THAT, WHEREAS, the General Assembly of North Carolina did enact into law an act to authorize automatic aid assistance between fire departments whereby full authority may be exercised by fire departments to send firemen and equipment beyond the territorial limits which they normally serve, said act having been codified as Chapter 69, §40 of the General Statutes ofNorth Carolina. WHEREAS, the purpose ofthis Agreement is to provide each ofthe parties hereto, through their mutual cooperation, a pre-determined plan, as agreed upon in dispatch protocol, by which each of them might render aid to the other in case of any incident which may demand services to a degree beyond the existing capabilities of any party. WHEREAS, it is deemed to be in the public interest for the parties hereto to enter into an Agreement for automatic aid assistance, in order to increase fire defenses and to assure proper fire control, as well as providing reserves needed to assure the community of adequate protection. WHEREAS, by action of the undersigned officials on the_ day of 2015, ----- said officials duly authorized this Agreement for Reciprocal Automatic Aid Assistance. NOW, THEREFORE, in consideration of the mutual covenants contained herein by and between the parties hereto, it is hereby agreed as follows: 1 1. Should it become necessary to activate the terms of this Agreement as herein set forth, due to conflagration, holocaust, civil disorder, or natural disaster, or otherwise upon notification of one of the parties to the other that an emergency does, in fact, exist and that aid is needed, the responding party/parties shall dispatch available equipment and manpower into action to assist the requesting party as may be required. 060115 HC BOC Page 20 2. It shall be the responsibility of the officer ofthe fire department ofthe responding party/parties that all personnel responding to the request for assistance are responsible persons and that the conduct and actions of said personnel shall be the responsibility of the responding party/parties. 3. The responding party/parties to the request for automatic aid under the terms of this Agreement shall assume all liability and responsibility for damage to its own equipment. The responding party/parties shall also assume all liability and responsibility for any damage caused by its own equipment while responding to or returning from a specific location. 4. Each party to this Agreement shall assume all costs of salaries, wages, bonuses or other compensation for its own personnel that responds for duty under the terms of this Agreement, and shall also assume all costs involving the use of apparatus, equipment, and tools used specifically in response to the request for aid, and shall make no charge for such use to the party requesting assistance. 5. Any party may, at any time, terminate this Agreement, through its respective Fire Chief, upon the serving of a 30 day written notice to the Emergency Services Director for County. 6. When fire department personnel respond pursuant to this Agreement, the jurisdiction, authority, rights, privileges, and immunities, including coverage under workers' compensation laws, shall be extended to department personnel during the entire incident until completion. 7. When any party to this Agreement is providing automatic aid to another party, it is agreed to respond with a minimum of one piece of fire equipment capable of carrying a minimum of 1 ,000 gallons of water. REQUIRED LAW ENFORCEMENT SERVICES; PERSONNEL A Assignment: duties. The COUNTY shall provide five (5) sworn county law enforcement personnel of the rank of Deputy and one Supervisor (all hereinafter the "Campbell Deputies") who shall be under the supervision and control of the HCSO and assigned to CAMPBELL for the purposes of providing law enforcement services exclusively within the Coverage Area. For these purposes, the Campbell Deputies shall: 1. Provide law enforcement services pursuant to this Contract in the same manner and at the same level as provided by the HCSO to Harnett County. 2. Not be dispatched by the HCSO to any calls for service outside the Coverage Area except for a dispatch call of officer needing assistance. 060115 HC BOC Page 31 3. Serve criminal or civil process only upon a person within the Coverage Area. 4. Only be assigned responsibilities to perform under this Contract by the HCSO, and not any officer, employee, or agent of CAMPBELL. Any and all requests for service pursuant to this Contract by CAMPBELL shall be by the CAMPBELl Vice President for Student Life or his designee to the HCSO and the final decision to respond shall be by the HCSO. 5. The Campbell Deputies, when on duty pursuant to the terms of this contract, shall remain at all times within the Coverage Area. B. Coverage Area. The Coverage Area to which the Campbell Deputies shall be assigned shall be that area shown on a plat by Joyner Piedmont Surveying entitled "CAMPBEll UNIVERSITY RESERVE" and dated August 20, 1998, a copy and legal description of which is attached hereto as Exhibits A and B and incorporated by reference, and any property previously acquired or hereafter acquired by CAMPBELL adjacent thereto (the "Coverage Area"). C. Duty Hours. The Campbell Deputies shall provide law enforcement services on a 24 hour basis, seven (7) days a week, fifty two (52} weeks a year, with at least one Campbell Deputy on duty at all times. D. Office Space. CAMPBELl shall provide office space to include, but not limited to, office equipment, phone service, computer access, and facsimile machine, at the CAMPBELL Campus Safety Office for the Campbell Deputies to use for administrative work solely related to the performance of this contract at Campbell's expense. E. Equipment uniforms. The HCSO shall provide all uniform and equipment, to include motor vehicles, for the Campbell Deputies in the same manner and equivalent quality as for other deputies of