Harnett County Emergency Medical Services Week (May 21 -27, 2017) Proclamation 6. Harnett County Emergency Services requested approval of a Resolution Authorizing Disposition of Personal Property to allow them to donate a 2005 Ford E-350 Bus to the Hamett United Police Athletic League (PAL) program. The Harnett United PAL program will title the vehicle in their organizational name and take full responsibility for all needed maintenance, repairs, title changes and insurance requirements. (Attachment 3) 7. Harnett County Veteran Services requested award of bid to The Spruill Construction Corporation for $38,000 to construct the Veterans Park Storage Building. Six bids were received; four bids were over budget and the lowest bid was not acceptable due to the bid containing a brick fa9ade. (Attachment 4) 8. Hamett County Information Technology requested award of bid to Tritronics for $429,971.38 to install updated audiovisual equipment in our Courthouse. Three bids were received with Tritronics being the lowest bidder. (Attachment 5) 9. Harnett County Parks and Recreation requested award of bid to Barrs Recreation for $52,041 for the playground equipment for the Boone Trail Community Center and Library playground. Three bids were received with Barr Recreation being the lowest. Barrs Recreation is also able to provide more equipment through a Burke Move with Us Grant worth $25 ,484. (Attachment 6) I 0. Harnett County Cooperative Extension requested permission to accept 2017-18 Adolescent Parenting Grant funds from the NC Department of Health and Human Services Department in the amount of $75,000 to support the Teen Pregnancy Prevention Initiative. There is a local in-kind match of $25,000, which includes office space for APP Coordinator, APP Library Space and Extension Director's Supervision of 5% of salary. 11. Harnett County Department of Public Utilities (HCDPU) requested approval of the North Harnett Waste Water Treatment Plant Upgrade Project Ordinance for $5,773 ,752. This project consists of the construction of a sludge dewatering system for both alum and wastewater sludge at the facility. It also consists of the addition of rotating disc filters and aeration basin anoxic zone mixers for improved treatment capability. These improvements are part of an increase in permitted treatment capacity at the plant from 5.6 MGD to 7.5 MGD. This project will be funded solely by HCDPU capital reserves. 12. Harnett County Sheriffs Office requested approval to accept the award of one Watch Guard 4RE Digital HD Panoramic in-car camera system valued at $5,000 and one Raptor KA Band Radar window mount radar unit valued at $1,800. These items will be awarded to Hamett County based upon the NC Governor's Highway Traffic Safety Grant point system. Harnett County Sheriff's Office requested approval to trade in eight (8) old Pro-I 000 radar units and antennas to Tarheel Waves LLC in Greensboro NC in exchange for repairs to a Golden Eagle radar unit. Repairs to the Golden Eagle unit are estimated at $1 ,550 with the unit valued at approximately $2 ,700. 14. General Services/Airport requested approval of the NC DOT/Division of Aviation grant agreement to develop alternatives for upgrading or replacing the existing Terminal Building at the Harnett Regional Jetport originally constructed in the early 1980s. Harnett County will receive a 90% federally funded grant with a local match of 10% funded by the current budget. The grant agreement also required approval of a resolution to appropriate the 10% of the total estimated project cost of$47,510. 15 . General Services/Airport requested approval of the NC DOT/Division of Aviation grant agreement to repair/replace the existing the primary Wind Cone at the Harnett Regional Jetport and add a supplemental wind cone at both ends of Runway 5-23. Harnett County will receive a 90% federally funded grant with a local match of 10% funded by the current budget. The grant agreement also required approval of a resolution to appropriate the I 0% of the total estimated project cost of $27,460. 16 . Harnett County Human Resources requested approval of the following 2017-2018 benefits plan for county employees as recommended by the Employee Benefits Committee: 1. Remain with BCBS of NC for health insurance 2. Remain with Delta Dental for dental insurance 3. Remain with Superior Vision for vision insurance 4. Remain with P&A Group for Flexible Spending Account administration 5 . Change from Reliance Standard to Unum Life Insurance Co. for Basic Life & AD&D, Short Term Disability, and Voluntary Life and AD&D. The change is to avoid a drastically high increase with Reliance due to a larger than normal number of life insurance claims during this benefit year. Chairman Springle opened the floor for informal comments by the public, allowing up to 3 minutes for each presentation