020518mHARNETT COUNTY BOARD OF COMMISSIONERS Minutes of Regular Meeting February 5, 2018 The Harnett County Board of Commissioners met in regular session on Monday, February 5, 2018, in the Commissioners Meeting Room, County Administration Building, 420 McKinney Parkway, Lillington, North Carolina. Members present: Gordon Springle, Chairman Howard Penny, Vice Chairman Barbara McKoy, Commissioner Joe Miller, Commissioner Member absent: Abe Elmore, Commissioner Staff present: Paula Stewart, Interim County Manager Dwight Snow, County Attorney Kimberly Honeycutt, Finance Officer Margaret Regina Wheeler, Clerk Chairman Springle called the meeting to order at 9:00 am. Commissioner McKoy led the Pledge of Allegiance and invocation. Chairman Springle called for additions or deletions to the published agenda. Mrs. Stewart requested the removal of the request for approval of the purchase of 71.2 acres located in Barbeque Township due to on-going contract negotiations. She requested the Harnett County School's request to transfer available funds to Capital and additional Capital funding be removed from the consent agenda for discussion purposes. Last, she requested the addition of Harnett County Emergency Services request for approval to apply for the 2018 Emergency Management Performance Grant. Vice Chairman Penny moved to approve the agenda as amended. Commissioner Miller seconded the motion, which passed 4 - 0. Tax rebates, refunds and releases (Attachment 1) 4. 2018 Boards and Committees on Which Commissioners Serve 5. Harnett County Emergency Services requested acceptance of the amended conditional award letter in the amount of $481,000 State Disaster Recovery Act (DRA) 17 funding appropriation and Memorandum of Agreement for the grant award. All grant activities must show a tie back to the Hurricane Matthew flood event of October 6, 2016. 6. Harnett County Health Director requested approval to increase the following fees: CPT CODE DESCRIPTION RECOMMENDED PRICE 90651 Gardasil $195 (current $185) 90707 MMR $75 (current $70) 7. Harnett County Health Director requested approval of the revised bad debt write-offs in the amount of $1,898.09, instead of $3,896.95 as previously stated. 8. Harnett County Capital Projects Director requested approval of the purchase of 71.2 acres located in Barbeque Township for a price of $113,920 funded by the Solid Waste Department. This property is adjacent to the Anderson Creek Landfill and will be used for buffer and further expansion of the facilities, if needed. 9. Harnett County Sheriff's Office requested permission to accept a donation of a Model BCA15 Rifle multi -caliber valued at $500, Serial #12673, from Bear Creek Arsenal in Sanford, NC. 10. Harnett County Sheriff's Office requested approval of the Harnett County Detention Center Health Plan. Harnett County contracts with Southern Health Partners to provide medical care to the Harnett County Detention Center. The medical plan is developed by Southern Health Partners and then reviewed and approved by the Sheriff and Health Director. 11. Harnett County Emergency Services requested approval to apply for the 2018 Emergency Management Performance Grant administered by the North Carolina Department of Public Safety Emergency Management. This is a federal grant administered by the State that is available to local governments to assist in the cost of developing and maintaining a comprehensive emergency management program. Chairman Springle opened the floor for informal comments by the public, allowing up to 3 minutes for each presentation up to 30 minutes. - Jerry Rivas of 364 Twin Ponds Road in Sanford addressed the Board. Mr. Rivas asked why we can't have non-violent offenders picking up road litter in the county. February 5, 2018 Regular Meeting Minutes Harnett County Board of Commissioners Page 3 of 7 Re -Entry Executive Director Dot Elhers and Director of Client Services Natalie Mabon thanked the county for providing Re -Entry office space free of charge for over 20 years. Mrs. Elhers asked the county to consider continuing to provide office space for the nonprofit. She distributed three letters of support. Commissioners, noting they no longer own the Noble House occupied by Re -Entry, suggested the group apply to the Nonprofit Committee for possible funding for office space. Commissioners asked them to work with staff to discuss the issue at an upcoming work session. Penny Christman from Carolina Seasons requested an update on the park in the Johnsonville area. She also listed improvements she would like to see at the Johnsonville Convenience Site. Everette Blake, of 352 Gardner Road in Angier, spoke on behalf of Horses for Hope that he said is a therapeutic riding facility that would be applying for funding through the Nonprofit Committee later this year. Commissioner Miller moved to approve the appointments listed below. Commissioner McKoy seconded the motion, which passed 4-0. Harnett County Planning Board Everett Blake and Jay Smith were reappointed to serve on the Planning Board for a term of three years expiring January 31, 2021. Mid -Carolina Aging Advisory Committee Lilly Mae Bailey, Susan Byerly and Patricia Dutton were reappointed to serve on this committee for a term of three years expiring January 31, 2021. Harnett County Schools requested the transfer of $595,805 from available funds to Capital and an additional $86,363 in Capital funding to be used toward several projects previously discussed. The projected amounts available for transfer based on current conditions are $500,155 projected balance available from $920,000 Reserve (K-3 Class size & HC Early College) and $95,650 projected balance available from $200,000 additional teacher positions. Upon recommendations by Mrs. Honeycutt, Commissioner Miller moved to approve transferring $595,805 into capital. Commissioner McKoy seconded the motion that passed 4-0. Commissioner Miller moved to approve the following projects: $60,000 WHHS Boiler Replacement $16,000 Lillington/Shawtown Cold Water Coil $380,000 WHHS Cooling Tower $338,469 WHHS Paving $305,375 WHMS Paving The Boone Trail water heater was not included barring further information. Vice Chairman Penny seconded the motion that passed 4-0. Vice Chairman Penny moved to defer the request for $86,363 in additional capital funding until a later date. Commissioner McKoy seconded the motion, which passed 4-0. February 5, 2018 Regular Meeting Minutes Harnett County Board of Commissioners Page 4 of 7 Chairman Springle introduced the Ordinance to Allow the Sale of