031708r 693 HARNETT COUNTY BOARD OF COMMISSIONERS Minutes of Regular Meeting March 17, 2008 The Harnett County Board of Commissioners met in regular session on Monday, March 17, 2008, in the Commissioner Meeting Room, County Administration Building, 102 East Front Street, Lillington,North Carolina. • Members present: Teddy J. Resolutions to add roads in the following subdivisions to state system (Attachment 2) Overhills Creek, Section 5, Part 3 Overhills Creek, Section 6, Part 1 Ballard Woods Anderson Creek Township 5. Service contract with Jones' Landscaping&Maintenance, Inc. for landscaping and irrigation installation at the new Harnett County Detention Center. The total contract price is $76,000-landscaping$35,935, irrigation$16,285 and maintenance$24,000. 6. Renewal of lease with Ralph and Margaret Mangum for Johnsonville Container site property located on Brooks Mangum Road. This renewal includes an increase of$300.00 making the annual rent amount $1,900.00. 7. Resolution authorizing purchase of real property from Zoner A. Taylor. Harnett County will pay Ms. Taylor$100.00 for the 4.70 acres located near Buies Creek and dissected by US Highway 421. (Attachment 3) 8. Four lease agreements with farmers to use county owned property for agricultural • purposes: 1. Marvin Tart, Jr.-17 acres, Harnett County Airport property 2. Max and Harry Matthews-14 acres, Harnett County Airport property 3. R.D. Lee Farms, Inc.-5 acres, Harnett County Airport property 4. Ronnie Hall-20 acres, Governmental Complex Property adjacent to Cape Fear River 9. Write off of delinquent Emergency Medical Services accounts for the month of February, totaling $21,185.90. 697 10. Frequency Reconfiguration Agreement with Nextel South Corp. to reconfigure the 800 MHz band to minimize harmful interference to public safety radio communications systems in the band. All costs of reconfiguration shall be paid by Nextel. The reconfiguration is made necessary by an order of the Federal Communications Commission. 11. Authorization for Dunn Rescue Squad, Inc. to spend budget fund balance to purchase two 2008 Ford Expedition vehicles. The vehicles will replace two 1999 Chevy Tahoes 110 with 130,000 and 120,000 miles. 12. Final Adjusting Change Order for TA Loving in the amount of$7,977.62 due to additional materials and modifications needed at the pump station associated with the Fort Bragg NTA housing Project. 13. Authorization for the Planning Department to apply for 2008 USDA housing Preservation grant in the amount of$95,000. Matching funds budgeted by the Department of Social Services is $20,000 (in hard costs for World Changers group). 14. Contract amendment increase of$225,000 for Marziano & McGougan in association with the Fort Bragg Northern Training Area.Project. This amendment is for the design, bidding and construction phase services for the new water tank to be located in the Cameron Hills Area. 15. Award contracts for six law enforcement vehicles for the Sheriff Department to Capital Ford, Raleigh; and one SUV to Ilderton Dodge, High Point. (Attachment 4) 16. Resolution awarding Sgt Charles Garner his service weapon upon his retirement from the Sheriff' epartment (Attachment 5) • 17. Memorandum of Agreement between the North Carolina Department of Transportation and the County of Harnett for removal of debris during a State of Disaster or Imminent Threat of Disaster and/or a State of Emergency declared pursuant to Chapters 14 and 166A of the north Carolina General Statutes. This memorandum of Agreement is renewable on an annual basis. 18. Reimbursement Resolution for the County to reimburse itself for capital expenditures incurred associated with the construction of the new Angier Elementary School; and Initial Resolution for the Angier'Elementary School Financing which includes several necessary findings, calls for the public hearing and authorizes application to the LGC. (Attachment 6) 19. Authorization for staff to pursue a sole source lease purchase of lights from Musco Lighting to light a practice field at Triton High School. This improvement will benefit several sports teams at the school and will be available for community use as well. The total project cost is $98,500. This figure includes $25,000. for installation by Walter Holmes electric. The final amount financed will be determined