It was ordered that in all eases in which the County has deeds for lands
sold under order of Court for non -hayment of tares, that the Tax Collector
be ordered not to advertise land for sale for the payment of 1930 taxes.

In joint Session with the Board of Edtsuation the Board of County Commissioner
ttok_up the question of the election of a Welfare Officer for the ensuing
term. It was moved by E.L. Cooke of the Board of Commissioners and seconded
by J.B. Ennis of the same Board that Miss Flora McQueen be elected for
this term. Upon vote she was unanimously .electdd by the two Boards.
It was moved by ELM. 0'1 inn and seconded by J.H. Williams that Supt. of
Roads, A.E' Holder, be authorized to make sale of 6 mules, " 4 at not less
than $150.00 and 2 at not less than $125.00. The proceeds of which sale
shall be applied on the indebtedness due the General County Fund by the
County Road Fund.

It was ordered, by the Board that J.S. McLean, Auditor, transfer $2000.00

It was ordered that Report of J.S. NeLean. Auditor showing distribution of
L.M. Chaffin's cheek for $1541.66 be accepted and ordered recorded on the
montte "docket.
Whereas the Board of Commissioners of Harnett County have been granted per
mission to issue bonds in the sum of $135,000.00 by Local Government Com-
mission with which to pay outstanding notes of 4135,000.00;
And Whereas it is the will of this Board that a Revolving Fund of $115,000
be, created out of the surplus of uncollected taxes and lands purchased by
the County at Tax:Woreclosure sales;
Now therefore, be it resolved: That as soon as the proceeds of said
bonds be received that the said noes of $135,000.00 be paid and that a re-
volving fund of $115,000.00 be created out of the surplus of the uncollected
taxes and the sale of lands which the County has purchased at Tax Foreclosure
sales and that as the said taxes are collected and sales of land are made
thegt after paying the running expenses of County the sum of $115,000.00 be
placed under the Supervision of the Local Government Commissioner as a
Revolving Fund.

RESOLVED that Annie Strickland, now confined in the county Jail of Harnett
County, be hired to G.M. Davis of Wayne County for the remainder of her
sentence of ninety days for the sum of $14.65, payable as follows: $5.00
on the first day of July, 1931; $5.00 on the first day of Inge 1931 and
44.65 on the first day of September, 1931, znd that bond in the sum of 425.00
be required.