up to 30 minutes. Jerry Rivas of 364 Twin Ponds Road in Sanford voiced opposition to proposed changes to three police power ordinances recently discussed by the Planning Board. Vice Chairman Miller moved to approve the appointments listed below. Commissioner Elmore seconded the motion, which passed unanimously. HARNETT COUNTY BOARD OF ADJUSTMENT Willie C. Surles, Jr. (nominated by Vice Chairman Miller) was appointed to serve on this board as a District 1 alternate for a term of three years expiring April 30, 2020. May 1, 2017 Regular Meeting Minutes Harnett County Board of Commissioners Page 4 of 6 051517 HC BOC Page 6 HISTORIC PROPERTIES COMMISSION Patricia Chalmers (nominated by Vice Chairman Miller) was appointed to serve on this commission for a term of three years expiring April 30, 2020. TRANSPORA TION ADVISORY BOARD Larry Smith (nominated by Vice Chairman Miller) was appointed to serve on this board for a term of one year expiring March 31, 2018. Buren Fulmer, Hamett Cotu1ty Forest Ranger, presented N.C. Forest Service 2016 Summary of Accomplishments in Hamett County. Mr. Fulmer reported that 341 landowners were assisted by the N.C. Forest Service in 2016 and 244 Forest Management Plans were prepared, placing an additional 9 ,286 acres under active forest management. Mr. Fulmer said 199 tax plans were requested due to the Forestry Present Use Value tax break. He reported 1,154 acres of trees were planted with cost share funds. Mr. Fulmer reported 111 landowners planted 1414 acres of long leaf pine trees through the Conservation Reserve Program. He noted the 2016 annual rental payment was $70,975 . He stated the Timber Restoration Fund was approved by Special Session in December 2016 and is available to areas effected by fire and flood. Hamett County had 10 landowners apply and were awarded $41 ,870 for reforestation effort this year. Mr. Fulmer noted increased logging activity in the County driven by the fiber/pulp market. Fifty-four active logging inspections where done in Hamett County in 2016. He also said the Ips Beetle has become a problem in Hamett County. Mr. Fulmer reported that in 2016 the NCFS in Hamett County responded to 65 fires with only 143 acres burned. Mr. Fulmer also reported 70,660 acres burned in western NC in November 2016 with resources from all over the United States assisting. In 2016, Forest Services participated in Fire Department Training Programs in Spout Springs, Boone Trail, Northwest Hamett and Erwin. The 10th Environmental Field Day was held for over 375 fifth graders. He also noted activities and controlled burning at the Anderson Creek Park. Mr. Fulmer stated the N.C. Forest Service's 2016 budget request from Hamett County is $115,011, which is an increase of$3,426 from 2016. He noted the increase is to cover the proposed 2% pay increase for four employees, a new computer and smart phones with a new real-time Fire Information System. Mr. Fulmer said the total cost-share payments for Hamett County landowners was $133,638 in 2016. Mr. Fulmer explained the Forest Service County Budget is 40% County funded, 60% State funded and the County is billed monthly based on previous month's expenses. Last, he said they would need a new truck in 2018-19 that will result in an $8,000 increase. Mr. Jeffries discussed a request from the Board of Education for approval of their revised 2016- 2017 Capital Needs Assessment to include the purchase of three (3) yellow buses costing $265,797 and a Skyjack 4632 for auxiliary services costing $18,300 totaling $284,097. The Board of Education said they intended to use $263,000 ofremaining capital funds, and approximately $31,000 left over in teachers' supplement, to purchase the three yellow buses. May 1, 2017 Regular Meeting Minutes Hamett County Board of Commissioners Page 5 of 6 051517 HC BOC Page 7 However, they are now requesting new monies to purchase the buses and skyjack as they are reporting the remaining capital funds were already allocated for other expenses. Mr. Jeffries said staff has been working hard to find additional funding and have been able to identify $122,000 to go towards the bus purchases . It was the consensus of the Board to postpone discussing this request until their upcoming budget work session. There was no County Manager's Report. Chairman Springle called for any new business. Jimmy Riddle, Emergency Services Director, briefed the board on recent Shearon Harris drill exercises. He said Harnett County received very high remarks from FEMA during the exit interview. Mr. Riddle also announced Hamett County Emergency Medical Services was recently awarded the American Heart Association Mission: Lifeline EMS Gold Plus Award for implementing quality improvement measures for the treatment of patients who experience severe heart attacks. Last, Mr. Riddle noted May 21-27, 2017 as Harnett