 160A-146, authority is given to the Dunn
City Council to create, change, abolish, and consolidate boards and commissions in order to promote
orderly and efficient administration of city affairs; and
WHEREAS, it is the desire of the Dunn City Council to establish a Community Appearance Committee
for the City of Dunn to serve as an Advisory Board to the City Council in providing leadership and
guidance on programs and projects to improve the City's overall appearance and image; and
WHEREAS, the purpose of this committee will be to provide input to the Council and management,
to study and make recommendations on improving the overall appearance of the City, and to
coordinate, initiate and promote City-wide beautification programs and projects while encouraging
community participation; and
WHEREAS, the Community Action Committee should include members of the community with
interest in the overall appearance and image of the City, with effort given to include individuals who
have had special training or experience in a design field, such as architecture, landscape design,
horticulture, or a closely related field.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Dunn, North Carolina, to
hereby establish a Community Appearance Committee for the City of Dunn consisting of up to 11
members as follows:

establishment of the Community Appearance Committee and promote the process to apply for
vacancies on said committee.

During the FY 20/21 planning retreat, city staff was given the direction and guidance by City Council to move
forward in the development and construction of the proposed dog park and passive garden. This goal was
set with an anticipated completion within the 2020 calendar year.
The dog park will be located on City of Dunn property consisting of 12 parking spaces (handicap included)
and two fenced in areas for unleased dogs. Around a quarter acre section for small dogs (under 25lbs) and
an area around three-quarters an acre for large dogs (25lbs and up).

PURPOSE:
To acknowledge and accept the Local Government Commission's approval of a loan through United
Community Bank for funding necessary to complete the work to be done on Tart Park.
BACKGROUND:
In June of 2018, the City undertook a planning project to develop plans for the complete renovation of
Clarence Lee Tart Park, In November of 2019, final bids were received and in December the City Council
approved the project and plans to proceed with the project. Since that time all contracts and permits are in
place, and on July 7, 2020, the City received approval from the Local Government Commission (LGC) to
proceed with the Installment Financing Contract from United Community Bank for the total Tart Park project,
This LGC approval needed to occur after the City's audit was completed and submitted for acceptance. That
acceptance took place in March, 2020. This resolution follows the public hearing regarding the loans
necessary to pay all expenses relating to work previously described, discussed, and approved related to the
renovations to Tart Park.
BUDGETIMPACT:
This Installment Financing contract in the amount of $2,120,000 covering expenses over and above the two
grants we currently have in place, make up the total loan with United Community Bank. The interest rate is
calculated as a 10 year loan with a 20 year amortization and the loan will be recalculated at the 10 year mark.
The interest rate will not exceed 2.55% interest, with a payback amount of approximately $140,000 per year.
The city will finalize the loan within the next month,
RECOMMENDATION/ACTION REQUESTED:
Motion to adopt the Loan Resolution related to the LGC approved Installment Financing Contract between
United Community Bank and City of Dunn for the Tart Park Project and to authorize the Mayor and City
Manager to execute any and all documents associated with this Resolution.

A RESOLUTION BY THE CITY OF DUNN
AGREEING TO PROCEED WITH LOANS FROM UNITED COMMUNITY BANK FOR THE
COMPLETION OF CLARENCE LEE TART PARK CONSTRUCTION AND RENOVATIONS
WHEREAS, the governing body of the City of Dunn desires to proceed with borrowing in the amount
of $2,120,000 from United Community Bank for the renovation, construction, and development of
Clarence Lee Tart Park.
WHEREAS, the North Carolina Local Government Commission as required in G.S.159-149,
approved the City's request to proceed with borrowing for this project at their regularly scheduled
meeting on July 7, 2020.
WHEREAS, The interest rate for this borrowing will not exceed 2.55% for terms of ten (10) years
with a twerty (20) year amitorization for the total project and will not have a repayment schedule
exceeding $140,000 per year.
WHEREAS, the governing body of the City of Dunn authorizes the Mayor and/or the City Manager to
sign all documents relating to the loans and/or grants.
THEREFORE BE IT RESOLVED this Resolution will become part of the official minutes of
the City Council meeting held on July 14, 2020.

