Minutes of Regular Meeting
August 18, 2008
The Harnett County Board of Commissioners met in regular session on Monday, August
18, 2008, in the Commissioners Meeting Room, County Administration Building, 102
East Front Street, Lillington,North Carolina.

Vice Chairman Hill called the meeting to order at 7:00 p.m. and Commissioner Andrews
led the pledge of allegiance and prayer.
Commissioner McNeill moved to approve the agenda as published with addition of
several budget amendments to the consent agenda and addition to regular agenda of
consideration of rescue funding for Benhaven Rescue Squad. Commissioner Andrews
seconded the motion and it passed unanimously.
Upon motion by Commissioner McNeill and seconded by Commissioner House, the
Board unanimously approved the following items on the consent agenda:

3. Tax refunds and releases (Attachment 1)
4. Authorization to sell two surplus 2002 15-passenger Dodge vans, for$1,000 each, to
the City of Dunn for use by the PAL program.
5. Authorization for the Sheriff's Department to accept a gift from the US Smokeless
Tobacco Company,manufacturer of smokeless tobacco products and premium wines.
The donation of a 6-wheel drive utility vehicle through the Polaris Ranger Donation
Program will be used for search of missing persons, drug operations, special events and
other activities.
6. Authorization for Emergency Management to submit a grant application to the 2009
Hazard Mitigation Assistance Program
7. Reimbursement resolution for school construction projects—Boone Trail Elementary
School, Johnsonville Elementary School and Harnett Central High School (Attachment 2)
8. Resolution of appreciation for United States Senator Elizabeth Dole(Attachment 3)
• 9. Authorization for Retired Senior Volunteer Program(RSVP) to submit a grant
application to the Harnett Community Foundation requesting$2,500 to support the
Medicare counseling services.
Commissioner Andrews moved for the appointments listed below. Vice Chairman Hill
seconded the motion and it passed unanimously.

Samantha Ficzko, Planner,presented a zoning change request for Lennon Family Limited
Partnership, landowner, CDA Properties, LLC, applicant, from RA-20M to Commercial
Zoning District, Buffalo Lakes Rd., 1.76 acres, Barbecue Township. The Planning Board
recommended approval of the request. Vice Chairman Hill called to order a public
hearing regarding the matter and opened the meeting for comments from the public.
Joseph Byrd, applicant spoke in favor of the requested change. There being no further
comments, Vice Chairman Hill closed the public hearing. Commissioner McNeill moved
to approve the zoning change as requested. Commissioner House seconded the motion
and it passed unanimously.
Samantha Ficzko, Planner,presented a zoning change request for Parminder Sandhar,
from RA-20M to Commercial Zoning District,NC 42, 0.60 acres, Buckhorn Township.
The Planning Board recommended approval of the request. Vice Chairman Hill called to
order a public hearing regarding the matter and opened the meeting for comments from
the public. Parminder Sandhar, owner, spoke in favor of the requested change. There
being no further comments, Vice Chairman Hill closed the public hearing.
Commissioner Andrews moved to approve the zoning change as requested.
Commissioner House seconded the motion and it passed unanimously.
Samantha Ficzko, Planner,presented a zoning change request for STKI Leasing, LLC, •
from RA-30 to Commercial Zoning District, SR 1811, from RA-30 to Commercial
Zoning District, SR 1811 Bud Hawkins Rd., 5.36 acres Averasboro Township. The
Planning Board recommended approval of the request. Vice Chairman Hill called to
order a public hearing regarding the matter and opened the meeting for comments from
the public. Jerry Mayka, representing applicant, spoke in favor of the requested change.
There being no further comments, Vice Chairman closed the public hearing.
Commissioner House moved to approve the zoning change request as presented.
Commissioner Andrews seconded the motion and it passed unanimously.
Samantha Ficzko, Planner, presented proposed text amendments and re-format of the
Mobile Home Park Ordinance. The Planning Board recommended approval of the
revised Mobile Home Park Ordinance. The new format will match the Zoning Ordinance
format. Vice Chairman Hill called to order a public hearing regarding the proposed text
amendments and opened the meeting for comments from the public. No comments were
offered and Vice Chairman Hill closed the public hearing. Commissioner McNeill
moved to adopt the Mobile Home Park Ordinance as presented. Commissioner Andrews
seconded the motion and it passed unanimously. The ordinance is copied in Ordinance
Book 2, page .
Samantha Ficzko, Planner, presented proposed text amendments to the Zoning Ordinance
regarding buffers, and administration, enforcement and penalties. The Planning Board •
recommended approval of the text amendments. Vice Chairman Hill called to order a
public hearing regarding the proposed text amendments and opened the meeting for
comments from the public. No comments were offered and Vice Chairman Hill closed
the public hearing. Commissioner McNeill moved to adopt two resolutions amending the
Zoning Ordinance. Commissioner House seconded the motion and it passed
unanimously. (Attachments 4a and 4b)
Wm. A. (Tony) Wilder, Assistant County Manager,presented for the Board's
consideration a Municipal Animal Control Ordinance. A public hearing was held and the