County 's Emergency Medical Services Week. Commissioner McKoy moved that the Board go into closed session for the following purposes: 1) To discuss certain economic development matters; and 2) To instruct the County staff concerning position to be taken by the County in negotiating a contract for the acquisition ofreal property. This motion is made pursuant to N.C. General Statute Section 143-318.11 (a)( 4)&(5). Vice Chairman Miller seconded the motion that passed unanimously. Chairman Springle recess the regular meeting. Members present: Staff present: Gordon Springle, Chairman Joe Miller, Vice Chairman Barbara McKoy, Commissioner Howard Penny, Commissioner Abe Elmore, Commissioner Joseph Jeffries, County Manager Paula Stewart, Deputy County Manager Dwight Snow, County Attorney Kimberly Honeycutt, Finance Officer Allen Coats, Deputy Finance Officer Margaret Regina Wheeler, Clerk The following agenda was before commissioners: ~ Benhaven Emergency Services, Inc. requests consideration of a resolution following a public hearing authorizing and approving the financing of a fire truck. ~ 2017/18 Budget Discussion ~ Adjourn Jimmy Riddle, Emergency Services Director, presented Benhaven Emergency Services, Inc. requests for consideration of a resolution authorizing and approving the delivery of an installment financing agreement by Benhaven Emergency Services, Inc, following a public hearing, for a tax-exempt loan related to the purchase of a replacement fire truck. Benhaven Chief Andy Thomas reported Benhaven Emergency Services, Inc. recently lost their first out Engine 1344 due to a motor vehicle accident. He said they have found a demo replacement truck for $458,000. Chief Thomas said they have received proceeds from the insurance company and this agreement would provide for a loan not to exceed $310,000 to pay the cost of acquiring a fire truck and certain related equipment, and if applicable, to pay certain expenses incurred in connection with the delivery of the agreement. It was the consensus of the Board to hold a public hearing and consider approval of the resolution authorizing and approving the delivery of an installment financing agreement for a tax-exempt loan related to the purchase of a replacement fire truck at their upcoming May 15 , 2017 regular meeting. Mr. Jeffries told the Board staff was close to presenting a proposed 2017 /18 balance budget for discussion . May J, 2017 Work Session Minutes Hamett County Board of Commissioners Page l of 3 051517 HC BOC Page 14 Mr. Jeffries discussed a revised request from the Board of Education for approval of their revised 2016-2017 Capital Needs Assessment to include the purchase of three (3) yellow buses costing $265,797 and a Skyjack 4632 for auxiliary services costing $18,300 totaling $284,097. Mr. Jeffries said staff has been working hard to find additional funding and have been able to identify $122,000 to go towards the bus purchases. Mr. Jeffries recommended shifting money from Harnett County Economic Development's sales tax expansion allocation to pay for the remainder of the new buses. He noted Harnett County schools are currently using three buses on loan from the state for one year and if they ordered the new buses now they should be able to get them around the middle of July. The group discussed economic development incentive payments. Commissioners noted the Board still had not gotten a balance sheet from the Board of Education as requested. The group discussed the Board of Education's capital money and fund balance. Commissioners directed Mr. Jeffries to request a financial statement from the Board of Education. Commissioners questioned the Board of Education's current request for $900,000 to fund the additional fifteen (15) teacher positions required by legislation to reduce class sizes given they already received that funding from the legislature. Mr. Jeffries noted le gislative changes would require 21 kids per classroom in 2018/19 that would require another 10 to 12 new teachers. The group also discussed where the 22 new teachers would be housed. In addition to the $1.2 million request, Mr. Jeffries sought direction regarding Interim Superintendent Fleming request for two additional teachers for dual language. Commissioners directed Mr. Jeffries to find out if the two additional teacher positions requested for dual language have they been approved for hire by the Department of Public Instruction Mrs. Honeycutt responded that money towards capital does not affect low-wealth funding. She discussed low-wealth funding in detail. The County's average appropriation is $1024 per pupil. Mrs. Honeycutt explained how the $3.8 tax expansion money is distributed, reporting over 58% of the funds went to the Board of Education this year. She noted $2.1 million of the sales tax expansion will go toward teachers' supplements