the HCSO assigned similar law enforcement responsibilities. CAMPBELl shall provide the Campbell Deputies with a hand-held radio that will be dedicated to the CAMPBEll public safety frequency, which the Campbell Deputies and Supervisor shall carry at all times while on duty. F. Required reports. For purposes of compliance with the federal Campus Security Act (20 USC §1092) the HCSO shall provide CAMPBELl with copies of all 2 060115 HC BOC Page 32 calls, daily reports, or any other information gathered by the HCSO relating to the Coverage Area. G. Part-time work. No part-time employees of the HCSO shall perfonn under this Contract without the permission of CAMPBELL. CAMPBELL may employ HCSO Deputies and Campbell Deputies to work off-duty for special events at CAMPBELL, including but not limited to sporting events, commencements, graduations, and concerts. While perfonning in an off-duty capacity, the deputy will receive compensation on the current University pay scale for the related special event. H. Emergency needs. If due to excessive sickness or other unforeseen circumstances, the five assigned Campbell Deputies can not provide the required level of service to the Coverage Area (hereinafter the "full complement"), the HCSO shall assign additional deputies to serve as Campbell Deputies until the assigned Campbell Deputies are back to a full complement. Any deputies so assigned by the HCSO shall be paid on the basis of an agreed upon rate between the parties, which shall be detennined on an annual basis on the anniversary of the date of this agreement. I. Selection of Campbell Deputies. CAMPBELL shall be permitted to decline the assignment of a deputy as one of the Campbell Deputies by providing to the HCSO in writing a valid basis therefore. which shall be a confidential communication to the Harnett County Sheriff or his designee. 2. PAYMENT FOR LAW ENFORCEMENT SERVICES A. HCSO Employees. Unless otherwise stated herein, the Campbell Deputies shall at all times be full-time employees of the HCSO which shall be responsible for the payment of the salaries, benefits, and the administration of benefit and personnel services for the Campbell Deputies. The Campbell Deputies shall be entitled to the same compensation and benefits of other deputies of equal rank, seniority, and similar law enforcement responsibilities within the HCSO. B. Costs of CAMPBELL. In exchange for the COUNTY the Campbell Deputies and the law enforcement services to be rendered, CAMPBELL shall pay to the COUNTY all costs and personnel benefits for the Campbell Deputies, which shall include but not be limited to the following: 3 060115 HC BOC Page 33 1. Any salaries and benefits that the COUNTY would expend for current full- time employees; 2. Any costs for uniforms, weapons, equipment (except motor vehicles), materials, supplies and training; 3. Any other additional costs that the COUNTY may have due to these such as increased liability, workers compensation or other insurance charges; and 4. Reimbursement to the COUNTY of fuel purchased by Campbell Deputies utilizing the County issued WEX Fuel card issued by HCSO to vehicles while providing law enforcement services to Campbell and the Buies Creek area as shown on Exhibit" A ", and reimbursement to the County for maintenance of motor vehicles for use by the Campbell Deputies. 5. Prior approval by the Vice President for Student Life or his/her designee is required for any equipment purchases in excess of One Thousand Dollars $1,000.00. C. Payment by CAMPBELL. The COUNTY shall i_nvoice CAMPBELL for the costs and expenses of law enforcement services provided Campbell Deputies as set forth herein on a monthly basis with said invoice payments to be paid by CAMPBELL and forwarded to the County Finance Office in a timely manner. 3. TERM. This Term of this Contract shall be for three (3) years to be effective beginning at 12:00 midnight on June 1, 2015, and shall extend through May 31, 2018. This Contract shall automatically renew for an additional Renewed Term of three (3) years unless either party shall give written notice to the other of its intent to terminate this Contract at least ninety (90) days prior to the end of this Term or a Renewed Term. 4. INDEMNIFICATION A COUNTY shall indemnify and hold harmless CAMPBELL, its trustees, officers, employees, and agents, from any and all liability and claims, actions or causes of action, demands, damages, costs, judgments, expenses, liabilities, attorneys' fees and legal costs, injunctive or declaratory relief, of any kind or character, including, without limitation, claims to recover damages for excessive force, violation of the right to personal security, deprivation of medical care, illegal and unreasonable search and 4 060115 HC BOC Page 34 seizure, false imprisonment, false arrest, illegal detention, malicious prosecution, violations of the United States and North Carolina Constitutions, abuse of process, negligence, violation of North Carolina or federal law, assault, battery, intentional and/or negligent infliction of emotional distress, claims under 42 U.S.C. §1983 or 42 U.S.C. §1988, use of force, violation of due process or equal protection rights, personal injuries, pain and suffering, emotional distress, loss of consortium, cruel and unusual punishment, deliberate indifference, negligent training, negligent retention, negligent supervision, and vicarious liability, caused by or arising out of activities of COUNTY and/or the Campbell Deputies while performing the law enforcement services required herein. B. For the purposes of the indemnification requirements as set forth herein, COUNTY shall maintain at all times, either through a program of self-insurance, a risk pool, or a commercial carrier(s) comprehensive general liability insurance covering property damage, bodily injury, and personal injury, and automobile liability insurance {including owned, non-owned and leased vehicles and automobiles), in an amount equal to not less than Five Million and 00/100 Dollars ($5,000,000.00) single limit per occurrence. COUNTY shall provide CAMPBELL proof of said coverage upon execution of this agreement, and each year thereafter. COUNTY shall name CAMPBELL as an additional insured on its policy required herein. 