10071940213 October 7, 1940. A regular meeting of the Board of Commissioners for the County of Harnett, North Carolina, was held at the courthouse in Lillington, North Carolina, the usual place of meeting, on October 7, 1940 at 10:00 O'clock A.M. Present: Chairman J.B.Ennis and Commissioners A.A.Cameron, L.R.Byrd, F.D.Jackson and R.L.Pate. Absent: None. The Chairman announced that this was the date and hour fixed by the Board for the public hearing upon the following bond order: ORDER AUTHORIZING $30,000. REFUNDING SCHOOL BONDS and that the Board would immediately hear any and all citizens and taxpayers who might desire to protest against the issuance of said bonds. No citizen or tarpaper of the County appeared, either in person or by attorney, to protest against the issuance of any of said bonds and the Clerk announced that no protest in writing, signed by any citizen or taxpayer, had been presented. Thereupon, upon motion of Commissioner L.R.Byrd, seconded by Commissioner F.D.Jackson and carried, the order introduced and passed on first reading on September 16, 1940, authorizing $30,000. Refunding School Bonds was read a second time and placed upon its final passage. The vote upon the final passage of said order was: Ayes: A.A.Cameron, L.R.Byrd, F.D.Jackson and R.L.Pate. Noes: None. The Chairman then announced that the order authorizing $30,000. Refunding School bonds had passed. The Clerk was thereupon directed to publish in the Harnett County News, once in each of two successive weeks, the bond order which w as finally passed this day, and to publish at the foot of said bond order the appended note as required by Section 19 of the County Finance Act. Commissioner L.R.Byrd thereupon introduced the following resolution which was read and is as follows: RESOLUTION PROVIDED FOR THE ISSUANCE OF $30,000 REFUNDING SCHOOL BONDS AND PROVIDING FOR THEIR SALE. BE If RESOLVED by the Board of Commissioners for the County of Harnett: Section 1. That the Board of Commissioners, after careful consideration, has ascertained and found and does hereby declare that it is necessary that Harnett County issue all of the bonds authorized by an order finally passed October 7, 1940 authorizing 830,000 Refunding School Bonds. Section 2. That for the purpose of refunding the bonds described in said order finally passed October 7, 1940, the negotiable coupon bonds of the County of Harnett shall be issued in the aggregate principal amount of $30,000 designated "Refunding School Bonds ", consisting of 30 bonds of the denomination of $1,000 each, numbered 1 to 30, inclusive, dated November 1, 1940 and maturing in numerica: order, lowest numbers first as follows: $15,000 on May 1, 1953 and $15,000 on May 1, 1954, without option of prior payment. Section 3. That all of said $30,000 Refunding School Bonds shall bear interest at a rate or rates not exceeding 6% per annum to be determined by the Local Government Commission at the time the bonds are sold, which interest shall be payable semi - annually on the first days of May and November of each year, both principal and interest to be payable at The Chase National Bank of the City of New York in New York City in any coin or currency of the United States of America which at the time of payment is legal tender for public or private debts. Section 4. That all of said $30,000 Refunding School Bonds ahhll be signed by the Chairman of the Board of Commissioners and by the Register of Deeds and ex officio Clerk of said Board, under the corporate seal of said County, and the annexed interest coupons shall be executed with the facsimile signature of said Register of Deeds and ex officio Clerk. Said bonds and coupons and the endorsements to be printed upon the reverse of each bond shall be in substantially the following form: No. $1,000. UNITED STATES OF AMERICA STATE OF NORTH CAROLINA COUNTY OF HARNETT REFUNDING SCHOOL BOND. The County of Harnett, in the State of North Carolina, is justly indebted and for value received hereby promises to pay to the bearer, or, if this bond be registered, to the registered owner hereof, on the first day of May, 19_, 2 4 the principal sum of - -ONE THOUSAND DOLLARS- - together with interest thereon at the rate of per centum per annum, payable semi - annually on the first days of May and NovI er of each year upon the presentation and surrender of the annexed interest coupons as they severally become due. Both principal and interest of this bond are payable -at The Chase National Bank of the City of New York in New York City in any coin or currency of the United States of America which at the time of payment is legal tender for public or private debts. For the prompt payment hereof, both