next year. Commissioners continued to discuss the Board of Education's fund balance. It was the consensus of the Board to approve, during their upcoming regular meeting, the allocation of $122,000 additional monies toward bus purchases as well as approve of th e purchase of three school buses and a skyjack. It was also the consensus of the Board to advise the Board of Education that they would need to fund the remainder of these purchases with their fund balance. Mr. Coats distributed a detailed cost estimate for $25,740,094 for the new Benhaven School Project. He noted the Board had previously authorized the sale of $30 million in bonds to cover the new Benhaven School costs. Staff suggested selling the $30 million in bonds and using the remaining funds to expand the Overhills HS cafeteria for $530,220 and up-fit May 1, 2017 Work Session Minutes Harnett County Board of Commissioners Page 2 of 3 051517 HC BOC Page 15 Benhaven for $3 ,729,686. Mr. Coats reiterated that the only project the Board has approved at this time is the new Benhaven School Project. Mr. Coats said we had to give the Local Government Commission (LGC) a final number today. He said these funds may be used for construction, renovations and land acquisition for schools however unused funds will sit in a bank account until allocated for the next school. Mr. Coats noted bond proceeds are the cheapest borrowing rate but the cost issuance of bonds is one of the highest. He stated the LGC must authorize the amount of bonds that can be sold but typically like to see bids. He said we currently have an architectural estimate of over $3. 7 million to up-fit Benhaven. Mr. Jeffries said there would be discussions with CCCC regarding programs and the use of the old Benhaven facility prior to renovations. It was the consensus of Board to sale $30 Million in bonds. HCDPU recently completed a Request for Qualifications (RFQ) from engineering consulting firms to provide design and construction administrative services on several upcoming projects. MBD was selected over another firm and this agreement establishes a standing contract to perform this work. The agreement is attached as is a proposal in the amount of $423,000 to design and provide construction admininstration services for the North Hamett Waste Water Treatment Plant Upgrade Project. Engineer agrees to provide the services described below to the Owner for the Harnett County Department of Public Utilities Wastewater Treatment Plant Sludge Evaluation and Design Project ("Project"). I. PROJECT DESCRIPTION AND SCOPE OF WORK The Project is titled as follows : • HARNITT COUNTY DEPARTMENT OF PUBLIC UTILITIES WASTEWATER TREATMENT PLANT SLUDGE EVALUATION AND DESIGN The Project shall include the following items : A. North Harnett Wastewater Treatment Plant NPDES Permit Modification to 7.5 MGD: B. C. This section includes the preparation of an Environmental Assessment and the submission and coordination of the NPDES permit application to NCDENR including the preparation of design calculations and an Engineering Alternatives Analysis . The evaluation shall include modifications and upgrades to the existing wastewater treatment plant to address treatment concerns and equipment modifications (oxidation ditch mixing, stainless steel disc filters, etc.). North Harnett Wastewater Treatment Plant Sludge System Evaluation: This section includes the evaluation of a sludge handling system that will address the sludge generated at the North Harnett Wastewater Treatment Plant and the Harnett County 42 MGD Water Treatment Plant . The sludge system will be capable of handling each sludge separately. The study will evaluate options for receiving, mixing, and dewatering the sludge from each facility separately. The evaluation shall address the requirements for production of Class A or Class B sludge . North Harnett Wastewater Treatment Plant Sludge System Design: This section will include design of the sludge system as defined in the study listed above including all General, Structural, Environmental, Electrical, and Mechanical designs, permitting, and bidding. Design shall also address the addition of mixing in the oxidation ditch and the installation of new tertiary filtration . II. ENGINEERING SERVICES Engineer shall provide Basic and Additional Services as set forth below. A . North Harnett Wastewater Treatment Plant NPDES Permit Modification to 7 .5 MGD: 1. Prepare an Environmental Assessment as defined by NCDENR including all design and environmental documentation required for review. b. Prepare and submit the updated NPDES permit application to increase the discharge to 7 .5 MGD. c. Prepare an Engineering Alternatives Analysis to evaluate options available for an alternate to the increase in the NPDES discharge permit. Preparation of the document will include flow and population