Minutes of Regular Meeting
October 18, 2004
The Harnett County Board of Commissioners met in regular session on Monday,
October 18,2004, in Courtroom 6, Harnett County Courthouse, 301 West Cornelius
Harnett Boulevard, Lillington, North Carolina.
Members present:

Chairman Byrd called the meeting to order and Commissioner Andrews led the pledge
of allegiance and prayer.
Commissioner Hill moved to approve the agenda as published with the changes listed
below. Commissioner Andrews seconded the motion and it passed unanimously.
Add: Recognition of Gary Averitte on receiving award.
Delete from consent agenda: item (g) sole source purchasing option for Dispatching
Mobile Data and Paging system, and (h) sole source purchasing option for Simon E-
911 Telephone System. These two items will be discussed at a Board workshop
before being brought back for consideration.
Chairman Byrd praised Gary Averitte, Harnett County Water Resources Manager, on
being named "Operator of the Year" by the North Carolina Waterworks Operators
Association. The award is presented each year to one water treatment professional in
the State of North Carolina for outstanding ability and devotion to the art and science
of water supply and purification.
Upon motion by Commissioner McNeill and seconded by Commissioner Titchener,
the Board unanimously approved the following items on the consent agenda:

3. Tax refunds and releases (Attachment 1)
4. Resolution to add roads to the state system (Attachment 2)
5. Resolution and related documents authorizing participation in the Community
Transportation System (Attachment 3)
6. Lease agreement for building located at 22 West Front Street, Lillington, to be used
as office space for the Chief Counselor's office. The building was owned by
Doyle Construction, but is now owned by Shelby H. Collins and husband, Brian
Collins. The building contains approximately 2,565 square feet of office space.
Rental shall be $1,700 per month. The term of this lease shall be five years
beginning October 1,2004, and extending through and ending September 30,2009.
7. Contract with General Electric Capital Corporation for new telephone system for
Parks & Recreation.
8. Resolution in support of accreditation for local health departments (Attachment 4)
9. Salary adjustment for Section 8 Housing Director: increase from current salary to
new salary of $39,000.
10. Authorization to accept a donation of from Progress Energy in the amount of
$4,387. which was used in FY 2003-04 to purchase a 12'x 20' storage building
for use at the Emergency Operations Center. In FY 2004-05 a donation of$5,000.
will be used to purchase 2 laptop computers and 6 printers. The laptops and one
printer will be used in the command post and field staff will use the remaining
5 printers.
11. Authorization for Emergency Services to apply for additional exercise funds from
FY 2002 Department of Justice Exercise Grant in the amount of
$14,140. The funds will be used for a Unified Incident Command Tabletop
Exercise and a Continuity of Operations Plan Tabletop and Full Scale Exercise.
12. Authorization for Emergency Services to use Sole Source Provider option to
purchase two ISI 4500/30 minutes carbon air tanks from Johnson fire & Safety
Systems.
13. Write-off of delinquent Public Utilities accounts for the third quarter of 2004 in
the amount of $21,939.81. All of these accounts have been in a delinquent status
for more than three years. Through the Debt-Setoff Program, Public Utilities has
received over $41,000 in bad debt previously written off.
14. Authorization for Management Information Systems (MIS) to use Sole Source
Provider to purchase Sungard HTE's Click2Gov software solution. This will
make it possible for on-line access to building permit information.
In the informal comment portion of the meeting, Mary B. Johnson, vice president,
Harnett County Tax Coalition, voiced concerns with the County regarding allegations
involving the Register of Deeds office during the 2000 election campaign.
Commissioner Hill moved for the appointment listed below. Commissioner Andrews
seconded the motion and it passed unanimously.
Harnett County Juvenile Crime Prevention Council
Caron Stewart appointed for a 2-year term to expire 9/30/06
nominated by Chairman Byrd
Chairman Byrd called to order a public hearing on a proposed Zoning Ordinance text
amendment regarding Parking and Off-Street Loading Requirements. Joseph Jeffries,
Chief Planner, presented the proposed text amendment. Chairman Byrd opened the
meeting for comments from the public. No comments were offered and Chairman
Byrd closed the public hearing. Commissioner McNeill moved to adopt the resolution
amending the Zoning Ordinance text as presented. Commissioner Hill seconded the
motion and it passed unanimously. (Attachment 5)
Chairman Byrd called to order a public hearing on a proposed Zoning Ordinance text
amendment regarding height of swimming pool fences. Mark Locklear, Senior
Planner, presented the proposed text amendment. Chairman Byrd opened the meeting
for comments from the public. No comments were offered and Chairman Byrd closed
the public hearing. Commissioner Andrews moved to adopt the resolution amending
the Zoning Ordinance text as presented. Commissioner McNeill seconded the motion
and it passed 4 to 1 with Commissioner Titchener casting the dissenting vote.

Departmental reports were filed with the Board from the Sheriff s Department, General
Services, Veteran's Services, Animal Control, and Intra-departmental budget
amendments (Attachment 7)
Mr. Emory reported on the following items:
1. There will be a workshop on "subdivision design with conservation in mind"
in New Bern, December 1, 2004.
2. Commissioner McNeill moved that the County commit, along with the Harnett
Forward Together Committee, to Progress Energy's proposal regarding placement
of three-phase electrical facilities at the entrance to Western Harnett Industrial
Park at a cost of $171,000. Commissioner Andrews seconded the motion and it
passed unanimously.
3. The Board, by consensus, supports Economic Development's request for waiver of
fees to be included in Harnett County's proposal for two projects, one involving
Edgerton I as well as Project Bullseye.
4. Commissioner McNeill moved to approve a change order for Edgerton II
Industrial Park asphalt paving project. Commissioner Hill seconded the motion
and it passed unanimously. (Attachment 8)
5. Commissioner Andrews moved for the County to accept an invitation to become a
member of the North Carolina Capital Area Metropolitan Organization (MPO) if
the Town of Angier chooses to join. Commissioner McNeill seconded the motion
and it passed unanimously.
6. Mr. Emory noted that Averasboro Battleground Commission has requested support
to provide officers to insure public safety at events.
Commissioner McNeill moved that the Board go into closed session for the following
purpose: To instruct the county staff in negotiating the terms on a proposed contract
for the acquisition of real property. This motion is made pursuant to N.C. General
Statute Section 143-318.11(a)(5). Commissioner Hill seconded the motion and it
passed unanimously.
Commissioner McNeill moved for the Board to come out of closed session.
Commissioner Hill seconded the motion and it passed unanimously.
There being no further business, Commissioner McNeill moved to adjourn.
Commissioner Andrews seconded the motion and it passed unanimously. The Harnett
County Board of Commissioners regular meeting, October 18,2004, adjourned at 7:45
p.m.
