The Harnett County Board of Commissioners met in regular session on Monday, February 6,
2017, in the Commissioners Meeting Room, County Administration Building, 102 East Front
Street, Lillington, North Carolina.

Chairman Springle called the meeting to order at 9:00 am. Vice Chairman Miller led the Pledge
of Allegiance and invocation.
Chairman Springle called for additions and deletions to the published agenda. Commissioner
Miller moved to approve the agenda as published. Commissioner Penny seconded the motion,
which passed unanimously.
Commissioner Elmore moved to approve the following items listed on the consent agenda.

5. Harnett County Parks and Recreation requested approval of the Governmental Complex
Park, Phase 1 Project Ordinance in the amount of $800,000. The project will be funded
by a Parks and Recreation Trust Fund Grant in the amount of $400,000 with the required
match coming from the FY 2018-2019 and FY 2019-2020 Capital Improvement Plan
budget. The Governmental Complex Park is adjacent to the Cape Fear River and the
Sandhills Farm Park. Phase 1 will consist of soccer fields, walking trail, canoe/kayak
water access, baseball fields, observation deck and observation area with boardwalk.
6. Resolution Declaring Its Intent to Partially Abandon Public Road or Easement and
Calling a Public Hearing on the Question (Attachment 4)

8. Harnett County Veteran Services requested approval of a new Veterans Services
Specialist position, pay grade 64 - $39,305 requested salary, in order to facilitate
expanding outreach programs, satellite locations in the western part of the county and the
Dunn/Erwin area. This is due to the forecasted veterans population growth and new
Department of Veterans Affairs program requirements.
9. Harnett County Public Utilities requested approval of write-offs for the 4th quarter of
2016 in the amount of $28,415.33. All of these accounts have been delinquent for more
than three years. The facilitation of these write-offs is an important step in a continuing
effort to effectively manage collections and bad debt.
10. Harnett County Sheriffs Office requested approval of the renewal agreement with Keffer
Commissary Network, LLC, for the Detention Center commissary.
11. The Averasboro Town Restoration Association requested a waiver of fees at the Coats -
Erwin landfill for the clean up and restoration of the Turlington-Shaw home site. The
waiver will be limited to $1,000.
12. Harnett County Engineer requested, on behalf of the Coats Senior Center, approval of a
waiver of tipping fees for land clearing and debris associated with the removal of trees
from their property. The waiver will be limited to $500.
13. Harnett County Finance Officer, on behalf of the Harnett County Board of Education,
requested approval of an additional capital request in the amount of $225,000 ($200,000
to replace a chiller at Harnett Primary and $25,000 to replace two water heaters in the
cafeteria at Dunn Middle School). The Board of Education requested that their 2016-17
Capital Needs Assessment that was submitted as part of the budget process be revised to
include these additional capital needs.
14. Administration requested approval of an amendment to the Harnett County Personnel
Ordinance, Article VI. Leaves of Absence, Section 2. Holidays to change the way shift
workers are compensated for holidays.
Chairman Springle opened the floor for informal comments by the public, allowing up to
3 minutes for each presentation up to 30 minutes.
Jerry Rivas of 364 Twin Ponds Road in Sanford complained about the response he
received to three questions he submitted. He also suggested that the County find a
way to offer scholarships and a signing bonus to people going through the BLET
training.
Bonnie Larche of 75 Brandon Drive in Buies Creek shared concerned regarding
transportation for the special adults and children in Harnett County.
Emily Swarsch of 34 Agdon Landing in Cameron shared information regarding the
Borgen Project and requested that commissioners send a letter to Senator Tillis
supporting global development legislation and bills that support global poverty relief.

Vice Chairman Miller moved to approve the appointments listed below. Commissioner Elmore
seconded the motion, which passed unanimously.
Averasboro Township Tourism Development Authority
The following were appointed to serve on the Averasboro Township Tourism
Development Authority Board of Directors for a term of one year:
- Kim Schmidlin, Carolina Therapy Services & Kelli's Krew Run
- Shannon Taylor, Hampton Inn
- Anil Ojha, Comfort Inn
- Jolene Thomas, Baymont Inn & Suites
Commissioners also accepted the recommendation of Kim Schmidlin for Authority
Chairman and Billy Tart as Vice Chairman.
Board of Equalization and Review
Chuck Robinson and Robert Smith were reappointed to serve on this Board for a term of
two years ending February 28, 2019.
Robert E. Doberstein, Joe Miriello and Carnell N. Robinson were granted term limit
waivers and were each reappointed for an additional one-year term ending February 28,
2018.
Sharon Stevens, Community Marketing Director for the Averasboro Township Tourism
Development Authority, presented the 2016 Annual Report of the Dunn Area Tourism Authority.
Mrs. Stevens said it is their mission to market and tell the world about Harnett County. She
noted they get funding for marketing through the hotels 6% occupancy tax. She reviewed a few
of their highlights of 2016. Mrs. Stevens also shared several tourism highlights. She reported
state and local tax revenues from travel to Harnett County amounted to $6.3 Million which
represents a $49.13 tax savings per resident. Mrs. Stevens thanked the County staff for their
assistance during several events. She also invited commissioners to an upcoming event of the
Tourism Resource Assistance Center.
Mr. Jeffries presented the following reports:
Tax Administrator's report of unpaid taxes for the fiscal year 2016-2017 that
constitutes a lien on real property totaling $3,048,097.87 as of January 31, 2017.
Harnett County Financial Summary Report — December 2016
Harnett County Sales Tax Analysis by Article — October 2016
Harnett County Veterans Services Activities Report — January 2017
Development Services Report — December 2016
Johnston -Lee -Harnett Community Action Inc.'s Community Services Block Grant
Program Fiscal Year 2017-18 Application for Funding
Mr. Jeffries provided commissioners a 2017/18 budget calendar. He also noted he would be on
vacation three days the following week.