To consider contract with Davis•Martin-Powell Engineers & Surveyors for professional services to perform a
field analysis on the property along Watauga Avenue, acquired by the City in March of 2020. This land was
purchased with the intentions to improve storm water drainage issues including educational and recreational
facilities in the upper Juniper Creek area. This land was identified in a previous study as a location for a
potential detention pond for the Juniper Creek Sub -basin.
BACKGROUND:
A previous study completed by DMP in 2014 identified the Watauga property as a potential location for a
detention facility. Since 2014, some of the storm system improvements have been completed, however, none
of the potential detention control measures have been considered further.
BUDGET IMPACT:
$38,870.00
RECOMMENDATIONIACTION REQUESTED:
Motion to approve the contract with DMP for Professional Services at $38,870.00 for a field analysis study of
the Watuaga property for the purpose of improving drainage issues along Juniper Creek. This will include a
Budget Amendment to use funds out of the stormwater fund balance account.

Background
Davis • Martin • Powell (DMP) previously submitted a grant application to the Division of Water Resources
(DWR) on behalf of the City requesting a $30,000 grant to help finance a $60,000 study of the City's storm
water system. The DWR approved a $15,000 grant and the Initial study scope was reduced to $30,000.
The Study was completed in 2014 and presented to the City for review and consideration
Due to the reduction in Scope of the original proposed Study, the envisioned detailed surveying and
analysis of drainage issues In the upper Juniper Creek area, including the proposed detention measures
along Watauga Avenue were removed from the study and not completed. This included mapping and
elevations of existing drainage features in the area along with Geotechnical and Environmental analysis.
Since 2014, some of the storm system improvements have been completed, however, none of the
potential detention control measures have been considered further. In March of 2020, the City acquired
property along Watauga Avenue, near the Rail Trail, that was identified in the Initial report as the site
location for Pond 1.
Scope of Services
The Scope of Work for this project is to determine the viability of utilizing the property along Watauga
Avenue, adjacent to the Rail Trail as a location for a stormwater control measure to assist with improving
downstream detriments to Juniper Creek and assisting the downstream communities with issues related
to excessive flows and erosion. See the attached Exhibit 2.1 from the original study.
DMP is proposing to complete a more detailed analysis for the specific site as depicted in Attachment C
to determine the feasibility of designing and constructing a stormwater control measure. Our specific
scope will include Preliminary Engineering, Surveying, Environmental Investigations and Geotechnical
Exploration.
The Scope will be as follows:

➢ Perform full boundary survey of tax parcel 1517-41-3102.000
— DMP will contact 811 underground location services to help Identify underground utilities within
the project area to assist with both Survey and Geotechnical investigation.
Task0001. Environmental
Wetland & Stream Delineation
➢ Delineate wetlands under the jurisdiction of the CWA within the project alignment.
Wetland/upland and/or wetland/open water boundary delineation will follow current US
Army Corps of Engineers (USACE) methodologies including regional supplements. The
jurisdictional boundary of wetland areas will be flagged in the field for survey by others.
➢ Characterize and identify stream channels under the jurisdiction of the CWA using current
USACE and NC Department of Environmental Quality (NCDEQ) methodologies.
Representative stream channel points (origin points and intermittent -perennial transition
points) will be flagged in the field for survey by others.
➢ Provide surveyor support including:
Provide sketch maps and flag numbers for all wetlands and streams, and
Review survey results for accurate depiction of jurisdictional resources.
® Protected Species Surveys
➢ CEI will survey the site for the presence of species protected by the Endangered Species
Act. This will Include rough -leaved loosestrife (lysimachio asperulaefolia) and red -
cockaded woodpecker (Picoides borealis) which are listed by the US Fish and Wildlife
Service as potentially occurring in Harnett County and this area specifically.
® Assess Seasonal High Water Table
➢ CEI's licensed soil scientist will assess the seasonal high water table at up to five locations
on the site via hand auger boring.
Task0002. Geotechnical Analysis
® Hand Auger Borings Exploration:
➢ Perform eight (8) hand auger borings within the development area extending to a planned
depth of 5 to 10 feet beneath the existing ground surface, in each hand auger boring, a
Dynamic Cone Penetrometer testing will be performed in general accordance with ASTM
STP-399 at select Intervals. Groundwater and Backfill:
➢ Groundwater readings will be obtained at the time of hand augers and will be left open
and checked for groundwater at least 24 hours after boring. After 24 hours, the hand
augers and will be backfilled with soil cuttings.
® Samples
➢ Field samples will be physically examined, and a visual classification will be assigned in
accordance with the Unified Soil Classification System.
® Hand Auger Boring Records
➢ Prepare test hand auger boring records which provide standard penetration resistances,
detailed soil descriptions, and groundwater conditions. Significant soil strata will be
delineated and partially weathered rock or auger refusal will be identified where
encountered.

