Commissioner Pate moved, seconded by Commissioner Johnson, that an Automatic

Commissioner Johnson moved, seconded by Commissioner R, L. Pate, that Earl
H. Wells, Dunn, N. C. be appointed County Dog Warden.
Commissioner Womble.Moved, seconded by Commissioner Ingram, that John N. Shaw
be appointed County Dog Warden.
Upon voting upon the said motion Earl H. Wells was appointed County Bog
Warden effective September•l2th. 1955, to /serve until the First Monday in-Dec-
ember; 1956, at a salary of $250.00 per mont4 and a traveling allowance of
$125.00 per month,
A- Petition on a Fire District calling for an election was presented.
Upon motion of Commissioner Pate, seconded by Commissioner Womble the, petition
was considered, and referred to Berles Johnson, tax Supervisor, with instructions
to examine the same and report to the Board of Commissioners whether or not the _
same is signed by fifteen per cent of the residence free holders in Buies Creek
Rural Fire Protection District. Motion carried.

chase, of the building known as the Library Building.
A delegation of citizens from the Buies Creek Community in Neillts Creek
Township, Harnett County, North Carolina, appeared before the Board-of Commissioners
with respect to the establishment of the Buie's Creek Rural Fire Protection District
and in connection therewith presented to the Board of Commissioners a Petition.rea7.d-

TO THE HONORABLE BOARD OF COMMISSIONERS OF- HARNETT COUNTY;,
We, the undersigned resident freeholders living in Harnett County, North Carolina
in the area hereinafter described and designated as "Buies Creek Rural Fire Protec-
tion-District," and representing more than fifteen per cent of the resident free-
holders living within said area, do hereby petition your honorable body to call an
election in said district as provided in Article 3A of the Chapter 69 of the General
'tatutes of North Carolina, for the purpose of submitting to the qualified voters
therein the question of levying and collecting a special tax on all taxable property
in said district, of not exceeding ten cents ,(10') on the one hundred dollars MOO.

the area contained and embraced within said Buies Creek Rural Fire Protection Dis-
trict and in which the undersigned reside is described as follows:
Beginning at the point where Thorntons Creek empties into the Cape
Fear River on the northern Bank of said river and runs thence in a wester -
ly direction with the northern bamk.of Cape Fear River to the point at
which the western boundary line of the lands of W. E. Kivett intersects
the northern bank of said river, a corner between the lands of W E.
Kivett and J. G. Layton Estate; thence in a northerly direction with the
line of Kivett and said Layton Estate, and continuing with a line of
said Kivett lands past the northeast corner 0±' said Layton Estate lands
to the intersection of said Kivett's line and the southern margin of

U. S. Highway No. 421 at a point near Sawyer's and Kivett's
(formerly Roger'si Store; thence in a northerly direction cross-
ing said U. S. Highway No. 421 and with the western margin of the
public road leading from said Sawyer's and Kivett's Store to the
Coats - Lillington Highway to a point where the southern boundary,
line of the lands of Neill uilchrist intersects the western mar-
gin of said road; thence with the southern boundary line of the
lands of Gilchrist in a westerly direction tothe corner between
Gilchrist and Matt Matthews; thence continuing in a westerly
direction with the southern line of the lands of Matt Matthews to
the cornerbetween the lands of said Matthews and Rex 0. Johnson;
thence continuing in a westerly direction with the southern boundary
line with the lands of Hex 0. Johnson passing Cedar Grove School
to the run of Dry Creek; thence in a northerly direction up the
run of Dry Creek to the intersection of the run of said creek
and the northern margin of the highway leading from Coats to Lill -
ington; thence in a northeast direction along the northern margin
of said Lillington -Coats Highway to the intersection of the western
boundary of the lands of K.B. Johnson andthe northern margin of salt)
highway at a point near H. T. Butts' Store; thence in a northerly
direction with the western line of said K. B. Johnson lands to the
northwest corner of said tract; thence continuing with the line of
said K. B. Johnson lands in an Easterly direction to the center of
the road leading from Butts' Store to Neill's Creek Church; thence
in a northerly direction up the center of said road to the point at
which the center line of said road and the northern boundary line
of the lands of D. F. Arrington intersect; thence in an easterly
direction with the northern line of D. F. Arrington's lands to the
run of Buie's Creek; thence in a northerly direction up the run of
said creek to the point at which said creek andthe dividing line be-
tween Neill's Creek and Black River `Townships intersect; thence in
an easterly direction with the dividing line between Black River
Township and Neill'sCreek Township to the point at which said divid-
ing line intersects the western bound line of Grove Township at a
point in or near the center of the old wire road a short distance
south of the residence of Hen 'Weaver; thence in a southerly direc-
tion along the center arc aid Old Wire Road to the point at thich
the northern boundary line of the lands of T. T. Lanier crosses
said road; thence in an easterly direction with the northern boundary
line of the lands of T. T. Lanier to the run of Thorntons Creek;
thence in a southerly direction with the run of 1'horntons Creek to
the point of beginning.
RESPECTFULLY SUBMITTED
Said Petition purported to bear the signatures of several hundred free-
holders resident in the area described and defined in said Petition and upon
receipt and consideration of the same,upon motion of Commissioner 'domble, seconded
by Commissioner Pate, said Petition was referred to the Harnett County Tax Super-
visor with instructions and direction to compare the signatures appearing on said
Petition with the Tax listing records in his office, and particularly the tax
listing records relating to the lands contained within the area described ins aid
Petition, fortnepurpose of ascertaining and determining whether or not said Peti-
tion contained thesignatures of more than fifteen percent of the resident free-
holders living in the area defined and described in said Petition, and said Tax
Supervisor was directed to forthwith report his findings to said Board.
Thereafter the Tax Supervisor of Harnett County filed with the Board of
Commissioners the following certificate.
"To the Honorable Board of Commissioners of Harnett County:
"This is to certify that I have checked the Petition designated as Buies
Creek Rural Fire Protection District with the tax listing records in my office
end I further certify that said Petition contains the signatures of more than
fifteen per cent of the resident free holders living in the area described and
defined ins aid district."

