04152002HARNETT COUNTY BOARD OF COMMISSIONERS Minutes of Regular Meeting April 15, 2002 The Harnett County Board of Commissioners met in regular session on Monday, April 15, 2002, in the Commissioners Meeting Room, County Administration Building, 102 East Front Street, Lillington, North Carolina. • Members present: Teddy J. Snow, County Attorney Kay S. Blanchard, Clerk to the Board Chairman Byrd called the meeting to order at 7:00 p.m. and Commissioner McNeill led the pledge of allegiance and prayer. Commissioner Andrews moved to approve the agenda as published with addition of a proposed resolution regarding the sale of timber from the Overhills High School site. Commissioner Hill seconded the motion and it passed unanimously. Work authorization for Airport relocation project (Attachment 5)k z 8. Election of Board of Directors of The Harnett County Public Facilities Corporation: William A. Wilder, Jesse Alphin and Billy G. Pope Chairman Byrd read and presented a resolution recognizing the Triton varsity cheerleaders and Coach Lisa Stewart on winning the North Carolina 3A State Cheerleading Championship. During the informal comment period of the meeting, Judy Gregory, 1313 Prospect Church Rd., expressed concerns with North Carolina House Bill 381 regarding Mental Health Bill 381. • Albert Gregory, Association of Retarded Citizens (A.R.C.), presented petitions and expressed concerns with State Bill 381 regarding Mental Health. Mr. Gregory expressed wishes for Harnett County to be exempt from the Bill. After comments from the Board members supporting A.R.C's request, Commissioner McNeill moved for adoption of a resolution reaffirming the Board's opposition and concern regarding proposed changes which could impact the delivery of services in Harnett County and request that Harnett County be exempt from House Bill 381. Commissioner Titchener seconded the motion and it passed unanimously. (Attachment 6) Commissioner Titchener moved for the appointments listed below. Commissioner Hill seconded the motion and it passed unanimously. Adult Care Home Communitv Advisory Committee Diane Sisk for a 3-year term to expire 04/30/05 nominated by Commissioner McNeill Airport Committee Cecil Edgerton for a 3-year term to expire 04/30/05 nominated by Commissioner Titchener Mid -Carolina Aging Advisory Committee • Jodi Pope for a 3-year term to expire 04/30/05 nominated by Commissioner Titchener Nursing Home Community Advisory Committee Diane Sisk for a 3-year term to expire 04/30/05 nominated by Commissioner McNeill Mid -Carolina Workforce Development Board Gwendolyn McNeill (Ms. McNeill has declined the appointment) Chairman Byrd called to order a public hearing on the North Carolina Department of Transportation Rural Operating Assistance Program for Harnett County. Ralph Thurman, Transportation Manager, presented the Rural Operating Assistance Program grant application and stated that the purpose of this public hearing was to obtain comments from the public regarding the program. Distribution of the funds will be as follows: Elderly and Disabled Transportation Assistance Program (EDTAP) is administered by General Services, Transportation Department and funding totals $61,205.00. This program provides transportation services to the County's elderly and disabled citizens. • Work First Proo -gram funds are administered by the Department of Social Services and totals $12,604.00. These funds are used to provide operating assistance for transitioning Work First participants. Rural General Public Program (RGP) is administered by General Services, Transportation Department and totals $36,011.00. Funds are intended to establish and provide transportation services for the general public through the Dial -A -Ride Program and to those individuals who are not participants with the human service agencies. Total funding amount for the three programs is $109,820.00. Commissioner McNeill noted that the Golden Adventurers senior citizens group expresses high praise for the transportation programs. Chairman Byrd opened the meeting for comments from the public. No comments were offered and Chairman Byrd closed the public hearing. Chairman Byrd called to order a public hearing on proposed text amendments to the Harnett County Zoning Ordinance. George Jackson, Planning Director, presented the proposed amendments which implements the recommendations of the NC 87 Highway Corridor Study. A formal public hearing was held in October, 2001 at Benhaven School. Chairman Byrd opened the meeting for additional comments from the public regarding this matter. No comments were offered and Chairman Byrd closed the public hearing. Commissioner McNeill moved to approve that Sections 8.0 — 8.9 be added to the Zoning Ordinance. This appendix is referenced in the resolution that will be copied • into the minutes concerning the next item. Commissioner Hill seconded the motion and it passed unanimously. Commissioner McNeill moved to adopt An Amendment to the Harnett County Zoning Ordinance and Map Adding Section 8.0 highway Corridor Overlay District to Article VI Zoning Districts and the Adoption of the Recommendations Contained in the NC 87 Corridor Study Dated March, 2001. Commissioner Andrews seconded the motion and it passed unanimously. (Attachment 7) Commissioner McNeill moved to adopt An Amendment to Article XV, Definitions of the Harnett County Zoning Ordinance to Add the Definition of Highway Corridor Overlay District. Commissioner Andrews seconded the motion and it passed unanimously. (Attachment 8) Neil