— itshould be noted that hand auger equipment is limited in its ability to penetrate hard soils, rocky
soils, obstructions in fill material, or below the groundwater table. One or more of the hand auger
borings may only provide limited information.
• Laboratory Testing
➢ Collect two (2) bulk samples from the hand auger locations for laboratory analysis.
Laboratory testing will include, Natural Moisture Content (ASTM D2216), Atterberg Limits
(ASTM D4318), and Standard Proctor (ASTM D698) Sieve Analysis without Hydrometer
(ASTM D422).
• Engineering Report
➢ Prepare a Technical Memorandum (TM) to be Included in the Master Technical Memo
outlining the results of the exploration. We will present evaluations and
recommendations concerning the following: site preparation, groundwater elevations
and their effect on the proposed propject, and remedial measures necessary to deal with
soft or loose soils if they are encountered. More specifically, the TM will present the
following major sections:
Project Information: Our understanding of the proposed construction will be
presented.
e Exploratory Procedures: The report will describe the methods of subsurface
exploration and laboratory testing.
Site and Subsurface Description: An overview of site conditions will be presented,
general geologic conditions for the site will be discussed, and a detailed discussion of
the subsurface soil and groundwater conditions will be presented.
i Evaluations and Recommendations: Based upon the field exploration, laboratory
testing, and our experience with similar site and subsoil conditions, we will present
recommendations for geotechnical aspects of the project
Task 0003. Project Management & Technical Memorandum
® Coordinate scheduling Tasks
® Provide periodic updates to City Staff via emails, phone calls and web calls
® Review results of Field Investigation Tasks as steps are completed
• Prepare a Technical Memorandum (TM) with information related to each of the above field
investigations to summarize the results of field activities. The TM will be provided in PDF
format, along with two (2) printed copies for review by the City.
Once the site proves viable for the design and construction of a Stormwater control measure and DMP
receives concurrence from the City, DMP will provide the City with an Amendment to this Proposal to
proceed with Preliminary Engineering and Final Design including:

scope outlined in this proposal based on similar projects. Additional design work due to site changes by
the owner, any needed geotechnicai analysis, or requirements imposed by any permitting agencies may
require adjustments to this fee. Any changes to this fee budget will be reviewed and approved before
additional cost is Incurred.
These services will be provided as a Task under the 2019 On -Call Professional Services Agreement.
Periodic Invoices corresponding to the completed task outlined above will be sent at the beginning of each
month, and payment will be due within 30 days.

— Access to the site Is provided prior to field work commencing, and site conditions allow for
accurate delineation to be performed during the field visits.
— A bush hog and operator on -site at the initiation of field activities to clear paths for access through
the thick vegetation portions of the site.

Rates that are current at the time the extra work is identified. Any meetings not included in the scope of
services will be considered extra. Extra work, including any adjustments to the Final Development Plan
after approval, will be identified either in writing or by verbal communication, but must be approved in
writing by client before proceeding to perform such additional services.
Schedule
DMP Is prepared to begin scheduling the work upon receipt of the signed proposal. Once the executed

