THIS EASEMENT, made and entered into this the 9th day of May, 20 17 , by and
between Sandra Gail Roberts and husband, David Ainsworth, parties of the first part and John
William Kimmons,party of the second part;
WITNESSETH:
WHEREAS, the parties of the first part are the owners of lands situated in Barbecue
Township, Harnett County, North Carolina, located on Roberts Road and which property is
identified as "9586-18-2523.000 Orene Roberts DB789, PG 104" on a map entitled "Physical
Survey Property of John Kimmons", prepared by M.A.P.S. Surveying, Inc., dated March 16,
2017,and attached hereto as EXHIBIT A;
WHEREAS, the party of the second part is the owner of a tract of property designated as
Tract 1, containing 5.000 acres, as shown on the map attached as Exhibit A;
WHEREAS,there is a mobile home located on the property owned by the party of the second
part which mobile home is located within the building setback lines and the existing written
easement described in deed recorded at Book 3469,Page 906:
AND WHEREAS, to reconcile the fact that the mobile home is located within the set
back and within the written easement and to make the written easement more true to the actual
easement as it exists on the ground, the party of the second part desires an easement for the
purpose of ingress, egress and regress to his property across the property of the parties of the
first part, which easement will be located 60 foot wide and 173.10 feet long immediately to the
south of the line designated as "546 46' 54" W Roberts Road" on the attached Exhibit A

AND WHEREAS, the parties of the first part have agreed to the above described
easement for a perpetual easement and right of way, said easement to be located 60 foot wide
and 173.10 feet long immediately below the call line "S46 46'54" W 173.10 Roberts Road" on
the lands of the parties of the first part which call line is shown on the attached Exhibit A.
NOW, THEREFORE, for and in consideration of the premises and the sum of TEN
DOLLARS to them in hand paid, the receipt of which is hereby acknowledged, said parties of
the first part do hereby bargain, sell and convey unto the party of the second part and his heirs
and assigns, a perpetual easement for ingress, egress and regress located 60 feet wide
immediately below the call line "S46 46'54" W 173.10 Roberts Road", which call line is shown
on the attached Exhibit A.
TO HAVE AND TO HOLD said right of way and easement to him, the said party of the
second part and his heirs and assigns forever.
THE PARTY OF SECOND PART HEREBY agrees to maintain this easement.
IN TESTIMONY WHEREOF, the parties have hereunto set their hands and seals the day
