Harnett County Development Services, as associated with FAMPO and on behalf of the Fayetteville Air Quality Stakeholders group, requested approval of a Resolution in Support of the Fayetteville Metropolitan Area Air Quality Stakeholders' Committee. (Attachment 1) 4. Harnett County Board of Commissioners authorized, empowered and commanded the Tax Administrator to collect the taxes set forth in the tax records filed in the office of Harnett County and in the tax receipts herewith delivered to the Tax Administrator, in the amounts and from the taxpayers likewise therein set forth. This charge is for the 2018/2019 tax year. Chairman Springle opened the floor for informal comments by the public, allowing up to 3 minutes for each presentation up to 30 minutes. The following citizens addressed the Board: - Cris Nystrom of 391 Senter Lane in Buies Creek - Tim Morris of Erwin August 20, 2018 Regular Meeting Minutes Harnett County Board of Commissioners Page 6 of 10 - Patsy Carson of Erwin - Michael Jackson of Erwin Commissioner Miller moved to approve the appointments listed below. Commissioner Elmore seconded the motion that passed unanimously. Board of Health Amy Allen was reappointed to serve on this Board for a term of three years expiring August 31, 2021. Linda Sturdivant was reappointed to serve on this Board for a term of three years expiring September 30, 2021. Harnett County Planning Board Niihau Ramsey was reappointed to serve and as alternate on this Board for a term of three years expiring September 30, 2021. Nonprofit Funding Committee Bob Woolston and Lucia Turlington were reappointed to serve on this committee for a term of three years expiring September 30, 2021. Development Services Director Mark Locklear petitioned the Board for a public hearing regarding proposed zoning change: Case # RZ-18-261 Landowners/Applicants: Senter V Others / Par 5 Development Group, LLC; 3.96 +/- acres; Pin #0654-51-3127.000; From RA -30 to Commercial Zoning District; US Hwy 401 N; Hector's Creek Township. Mr. Locklear noted the Harnett County Planning Board, during their August 6, 2018 meeting, voted unanimously (4-0) to recommend approval based on existing residential uses and the County's Land Use Plan. He reported Small Scale Zoning was considered and all four facts were approved as well. Mr. Locklear said no one attended the meeting in opposition. The Site is currently vacant. Surrounding land uses consist of single-family residential lots and several nonresidential uses. Immediately adjacent to the west is a 95 -acre industrial site. Also, approximately 200' north of this site are 5.6 acres of commercially zoned property (8 lots). Services available include Harnett County public water and private septic tank. Mr. Locklear stated staff's evaluation as: The IMPACT to the adjacent property owners and the surrounding community is reasonable, and the benefits of the rezoning outweigh any potential inconvenience or harm to the community. REASONING: The requested zoning change to Commercial will not have a negative impact on the community, as it is similar in nature to existing zoning districts and development patterns in this area. The requested zoning district is COMPATIBLE with the existing Land Use Classification. REASONING: The requested zoning is compatible with the existing Land Use Classification of a Compact Mixed Use, as well as within the Compatibility August 20, 2018 Regular Meeting Minutes Harnett County Board of Commissioners Page 7of10 Development Target area. These two designations highlight growing areas of the County that consist of planned residential areas mixed with a variety of nonresidential uses. The proposal does ENHANCE or maintain the public health, safety and general welfare. REASONING: The requested rezoning to Commercial would maintain or enhance the public health, safety and general welfare due to the area's existing commercial uses as well as the potential site improvements that would be required. The request is for a SMALL SCALE REZONING and should be evaluated for reasonableness. REASONING: Due to the size of the tract and that the proposed zoning district is not immediately adjacent the application should be evaluated for Small Scale Rezoning. Suggested Statement -of -Consistency: Staff concludes that the requested rezoning to Commercial is compatible with Harnett County regulatory documents and would not have an unreasonable impact on the surrounding community based on the growth in this area as well as the County's Land Use Plan designation for this area therefore it is recommended that this rezoning request be approved. Mr. Locklear responded that if this site is rezoned commercial; and he understands it is being looked at for some type of retail establishment, that the applicant would then have to apply to NCDOT for a driveway permit. He said at that time NCDOT would dictate whatever traffic improvements would need to be made. Vice Chairman wanted to make sure the applicant understood potential upcoming impacts and changes. Chairman Springle called to order a public hearing on the matter and opened the meeting for comments from the public. - Jody Bland with Par 5 Development, the applicant, spoke in favor of the proposed rezoning. He addressed buffer and NCDOT requirements. Seeing no one else move, Chairman Springle closed the public hearing. Commissioner Miller moved to approve the requested rezoning to Commercial as it is compatible with Harnett County regulatory documents and would not have an unreasonable impact on the surrounding community based on the growth in this area as well as the County's Land Use Plan designation for this area. Vice Chairman Penny seconded the motion that passed unanimously. Mr. Locklear petitioned the Board for a public hearing regarding proposed Zoning Change: Case # RZ-18-257 Landowner/Applicant: Thomas Garland Parker; 1.09 +/- acres; Pin #9594-06- 7981.000; From RA -30 to Commercial Zoning District; NC Hwy 24/87; Anderson Creek Township. Mr. Locklear noted the Harnett County Planning Board, during their August 6, 2018 meeting, voted unanimously (4-0) to recommend approval based on adjacent Commercial zoning and compliance with the County's Land Use Plan. Mr. Locklear said no one attended the