projections, as well as engineering evaluation and coordination. d. Coordinate the NPDES application and response to any comments provided by NCDENR through the evaluation process . B. Sludge System Evaluation/Preliminary Engineering Report North Harnett Wastewater Treatment Plant and Harnett Water Treatment Plant: 1. The Engineer shall prepare the following : a. Detailed evaluation of sludge generation based on final permit requirements for the North and South Harnett Wastewater Treatment Plants and the Harnett County 42 MGD Water Treatment Plant. The sludge evaluation information will be compiled based on the location of the sludge treatment facility with the sludge from the North Harnett Wastewater Treatment Plant and the Harnett County Water Treatment Plant being combined at the North Harnett Wastewater Treatment Plant site . Prepare detailed options for handling of the sludge from each of the facilities . At the North Harnett Wastewater Treatment Plant, the wastewater generated sludge and the Water Treatment Plant sludge will be handled separately but in a combined facility. The evaluation will determine the needs and requirements for the generation of Class A and Class B from the North Wastewater Treatment Plants . b. Development of preliminary plans and cost estimates for each of the alternatives reviewed including any permitting requirements for each facility. c. Recommendation to the Owner for final evaluation. C. Final Design Phase 1. The Engineer shall: a. Following the review and acceptance of the Preliminary Engineering Report, Engineer shall prepare a detailed schedule for the completion of the final plans and specifications. The detailed schedule shall include submittal dates including a 60%, 90% and 100% review submittal, as well as design review meetings throughout the process. Page 2 051517 HC BOC Page 43 b. Prepare drawings and specifications that reflect the scope of work defined in the Preliminary Engineering Report, and as agreed upon with Harnett County Department of Public Utilities. c. Provide technical criteria, written descriptions, and design data for use in the selection of equipment to be provided as a part of this contract. d. Prepare final submittals for permitting including NCDENR Construction Permit, Land Disturbance Permit, and any additional coordination required for the bidding, construction, and operation of the Project. e. Prepare final detailed cost estimates for each of the projects. The projects will be bid in a schedule coordinated by Harnett County Department of Public Utilities. Individual cost estimates will be prepared for each construction schedule. f . Prepare and assemble final documents for bidding and coordination. Ill. SCHEDULE FOR RENDERING SERVICES IV . A. Commencement : Engineer is authorized to begin rendering services upon receipt of a Notice to Proceed . 8. Time for Completion: 1. Engineer shall complete its obligations within 180 calendar days from receipt of a Notice to Proceed. Specific periods of time for rendering services, or specific dates by which services are to be completed, are provided and are hereby agreed to be reasonable. 2. If, through no fault of Engineer, such periods of time or dates are changed, or the orderly and continuous progress of Engineer's services is impaired, or Engineer's services are delayed or suspended, then the time for completion of Engineer's services, and the rates and amounts of Engineer's compensation, shall be adjusted equitably. 3. If Owner authorizes changes in the scope, extent, or character of the Project or Engineer's services, then the time for completion of Engineer's services, and the rates and amounts of Engineer's compensation, shall be adjusted equitably. 4. Owner shall make decisions and carry out its other responsibilities in a timely manner so as not to delay the Engineer's performance of its services. 5. If Engineer fails, through its own fault, to complete the performance required in this Agreement within the time set forth, as duly adjusted, then Owner shall be entitled, as its sole remedy , to the recovery of direct damages, if any, resulting from such failure . V. PAYMENT PROCEDURES A. B. Preparation of Invoices: Engineer will prepare a monthly invoice in accordance with Engineer's standard invoicing practices and submit the invoice to Owner. Payment of Invoices: Invoices are due and payable within 30 days of receipt. If Owner fails to make any payment due Engineer for services and expenses within 30 days after receipt of Engineer(s) invoice, the amounts due Engineer will be increased at the rate of 1.0% per month (or the maximum rate of interest permitted by law, if less) from said thirtieth day. In addition, Engineer may, without liability, after giving thirty days written notice to Owner, suspend services under this Agreement until Engineer has been paid in full