Board approved the ordinance at its last regular meeting. One commissioner was absent
and N.C. General Statute requires a unanimous vote for adoption of an ordinance at its
first reading but it may be adopted by a majority vote at a second consideration.
Commissioner McNeill moved to adopt the Municipal Animal Control Ordinance as
presented. Commissioner Andrews seconded the motion and it passed unanimously.

Departmental reports were filed with the Board from the Planning Department, Animal
Control and Report of Unpaid Taxes as of June 30, 2008. (Attachment 6)
• Neil Emory, CountyManager, noted that Benhaven Rescue had requested consideration

of additional funding for the upcoming fiscal. The Board did not make a decision on the
request during the budget process but set aside $30,000. in-contingency if it was
determined that he request was warranted. After reviewing their budget as well as the call
volume involved Mr. Emory recommended that eh additional $30,000 be appropriated to
the rescue squad: Commissioner Andrews moved to authorize appropriation of$30,000.
from contingency to Benhaven Rescue Squad. Commissioner McNeill seconded the
motion and it passed unanimously.
Commissioner House moved that the Board go into closed session to discuss a personnel
matter. This motion is made pursuant to N.C. General Statute Section 143-318.11(a)(6).
Commissioner McNeill seconded the motion and it passed unanimously.
Commissioner McNeill moved that the Board come out of closed session. Commissioner
House seconded the motion and it passed unanimously.
There being no further business, Commissioner McNeill moved to adjourn.

Conunissioner moved that the following resolution(the "Resolution").a copy
of which was available with the Board and which was read by title:
RESOLUTION OF THE COUNTY OF HAR.NETT. NORTH CAROLINA DECLARING THE
INTENT OF THE COUNTY OF HARNESr.IYORTit CAROLINA TO REIMBURSE ITSELF FOR
CAPITAL EXPENDITURES INCURRED IN CONNECTION WITH THE ACQUISITION,
CONSTRUCTION, IMPROVEMENT, EQUIPPING AND FURNISHING OF CERTAIN
GOVERNMENT FACILITIES IN THE COUNTY FROM THE PROCEEDS OF CERTAIN TAX-
EXEMPT OBLIGATIONS TO BE EXECUTED AND DELIVERED IN CALENDAR YEARS 2009
AND 2010.
WHEREAS, the Board of Commissioners (the "Board-) of the County of Harnett, North
Carolina(the -County')has determined that it is in the best interests of County to(I)construct. furnish
and equip a new Boone Trail Elementary School,(2)construct.furnish and equip a 24-classroom addition
to Harnett Central High School and (1) construct, furnish and equip a Ii-classroom addition to
Johnsonville Elementary School(collectively,the"Projects");
IVIJERE"IS,the County presently intends,at one time or front time to time,to finance all or a ID
portion of the costs of the Projects with proceeds of tax-exempt obligations and reasonably expects to
issue its tax-exempt obligations(the "Obligations")to tFnanee.or to reimburse itself for,all or a portion
of the costs of the Projects:and
WHEREAS, the County desires to proceed with the Projects and will incur and pay certain
expenditures in connection with the Projects prior to the date of issuance of the Obligations(the"Original
Erpendire.rex ,such Original Expenditures to he paid for originally from a source other than the proceeds

