The Harnett County Board of Commissioners met in regular session on Monday, May
6, 2002, in the Commissioners Meeting Room, County Administration Building, 102
East Front Street, Lillington, North Carolina. •

Chairman Byrd called the meeting to order at 9:00 a.m. and Commissioner Titchener
led the pledge of allegiance and prayer.
Commissioner Hill moved to approve the agenda as published with additions listed
below. Commissioner Andrews seconded the motion and it passed unanimously.
Consent agenda: letter of congratulations to Sandy Carrroll, recent retiree from
Dunn Rescue Squad
Regular agenda:

Upon motion by Commissioner McNeill and seconded by Commissioner Titchener, the

4. Authorization for Cooperative Extension to apply for the following grants:
•
1. North Carolina Division of Child Development in the amount of $63,616.00,
for FY 2002-2003. If awarded, funding will to be used for continued
operation of the Harnett County Child Care Resource And Referral Program.
2. Harnett County Partnership for Children, to provide funds for continued
operation of the Parents as Teachers program for FY 2002-2003.
3. Harnett County Partnership for Children, to provide funds for continued
operation of the Family Child Care Home project for FY 2002-2003. If
awarded, these funds would support the efforts of the Child Care Resource
and Referral Program in recruiting, training, and increasing the safety and
quality of care provided by Family Child Care Home providers.
4. Cooperative Community & Rural Development Program, in the amount of
$25,000.00 to be used to organize a travel and tourism task force to develop
plans and strategies to increase tourism and travel within Harnett County
utilities, open green spaces and increasing tourism venues through
agriculture.
5. Memorandum of Understanding with Board of Education which outlines the overall
• financing strategy for the two new schools as well as the commitments required by
both the Board of Education and the Board of Commissioners. (Attachment 2)
6. Phase I Contract, Project Planning Component for Harnett County Comprehensive
Architectural Survey funded by The Transportation Equity Act of the 21 st Century
(TEA-21)and Harnett County.
7. Approval to proceed with development of a furniture purchase for the new
courthouse. Sealed bids were taken on Wednesday, March 27 and have been
evaluated by a steering committee. A furniture purchase will be prepared and
brought back to the Board for consideration.
Resolution directing the Tax Administrator not to collect minimal property taxes
on classified motor vehicles. (Attachment 3)
Wilton Lee, 132 Rosebud Lane, Spring Lake, voiced concerns regarding abandoned
mobile homes on Ray Road and cars speeding in his neighborhood.
Commissioner Titchener moved for the appointments listed below. Commissioner

John Snipes, Dunn -Erwin Rail Trail Committee member, provided an update on the
Rail Trail project and reviewed the Master plan developed for the corridor.
Wm. A. (Tony) Wilder, Assistant County Manager, presented a proposed revised
Animal Control Ordinance for the Board's consideration. The revisions address
dangerous exotic animals, fee amounts excluded from the ordinance, definition of run -
at -large and definition of Animal Control department head. Commissioner Hill moved
to adopt the revised ordinance as presented. Commissioner McNeill seconded the
motion and it passed unanimously. (Copied into Ordinance Book 2)
Departmental reports were filed with the Board from General Services, Health
Department, Veteran's Affairs, and the Sheriff's Department.
Mr. Emory reported on the following items:
- The proposed Budget for FY 2002-2003 will be presented to the Board of
Commissioners soon.
- Fort Bragg is considering a site in Harnett County to build base housing.
- A letter of congratulations from the Board will be written to Dunn Rescue
�w� t retiree, Sandy Carroll.
Commissioner Titchener moved to adopt a resolution requesting that local government •
revenue sources be made secure. Commissioner Andrews seconded the motion and it
t ( passed unanimously. (Attachment 4)
Commissioner Titchener moved to adopt a resolution regarding appointments to the
Lee -Harnett Area Authority Board. Commissioner McNeill seconded the motion and it
passed unanimously. (Attachment 5)
Wm. A. (Tony) Wilder, Assistant County Manager, reported that grant $xnding in the
amount of 1.6 million dollars has been awarded for the Airport runway extension
project. Commissioner Titchener moved to authorize Mr. Wilder to proceed with
executing paper work to receive the grant. Commissioner Andrews seconded the
motion and it passed unanimously.
Commissioner McNeill moved for the Board to go into closed session for the following
purposes:
(1) To instruct the County staff concerning the position to be taken on
behalf of the County in negotiating the terms of a proposed contract
for the acquisition of real property; and
(2) to discuss matters relating to the location or expansion of industries
or other businesses in Harnett County.