REPORT:
TO THE HONORABLE BOARD OF COUNTY COMMISSIONERS OF BARNETT COUNTY:
I herewith submit a report of the investigation of the existing laws pertaining
to the liability of the Couty of Harnett for moneys to be paid to the 4heriff
of Harnett Bounty. In this report I have not included any recent legislation for
the reason that the acts have not been printed.
1. By Chapter 684 Public- LocaL Laws 1915 the Sheriff, along with other offi-
cers of the said county of Harnett, was placed on a salary basis.
Section 10 of this act provides:
"The 'sheriff of said county shall also apppint a jailer whose salary shall
be fixed byethe Board of Commissioners of said County, and the actual expenses
of maintaining said jail as heretofore, shall also be allowed by the Board of
Commissioners of said county from the funds of the County as now provided, as well
at the salaryof the jailer". r
2. Section 2 of Chapter 56 Publie Local Laws 1921, Extra Sessions,
provides=
9That the fees, commissions, profits and emoluments received by said
officers of Harnett County under the provisions of Section one hereof(Sheriff
Register of Deeds, Clerk of the buperior "oust and 'leek of the Recotders'
Court) shall be received and accepted by them as full and complete compensation
for their services as such officers; provided the Sheriff of Harnett County
shall also receive the amount of his actual expensesfor conveying prisoners froz
place Of trial to jail and from jail to place of trial, for taking prisoners to
tate Prison or Chain -gang, or for taking insare persons to the 'Ctate- Hospital
it shell be the duty of the Sheriff to render to the Board of Commissioners of
said County a monthly statement of the expenses above provided for, showing
the date of such expense was incurred; the purpose for whieh incurred, and the
amount thereof; and thereupon, if the Board of Commissioners be satisfied that
the amount sub,itted is correct, the same shall be paid to the Sheriff out of
the General County Minds in the manner provided for the payment of other
county expenses "(
3. Section 6, chapter 42 of Public -Local Laws, Extra Session 1924 provides:
fThe Sheriff of Harnett "aunty on and after the first of October, 1924,
shall receive as compensation all fees, costs and other allowances now received an
and paid to the Sheriff of Harnett Con.nty, exclusive of eommissionsn or other
compensation in or connected with: the collection of taxes, and in addition
thereto shall be paid by the Board of Commissioners of said Bounty a salary of
$2100.00 per annum, the same to be payable monthly.
4. Section 2 of Chapter 435 Public -Local Laws 1925, amending the preceding
section, provides:
"That send chapter be fnrtther amended by adding at the end of section
thereof the following: Provided that the Board of commissioners of Harnett
Bounty in its discretion may allow the Sheriff an additional sum, not exceeding
$1500.00 annually, for purpose of defraying the expenses of deputy sheriffs and
all other expenses incident to the office of Sheriff .
5. Section 3944 of the Consolidated Statutes of North Carolina provides:
'The Sheriff shall have care and custody of the jail in his county; and
shall be "or appoint a keeper thereof".
6. Section 3919 Oonaolidated Statutes of North Carolina provides:
"Jailer shall receive for furnishing prisoners with fuel, one pound of
wholesome bread, one pound of roasted or boiled flesh, and a sufficient quantity
of water with every necessary attendant, a aum not exceeding fifty cents per day
unless the Board of Commissioners shall deem it expedient to increase the fees
which it may do provided such increase shall not exceed fifty per cent of the
above sum ".
7. Section 3008 Consolidated Statutes provides the followeng
(a) bheriff shall be allowed the following fees and expenses and
no other, namely:
Note: Only fees affecting the County are set out.
Arrest of a person indicted including all services connected with the
taking and justification of bail, $1.00;
Imprisonment of any person in a civil or criminal action, thirty cents;
and release from prison, thirty centa.
Executing supoena on witness, thirty cents:
Conveying prisoner to jail to another county, ten cents per mile:
For prisoner's guard, if "any - necessary, and approved by the Oounty
Commissioners, going and returning, per mile. for each five cents.
Expense of guard and all other expenses of conveying prisoner to jail
or from jail to another for any purpose, or to pny place of punishment, or to
appear before a court of Justice of Peace in another county, or in going to an
another eounty for a prisoner, to be taxed in the bill of costs and allowed
by the board of Sommissioners of the County in which the criminal proceedings
were instituted.
For conveying prisoners to the penitentiary 42.00 per day and actual
expenses; also $1000 per day in actual expenses for each guard, not to exceed
one guard for every three prisoners, as the sheriff upon affidavit before the
Clerk of the Ouperior Qourt of his county shall swear to be necessary for the
safe conveyance of the convict, to be paid by the Board of Commissioners of the
Bounty in which the criminal proceedings were instituted.
Providing prisoners in county Jail wiyh suitable bed, bed clothing,
other clothing and fuel, and keeping the prison and grounds clean, whatever
sum shall be allowed by Ae 'commissioners of the County.
Summoning a grand jury or a petit jury, for each one summoned
cents and ten cents for each pweson summoned on the special venite.

For serving any writ or other process with the aid of the b unty, the
usual fee of $1.00, and the expense necessarily incurred thereby to be
adjudged by the "ounty Commissioners, and taxes as other costs.