principal and interest as the same shall become due, the full faith and credit of said County are hereby irrevocably pledged. This bond is one of a series issued by said County under and pursuant to the County Finance Act, as amended, and the Local Government act, as amended, and an order and resolutions duly adopted by the Board of Commissioners of said County for the purpose of refunding a like amount of the principal of valid subsisting bonded indebtedness which was lawfully incurred by a school district in said CounLy for the maintenance of the constitutional six months' school term and which has been assumed by said County. It is hereby certified and recited that all acts, conditions and things required to happen, exist and be performed precedent to and in the issuance of this bond by the laws and Constitution of North Carolina, have happened, exist and have been performed in regular and due form and time as so required; that provision has been made for the levy and collection of a direct annual tax upon all taxable property within said County sufficient to pay the principal and interest of this bond as the same shall fall due; and that the total indebtedness of said County, including this bond, does not exceed, and that the total indebtedness of such school district at the creation of the indebtedness refunded hereby, including said indebtedness, did not then exceed, any constitutional or statutory limitation thereon. This bond is registerable as to principal alone in accordance with the provisions endorsed hereon. IN WITNESS WHEREOF, said County of Harnett by order of its Board of Commissioners, has caused this bond to be signed by the Chairman of said Board and by the Register of Deeds of said County and ex officio Clerk of said Board, under the corporate seal of said County, and has caused the annexed interest coupons to be executed with the facsimile signature of said Register of Deeds and ex officio Clerk, all as of the first day of November, 1940. (ENDORSEMENTS ON BONDS) This bond may be registered as to principal in the Bond Register of the County of Harnett, by the Register of Deeds and ex officio Clerk of the Board of Commissioners as Bond Register, or by such other Bond Registrar as may be legally appointed by the governing body of said County, notation of such registry to be made hereon by such Bond Registrar, and this bond may thereafter be transferred on said Bond Register only upon a written assignment of the registered owner or his attorney, duly acknowledged or proved, such transfer to be endorsed hereon by the Bond Registrar. Such transfer may be to bearer and thereby transferability by delivery shall be restored, subject, however, to successive registrations and transfers as before. The principal of this bond, if registered, shall be payable only to the registered owner or his legal representative. Notwithstanding the registration of this bond, the coupons shall remain payable to bearer and shall continue to be transferable by delivery. Section 5. That all of said $30,000 Refunding School Bonds shall be registerable as to principal alone in accordance with the provisions for registration hereinabove provided for endorsement upon said bonds, and the Register of Deeds and ex officio Clerk of the Board of Commissioners is hereby appointed and designated Bond Registrar for the purpose of registering said bonds, subject to the right of this body hereafter to appoint and designate another Registrar. No charge shall be made to any bondholder for the privilege of registration herein granted. Section 6. That the County Accountant is hereby directed to request the Local Government Commission to advertise and sell said bonds. Upon motion of Commissioner L.R.Byrd, seconded by Commissioner A.A.Cameron, the foregoing resolution entitled "Resolution providing for the issuance of $30,000 Refunding School Bonds and providing for their sale" was adopted by the following vote: Ayes: A.A.Cameron, L.R.Byrd, F.D.Jackson and R.L.Pate. Noes: None. Be it resolved that the time within which Lola O'Quinn, Delinquent Tax Collector, has been authorized to receive pre - payment of taxes for the 1940 -41 levy as shown by Minute Docket No. 7, page 179, be extended from October 6, 1940 to include the day October 7, 1940. At the request of the Board of Education the Board of Commissioners authorized the transfer of funds in amount of $1,000.00 from Code 684 -1 to Code 626 -2A. This is to enable the Board to place George Reed Home Economics teachers At Lillington and Angier School. WHEREAS, the County of Harnett entered into a contract with John McArtan whereby it would sell to him the 367 acres of land in Anderson Creek Township Harnett