I. That the written application of the Petitioner with attachments has been duly submitted to the Erwin Bond
of Commissions as required by 094111.2 of the Town of Erwin Zoning Ordinance(hereinafter inferred '

2. That the application substantially complies with the requirments of the Code in that it requests uses
permitted by a Conditional Use Permit under the Code, including autoorieoted businesses in the B-2
Highway Business district;

The Petitioner requests a Special Use Permit to establish a day care facility;
4. That the Erwin Board of Commissioners is empowered under sections of the Code, set out above to grant
such uses as allowed,provided that it will not adversely affect the public interest;
5. That the hereinafter described conditional use is deemed to be reasonable and is not in degradation of the
intent of the ordinance.
NOW, THEREFORE, in accord with the provision of the Coda, the following special use is granted to the
Applicant to establish an auto-oriented business on the premises described in Paragraph 3, Page 1, subject to the
following:
CONDITIONS:
I. That the Petitioner,Edward R.Cox is granted a Conditional Use Permit for an auto-oriented business in the
B-2 district;
2. That a Planning Department official shall be allowed to inspect the facility periodically for compliance with
all permit conditions and applicable zoning regulations. A violation of the permit shall be a violation of the
Code,and will malt in revocation of the permit;
