The foregoing recitals are hereby incorporated into and made a part of this Agreement as though set forth verbatim. 2. Earnest Money Deposit. Upon execution of this Agreement, WJH shall deposit earnest money in the sum of Twenty-Thousand Dollars ($20,000.00) ("Earnest Money") and is being released directly to the Seller as working capital and is to be used solely to facilitate the clearing, padding and establishment of water connections for these lots. Seller agrees that Buyers obligation to purchase these lots is expressly subject to the completion of the above work. In consideration of the advancement of these funds and concurrently with receipt of said funds, Seller shall execute a Deed of Trust in favor of Buyer against the subject property in the amount equal to the amounts advanced.This contract shall serve as evidence of the secured obligation and this paragraph shall survive any subsequent default by Seller.