of the Obligations,and the County intends,and reasonably expects,to be reimbursed for such Original
Expenditures from a portion of the priteceds of the Obligations to he issued at a date occurring after the
dates of such Original Expenditures;
NOW THEREFORE, BE IT RESOLVED by the Board of Commissioners of the County of
Harnett.North Carolina as follows:
Section I. Official Declaration of Intent. The County presently intends,and reasonably expects,
to reimburse itself for the Original Expenditures incurred and paid by the County on or after the date
occurring 60 days prior to the-date of adoption of this Resolution from a portion of the proceeds of the
Obligations. The County expects that the maximum principal amount of tax-exempt obligations
reasonably expected to be executed and delivered, as part of the Obligations, for the Original
Expenditures with respect to the Projects to be reimbursed is$45,000,000.
• Section 2. Compliance with Regulations. The County adopts this Resolution as a declara
tion of
official intent under Section 1,150-2 of the Treasury Regulations promulgated under Section 103 of the
Internal Revenue Code of 1986,as amended,to evidence the County's intent to reimburse itself for the
Original Expenditures from proceeds of the Obligations.
5ectiou 3. Itemization of Capital Expenditures. The Finance Officer of the County,with advice

SECTION XX Purpose of Chapter
The purpose of this cl•.apter is to provide and define authority of the Harnett County Animal Control
department within the towers of Angier,Coats,Erwin and Lillington Harnett Camay Animal Control
has charge of protecting the citizens of these towns from rabies transmitted by unconfined,
uncontrolled or uo-irnmunized animate,to regulate animals Mot may be a nuisance,to insure that all

animals are treated in a humane manner and in the prornoton of responsible pet ownership and animal
welfare.Heinen County Animal Central in cooperation with the towtrs orAngier.Coats,Erwin and
Liilington arc hereby charged with the responsibility of Animal Control in conjunction within these
towns jurisdictions.This ordinance will supersede all town Animal Control ordinances and shall
pertain to the towns of Angier,Erwin.Coats and Litlington only.The most current Barnett County
Animal Control ordinance shall also pertain to the Towns in agreement of this ordinance,
SECTION XXi Estabiishment of Bird Sanctuary
(A)The area embraced within the corporate limits of the Town and all land - 1110 owned et leased by the Town outside the corporate limits is hereby designated as a bird
sanctuary.
(B)It shall be unlawful to intentionally trap,hunt,shoot,or otherwise kill,within
a sanctuary hereby established,any native wild bird.It shall be lawful to trap birds or fowl
specifically declared a nuisance by the Town board when ttteil birds or fowl arc found to he
conegregating in such number in a particular locality that they constitute a nuitancre or a
menace to health or propeny_
(C)The bird clubs of the Town are hereby granted permission to erect artistic
signs,giving notice of the regulations therein provided,at such places and of such design as
may b0 approved by the Town Board.

SECTION XXiI Hunting,Killing,and Trapping of'Animals
It shall be unlawful for any person to hunt oa kill any animal within the territorial limits nfthe Towns.
Trapping may be done with permission from the Harnett County Animal Control Department.This
section does not apply to the Police Departments or Harnett County Animal Control,or duty
authorized agents when enforcing the provisions provided in this Ordinance.
• SECTION XXIII Keeping Livestock and Fowl
No person may keep within the Town any Livestock and/or Fowl except in accordance with this
section.
(A) it shall be unlawful for any person to maintain,keep.house or stable any.
horse.mule,pony,cow,sheep.goat or any livestock or fowl within the corporate limits
of the Town within 590 feet afany residential of commercial building,school grounds.
church or other establishment. 11/1(B) It shall be unlawful for any person to maintain,keep or house any cattle,
scat,horse or ether Livestock or Fowl on a fenced lot containing less then one(nacre.

(C) it shall be unlawful for any person to mairanin keep or house within the
town any swine.
(D) It shill be unlawful to permit any fowl,including but not limited to
thickens,ducks,geese,turkeys,guineas or other fowl,to run at large within the
corporate limits of the Town.
(I) Any Fowl kept within the corporate limits of the Town must be contained
by a fence,building or other enclosure that will ensure that the fowl will not run at
large.
(F) Any Fowl found running at large may he taken into possession and/or
destroyed by Harnett County Animal Control anywhere within the corporate limits of
the town.
(ts) No more than set(6)Fowl,incluslirtg but riot limited to chickens,ducks,
Geese,turkeys,guineas or oher Fowl may be kept on a lot containing one(l)acre or
less.
SECTION XXIV Number of Dogs
it shall be uninwful for any person to keep on any lot or premises within the corporate limits more than
three(3)dogs.This limitation shall not apply to dogs less than four(4)months of age.
Any person wanting to keep mare than three(3)dogs will apply to the Town for a license to operate a
dog kennel.Prior to the Issuing of such license it shall be determined that the kennel would be in •
compliance with all Town and Stare regulations.
SECTION XXV Number of Cats
It Anil be unlawful for ens person to keep en any lot or premises within the corporate limits more than •
three(3)cats This limitation shalt not apply to cats Ices than four(.1)months gage.