Alcoholic Beverages before Noon on Sundays at Licensed Premises with the Unincorporated Areas of Harnett County. Chairman Springle reminded the group the "Brunch Bill" authorized cities and counties to adopt an ordinance to allow sales beginning at 10:00 am on Sunday; basically allowing licensed premises to sale alcoholic beverages two hours earlier on Sunday. As a point of order Attorney Snow noted within the Harnett County Board of Commissioners Rules of Procedures, as well as N.C. General Statute, for an ordinance to be adopted at the meeting where it is first introduced it must be approved by all members of the Board of Commissioners. Vice Chairman Penny moved to table consideration of the ordinance until all board members are present. Commissioner McKoy seconded the motion, which passed 4-0. CPA Matt Braswell with Martin, Starnes & Associates presented the Comprehensive Annual Financial Report (CAFR) for the fiscal year ending June 30, 2017. Mr. Braswell said they issued an unmodified opinion, meaning it is a clean opinion and the county's financial statements are in accordance with General Accounting Principles and are materially correct. He also noted staff was very cooperative. Mr. Braswell reviewed the general fund summary noting a total fund balance of $41,847,828 with an increase in unassigned fund balance of $6,235,035. The unassigned balance as a percent of expenditures in the general fund is 27.2% in 2017. He provided audit highlights for property tax, restricted intergovernmental, other taxes & licenses, Human Services, Education, Public Safety, Water & Sewer Fund, Solid Waste Fund, and Enterprise Funds Operating Income (loss) — Full Accrual. YMCA CEO Rick Houp requested approval of a contract between Harnett County and the YMCA of Sandhills to open a YMCA facility located in western Harnett County. The funding agreement states the County shall pay the YMCA $9,500 per month for 10 years. The proposed YMCA will be located off Hwy 87 in western Harnett County and will include a gymnasium, indoor lap pool, exercise rooms for weight training, cardio, and group exercise, locker rooms, and a childcare area. Mr. Houp talked about services the YMCA could provide throughout the county and reassured the Board the County would have input in the YMCA programs. Commissioner Miller moved to approve the contract between Harnett County and the YMCA of Sandhills to open a YMCA facility located in western Harnett County. Vice Chairman Penny seconded the motion, which passed 4-0. Mrs. Stewart presented the following report: Harnett County Financial Summary Report — November, 2017 Harnett County Sales Tax Analysis by Article — September, 2017 Harnett County DSS Monthly Report — December 2017 Mrs. Stewart reviewed upcoming meetings and invitations. She also noted she would be out of the office the following week. There was no new business. February 5, 2018 Regular Meeting Minutes Harnett County Board of Commissioners Page 5 of 7 Commissioner McKoy moved that the Board go into closed session for the following purposes: 1) To discuss certain personnel matters; and 2) To instruct the county staff concerning the position to be taken by the County in negotiating a contract for the acquisition of real property. This motion is made pursuant to N.C. General Statute Section 143-318.11(a)(6)&(5). Commissioner Miller seconded the motion, which passed 4 — 0. County Manager/Community & Government Relations Dir. The group reviewed and discussed the County's following top five legislative priorities: 1. Assist Harnett County in Expanding Broadband Access in Underserved Areas Many portions of Harnett County do not currently have access to broadband. This is another significant barrier to economic growth in the county. Harnett County asks for assistance in developing infrastructure and providing broadband to underserved areas within the county. 2. Address Disparities Related to Funding Formula for Military -Related Students Even though Harnett County has a substantial percentage of military -related students in its school system, the County receives considerably less in federal funding per student than do surrounding counties. Harnett County seeks increased funding to support the education of these students and reduce the burden on the County's taxpayers. Support Efforts to Expand Natural Gas Capacity Access to natural gas is a basic requirement for many industries and businesses looking for sites to locate new facilities. Despite a significant population growth in western Harnett County, a lack of access to natural gas has prevented the commercial and industrial growth that would normally accompany these increases in population. Harnett County seeks assistance in identifying ways to expand natural gas capacity throughout the county. 4. Assist County with Developing Economic Development Products Harnett County currently lacks attractive buildings and sites for industrial prospects. Over the last six months, this has resulted in the inability to respond to 20 out of 23 economic development prospects due to the lack of a sufficient product. An increasing number of site searches involving greenfields require the sites to be certified. Harnett County does not currently have any certified sites. Harnett County Economic Development requests assistance in funding the development of shell buildings and certifying sites, which will allow the County to compete for more business and industry to bring increased opportunity and prosperity to the county's residents. 5. Grant County Boards of Commissioners the Ability to Construct Schools The Harnett County Board of Commissioners asks for the authority to construct schools, which will assist the county in efforts to reduce existing and future issues with overcrowding. Currently, only the Board of Education has this authority. They also briefly reviewed the following remaining nine legislative priorities for the County: > Continue Support of Construction of Four Lane Highway into Wake County > Authorize Use of Recreation Fees for Construction > Allow Counties to use E-911 Funds for E-911 Needs Other than Equipment > Reduce Waiting Period to Auction Livestock > Address Motor Vehicle Gap Billing Issues > Allow Counties to Enact Impact Fees to Support Public Education > Preserve Maternal and Child Health Block Grant Funding > Increase Support of County Veterans Services Programs > Allow Firefighters at Non -Profit Departments Access to Local Government Retirement System Following the luncheon, Commissioner Miller moved to adjourn the meeting.
