Members present: Staff present: Gordon Springle, Chairman Howard Penny, Vice Chairman Barbara McKoy, Commissioner Abe Elmore, Commissioner Joe Miller, Commissioner Heather Pollard, Human Resources Director Chairman Springle called the meeting to order at 9:00 am. The purpose of the special session was to conduct interviews for County Manager. Commissioner Miller moved that the Board go into closed session to discuss certain personnel matters. This motion is made pursuant to N .C. General Statute Section 143-318.l l(a)(6). Commissioner McKoy seconded the motion that passed unanimously. Vice Chairman Penny moved that the Board come out of closed session. Commissioner Elmore seconded the motion that passed unanimously. Commissioner McKoy moved to adjourn the meeting at 3 :45 pm. Proclamation -2018 National Service Recognition Day 3. Proclamation -April 2018 Child Abuse Prevention Month 283,800 increase 283,800 increase 283,800 increase 283 ,800 decrease 4. Harnett County Finance Officer requested approval of a resolution authorizing the County of Harnett to engage in electronic payments as defined by G.S. 159-28 or G .S. 115C-441. Due to the expanded use of paperless payment methods, the NC Department of State Treasurer requires the approval of a resolution by the governing body, which permits the use of these types of transactions by the Finance Officer. (Attachment 1) 5. Harnett County Cooperative Extension requested approval to accept a grant for $7,400 from the NC AgVentures Grant Program. Grant funding will be used to purchase seed and help establish alfalfa research plots on five (5) Harnett County farms in 2018. 6. Harnett County Sheriffs Office requested approval to accept the award of equipment from a NC Governor's Highway Safety Grant: three (3) Raptor radar units valued at $2,500 each and one (1) ProLaser 4 MPH unit valued at $2,800. This equipment is awarded to participating agencies, based on a point system, with no cost to the agency. 7. Harnett County Department of Public Utilities (HCDPU) requested approval of an increasing change order in the amount of $217,000 for HCDPU utility billing software. This software purchase was part of the recommended improvements in the HCDPU Efficiency Study completed in 2015 . The change order is needed to pay for additional training and installation time. These funds were budgeted in this year's capital budget. 8. Harnett County Board of Education requested $50,256 additional funds for the completion of their 2017-2018 capital projects. Chairman Springle read aloud the proclamation proclaiming April 3, 2018 as National Service Recognition Day in Harnett County. Chairman Springle also read aloud the proclamation proclaiming April 2018 as Child Abuse Prevention Month in Harnett County. Chairman Springle opened the floor for informal comments by the public, allowing up to 3 minutes for each presentation up to 30 minutes. Everett Blake of 352 Gardner Road in Angier addressed the Board. As a Cisco Systems representative, Mr. Blake said he recently spoke to sophomores at our four high schools during their Career Day, which he said was a great success. Nonprofit Committee Chairman Bob Woolston said the committee received 27 applications for consideration this year. He thanked Shannon Eason for compiling the information. Commissioner Miller seconded the motion that passed unanimously. Commissioners thanked the committee for their work. Brian Haney, Interim Assistant County Manager and Community and Government Relations Director, reviewed proposed text for a plaque to be attached to the new Harnett County Administration Building at 420 McKinney Parkway in Lillington. It was the consensus of Board to move forward with the text for the plaque as presented. Mrs. Stewart provided an update on the recent Shawtown Community Meeting. She noted the meeting was well attended and the community voted to go along with what the County is proposing for the campus, including demolishing the 1949 building. Mrs. Stewart said the community is looking forward to us revitalizing the campus and moving people there. She said this was the first of many meetings they will have to talk about the things we are going to do there. Mrs. Stewart said they would have to figure out how to renovate the gym following renovations and the demolition. Commissioners Penny and McKoy, who also attended the meeting, commented. Mrs. Stewart reviewed upcoming meetings and invitations . Commissioner Miller said he would like the Board to make panhandling illegal in Hamett County. He said he has talked with the Sheriff about this. Staff will research this for discussion during an upcoming work session. Commissioners recognized Marty Clayton with Duke Energy. Commissioner McKoy moved that the Board go into closed session for the following purposes: 1) To construct with the County's legal staff in order to preserve the attorney-client privilege concerning the