This motion is made pursuant to N.C. General Statute Section 143-318.11(a)(5)&(4).
Commissioner Hill seconded the motion and it passed unanimously.
Commissioner Hill moved for the Board to come out of closed session. Commissioner
McNeill seconded the motion and it passed unanimously.
There being no further business, Commissioner McNeill moved for adjournment.
Commissioner Titchener seconded the motion and it passed unanimously. The Harnett
Co ty Board of Commissioners' regular meeting, May 6, 2002, adjourned at 10:11

MEMORANDUM OF UNDERSTANDING
BETWEEN THE
HARNETT COUNTY BOARD OF EDUCATION
AND
HARNETT COUNTY BOARD OF COMMISSIONERS
REGARDING
CONSTRUCTION OF LILLINGTON/SHAWTOWN ELEMENTARY AND
ADDITIONAL HIGH SCHOOL
WHEREAS, this Memorandum of Understanding, dated March 4, 2002 by and between
the Harnett County Board of Education and the Harnett County Board of Commissioners
for a short-term building program is first and foremost designed to meet the needs of all
children served, based on the growth of the county,
WHEREAS, new facilities are to be designed to meet the high quality of education
delivered in Harnett County,
WHEREAS, new facilities are needed to replace aging Lillington and Shawtown
Elementary Schools, and a new High School to meet current student enrollment and
projected future growth in the western area of Harnett County,
WHEREAS, new facilities should focus on providing the most functional facilities at a
minimal cost for the next decade.
NOW, THEREFORE, BE IT RESOLVED THAT:
• The Board of Education and Board of Commissioners agree to jointly support the
Memorandum of Understanding, and direct staff to work diligently towards
implementation of all elements with the Memorandum of Understanding.
• The Board of Education and Board of Commissioners each agree that neither board
will adopt or implement any policy, program or financial commitment which will
keep the Memorandum of Understanding from being fully implemented.
The Board of Education and the Board of Commissioners each agree that they shall
discuss with and consult with the other board prior to making any change in any
policy, program or financial commitment which will keep the Memorandum of
Understanding from being fully implemented. The Board of Education and the Board
of Commissioners further agree that the entire Memorandum of Understanding shall
be null and void if either board takes such action without the mutual agreement of
both boards.
Construction Plans
1. Construct a new elementary school to replace Lillington Elementary and
Shawtown Elementary.
2. Construct a new High School to meet current and future student enrollment and
relieve current High School overcrowding.

Financing Plan
The Board of Education has $10,000,000 cash on hand. These funds, at the request of the
bond counsel, will be used to extinguish debt on the 1994 COPS issue.
The total cost of implementing the construction of the schools under this Memorandum is
estimated to be $34,300,000 which includes $31,000,000 of debt issued in the form of
Certificates of Participation. The debt service requirements on this issue are as follows.

The Board of Education will construct 2 new schools, Overhills High School and
Lillington-Shawtown Elementary. The funding for these 2 schools will be from Harnett
County sales tax, Hamett County Schools Public School Building Fund (ADM money),
cash on hand with the Harnett County Schools, and a new certificates of participation
issue (cops) by Hamett County for $31,550,000 in May 2002.
The Local Government Commission has approved our plan for financing these schools.
They have required us to apply current available funds to the existing 1994 cops debt to
help extinguish that debt.
The School Board has cash on hand of $10,000,000 which is reserved for construction
projects. These funds will be used towards payments on the 1994 cops issue beginning
June 1, 2002. These funds will fully service the semi-annual principal and interest
payment on the 1994 cops through December 1, 2005. The remaining debt will be paid
from County sales tax and schools ADM funds as outlined in the next paragraph.
Effective June 1, 2002 the county will have available $1,300,000 from sales tax and the
school system will have available $300,000 from ADM funds. These funds will be
placed in an escrow account beginning June 1, 2002 and every six months thereafter to
meet the cops semi-annual principal and interest payments. These funds will be used to
continue payment of the 1994 cops debt until that debt is extinguished. These funds will
• also be used to pay the debt service on the 2002 cops issue.
Sales tax and ADM funds collected in excess of the $2,600,000 and $600,000 required
annually for debt service on the 1994 and 2002 cops issue, will be used for future capital
needs of the Harnett County Schools.