Emory, County Manager, presented a Resolution to Dispose of Timber By Private Sale. The timber at the Overhills high school tract will need to be cleared prior to the commencement of the school construction. Commissioner Andrews moved to adopt the resolution as presented. Commissioner McNeill seconded the motion and it passed unanimously. (Attachment 9) Departmental reports were filed with the Board from the Sheriff's Department, Veteran's Service, Animal Control and Emergency Medical Service. is Neil Emory, County Manager, noted that the Cooperative Extension Annual Report meeting will be held May 6, at 7:30 a.m. at Lillington Presbyterian Church. Mr. Emory reminded the Board members of Special Olympics, April 17, at Harnett Central High School. Commissioner McNeill moved for the Board to go into closed session for the following purposes: 1) to give instructions to the County staff and County Attorney concerning the handling of a claim and a judicial actions, namely Porter versus Stewart, U.S. District Ct. File No. 89-950-CIV-5. 2) to discuss matters relating to economic development matters. This motion is made pursuant to N.C. General Statute Section 143-318.11(a)(3)&(4). Commissioner Andrews seconded the motion and it passed unanimously. Commissioner McNeill moved for the Board to come out of closed session. Commissioner Hill seconded the motion and it passed unanimously. There being no further business, Commissioner McNeill moved for adjournment. HARNETT COUNTY AIRPORT WORK AUTHORIZATION FOR PROFESSIONAL SERVICES Work Authorization No. 02-01 March 26, 2002 TBI Project No. 2701-0201 It is agreed to undertake the following work in accordance with the provisions of our Contract for Professional Services. The Contract shall be amended to allow for the following work: Description of Work Authorization: Engineering Design, development of bid documents, and receipt of bids for the Relocation of Airport Road at the Harnett County Airport. Relocation shall be in accordance with North Carolina Department of Transportation guidelines and at the location requested by the NC Department of Transportation (Division of Aviation and Highways). Engineering Services will include Project Development Phase Services, Engineering Design for Road Relocation, coordination with utility companies, and coordination with the NC Department of Transportation and the NC Division of Aviation. Engineering Services will also include the coordination with the NC Department of Transportation for temporary closure and confirmation of final alignment of Old Stage Road (NC 1769) to define property acquisition limits. The Engineer.shall also provide additional Subsurface Testing and Surveying. The plans and specifications shall be coordinated with NC Department of Transportation in Fayetteville. Time Schedule: The Project Development Phase is complete. The Basic Engineering Services for Airport Road Relocation shall be completed within forty (40) days of written authorization. Cost of Services: The method of payment for the Project Development Phase and the Engineering Services Phase shall be lump sum in accordance with Section V the Contract. The lump sum amount for the Project Development Phase shall be $7,600.00. The lump sum amount for Engineering Phase Services shall be $17,100.00. The method of payment for coordination with NC Department of Transportation for temporary closure and final alignment of Old Stage Road (NC 1769) shall be on an hourly basis, plus expenses. In addition, any onsite meetings by the NCDOT, meetings with property owners, or public meetings, shall be on an hourly basis, plus expenses. RESOLUTION WHEREAS, Lee -Harnett Area Mental Health, Developmental Disabilities and Substance Abuse Authority (under this and former names given to this organization hereinafter referred to as Area Program) has provided quality mental health, developmental disability and substance abuse services to the citizens of Harnett County since February 5, 1968; and WHEREAS, the Area Program's administration has been responsive and accountable to the Board of Commissioners and citizens of this County; and WHEREAS, the current Area Program has provided stable and responsible administration of its programs; and WHEREAS, the Area Program was recently recognized by the Council of Accreditation for Children and Family Services as meeting national accreditation standards and as being one of the outstanding programs in the State; and WHEREAS, the current arrangements has proven to be satisfactory to the Board of Commissioners and the citizens of this county. NOW, THEREFORE BE IT RESOLVED that the Harnett County Board of Commissioners does hereby request that the provision of mental health services under the current Area Program be maintained and that the program be exempted from the provisions of House • Bill 381. STATE OF NORTH CAROLINA COUNTY OF HARNETT AN AMENDMENT TO THE HARNETT COUNTY ZONING ORDINANCE AND MAP ADDING SECTION 8.0 HIGHWAY CORRIDOR OVERLAY DISTRICT TO ARTICLE VI ZONING DISTRICTS AND THE ADOPTION OF THE RECOMMENDATIONS CONTAINED IN THE N.C. 87 CORRIDOR STUDY DATED MARCH 2O01. WHEREAS, the Board of Commissioners for Harnett County adopted a zoning ordinance • having countywide jurisdiction and zoning maps having jurisdiction for the area north of the Cape Fear River on July 18, 1988; and WHEREAS, the Board of Commissioners for Harnett County adopted zoning maps having jurisdiction for the area south of the Cape Fear River on April 3, 1989; and WHEREAS, a lawsuit was filed challenging the validity