handling of a certain claim; and 2) To instruct the County staff concerning the position to be taken by the County in negotiating a contract for the acquisition of real property, and 3) To discuss certain personnel matters, and 4) To assist in the formulation of plans by the Hamett County Board of Education relating to the emergency response to incidents of school violence. This motion is made pursuant to N.C. General Statute Section 143-318.11 (a)(3)(5)(6)&(8). Commissioner Miller seconded the motion, which passed unanimously. Commissioner Miller moved that the Board come out of closed session. Vice Chairman Penny seconded the motion that passed unanimously. Commissioners planted pinwheels in front of the County Administration Building in recognition of April as Child Abuse Prevention Month. Commissioner Elmore moved to adjourn the meeting at 10:52 am. Specific Action Requested: That the Board of Commissioners approves a joint resolution adopting NC Geodetic Survey's preliminary resurvey of the common boundary (corner) between Wake County , Harnett County, and Chatham County and commitment to pursue joint enabling legislation to modify the Wake County and Chatham County Boundary as described in the 1961 Survey. Item Summary: Uncertainty with the location of county boundary lines is not uncommon in North Carolina . Today's technology can locate boundary lines much more precisely and uncover discrepancies in those boundaries . These discrepancies can create issues when it comes to tax assessment, property value, deed recordation , zoning , building permitting , public safety, board of elections, and the school system . Staff is working with Wake and Chatham Counties to resolve uncertainties in those shared boundaries . For example, there are differences between the boundary line that Wake County uses versus the one that Harnett County uses . In some instances, the boundary line used between the two counties varies as much as 200 feet. Th is has resulted in confusion over the delivery of services and tax assessment to the properties along the boundary line. Given the uncertainties, Wake and Harnett County staff requested the NC Geodetic Survey office to conduct historical research and field work to determine the accurate location of the shared boundary line for Wake and Harnett Counties. During their work they discovered errors in the 1961 Wake County and Chatham County survey whereby the actual Wake/Chatham/Harnett corner is approximately 500 ' southwest of the corner established in the 1961 Wake/Chatham survey. This error is the cause of today 's uncertainties along the Wake/Harnett boundary line . NC Geodetic Survey has prepared a new preliminary survey indicating the correct location of the Wake/Chatham/Harnett corner. To establish this as the correct boundary corner for the three counties , and correct the Wake/Chatham County boundary line, state legislation must be enacted in accordance with N.C .G .S . 153A-17. The attached resolution , to be jointly adopted by all three counties , provides support for legislation to make this correction in the 2018 NC General Assembly short session . After legislation is enacted, Wake and Harnett Counties will work toward locating its official boundary in accordance with N.C .G .S. 153A-18. This does not require legislative action by the NC General Assembly and can be enacted locally upon agreement between the two counties . 041618 HCBOC Page 31 On November 14 , 2017 , staff introduced this issue to the Board of Commissioners at their work session and received direction to continue working with Wake County and Chatham County. Wake and Chatham Counties received similar direction from their Boards. Since that time, staff from each county has worked collaboratively on identifying all the parcels impacted to correct the boundary line issue. Staff conducted two commun ity meetings (December 5, 2017 and March 27, 2018) where property owners could learn more about the issue. Property owners were also sent letters detailing the impact on their property. For example, where the boundary line splits a parcel, the property will now become split assessed between the two counties . This is in accordance with state law. In other cases, the property will move entirely from one county to the other. Two of the more common concerns from property owners are: 1) will future development be restricted in some way on a parcel that is split between the two counties? and 2) will a split parcel affect the current agricultural tax deferment? The answer to both questions is no impact at all. The attached resolution is also being considered by the Wake and Chatham County Board of Commissioners . Upon agreement by the counties , staff will work collaboratively to draft the legislation for the 2018 NC General Assembly short session , which begins in May . After ratification of the bill, Harnett and Wake Counties will consider adoption of a joint