Bringing up a prisoner upon habeas corpus to testify or answer to any
gourt, or before any judge $1.00, and all actualand necessary expenses for
such services, and ten cents per mile by the route most usually travelled,
and all expenses for any guard actually employed and necessary.
8. Section 1346 provides, among other things, that the sheriff or
keeper of any jail shall, every day cleanse the room of the prison in which
any prisoner is confined, and cause all filth to be removed therefrom; and
shall also furnish the prisoner plenty of good and wholesome water three times
per day; and shall also furnish each prisoner fuel, not less than one pound
of wholesome bread, one pound of good roasted or boiled flesh and every nec-
essary attendant.
0;. Sectdon 1347 of the Oonsolidated Statutes, provides, among other
things, that if there is no visible estate belonging to the prisoner whereon
to levy such fees and charges, the amount shall be paid by the County.
10. Section 1319 of the Vonsolidated Statutes privdea the following:
"It is the duty of the Board of Commissioners in every county to have
the common jail so heated by furnaces, stoves or otherwise as to render them
warm and comfortable. A failure to discharge the duty herein specified shall
constitute a misdemeanor, punishabjr8 by fine or imprisonment or both, in the
discretion of the court ".
11. Section 1320 Oonsolidated'Statdtes provides the following:
The Board of Godnty Commissioners, from time to time, as may be
necessary, shall order the sheriff of the bounty to purchase for the use of
their jail a certain number of goods, warm blankets and other suatable bed
clothing, which shall be securely preserved by the jailer and furnished to the
prisoners for their use and comfort, as the season or other circumstances may
require, and the sheriff at least once in every year shall report to the Board
of Commissioners the condition and number of such blankets and bed clothing ".
12. Section 3411(x) for oteii.n.y every distillery seized under this
artisle, the sheriff or other police officer shall receive such sum as the
oard of Commissioners of the Lounty in which the seizure was made, in the dis-
oretion of said Board, allow, which sum shall not be leas than $5.00, nor more
than $20.00; Provided, that the Oommissioners shall not pay any amount if they
are satisfied after due investigation that the seizure of the distillery was not
bona fide made; Prof ided, further, that *hen the sheriff of a 4ounty captures
a distillery, he shall receive sa the fee for his own use, regardless of whether
he be on fees or salary.
In my opinion, which opinion is substantiated by the personal opinion
of Assistant Attorney General Nash, who was kind enough to confer with me, the
Board of Oommissioners of Harnett bounty is compelled to pay to the Sheriff og
Harnett County, or his deputies the keeper of jail, the following only:
1. Far any moneys expended for fuel, heat, clothes and bed clothing neces-
sary for the prisoners confined in the Ocunty Jail.
2. To pay the sheriff or keeper of the jail not more than fifty cents per
day for board of each prisoner if the prisoner fails to pay said board.
3. To pay the sheriff in monthly installments the salary of $2100.00 per
annum.
4. To pay the sheriff, his deputies or jailer the fees set out in section
of this report, when the county is liable for any court costs or any part
thereof.
In my opinion the Board of Commissioners, may in its discretion, allow the
sheriff, his deputies or jailer only the following
1. $1500.00 annually, and not exceeding the sum for the purpose of defrayin
expenses of deputy sheriffs and all other expenses incident to office of sheriff.
2. To pay the sheriff or other poliace officer of said county a reward noy
exceeding twenty dollars nor less and $5.00 for each still captured within the
county.
3. To pay not exceeding seventy five cents per day for the board of each
prisoner when said prisoner has no estate ablatulu with which to pay said board.

We, the Grand Jury, for the May term 1931 of Harnett Superior Court do here-
by submit this as our report covering our transactions and recommendations during
said term:
We have diligently inquired into and made returns of all bills of indictment
sent us by the Solicitor.

e have inspected the 4ounty Home, and found it in an excellent condition
and all the inmates appear^to be properly cared for.
We have inspected the 0onviet Camp and found it to be in satisfactory
condition. We are glad to mention in our report that they have a good crop in
excellent condition, and also a good quantity of cured meat raised last year.
We have inspected the Jail and `court House and found them to be in satin
factory condition.
We desire to make the following recommendations:
We recommend that the grounds of the Courthouse be cleaned up and that the
old well at the North side of the Courthouse be filled up. We also recommend
that the leaks in the roof of the courthouse be repaired.
We recommend to. our Representatives in the Legislature to introduce a bill
in the Legislature giving us a six months permanent Grand Jury.
We recommend that a garage be built at the County Home.

The Board of County Commissioners mer in call session, all members being
present:

It was ordered that a hat rack and a water cooler be placed in the room
used by the "ommissioners as a meeting place.
It was ordered that check be issued to Chase National Bank for 412.09
for expense incurred in handling Harnett county Bonds.
It was moved by H M O'Quinn and seconded by J B Ennis that this Board go
on record as being opposed to any salary supplements to School teachers or
Principals on account of present financial depression among the tax payers,
especially the farmers of the bounty in the interest of tax reduction. This
motion was unanimously adopted by a vote of the Board.
The Board having considered the new valuation as ascertained by the
appraisement of 1931 find that said value is too low as to real estate by 10%
it is ordered that said value be increased 10%; that this be taken as a basis
and the Board will consider adjustments of individual properties to the end
that all property may be valued and taxed at its true value within the limits
set forth in the statute of 1931. This Motion was adopted by a unanimous vote
of the Board.
It was then ordered that the Board adjourn until June 13th. 1931.