SECTION XXVI Confinement and Running at Large
(A) No person owning or having possession,charge,custody of control of any animal may
cause,permit or allow the animal to stray or in any manner to run at large upon any public
street,sidewalk or other public property or to sway,run at large or otherwise trespass upon
the private property of another_
(B) It shall be unlawful for the owner of any animal to allow such animal to be at
large on any Town property.
(C) It stall be unlawful for any person awning,harboring,keeping on in charge of
any animal to fail or refuse to remove feces deposited by the animal on any
street,sidewalk,park or other publicly owned property,

(D) It shall be unlawlitl for the owner of any animal to fail or refuse to remove
feces deposited by the animal on any private property.
SECTION XXVII Possession of Animals and Strays
(A) It shall be unlawftd for any person in the town knavingly and intentionally,
unless with consent of the owner,to harbor,feed and k,rep in their possession by
confinement or otherwise allow to remain on their property any animal which does not
belong to them unless they notify Harnett County Animal Control within forty-tight(-113)
• hours from the time such animal aurae into his possessiot.
•
(B) Any person who feeds a stray animal and/or allows the animal to at on their
property for at least two(2)days will be considered the legally responsible for such animal
and any violations caused by the animal.
(C) It shall be unlawful fur any person to reline to surrender any such sway animal
to the Police Department or Harnett County Animal Consul or person duly authorial upon
demand.
(I)) The purpose of this soctiou is to aid in rabies control and to prevent the
intentional or unintentional possession Of pets belonging to other persons.
SECTION XXVIII Impoundment and Reclaiming of Captured Animals
(A) Any animal within the Town without an owner,any animal running at large within the
Town,or any animal whose owner fails to have the animal vaccinated in accordance with
the lawn of the State,or an animal appearing within the Town without a rabies vaccination
rag shall be taken by Harnett County Animal Control anal confined for a period of time
until reclaimed by the owner with a prepaid rabies voetcber,adopted with pre-paid rabies
voucher or etahanixed by the Harnett County Animal Control Department.
• (B) If any animal is not redeemed by the owner within three(3)days from the time Animal
Control takes possession of the animal,the animal shall be put up for adoption or disposed
of under the regulations set forth by the Harnett County Animal Control Ordinance and the
North Carolina General Statutes.
(C) In order for the owner to redeean an animal,such owner must first show that the rabies
vaccination tag has been procured.In addition the owner shall payer penalty awarding to
the Harnett County Animal Control Ordinance for allowing die animal to run at large,The
fee may be adjusted in the new fiscal years in the Harnett County Animal ftser The owner
must pay daily expenses for boarding and caring for the animal,
SECTION XXIX Potentially Dangerous and Dangerous Dogs
(A) It shall be unlawful for a citizen to keep a dog within the corporate limits of the Town a •
dog that has been deemed potentially dangerous or Dangerous by Harnett County Animal
Control.
(B) Any owner found in violation of this section will be required to release the dog to the
Harnett County Animal Control Departntem for eushartasia and will face a civil fine of
Sa00.00.
SECTION XXX Inherently Dangerous Exotic Animals
Shall be in accordance with the Harnett Comity Animal Control Ordinance.
SECTION XXXI Enforcement,Penalties and Remedies
Enforcement Administration
Primary responsibility for enforcing the provisions of this chapter is assigned to the Barnett County
Animal Control Department,Municipal Police Departments will assist when needed
Penalties and Remedies
® Penalties and remedies shall be in accordance with the Harnett County Animal Control trdinance.
SECTION XXXII Ordinance in Conflict
All ordinances in conflict with the provisions of this Ordinance are repealed to the extent of
such conflict