resolution to establish the correct Harnett-Wake County Boundary. Also Harnett and Chatham Counties will consider adoption of a joint resolution to establish the correct Harnett-Chatham County Boundary . All proposed corrections to the county boundary lines will become effective on January 1, 2019. Several months prior to the effective date of January 1, 2019 , each County will apply zoning to the properties or portions thereof that are being transferred into the county. Smith survey recorded in Book of Maps 1961 , Page 68, Wake County Registry; and WHEREAS , in recent years, confusion over the situs of specific parcels of land in Wake County and Harnett County has arisen; said confusion being heightened by the ever increasing residential and commercial development in proximity to this boundary line, which affects tax assessments, deed recordation , zoning and regulatory inspections, public safety, elections and school assignment in the respective counties; and WHEREAS , through recent survey work completed by North Carolina Geodetic Survey in association with locating the boundary between Wake County and Harnett County, errors have been discovered in the 1961 Wake County and Chatham County survey which mu st be resolved with corrective legislation in accordance with N.C.G.S. § 153A-17; and WHEREAS, the preliminary survey recently completed by North Carolina Geodetic Survey i s attached hereto as Exhibit A which indicates the actual Wake/Chatham/Hamett comer is approximately 500.72 feet southwest of the comer established in the 1961 Wake County and Chatham County survey; and WHEREAS, the Wake County and Chatham County boundary is an integral part of locating the Wake County and Harnett County boundary as all three counties share a common comer; and WHEREAS, Hamett County did not ratify the 1961 Wake County and Chatham County survey and as such, has been using a comer reference that differs from that used by Wake County and Chatham County ; and 1 041618 HCBOC Page 33 WHEREAS , Wake County, Chatham County, and Harnett County staff have held joint meetings to develop a strategy for correcting the mutual comer boundary between the three counties and have determined that a boundary correction in the Wake County and Chatham County line is a pre-requisite to locating the Wake County and Hamett County boundary line; and WHEREAS, the property owners that will be affected by the location of the common comer between Wake County, Chatham County, and Harnett County and resultant modification to the 1961 Wake County and Chatham County boundary line have been notified; and WHEREAS, the Wake County Board of Commissioners, Chatham County Board of Commissioners and Harnett County Board of Commissioners, with the assistance of the North Carolina Geodetic Survey desire to establish the accurate location of the comer between the three counties and also correct the common boundary line between Wake County and Chatham County; and WHEREAS , the Wake County Board of Commissioners, Chatham County Board of Commissioners and Harnett County Board of Commissioners hereby request that North Carolina Geodetic Survey prepare an official survey for adoption and ratification by the North Carolina General Assembly during the 2018 short session consistent with the purpose laid out in this Joint Resolution; and WHEREAS, following the establishment of the mutual comer between the three counties and correction in the boundary line between Wake County and Chatham County, Hamett County and Chatham County will jointly authorize, by separate resolution, North Carolina Geodetic Survey to prepare an official survey for the purpose of locating the of ficial boundary between them in accordance with § l 53A-l 8; and WHEREAS , following the establishment of the mutual comer between the three counties and correction in the boundary line between Wake County and Chatham County, Wake County and Hamett County will jointly authorize, by separate resolution, North Carolina Geodetic Survey to prepare an official survey for the purpose of locating the official boundary between them in accordance with§ 153A-18. NOW THEREFORE, BE IT RESOLVED BY THEW AKE COUNTY BOARD OF COMMISSIONERS, CHA THAM COUNTY BOARD OF COMMISSIONERS AND THE HARNETT COUNTY BOARD OF COMMISSIONERS that the survey completed by the North Carolina Geodetic Survey attached hereto as Exhibit A is hereby adopted for the purpose of establishing the common boundary (comer) between Wake County, Chatham County and Hamett County and for correcting errors in the 1961 Wake County and Chatham County boundary survey. 2 041618 HCBOC Page 34 BE IT FURTHER RESOLVED that staff is directed to pursue joint legislation from the North Carolina General Assembly for ratification of the common boundary (corner) between Wake County, Chatham County and Harnett County and modification of the 1961 boundary line between Wake County and Chatham County in accordance with N .C.G.S.