all amounts due for services, expenses, and other related charges . Payments will be credited first to interest and then to principal. VI. ADDITIONAL SERVICES If authorized by Owner, or if required because of changes in the Project, Engineer shall furnish services in addition to those set forth above . Owner shall pay Engineer for such additional services as follows: For additional services of Engineer's employees engaged directly on the Project an amount equal to the cumulative hours charged to the Project by each class of Engineer's employees times standard hourly rates for each applicable billing class; plus reimbursable expenses and Engineer's consultants' charges , if any. VII. TERMINATION The obligation to provide further services under this Agreement may be terminated as follows; A. For Cause : l. By either party upon 30 days written notice in the event of substantial failure by the other party to perform in accordance w ith the Agreement's terms through no fault of the terminating party. 2. By Engineer upon seven days written notice if Engineer believes that Engineer is being requested by Owner to furnish or perform services contrary to Engineer('s) responsibilities as a licensed professional; or upon seven days written notice if the Engineer('s) services for the Project are delayed or suspended for more than 90 days for reasons beyond Engineer('s ) control. Engineer shall have no li ability to Owner on account of such termination . Notwithstanding the foregoi ng , this Agreement will not terminate as a result of a substantial failure under Pag e4 051517 HC BOC Page 45 paragraph VI.A .1 if the party receiving such notice begins, within seven days of receipt of such notice, to correct its failure and proceeds diligently to cure such failure within 30 days of receipt of notice; provided, however, that if and to the extent such substantial failure cannot be reasonably cured within such 30 day period, and if such party has diligently attempted to cure the same and thereafter continues diligently to cure the same, then the cure period provided for herein shall extend up to, but in no case more than, 60 days after the date of receipt of the notice. B. Effective Date of Notice: If Owner elects to terminate the Agreement in accordance with Section IV(A)(l), Owner may, but shall have no obligation to, set the effective date of termination at a time up to 30 days later than otherwise provided to allow Engineer to demobilize personnel and equipment from the Project site, to complete tasks whose value would otherwise be lost, to prepare notes as to the status of completed and uncompleted tasks, and to assemble Project materials in orderly files . VIII. CONTROLLING LAW This Agreement is to be governed by the law of the state in which the Project is located . IX. SUCCESSORS, ASSIGNS, AND BENIFICIARIES Owner and Engineer each is hereby bound and the successors, executors, administrators, and legal representatives of Owner and Engineer (and to the extent permitted by paragraph VIII.B the assigns of Owner and Engineer) are hereby bound to the other party to this Agreement and to the partners, successors, executors, administrators, and legal representatives (and said assigns) of such other party, in respect of all covenants, agreements, and obligations of this Agreement. Neither Owner nor Engineer may assign, sublet, or transfer any rights under or interest (including, but without limitation, moneys that are due or may become due) in this Agreement without the written consent of the other, except to the extent that any assignment, subletting, or transfer is mandated or restricted by law. Unless specifically stated to the contrary in any written consent to an assignment, no assignment will release or discharge the assignor from any duty or responsibility under this Agreement . X. GENERAL CONSIDERATIONS The standard of care for all professional engineering and related services performed or furnished by Engineer under this Agreement will be the care and skill ordinarily used by members of the subject profession practicing under similar circumstances at the same time and in the same locality. Engineer makes no warranties, express or implied, under this Agreement or otherwise, in connection with Engineer('s) services. Engineer and its consultants may use or rely upon the design services of others, including, but not limited to, contractors, manufacturers, and suppliers . Engineer shall not at any time supervise, direct, or have control over any contractor('s) work, nor shall Engineer have authority over or responsibility for the means, methods, techniques, sequences , or procedures of construction selected or used by any contractor, for safety precautions and programs incident to a contractor('s) work progress , nor for any failure of any contractor to comply with laws and regulations applicable