PURPOSE:
To secure grant and/or loan funding from USDA Rural Development for the replacement of wastewater
collection system piping throughout the City.
BACKGROUND:
During the last several budget retreats replacement of aging water & sewer infrastructure has been a top
priority for Council, At the July 10, 2018, meeting, City Council awarded an engineering contract to Davis
Martin Powell for the completion of a preliminary engineering report which is required when submitting an
USDA Rural Development funding application. After the evaluation of various existing inspection reports, the
line segments that were identified as being in poor condition and considered to be a major contributor to
inflow & infiltration were prioritized with cost estimates. To reduce the financial strain on the City, the
engineer has recommended that the project be divided into 4 phases and implemented through a 10-12 year
program. Phase 1 will consist of approximately 9,135 linear feet and will encompass portions of S. Powell
Avenue, Joy Street, Carolina Drive, S. Clinton Avenue, Best Street, Dunn -Erwin Road, and Commerce Drive
(See attached Phase 1 Map).
Anticipated Schedule:
Submit USDA approved Preliminary Engineering Report to City Council September 2020
Receive grant/loan offer from USDA September 2020
Design/bid/award August 2021
Complete Construction September 2022
BUDGET IMPACT:
Phase 1 is estimated at $2,651,250 with debt service beginning 2022-2023. This is a 40-year loan with an
estimated annual payment of $113,900.

PURPOSE:
To authorize the Police Department to accept a federal grant from the NC. Governor's Highway Safety
Program. For the first year, the grant will cover 85% of the salaries and benefits for 2 police officers and
100% of equipment cost to include vehicles, computers, radars, lidar and in -car video equipment. The total
funds to be received in the first year of the grant is $181,139.00. The next 3 years, match will be based on
salaries and benefits only.
This grant will help the Police Department address traffic issues associated with the upcoming 1-95 widening
project.
BACKGROUND:
The Governor's Highway Safety Program helps fund the efforts of law enforcement agencies, local
governments, community organizations, schools and nonprofits to reduce traffic crashes in North Carolina.
The City Council approved application for the grant in December, 2019. Dunn Police officers will conduct
targeted traffic related enforcement, conduct educational events, and focus on community outreach in an
effort to increase awareness of traffic safety issues and to reduce fatalities related to impaired driving and
speed,
BUDGETIMPACT:
The City of Dunn will be required to meet the match for as follows:
Year 1: Grant (85%) - $ 181,139.00; City Match (15%) - $31,966 — Salaries, Benefits and Equipment
Year 2: Grant (70%) - $76,583.50; City Match (30%) - $32,821.50 — Salaries and Benefits
Year 3: Grant (50%) - $54,702,50; City Match (50%) - $54,702.50 — Salaries and Benefits

• The City, as of June 30, 2020 had $3,403,121 in cash in the General Fund and $2,361,426 in
the (NCCMT Term Account) Water -Sewer Fund. Through June of 2019 the City had $4,381,844 in
the General Fund and $2,325,007 in the Water and Sewer Fund. We have over $1,000,000
requested for repayment from DEQ for funds paid on the Wastewater Treatment plant project.
• Our Taxes for the 2019 year are done. We do not expect any substantial amount to be
collected this month. To date we have received approximately $4,233,230 in property taxes or
approximately 100% of our expected tax income. Our Estimate for the 2019 year was $4,243,600.
These totals include Property, Motor Vehicles, and Downtown Service District taxes.
• Sales Tax Revenue through April is $2,022,430. Our Budget for that income is set at
$2,212,000. Sales Tax Reports from the Department of Revenue are provided at least two months
behind actual collections. This is 91.4% of our total expected income. These revenues continue to
track better than expected.
LUtilities Sales Taxes are reported quarterly. Through the third quarter, the month of March,
been reported, this is the total amount we will count for this Budget Year. The total received to
date is $700,927. This amount includes Electricity, Natural Gas, Telecommunications, and Video

• The General Fund assessments, Water and Sewer assessments, and old demolitions total $127,314. Of
this more than $82,000 is over 10 years old. This amount involves 41 individuals and does not change
from month to month.
• For our Weedy Lots and new Demolitions, we have billed out $395,586, made adjustments and
received payments totaling $128,687. That leaves us with the amount owed the city of $ 266,889. No
payments were received for any of these bills this month.
• We have 30 leins in place totaling more than $ 185,000. No new changes for this month.
• No new Debt letters were sent this month.
• 140 property owners make up approximately $230,000 worth of the debt. 55 property owners make
up $199,000 of this amount. We have 7 property owners where we are unable to contact them due to