once existing funds within Parks and Recreation have been utilized that could be applied to the project. In the informal comments portion of the meeting, Jim Burgin, candidate for county commissioner, asked the Board to meet with all parties involved to resolve the hospital issue. • Commissioner McNeill moved for the appointments listed below. Commissioner Andrews seconded the motion and it passed unanimously. Adult Care Home Community Advisory Committee Patricia Ann Benson for a one year term to expire 03/31/09 Nominated by Commissioner McNeill Historic Properties Commission Melanie Collins for a 3-year term to expire 03/31/11 698 Nominated by Commissioner Andrews Juvenile Crime Prevention Council James Futrell for a 2-year term to expire 03/31/10 John Finger, President, Harnett County Veterans Council,provided an update on the Harnett County Veterans Park and the USS Harnett County Memorial project. Commissioner McNeill moved to approve full funding of Phase I and II of the project as noted below. Vice Chairman Hill seconded the motion and it passed unanimously. • USS Harnett County Monument: Base- 4 'long X 1' 2"wide X 8"high Tablet—3' long X 8"wide X 5' high Edgerton Memorials will cut stone, engrave and place monument in Park. Total cost: $2,500.00 Yard Arm: Base—3' X 3' X 3" concrete pad installed by Danny Lee Yard Arm—25' fiberglass/brushed aluminum Flags and Pennants Total cost: $2,459.00 Joel Strickland, RPO Coordinator, presented for the Board's consideration an amended Memorandum of Understanding for Cooperative, Comprehensive and Continuing Transportation Planning and the Establishment of A Rural Transportation Planning Organization for the Counties of Bladen, Cumberland, Harnett, and Sampson, comprising the Regional M Planning Area, and the municipalities contained therein, excluding Fayetteville, Hope Mills and Spring Lake and the North Carolina Department of Transportation. Commissioner Andrews moved to approve as presented. Commissioner McNeill seconded the motion and it passed unanimously. Mike Harris, USDA Rural Development,presented an Amended Letter of Conditions to the South Central Water and Sewer District Phase IA Wastewater Project due to an • increase in loan funds provided by USDA. Chairman Byrd stated that the Board would now convene as the South Central Water and Sewer District governing board. Commissioner McNeill moved to adopt a resolution to accept the conditions set forth in the amended Letter of Conditions. Commissioner House seconded the motion and it passed unanimously. Chairman Byrd closed the South Central Water and Sewer District portion of the meeting. (Attachment 7) Mark Locklear, Manager, Planning Services,presented proposed text amendments to the Historic Preservation Ordinance. Chairman Byrd called to order a public hearing regarding the matter and opened the meeting for comments from the public. No comments were offered and Chairman Byrd closed the public hearing. Commissioner McNeill moved to adopt a Resolution Amending the Harnett County Historic Preservation Ordinance. Commissioner Andrews seconded the motion and it passed unanimously. (Attachment 8) Mark Locklear, Manager, Planning Services,presented proposed text amendments to the Zoning Ordinance. Chairman Byrd called to order a public hearing regarding the matter and opened the meeting for comments from the public. No comments were offered and Chairman Byrd closed the public hearing. Vice Chairman Beatrice Hill moved to adopt a Resolution Rewriting the Harnett County Communications Tower Ordinance. Commissioner House seconded the motion and it passed unanimously. (Attachment 10) 699 Departmental reports were filed with the Board from the Health Depai hilent, Animal Control, Planning Department, Veterans Service and Finance Office(Attachment 11) In the County Manager's report Mr. Emory reminded the commissioners of upcoming events: Litter Sweep Annual Clean-up, April 19th—May 3rd NCACC District Meeting, April 25th Cooperative Extension Annual Report, May 5th Vice Chairman Hill moved for the Board to go into closed session concerning the S handling or settlement of a claim. Commissioner McNeill seconded the motion and it passed unanimously. Commissioner McNeill moved to come out of closed session. Commissioner House seconded the motion and it passed unanimously.