to contractor(s) work. Page 5 051517 HC BOC Page 46 Engineer neither guarantees the performance of any contractor nor assumes responsibility for any contractor(s) failure to furnish and perform its work in accordance with the contract between Owner and such contractor. Engineer shall not be responsible for the acts or omissions of any contractor, subcontractor, or supplier, or of any Contractor(s) agents or employees or any other persons (except Engineer('s) own employees) at the Project site or otherwise furnishing or performing any of construction work; or for any decision made on interpretations or clarifications of the construction contract given by Owner without consultation and advice of Engineer. The general conditions for any construction contract documents prepared hereunder are to be the General Conditions of the Construction Contract as prepared by the Engineers Joint Contract Documents Committee (No. C-700, 2013 Edition). The parties acknowledge that Engineer(s) scope of services does not include any services related to a Hazardous Environmental Condition (the presence of asbestos, PCBs, petroleum, hazardous substances or waste, and radioactive materials). If Engineer or any other party encounters a Hazardous Environmental Condition, Engineer may, at its option and without liability for consequential or any other damages , suspend performance of services on the portion of the Project affected thereby until Owner: (i) retains appropriate specialist consultants or contractors to identify and, as appropriate, abate, remediate, or remove the Hazardous Environmental Condition; and (ii) warrants that the Site is in full compliance with applicable Laws and Regulations. XII. TOTAL AGREEMENT This Agreement (consisting of pages 1 to 10 inclusive), constitutes the entire agreement between Owner and Engineer and supersedes all prior written or oral understandings . This Agreement may only be amended, supplemented or modified by a duly executed written instrument. XIII. PAYMENT Using the procedures set forth in paragraph IV. The use of the documents by the Owner or by any person or entity for any purpose other than the Project as set forth in this Contract shall be at the full risk of the Owner or such person or entity. 1.4 Standard of Care: 1.4 .1 The Engineer represents and agrees that it is qualified and fully capable to perform and provide the services required or necessary under this Contract in a fully competent, professional and timely manner, and that its consultants are al so fully capable and qualified to perform and provide the services that they will provide hereunder. 1.4 .2 The Engineer shall be responsible for all errors or omissions , in the drawings, specifications, and other documents prepared by the Engineer or its consultants. It shall be the responsibility of the Engineer throughout the period of performance under this Agreement to use reasonable professional care and j udgment to guard the Owner aga inst defects and deficiencies in the contractor's work. 1.4.3 The Engineer shall correct at no additional cost to the Owner any and all errors, omissions , discrepancies, ambiguities, mistakes or conflicts in the drawings, specifications and other documents prepared by the Engineer or its consultants. 1.4.4 The Engineer shall assure that all drawings, specifications and other documents prepared by the Engineer or its consultants hereunder are in accordance with applicable laws, statutes, building codes and regulat ions and that all necessary or appropriate applications for approvals are submitted to federal, state and loca l governments or agencies in a timely manner so as not to delay the des ign or construction activities of the Project . 1.4.5 The Engineer and its consultants shall perform all services in a timely manner i n accordance with all schedules for the Project or requ i red under this Agreement. 1.5 Termination for Convenience by Owner : Th is Agreement may be term inated without cause by the Owner and for its convenience upon seven (7 ) days written notice to the Engineer. In the event of termination for the convenie nce of the Owner, the Engineer shall be paid that portion of its fees and ex penses that it has earned to the date of termination, les s any costs or expenses incurred or Pag e 7 051517 HC BOC Page 48 anticipated to be unearned by the Owner due to errors or omissions of the Engineer. B. Insurance 2.1 General Requirements 2.1.1 The Engineer shall purchase and maintain and shall cause each of its consultants to purchase and maintain during the period of performance of this Agreement and for five years after issuance of a Certificate of Final Completion of the Project insurance for protection from claims under workers' or workmen's compensation acts; Comprehensive General Liability Insurance (including broad form contractual liability and complete operations, explosions, collapse, and underground hazards coverage) covering claims arising out of or relating to bodily injury, including bodily injury, sickness, disease or death of any of the Engineer's or its consultants' employees or any other person and to real and personal property including loss of use resulting thereof; Comprehensive Automobile Liability Insurance, including hired and non-owned vehicles, if any, covering personal injury or death, and property damage; and Professional Liability Insurance, covering personal injury, bodily injury and property damage and claims arising out of or related to the performance under this Agreement by the Engineer or its agents, consultants and employees. 