meeting in opposition and RULAC did not have any concerns. The site is currently occupied by an uninhabited residence, which was a part of the former manufactured home park. Surrounding land uses consist of various commercial and professional August 20, 2018 Regular Meeting Minutes Harnett County Board of Commissioners Page 8of10 establishments, high-density residential developments, and individual single-family residences. Services available include Harnett County public water and sewer. Mr. Locklear stated staff's evaluation as: The IMPACT to the adjacent property owners and the surrounding community is reasonable, and the benefits of the rezoning outweigh any potential inconvenience or harm to the community. REASONING: The requested zoning change to Commercial will not have a negative impact on the surrounding properties or the community as it is similar in nature to existing zoning districts and development patterns in this area. - The requested zoning district is COMPATIBLE with the existing Land Use Classification. REASONING: This parcel is immediately adjacent to Commercial zoned property and therefore does not need to be evaluated for Small Scale Rezoning. It is recommended that this rezoning request be approved. Chairman Springle called to order a public hearing on the matter and opened the meeting for comments from the public. Seeing no one move, Chairman Springle closed the public hearing. Vice Chairman Penny moved to approve the requested rezoning to Commercial, as it would not have an unreasonable impact on the surrounding community due to its compatibility with the Harnett County Land Use Plan as well as the existing commercially zoned properties within the area. Commissioner Penny seconded the motion that passed unanimously. President Alvin McArtan and member Donald Thomas presented the Sandhills Antique Farm Equipment Club annual report. Sandhills Antique Farm Equipment Club is a 501(C)3 tax- exempt corporation that leases land from the County. The Club's mission is to preserve southern agricultural heritage through restoration and display of antique farm equipment at work, and to provide fun and educational family activities for North Carolinians of all ages. Mr. McArtan spoke of club member Tom Steves who passed away last year. Mr. Thomas reported on some of the activities at the Sandhills Farm Park as well as Club activities and involvement in the community. The Club also hosts Ag Science Field Days four times a year for all Harnett County 5th graders. Mrs. Stewart presented the following reports: - Public Health Activities Report — 2017/2018 - Interdepartmental Budget Amendments August 20, 2018 Regular Meeting Minutes Harnett County Board of Commissioners Page 9 of 10 Mrs. Stewart also reviewed upcoming meetings and invitations. Chairman Springle called for any new business. Commissioner Miller talked about the recent "Clear the Shelter Day" event at Harnett County Animal Services. He also talked about improvements made at the animal shelter. Chairman Springle and Commissioner McKoy talked about their recent visit to an energy positive school in Hoke County and noted a forthcoming presentation about the program to the Harnett County Board of Commissioners and Board of Education. Vice Chairman Penny moved that the Board go in to closed session for the following purposes: 1) To instruct the County staff concerning the position to be taken by the County in negotiating a contract for the acquisition of real property, 2) To discuss certain personnel matters; and 3) To discuss certain economic development matters. This motion is made pursuant to N.C. General Statute Section 143-318.11(a)(5),(6)&(4). Commissioner Elmore seconded the motion, which passed unanimously. Vice Chairman Penny moved that the Board come out of closed session. Commissioner Miller seconded the motion that passed unanimously. Commissioner Elmore moved to adjourn the meeting at 8:30 pm. Gorr on Springle Regina eler, Clerk August 20, 2018 Regular Meeting Minutes Harnett County Board of Commissioners Page 10 of 10 ATTACHMENT 1 Harnett COUNTY NORTH CAROLINA www.harnett.org A RESOLUTION IN SUPPORT OF THE FAYETTEVILLE METROPOLITAN AREA AIR QUALITY STAKEHOLDERS' COMMITTEE WHEREAS, the federal Clean Air Act, through the Environmental Protection Agency (EPA), establishes air quality standards to protect public health and welfare; and WHEREAS, the Fayetteville Metropolitan Area Air Quality Stakeholders' Committee has acknowledged the importance of these standards in promoting quality of life, economic development, and future healthy development; and WHEREAS, the Fayetteville Metropolitan Area Air Quality Stakeholders Committee will strive to maintain at or below the Federal ozone standard as set annually by the EPA; and WHEREAS, in 2003, the Air Quality Stakeholders Committee was created to proactively improve air quality for the citizens in the Fayetteville Metropolitan Area and its participating local governments; and WHEREAS, EPA, in conjunction with state governments, business, industry, and environmental interest, has developed an option known as an "Ozone Advance Program", through which an area, in partnership with the North Carolina Department of Environmental Quality (NC DEQ) and EPA, can voluntarily improve conditions through strategies developed through an Action Plan to help avoid a designation of non -attainment; and WHEREAS, the benefits of participating in an Ozone Advance Program include: clean air sooner, potentially avoiding non -attainment designation; preference during EPA federal grant allocations; flexibility to achieve standards in cost effective ways; development of local standards in partnership with stakeholders and the state, and other benefits; NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of Harnett County, North Carolina as a member of the Fayetteville Metropolitan Area Air Quality Stakeholders Committee, that the Committee fully supports the Ozone Advance Program as approved by the Fayetteville Area Metropolitan Planning Organization Transportation Policy Board and will participate in the development and implementation of an Action Plan, which will reduce ground -level ozone concentrations in preparation for the upcoming ozone standard.