County, North Carolina, under certain conditions and on terms therein stipulated; AND WHEREAS, after due notice by the collector of Delinquent Taxes and revenue for the County, the said John McArtan has failed to abide by the terms of the contract, and has failed to make payment as provided; NOW, THEREFORE, be it resolved that the contract of sale by and between the County of Harnett and John McArtan in respect of the sale of 367 acres of land in Anderson Creek Township, Harnett County, be and it hereby is rescinded and cancelled, and the partial payments made thereunder be forfeited or liquidated damages as in the contract provided. this Resolution relates to that property described in Judgment No. A -1295, office of Clerk of Superior Court of Harnett County. Fifth: And further be it resolved that said W.D.Harrington, Tax Collector of Harnett County for the year 1940 county tax levy, be and he is hereby relieved and discharged from the duty of collecting any taxes prior to the 1940 County levy made by the Board of Commissioners of Harnett County. Sixth: And further be it resolved that said W.D.Harrington be and he is hereby ordered to deposit daily all sums and amounts collected on said 1940 county taxes in the First- Citizens Bank and Trust Company of Dunn, North Carolina, the official depository of the said County of Harnett, to the credit of Harnett County 1940 Tax Distribution Account, and that the said official depository bank shall daily issue to said W.D.Harrington a receipt for such deposits and the said W.D.Harrington shall thereupon daily deliver to the County Accountant each and every of said receipts so received from said depository; and that upon compliance therewith by said Tax Collector, that thereupon he, the said W.D.Harrington, Tax Collector, and his said surety on his said bond, shall be released and relieved of all further liability and responsibility for such amounts or sums so deposited in said depository. Seventh: And be it further resolved that the First - Citizens Bank and Trust Company, Dunn, N.C. Branch, be and the same is designated as the official depository of the County of Harnett, for all funds of said County, including all funds which may be collected by the said W.D.Harrington as Tax Collector of Harnett County for the 1940 County tax levy made by the Board of Commissioners of said County. Eighth: And be it further resolved that the First - Citizens Bank and Trust Company, said depository, be and it is hereby ordered and required to make bond in keeping with the provisions of law to secure all deposits of the County of Harnett, including all sums which may be collected by the said W.D.Harrington, Tax Collector for the 1940 county tax levy and deposited in the said Bank, in a sum of not less than $75,000. to be increased and fixed from time to time as the amounts of deposits at any one time may require, said bond to at all times be in a principal amount aggregating more than the total deposits of said Barnett County on any given date; and in lieu of said bond the said First- Citizens Bank and Trust Company may place in trust with Wachovia Bank and Trust Company, Raleigh, N.C., Trustee, acceptable securities approved by the County Accountant, for the benefit of securing all the deposits of Harnett County in said First - Citizens Bank and Trust Company, the aggregate amount of such securities to be in a sum not less than the bond required by law. NORTH CAROLINA -- Harnett County: RESOLUTION On Motion of Commissioner L.R.Byrd, and seconded by Commissioner F.D.Jackson, anddnly passed and carried, BE IT RESOLVED and ordered by the Board of County Commissioners of Harnett County, as follows: First: That the tax settlement of W.D.Harrington, Tax Collector for the year 1939 county tax levy, together with the insolvent list for said 1939 tax levy, hereto attached and made a part hereof, said insolvent list having been heretofore approved and accpeted, be and the same is hereby accepted and approved, and same is hereby ordered to be recorded in the records of the Minutes of the Board of County Commissioners of Harnett County; Second: And further be it resolved and ordered by the Board of County Commissioners of Harnett County, that the said W.D.Harrington, Tax Collector of Harnett County, for the year 1939 county tax levy, be and he is hereby released and relieved and discharged of and from any and all further liability and responsibility for the collection of any and all delinquent and insolvent taxes for the year 1939 county tax levy; Third: And further be it resolved and ordered that the County Auditor be and he is hereby authorized and directed to execute and deliver any and all necessary and proper