2.1.2 The minimum insurance ratings for any company insuring the Engineer shall be Best's A-. Upon notice of such cancellation, non-renewal or reduction , the Engineer shall procure substitute insurance so as to assure the Owner that the minimum limits of coverage are maintained continuously throughout the periods specified herein . 3.4 Indemnity 3.4.1 The Engineer agrees to indemnify and hold harmless the Owner from all loss, liability, claims or expense, including attorney's fees , arising out of or related to the Project or Engineer's performance under this Agreement and arising from bodily injury including death or property damage to any person or persons caused in whole or in part by the negligence or misconduct of the Engineer except to the extent same are caused by the negligence or willful misconduct of the Owner. It is the intent of this provision to require the Engineer to indemnify the Owner to the fullest extent permitted under North Carolina law . C. E-Verify: Engineer certifies that it and its consultants comply with the requirements of Article 2 of Chapter 64 of the North Carolina General Statutes. D. In his book Public Schools and Economic Development, What the Research Shows, Jonathan D. Weiss concluded that "School quality has a direct and positive influence on residential property values." We do not presume to be prescriptive as to how our low- performing schools may be improved. Instead, we ask only that the School Board and Board of Commissioners work together to make the quality of public education in Harnett County an attraction for businesses and families . Our Libraries Public libraries have obvious socia l impact on neighborhoods and communities. There is a measurable economic impact of libraries. A 2011 study of Minnesota's public libraries found "RO I is estimated at $4.62 for every taxpayer $1 generated in support of Minnesota's public libraries." Our county needs a single, co un ty-operated library system. In planning for such a syste m, we ask the county to utilize existing buildings and personnel, wherever possible. We suggest at least a 90-day trial or probationary period for existing personnel. County spending on libraries for municipal re sidents should be consistent with that for other county residents. Our towns have invested in buildings for our libraries. When the county con st ructs library buildings in rural areas, we ask that the cost of such buildings and maintenance be absorbed by that community or for the county to provide equivalent support to the towns for our facilities. 051517 HC BOC Page 59 Parks and Recreation We are pleased to see the county's recent focus on expanding access to parks and recreation . It has been our pleasure to work with the county for decades to provide recreational opportunities for our citizens and families living outside our towns . Towns should be an integral part of the planning and development of a coordinated countywide recreation network. The value of municipal contributions in land, facilities, and personnel should be considered by the county in allocating its resources. We believe residents of unincorporated areas should bear part of the cost of recreation and parks within their communities through additional taxes or fees, just as those living in municipalities support them with their town taxes. Unified Development Ordinance Harnett County's Unified Development Ordinance (UDO) specifically excludes areas within our municipalities and ETJs. While this recognizes the authority of individual towns, it can serve as a disincentive to development within our boundaries. We are requesting a coordinated review of Harnett County's UDO and our equivalent municipal ordinances with the goal of equalization of UDO standards throughout Harnett County. The replacement vehicle has a cost of$458,000.00 and can be delivered in 60-90 days . We are requesting the Hamett County Commissioners to approve this none budgeted replacement of the vehicle . Due to our loss of an ambulance and now the fire truck, our plan as approved in the Commissioners on April 3, 2017 has changed due to the fire truck loss .
