May 23, 1938 County met in a call session 'on with J.B.Ennis, Chairman, present T.Noel, Angus A.Cameron, Lonnie R. County Attorney H.C.Str.ickland was It is ordered that County Attorney be directed to sign order of partial non -suit in case of County -vs- L.B.Pope et als so as to release from suit 203.45 acres of land described in Deed of Trust to T.W.Sterrett, Trustee, recorded in Book 245, page 285, Harnett County Registry, for the year 1936 and prior years. It is considered and ordered that the County Attorney be and he is hereby authorized and empowered to deduct the sum of $11.75 from amount of the costs in that action entitled County of Harnett -vs- M.G.Lee and others, being No. 1908, provided the said taxes sued on are paid with costs, interest and penalties. WHEREAS, in that action in the Superior Court of Harnett County, wherein the Town of Dunn is the plaintiff and Mrs.J.F.Wood (Lizzie Wood) and the County of Harnett and others are the defendants, the lands sued on and sought to be foreclosed were offered for sale; at public auction, and that N.M.Johnson became the,last and highest bidder for the .same at the price of the sum "of 41708.00, and that the said sale' was duly confirmed by His Hbnor W.C.Harris, -udge, on May 11, 1938; and whereas, the Board of the Commissioners are of the opinion that the said lands have brought a fair market price, it is ordered as follows: 1. That the County Attorney determine the proportionate part of the said sum of $1708.00 bid by the said. N.M.Johnson, and that he accept the same as full payment of all taxes due the County of Harnett on the said two lots of . land described in that deed from J.Shephard Bryan, Commissioner, to N.IvI.Johnson, dated May 16, 1938, for the year 1938 and the years prior thereto. 2. That upon the receipt of the proportionate part of the said sum of $1708.00 to which the County of Harnett is lawfully-entitled to receive as taxes on the said two lots described in the complaint in this action, .by the said County Attorney, all taxes for the year 1938 and the prior years thereto, shall be deemed and considered fully paid and that the County of `Harnett shall have no claim whatsoever against said property for any taxes for the year 1938 and prior years. Acting upon a report of the Committee composed of Geo.T,Norl and J.S.McLean, it is ordered that valuation of property of Mrs. Novella Hodges, on North Ellis Avenue, in the town of Dunn, be reduced in tax valuation from w2450.00 to $1950.00 on;accountr of error in listing. County Attotney H.C.Strickland was present also. It is ordered that the stock of merchandise of Johnnie Williford, Black River Township, be listed and assessed for taxation for 1938 at 2,000.00. It' is ordered that Aicie R.Byrd, Coats, N.C., be granted license to sell .. beer on premises. It is ordered that beer license be granted L. *Williams, Erwin, N.C.R -1 on premises of Black River Service Station. It is ordered that beer license be granted to Mrs. Otis Aiken, at Angier Cafe, Angier, N.C. It is ordered that the several registrars, poll holders and judges of election and their lawful appointed assistants be paid for their service in connection with the primary held June 4, 1938, when said bills shall have been approved by the Chairman of the County Board of Elections and audited by the Auditor. It appearing that John Moore Lee has placed with the Auditor cheek' covering 1937 taxes and has withdrawn the appeal noted. on Minute Docket ,No. 6, page 531.j It is ordered that the last three sentences of said order be stricken go that valuation will-remain $2100.00 on lot and $2150.00 on house. Upon recommendation of the Sheriff and it appearing that the - townships named below are without the services of constables and that the appointees named below have been nominated to that office, it is ordered that the following be and they are hereby-appointed as constable of their respective townships as set forth below to serve until they or -their successors shall, be elected and qualified; E.B.Beasley Constable in Averasbova Township Fletcher Bethune constable in Lillington Township Otho E.Mangtm constable -in Johnsonville Township PROVIDED, however, that neither of these aforementioned appointees shall serve until they shall each give bond in the sum` of $1,000.00 to be approved by the Board and qualified by taking the, required oaths. It appearing to the Board that taxes on one lot in the town of Dunn, listed in the name of W.Tom Royal for the year 1927 have not been paid and_, that said lot was not sold at general sale for taxes for year 1927 as required by law, and that the sales certificate for said year includes a 40 acre tract listed to W.Tom Royal but does not include the let and that said lot was sold under mortgage or deed of trust, and Mrs. Ora Royal became the purchaser and all taxes were paid except 1927 taxes, and that statement furnished by Auditor's office of a former Administration did not include 1927 taxes and that innocent parties would now- suffer loss if said taxes should be collected by reason of error of the parties in authority at the time. It is ordered that said taxes for year 1927 be and the same are hereby remitted. It is ordered that the tract of land in- Eeotorts Creek Township, listed to Miss Dora Matthewst be reduced in value for the purpose of taxation as follows: 25 acres @ $30.00 per acre; 27* acres C $13.00 per acre; and 10 acres © $6.50 per acre. It is ordered that William Archie West of Anderson Creek Township be admitted to the County Home as an inmate. It is ordered that the tax valuation on 13 3/10 acres of land, listed to Martha WOodall'Pasivia j Averasboro Township, be reduced in valuation from $430.00 to $130.00.