of the zoning ordinance and maps applicable to the area south of the Cape Fear River; and WHEREAS, the North Carolina Court of Appeals ruled on May 19, 1992 that the zoning ordinance heretofore adopted by the county is invalid as it applies to the area south of the Cape Fear River; and WHEREAS, on September 7, 1999 the Board of Commissioners for Harnett County adopted an update to the county's Land Use Plan which recommended zoning for the unzoned section of Harnett County, and WHEREAS, the Board of Commissioners for Harnett County directed the County Manager and staff to develop proposed zoning maps for each township south of the Cape Fear River and to conduct public meetings within each township to review the proposed zoning maps and receive public comment during the Fall of 1999; and WHEREAS, at the public meetings numerous speakers expressed concern about potential development along N.C. 87 Highway which is being upgraded to a multi -lane highway; and WHEREAS, on June 5, 2000 the Board of Commissioners re -adopted zoning for all • townships south of the Cape Fear River except Stewart's Creek; and WHEREAS, the Planning Department was directed to conduct a study of the N.C. 87 corridor from Cumberland County to Lee County; and WHEREAS, such a study was conducted by the N.C. Division of Community Assistance with input from the Harnett County Planning Board and Planning Department staff and said study was completed in March 2001 and was tbrwarded to the Board of Commissioners with a favorable reconmmendation; and WHEREAS, after being duly advertised a public hearing was held by the Board of Commissioners on October 9, 2001 at Benhaven School in Olivia, N.C.; and WHEREAS, the Board of Commissioners have reviewed and considered the public comments received; and WHEREAS, the Planning Board, as prescribed by Article XIII of the Zoning Ordinance has recommended adoption of proposed amendments set forth in the N.C. Highway 87 Corridor study, February 2001; and WHEREAS, the Board of Commissioners held a public hearing on April 15, 2002 for the purpose of receiving public comment about the proposed amendments; and NOW THEREFORE BE IT ORDAINED that the Harnett County Board of Commissioners does hereby amend the Zoning Ordinance text by adding Section 8.0 Highway Corridor Overlay District to Article VI which is included as an appendix hereto and that the official zoning map be amended by adding a corridor which is six hundred feet (600') in width along both sides of the right-of-way of N.C. 87 Highway for its entire • length within Harnett County with said corridor being subject to the additional requirements of Section 8.0 through Section 8.9. STATE OF NORTH CAROLINA COUNTY OF HARNETT • AN AMENDMENT TO ARTICLE XV, DEFMTIONS OF THE HARNETT COUNTY ZONING ORDINANCE TO ADD THE DEFINITION OF HIGHWAY CORRIDOR OVERLAY DISTRICT WHEREAS, the Board of Commissioners for Harnett County adopted a zoning ordinance text having countywide jurisdiction July 18,1988; and WHEREAS, said zoning ordinance contains provisions for preparing and adopting amendments ; and WHEREAS, other studies have been done which contain terms not defined in the current zoning ordinance text; and WHEREAS, the zoning ordinance text has been amended to include a process whereby certain highways could be included in a highway corridor overlay district; and WHEREAS, the definition of a Highway Corridor Overlay District does not currently exist; and NOW THEREFORE BE IT ORDAINED, that a Highway Corridor Overlay District be defined as a zoning district which encompasses one or more underlying zones and imposes additional development standards and requirements above those required by the underlying district(s) For purposes of this ordinance, the width of the corridor is six hundred feet (600') along both sides of the highway right-of-way unless modified by the Board of Commissioners. • Duly adopted this day of April, 2002 and effective upon adoption. RESOLUTION TO DISPOSE OF TIMBER BY PRIVATE SALE f Harnett is the owner of certain real r known as the • WHEREAS, the County o property Overhills acquisition which is described in that deed recorded in Book 1291, Page 496 Harnett County Registry; that on a portion of That real property on NCSR 1121 (Ray Road) the County Board of Education proposes to locate and construct a high school facility; that in order to construct the high school facility it is necessary to clear the school site of standing timber; and WHEREAS, the County through an independent forest management consultant has evaluated the timber to be cleared which has a value of less than Thirty Thousand Dollars ($30,000.00); and WHEREAS, pursuant to the provisions of N.C. General Statutes §153A-116 and §160A- 266 et seq, the Harnett County Board of Commissioners hereby authorizes the Harnett County Manager to dispose of that standing timber which needs to be cleared at the Overhills high school facility site by private sale at a negotiated price. NOW, THEREFORE, BE IT RESOLVED that the Harnett County Board of Commissioners does hereby authorize the Harnett County Manager to dispose of the above referenced timber by private sale at a negotiated price acceptable to the County Manager and • further the County Manager is given the authority to execute any documents, including timber cutting contracts or timber deeds needed to complete the sale. BE IT FURTHER RESOLVED that this Resolution be published once after its adoption and that no sale shall be consummated thereunder until ten (10) days after its publication.