5. GENERAL PROVISIONS. A This contract or any extension thereof shall be binding upon the assigns and successors in interest of the parties hereto as fully and to the same extent as if such assigns or successors had joined in the execution hereof. B. The parties will cooperate with each other to accomplish and carry out their respective duties, obligations and commitments hereunder. C. The terms and provisions hereof may be waived, released, modified or amended only by the unanimous written consent of the parties hereto. D. This contract shall be construed and governed according to the laws of the State of North Carolina. Project Description: Harnett County is seeking a standard project grant. Harnett County is looking to expand its service area for recycling efforts and to improve the quality of our recycling convenience centers. We plan to accomplish with the opening of a new expanded, manned convenience site in Western Harnett County. The Johnsonville site will serve as the prototype for our expanded convenience centers. Harnett County provides convenience centers at four locations as well as at both landfills. strong roots • new growth 060115 HC BOC Page 40 Mr. Fitzpatrick Page 2 There is an existing site on Brooks Mangum Road that is leased by the county. The site is cramped, not user friendly for residents and there is no room for expansion of the site. This site is our highest volume site, and there is poor circulation of vehicles within the site which creates long queues along Brooks Mangum Road. The new site, which is county owned, will offer the collection of white goods, tires, electronics, commingled recyclables, clean shingles, clothing, antifreeze, motor oil, oil filters and cooking oil. The geometry of the new site allows us to have a long driveway for better vehicle circulation. Currently, the landfills are the only location that white goods, tires and electronics are collected. This site has the potential to significantly increase diversion of materials for this region of the County. The western Harnett area is rapidly growing and this would allow us to accommodate more volume at the new site. It will also be more convenient for residents to use this facility for electronics recycling, shingles, white goods and tires. Cooking oil, Motor Oil, and anti-freeze will be new additions to the County's recycling program. We are requesting infrastructure to establish the site that will also house one recyclables compactor that will be purchased using CCCRC grant funds. The infrastructure we would like to request through the 2015 CWRAR Grant includes road construction, site improvements, electrical work for compactor, fencing, site attendant hut, a special waste canopy and signs. The special waste canopy will house electronics, used cooking oil, motor oil and filters. The project will continuously serve the community. There are no municipalities in the western portion ofthe county and we are trying to make recycling more convenient for residents. Scope of Contract for Construction The project entitled Harnett County \VTP Sludge Line includes the construction of a 6 inch forcemain from the water treatment plant site to the North Harnett \VWTP where it discharges into the sludge lagoon. The construction includes a bore and jack under the railroad, a directional bore under US Hwy 421 and a bore and jack under the traffic circle on Duncan Street. There is a portion of the project that was bid as a part of the \Vater treatment plant project that was recently bid and awarded to State Utilities. The water plant project included the pump station and a segment of force main that was located inside the plant site and extended out to Duncan Street. 304830 Bid Solicitation The project was advertised in the Raleigh News and Observer on March 26th, 27th and 29th for bids due on April23, 2015. The project was also advertised in bulletins from Dodge Plan Room and IsqFt Plan Room. Three bid packages were sent to contractors and suppliers and three addenda were issued during the advertising period. The "Harnett County, Minority-Owned, Woman-Owned, Disadvantaged Owned, Outreach Plan and Guidelines" was included in the Contract Documents which required executed documentation with the bid detailing the Contractor's efforts and results in recruiting minority participation for the project. At the time of the bid opening, three bids were received on this project ranging from a low bid of $299,736.00 to a high bid of $431,712.00. The low hid was submitted by Temple Grading&: Construction of Bunnlevel, 1'\orth Carolina. \\'chaw reviewed the hids and the scope of work for the project and feel that the bids arc reflective of the work involved for the construction of the Harnett County WTP Sludge Line project. We therefore recommend that the project be awarded to Temple Grading & Construction for a total amount of $299,736.00. Copies of the Certified Bid Tabulations are attached. Project Operational Considerations Installation of the sludge line will reduce operational costs at the water treatment plant. The line will transfer the sludge generated by the water treatment plant process to the sludge lagoon at the North Harnett WWTP and eliminate the need to pump and haul sludge from the water treatment plant. Project Budget V\'e recommend the following project budget for the completion of the Sludge Line: Temple Grading Design and Bidding Construction Management Contingency 5°;b Total Summary $299,736.00 $ 22,500.00 (Included in WTP CM) $ 15,000.00 $337,236.00 It is our opinion that the project was well advertised to the construction industry.