Thereupon Commissioner Pate introduced the following resolution which. was
read:
WHEREAS' certain resident freeholders living in Neills Creek township, Harnett
County, North Carolina, have presented to the Board of Commissioners of Harnett
County a Petition requesting said Aboard of Commissioners to call an election, as
provided in Article 3A of Chapter f the General Statutes of North Carolina, as
amended, for the purpose of submitting to the qualified voters living within the
area described and defined in said Petition the question of whether or not a special
tax on all taxable property in said district, of not exceeding ten cents (10) on
the one hundred dollars ($100.00) valuation of property, shall be levied for the
purpose of providing fire protection in said district; And,
WHEREAS said Board of Commissioners of Harnett County has examined said Pe-
tition and finds the same to be in due form and according to law, and further finds
as a fact that the same,contains the signatures` of more than fifteen per cent
(15 %) of the resident freeholders living in the area described in said Petition;
And
WHEREAS' the Board of Commissioners of Harnett County desire, as required
by law, to call an election in said Buies Creek Rural Fire Protection District for
the purpose of submitting to the qualified voters therein the question -of whether
or not a tax shall be levied upon the taxable property therein for the purpose of
providing rural fire protection in said district as provided by law;
NOW, THEREFORE be it ordered and resolved by this Board of Commissioners for
the County of Harnett:
1. That, pnnsuant to the, provisions of Article 3A of Chapter 69 of the General
Statutes of North Carolina, as amended, . an election is hereby called to be held
in that area designated and above described as " Buies Creek Rural Fire „Protection
District,” for the purpose of submitting to the qualified voters therein the
question of levying and collecting a special tax on all taxable property in said
district, not exceeding ten cents (10¢) on the one Hundred Dollars $100.00)
valuation of property, for the purpose of providing fire protection in said dis-
trict.
2. That said election is hereby called to be held bn Saturday, November 12,
1955, between 6 :30 A.M. and 6:30 P.M., Eastern Standard Time, at which there shall
be submitted to the qualified voters in said dietrict the following questions:
".In favor of tax for fire protection in Buies Creek Rural Fire Protection
District."
"Against tax for fire protection in Buies Creek Rural Fire Protection
District »"
3. That for said election there shall be a new registration of the qualified
voters living within said district, and for the registration of such voters, the
registration book shall be opened from 9 :00 a.m. until sunset on each day,'be-
ginning Saturday, October 15, 1955, and closing on October 29, 1955. On each
Saturday during such registration period such books shall be open at the polling
place. Saturday, November 5, 1955, shall be challenge day.
L. That the polling place for said election shall be the Blackmon Building
located on the East Side of Main Street and opposite the Drug Store in Buies
Creek, North Carolina, The Registrar for said election shall be Preston Butts,
and the judges for such election shall be Mrs. Grace McKay and Jeff Stewart.'
5. That the form of the ballot to be used at said election shall be substan-
tially as follows:

6. That said election shall be according to the provisions ana laws
covering general elections so far as the same may be applicable, and
the Harnett County Board of Elections is hereby ordered and direct-
ed to arrange for the holding of said election as by law provided and in
accordance with the terms hereof. The cost of holding said election
shall ba paid by arnett County.
7. That the Board of 21ection by Harnett County shall cause to be
published in the Harnett County News, a newspaper published in
Lillington, North Cirolina, at least once each week for sevensuccessive
weeks next preceding the d.te on which said election is to be held,
a notice reading substantially as follows:
NOTICE OF SPECIAL ELECTION AND NEW REGISTRATION IN THE
BUIES CREEK RURAL FIRE PROTECTION DISTRICT, COUNTY OF
HARNETT, NORTH CAROLINA:
A special election will be held in the buies Creek Rural Fire Protection
District between 6 :30 a. m. and 6:30 p.m. Eastern Standard Time, on Saturday,
November 12, 1955, at which time the qualified voters in-aid Buies Creek Rural
Fire Protection District shall be entitled to vote upon the question of levying
and collecting a special tax on all taxable property ins aid district, of not ex-
ceeding ten cents (10¢) on the one hundred dollars (4100.00) valuation of the
property, for the purpose of providing fire protection in said district. If
said election is carried, the board of County Commissioners of Harnett County
shall be authorized and directed to Levy and collect in said district a tax in
such an amount as it may deem necessary, not exceeding ten cents (101) on the
One hundred dollars (P100.00) valuation of property in said district from year
to year to be used only for furnishing fire protection within said district.
For said election a new registration of all qualified voters residing
within said district shall be had, and the books for the registration of voters
will be open from 9:00 a.m. until sunset on each day beginning Saturday, October
15, 1955 and closing on Saturday, October 29, 1955. On each Saturday during
such registration period said books will be open at the polling place. Saturday,
November 5, 1955 shall be challenge day.
The polling place for said election shall be the Blackmon Building on the
East side of Main Street in Buies Creek, the Registrar for said election is
Freston Butts, and the Judges are Mrs. Grace McKay and Jeff Stewart.
All qualified voters residing in said district shall be entitled to
register and vote in said election and said Buies Creek Fire Protection District