Chairman Springle called for any new business. He shared the Department of Social Services
monthly report showing the services offered as well as how much money they contribute to the
economy.
Commissioner McKoy moved that the board go into closed session for the following purposes:
1) To discuss matters relating to the location or expansion of industries or other businesses
in the area served by the Harnett County Board of Commissioners; and
2) Consultation with the County's legal staff in order to preserve the attorney-client
privilege concerning the handling of certain claims and litigation including the following
cases:
a. "Estate of John David Livingston, II, et als vs Kehagias, et als, US District Court,
Eastern District, Western Division, File No. 5:16 CV -00906 -BO, and
b. Workers compensation claim of Michael Hayes I.C. Claim No. 16-016535.
This motion is made pursuant to N.C. General Statute Section 143-318.11(a)(4)&(3).
Vice Chairman Miller seconded the motion, which passed unanimously.
Commissioner Miller moved that the Board come out of closed session. Commissioner Elmore
seconded the motion, which passed unanimously. Commissioner McKoy moved to amend her
original motion that the board go into closed session to include:
c. Workers compensation claim of Hyon Hwang I.C. Claim No. 16-030868.
Vice Chairman Miller seconded the motion, which passed unanimously.
At 10:43 am, Chairman Springle recessed the meeting to reconvene at 11:45 am for their 2017
legislative luncheon.

o Allow Counties to Enact Impact Fees to Support Public Education
o Allow Harnett County to establish a Multi -County Agricultural Business District
o Allow Counties to use E-911 Funds for E-911 Needs Other than Equipment
o Preserve Federal and State Block Grants for County Administered Social Services
Programs
o Authorize Counties to Condemn and Demolish Unsafe Properties

o Ensure adequate state funding for Mental Health Services and Facilities at the Local
Level
o Grant County Boards of Commissioners the Ability to Construct Schools

Vice Chairman Miller asked about proposed legislation that would make property taxes free for
disabled veterans. Representative Lewis said he and Senator Rabin understand the concerns
regarding this proposed legislation. He said the argument he will make is if this is a priority for
the State then the State should fund it, which will probably kill it, but that would not be his
intent; it is an unfunded mandate.

RESOLUTION OF THE HARNETT COUNTY BOARD OF COMMISSIONERS
DECLARING ITS INTENT TO PARTIALLY ABANDON PUBLIC ROAD OR EASEMENT AND
CALLING A PUBLIC HEARING ON THE QUESTION

WHEREAS, the laws of the State of North Carolina, and in particular North Carolina General
Statute 136-63, authorizes the Harnett County Board of County Commissioners, on its own motion or on
petition of a group of citizens, to submit a request to the Board of Transportation to change or abandon
any road in the secondary system when the best interest of the people of the county will be served
thereby;
WHEREAS, the North Carolina Department of Transportation, upon petition, investigated and
recommended the partial abandonment of the below referenced public road or easement from the State's
Secondary Road System;
WHEREAS, the provisions of North Carolina law require that a resolution be adopted by the
Board of Commissioners declaring the intent of said board to accept the recommendation to abandon such
public road or easement from the State's Secondary Road System; and
WHEREAS, said Board calls a public hearing on the question and to hear all interested persons
who appear with respect to whether the abandonment would be detrimental to the public interest or to any
individual property rights.
NOW, THEREFORE, be it resolved by the Harnett County Board of Commissioners as follows:
1. It is declared to be the intent of the Harnett County Board of Commissioners to approve the
North Carolina Department of Transportation's recommendation to partially abandon from
the State's Secondary Road System the public road or easement which has hereto served as a
portion of SR 2072 (McNeill -Hobbs Road) as herein described. The public road or easement
to be abandoned is the 0.36 mile portion of SR 2072 (McNeill -Hobbs Road) from 628' ±
southeast of the intersection with North Carolina Highway 210 to 1882' ± southeast of the
intersection with North Carolina Highway 210 located in the Township of Stewart's Creek,
Harnett County, North Carolina is more specifically shown on the attached Exhibit A.
2. A public hearing on the proposed abandonment of said public road or easement shall be
conducted by the Harnett County Board of Commissioners at 7:00 p.m. on the 20th day of
February, 2017, at which time said Board shall hear all interested persons who appear with
respect to whether the abandonment would be detrimental to the public interest or to any
individual property rights. Said public hearing shall be conducted in the assembly room of
the Harnett County Administration Building, 102 East Front Street, Lillington, North
Carolina 27546.

A RESOLUTION OF THE HARNETT COUNTY BOARD OF COMMISSIONERS TO
DISCONTINUE AUDIO RECORDINGS OF CLOSED SESSION MEETINGS
THAT WHEREAS, the Harnett County Board of Commissioners approved that audio
recording be made of their closed session meetings on December 17, 2012; and
WHEREAS, the Board no longer deems it necessary for audio recordings to be made of
closed session meetings as the written accounts are correct and adequate; and
WHEREAS, the Board instructs staff to properly dispose of past audio recordings of
closed session meetings as the official written minutes have been approved; in accordance with
the County Management Records Retention and Disposition Schedule:

#6. Audio and Video Recordings of Meetings
- Disposition Instructions: Destroy in office after approval
of official written minutes.
NOW, THEREFORE, BE IT RESOLVED, by the Board of Commissioners of Harnett
County to discontinue audio recordings of closed session meetings and properly dispose of past
recordings.
Adopted by the Harnett County Board of Commissioners in regular session, this 6th day
of February, 2017.