Resolution Directing Tax Administrator Not To Collect
Minimal Property Taxes On Classified Motor Vehicles
Whereas, N.C.G.S. 105-330.5 has been amended to allow counties to be relieved
of collecting minimal property taxes on classified motor vehicles in an amount up to
$5.00; and •
Whereas, the cost of billing is estimated to exceed $3.00 on property tax bills
rendered in Harnett County; and
Now, Therefore, Be It Resolved that the Harnett County Board of Commissioners
hereby directs the Tax Administrator not to render property tax bills on classified motor
vehicles when the total bill including municipal and special district taxes does not exceed
$3.00.
Be it further resolved that the Tax Administrator keep a record of the taxpayers
and the amount of taxes not billed by the county and report to the Board of
Commissioners as part of the settlement each year.
This motion was made by Commissioner McNeill
and seconded by Commissioner Titchener , and passed
by unanimous vote of the Harnett County Board of Commissioners on this, the
6tb day of May, 2002.

Resolution
Requesting That Local Government Revenue Sources Be Made Secure
WHEREAS, the County of Hamett is required by North Carolina law to operate and maintain a
balanced budget and comply with the provisions of the Local Government Budget and Fiscal Control
Act; and
WHEREAS, the County of Hamett is required to maintain a sufficient fund balance to operate in
a fiscally sound manner and to have adequate reserves in case of emergencies; and
WHEREAS, the Harnett County Board of Commissioners have a responsibility to provide for the
health, safety and well being of the citizens of this community by providing necessary services; and
WHEREAS, the ability of county governments to borrow for capital infrastructure needs is
dependent on reliable revenue sources for repayment; and
WHEREAS, adequate revenues are required to cant' out the above mentioned responsibilities;
NOW, THEREFORE BE IT RESOLVED THAT the Harnett County Board of Commissioners
respectfully requests that the General Assembly enact legislation that will secure the local government
revenue sources and ensure that these revenues are distributed to local governments on a timely basis as
set forth by the state's General Statutes. •

Resolution
WHEREAS, General Statute 122C-1IS. 1 states that the boards of Commissioners within the
multi -county area shall have the option to appoint the members of the area board in a manner other than
required under section 1.11(b) of House Bill HI by adopting a resolution to that effect; and
WHEREAS, Lee-Hamett Area Mental Health, Developmental Disabilities, and Substance Abuse
Authority has been governed by an Area Authority Board of fifteen members which has been jointly
appointed by the Lee County Board of Commissioners and Harnett County Board of Commissioners
•
since 1968; and
WHEREAS, the Lee -Harnett Area Mental Health, Developmental Disabilities, and Substance
Abuse Authority Board is composed of seven Lee County members and eight Harnett County members
and the size may be changed to no less than 15 members and no more than 25 members by agreement that
is evidenced by concurrent resolutions adopted by each board of commissioners; and
WHEREAS, each Board of County Commissioners has appointed one commissioner as a member
of the Area Board and these members have appointed the other members and have the authority to
remove an appointed member with or without cause; and
WHEREAS, the group of county commissioners authorized to make appointments to the area
board has declared vacant the office of a member of the area board who has not attended three scheduled
meetings without justifiable excuse within a 12 month period; and
WHEREAS, the group of county commissioners authorized to make appointments to the area
board has appointed new members to the area board to fill vacancies occurring on the board before the
end of the appointed term of office. These appointments were for the rest of the unexpired term of office;
and
WHEREAS, whenever a vacancy occurs on the board, it has been filled within 120 days; and
WHEREAS, the Lee -Harnett Area Authority Board has included:
1. At lease one county commissioner from each county in the area;
2. At least one physician licensed under Chapter 90 of the General Statutes to
practice medicine in North Carolina who, when possible, is certified as having
completed a residency in psychiatry;
3. At least one professional representative from the fields either of psychology,

social work, nursing, or religion;
4. At least one individual each, either a primary consumer or an individual from a citizens'
organization, representing the interests of individuals with:
(a) Mental illness; and
(b) Developmental disabilities.
5. At lease one primary consumer presently and openly in recovery representing
the interest of individuals suffering from alcoholism or other drug abuse.
6. At lease one family consumer each representing the interest of individuals with:
(a) Mental illness;
(b) Developmental disabilities, and
(c) Alcoholism or other drug abuse.
7. At least one attomey licensed to practice in North Carolina.
8. At least one member who has experience in finance and can understand and interpret audits
and other financial reports.
WHEREAS, any member of the area board who is a county commissioner serves
on the board in an ex officio capacity. The terms of county commissioners on the area board are
concurrent with their terms as county commissioners, the terms of the other members on the area board
shall be for four years; and the number of terms shall he evidenced by approval of each board of
commissioners.
NOW, THEREFORE BE IT RESOLVED by the Harnett County Board of
Commissioners that:
Section 1. It shall continue to appoint members to the Lee -Harnett Area
Authority Board in like manner.

Section 2. This resolution be spread upon the minutes of this meeting and a duly
authenticated copy be presented to the Lee Harnett Area Mental Health,
Developmental Disabilities and Substance Abuse Authority.
