06211928MINUTES OF SPECIAL MEETING OF BOARD OF COUNTY COMMISSIONERS ON THURSDAY JUNE 21, 1928. Speoial Session. The Board. of County Commissioners met in Special Session on Thursday June 21, 1928, with the following members present: Buchanan, chairman; Ingram, Hockaday, Byrd. Commissioner Snipes being absent. RESOLUTIONS: The following resolutions were passed authorizing the board of County Commissioners to borrow money for the purpose of erecting school buildings. *WHEREAS, the board of Education of Harnett County has requested the Board of County Commissioners of Harnett County to borrow the sum of $10,000.0 for the purpose of erecting a school building in Lillington Township, known as "Shawtown Project", which building is necessary for the proper operation of a school for the term of six months; and whereas, the State Board. of Education of Borth Carolina, did on March 19, 1928, approve a loan of 410,000.00 to the County board of Education of harnett County for the purpose of erecting said school building, which approval is in words and figures as follows: Supt. B.P. Gentry, Lillington, N.C. Dear Sir: Literary Fund 1. Approval. At a meeting of the State board of Education held in the Executive Chamber at 11;30 A.M. on March 19, 1928, under authority of Article 24, Chapter 136, Public Laws of 1923, an application for a loan from the Literary Fund was approved for the specific project mentioned below: County Project Amount Approved' Harnett Shawtowu(c) 410,000.00 2. Use. This money can be used only for the purpose and for the specific project for which the application is approved. (See article 24, Chapter 136, Public Laws of 1923). 3. Late Available. This money will be available on the 10th day of February, 1929. 4. Temporary Local Loans. The Attorney Generals office informs me that the order of the county board of commissioners in authorizing a loan from the Literary Fund, when the application is approved by the State Board of Education is to all intents and purposes equivalent to a bond order, thus enabling the county commissioners to make temporary loans against this approvaj to finance the project partially until the loan itself is available. with sincefest good wishes, I am, Very truly yours, State Super- A.T. NOW, THEREFORE, be it xesolved by the Board of County Commissioners of harnett County, that said board be authorized to borrow on the full faith and credit of said County the sum of TEN THOUSAND DOLLARS ($10,000.00), for the purpose of erecting the said school building mentioned above in said resolution, and that the chairman of this board be authorized to execute a note dated June 28, 1928, payable to bearer, signed by the chairman of the board, and attested by the C]erk 1» said board, payable on the 28th day of November, 1928, and bearing interest at the rate not exceeding six per eent as may be received by the chairman after due advertisement of the said note, and that said note be delivered and negotiated by the C airman of the board of Commissioners for the purposes aforesa (. �i f� 'A'y Chairman. $9,000.00: WHEREAS, the board of bducation of Barnett County has requested the Board of Commissioners of Harnett County to borrow the sum of 49 000.00 for the purpose of erecting a school building in upper Little River 'Township, Mows as "Upper Little River Project*, which building is necessary for the proper-. operation of a school for the term of six months; and whereas, the State Board of Education of Borth Carolina did on March 19, 1928, approve a loan of $9,000.00 to the Bounty Board of Education of Harnett County for the purpose o erecting said school building, which approval is in words and figures as.follo s: Supt. At a meeting of the State Board of MAaeation, held in the Executive Chamber at 11;00 A.M. on June 15, 1928, under authority of Chapter 201, Public Laws of 1925, application for loans from the 1925 Special Building Fund, third installment, were approved for the specific projects mentioned below: C��ou�njj[[ Amount Approved iliFisiff Upper ittle River 39,000,00 2. Use. This money can be used only for the purpose and for the specific project for which each application is approved. (See Chapter 201, Public Te.ws of 1925). 3. "interest charges. This money will be available on the 15th day of December, 1928, but it is necessary that the interest be paid in advance. Under the County Fiscal Control Act, we can no longer deduct from the rincipal sum the amount of interest for one year in advance. The interest at 4t per cent on this loan should, therefore, be included in your May budget. 4. Members ions in regard to N•A• Townsend tax "RESOLVED, That all matters in controversy between the County of Hernett,_Dixie Fire Insurance Company, A.L. Brooks and N.A. Townsend, Trustees be compromised upon the following terms: That the Dixie Fire Insurance Company pay for the years 1923, 1924, and 1925, the sum of 41,584.35,,,, which sum includes the proportional part of the principal and interest of the tax for the years above stated, 412.00 of court cost and 475.00 as attorneyrs fees: Now, therefore, be iti'resolved, that the lands described in the deed from A.L. Brooks and N.A. Townsend, Trustees, to Sarah M. Wade, the deed from A.L. Brooks and N.A. Townsend, Trustees, to S.E. Pope and wife, Inez Pope, and in the deed from A.L.pBrooks and N.A. Townsend, Trustees, to the Trustees of the Dunn Graded School be released from taxation for the years 1923, 1924 and 1925, upon the payment of the aforesaid sum of 41,584.35; and that•the attorney'for Harnett County sign a consent judgment in the matter entitled "County of Harnett vs. J.L. Wade, Dixie Fire Insurance Company and others", said judgment to dismiss the said action against Dixie Fire Insurance Company, A.L. Brooks and N.A. Townsend, Trustees; and that a certified copy of this resolution be forwarded to the Dixie Fire Insurance Company of Greensboro, North Carolina, in lieu of official receipt. Wade listed for taxation in Averasboro township the following tracts: 1 Lot N. Layton Street (res.) 1 Lot W. Broad Street (store/ 1 Lot behind water tank, 1 Lot N. Vance Street, That total valuation of all, four lots was 419,600.00. That your petitioner is the owner of a mortgage on the two first above mentioned, but has no interest in the last two mentioned lots. That your petitioner is informed and advised that the valuation of the first two lots is 418,300.00. That tw pro rata tax on these two lots would be the sum of 4374.30, with n = interest from October 3, ¶.927, which interest amounts to 414.97; that that the pro rata part of said tax lawfully due on said two tracts first above mentioned is, for 1926, the sum of $389.40, which said sum is herewith tendered upon the condition that the two first above mentioned be released from further taxation for the year 1926. Be it resolved that upon consideration by the Board. of County Commissioners of Harnett County, that the foregoing offer of settlement of the Dixie Fire Insurance Company be accepted, and that the first two lots above mentioned be released from further taxation for the year 1926. Voting for said r esolution: Buchanan, Ingram, Byrd, Hockaday. Voting against said resolution: None. It is ordered that the chairman of the Board and the County Attorney be appointed a committee to investigate the budget for various county officers and report at next regular meeting. (June 28) Williams It is ordered that land. of J. Claude ;A..... in Anderson Creek township be reduced to $1750.00 on account of error in acreage of cleared. land. It is ordered that Board adopt resolutions for notes for $10,000.00 and 49,000.00 respectively. All members present voting for said Resolutions. It is or de red that J.S. Hockaday, B.P. Ingram and County Auditor be appointe4 a committee to make settlement with Tax Collector, John Green, of the 1927 collections. (June 28th) 8ESOIUTI0N: Resolved, that the School Budget for 1928 -1929 as prepared by the Board. of Education be not approved, but that the sum of 4259,000.00 to be raised by taxation, to which sum shall be added the equalization fund to be received from the State, all fines, forfeitures and other funds lawfully belonging to the Board of Education, be appropriated for the use of the Board. of Education for operation of schools for a term of six months for the year 1928 -1929.