EO 124 & EO 142
This plan covers February, March, April, May and June, 2020 billings for City of Dunn utility services.
The payment plan period commences August 1, 2020 and concludes February 26, 2021.
Customers do not have to establish a payment plan by signing a document. If the account has an
outstanding balance for the months included in Executive Order (ED) No. 124 and EO No. 142, the
payments will automatically be calculated by dividing the affected balance over a six month period of
time.

During the month of June I started my training with Victoria forms to get everything
set up so that our forms on our website are more accessible and easier to manage
for the public as well as our staff. I also helped complete the Main Street Status
process for our Downtown.
02- In Progress
I am working on transitioning my time between Communications Coordinator and
Downtown Manager. I have been adjusting to this role and am working on some
materials for our downtown businesses to use during this pandemic. I am also
meeting with several companies that were recommended for a way to make
communication between the public and our staff easier.
03- Goals
My main goals for the upcoming months will be to visit each downtown business and
introduce myself. Work on a few plans for the upcoming months when things open
back up to welcome people back to Downtown and encourage residents to come
visit. I am also continuing to work on our social media policy and hope to have the
first employment form up on our website within the next couple of weeks.

Sports Programs
The decision to cancel spring sports was made on May 8, 2020 after updates were issued on Governor
Cooper's reopening plan. The Finance Department issued refunds to spring sports participants and
sponsorships on June gin
All Dunn Parks and Recreation facilities remain closed to the general public with the health and well-
being of our patrons being most important to us. During phase 2 the following amenities are available
while practicing social distancing and maintaining gathering limits waling trails, open spaces and tennis
courts.
Online Gaming
City of Dunn Parks and Recreation hosted a free E-Sports Madden Tournament for youth and adults.
Youth ages ranged from 8-17 years of age and adults ages were 18 and up. This was a fun way to engage
the community while allowing everyone to participate in competitive play. Holding registration and
games online allows everyone to enjoy the tournament from their homes while obeying the governor's
restrictions. We had a total of 29 participants in the tournament which lasted a span of two weeks.

Tart Park Renovation
Despite high volume of rain, the project remains on schedule. The Stewart Group Enterprises (site
contractor) are continuing with rough grading, with irrigation, dugout footings and fencing projected to
begin next week. Engineered Construction Company (building contractor) has completed the framing

and completed 50 percent of the roofing on the central complex. Electrical and HVAC components of
the complex are being roughed in. Walter Holmes Electric (lighting contractor) has installed all sports
lighting poles and fixtures.
Recreation Advisory Board
Last meeting was held on Tuesday, February 12th 6:00 p.m. at Dunn Community Center. The April 14`h
meeting was cancelled due to COVID-19 and gathering restrictions. The next meeting is scheduled for
August 11, 2020 at 6:00 p.m.

RE: BUDGET MESSAGE
To the Dunn ABC Board
The Annual Budget for the fiscal year July 1, 2020 through June 30, 2021 (FYI 1/12) has
been prepared in accordance changes to N. C. General Statute 1813-702 "Financial
operations of local boards". The ABC Board determines, through adoption of an annual
budget, the level of customer set -vices that the ABC system will provide and the resources
available for operations and capital projects.
The primary drivers during the preparation of this budget included projected operating
costs required to sustain acceptable levels of customer service during fiscal year
2020/2021 and the need to provide distributions to beneficiaries.
The budget consist of projected revenues from liquor sales of $2.80 million, taxes related
to income of $608 thousand, cost of sales of $1.55 million, operating expenses costs of
$494thousand.
Highlights of Budget:
Some sales increases are projected based on last year's sales.
The assumption that no debt will be incurred.
Longevity pay will continue.
Distribution to the City of Dunn will be the $125 thousand.
The Board's Budget Process: It is anticipated that the budget process will be improved in
future years.
Debt: The Board does not have any debt at this time; there is no anticipation of incurring
debt during the budget year.