instruments for the full and proper clearance and discharge for the said 1939 tax levy, both for the said W.D.Harrington, Tax Collector, and his Assistant Tax Collector, Mrs. Elizabeth Lasater Matthews, and said Maryland Casualty Company of Baltimore, Maryland, Surety on said bonds of said Tax Collector and Assistant. Fourth: And be it further resolved and ordered that said W.D.Harrington, Tax Collector for year 1939 tax levy, and said Mrs.Elizabeth Lasater Matthews, Assistant Tax Collector for said year 1939 tax levy, and said Maryland Casualty Company of Baltimore, Maryland, as Surety on bonds of the said tax Collector and Assistant Tax Collector for year 1939 tax levy, be and they are hereby released and discharged of and from collection of taxes for the year 1939 county tax levy. 219 And it is further ordered that this Resolution be recorded in the records of the Minutes of the County Commissioners of Harnett County. NORTH CAROLINA -- Harnett County: RESOLUTION On motion duly made and carried, BE IT RESOLVED that W.D.Harrington, Tax Collector for the year 1939 county tax levy, be and he is hereby allowed the sum of $1.20 for.each and every land sale made by him for the year 1939 taxes, and salary up to October 1, 1940, and the County Auditor is hereby authorized and directed to pay said W.D.Harrington said sum so allowed herein for land sales of 1939 and salary to said October 1, 1940. And further be it resolved that said W.D.Harrington shall pay out of the compensation herein allowed for said land sales, all expenses whatsoever in connection with said 1939 land sales, including the account of newspapers for publication of said land sale notices. On motion of Commissioner L.R.Byrd, and seconded by Commissioner F.D.Jackson it is hereby ordered by the Board of County Commissioners of Harnett County, that the bond of W.D.Harrington, the duly appointed Tax Collector of Harnett County for the year 1940 tax levy of Harnett County in the sum of $25,000.00, with Maryland Casualty Company of Baltimore, Maryland, as Surety, be and the same is hereby ratified, approved and accepted, and the said bond is hereby ordered to be recorded in the records of the Minutes of the Board of County Commissioners of Harnett County, and same filed with the Clerk of Superior Court of Harnett County. The condition of the foregoing obligation is such, that whereas, the said Principal was duly elected Tax Collector of Harnett County, North Carolina, for the term beginning on the 1st. day of October, 1940, and ending on the 1st. day of October, 1941, and the Board of Commissioners of. Harnett County have delivered to said Principal as such Tax Collector the Tax Duplicate of said Harnett County for the year 1940. Now, therefore, if the said Principal shall well and faithfully perform all and singular the duties incumbent upon him by reason of his election as such Tax Collector of Harnett County, North Carolina, and shall faithfully and diligently attend to the collection of the taxes shown on said tax duplicate and shall exercise due diligence to effect the collection of all such taxes within the time prescribed by law, and shall within the time and in the manner prescribed by law honestly pay over to the Treasurer of Harnett County all moneys coming into his hands or col]e cted by him as such Tax Collector, and shall within the time prescribed by law account and settle with the Treasurer of Harnett County, or other proper official, for all taxes set forth in said Tax Duplicate for said County, except as to such amounts lawfully allowed as deductions; then this obligation shall be null and void, otherwise to remain in full force and effect. Harrington, Tax Collector, Harnett County, N.C., in the penalty of Five Thousand and no /100 Dollars (05,000. 00) to the payment whereof, well and truly to be made and done, the said Principal binds himself his heirs, executors, and administrators, and the said Surety binds itself, its successors and assigns, jointly and severally, firmly by these presents: The Condition of the aforegoing obligation is such, that WHEREAS, the said Principal was elected or appointed Deputy Tax Collector, Harnett County, N.C. for the term beginning on the 1st. day of October, 1940, and ending on the lst. day of October, 1941; NOW, THEREFORE, if the said Principal shall during the term of this bond, well and faithfully perform all and singular the duties incumbent upon him by reason of his election or appointment as said Deputy Tax Collector, Harnett County, N.C. except as hereinafter limited, and honestly account for all moneys coming into her hands as said Deputy Tax Collector, Harnett County, N.C. according to law then this obligation shall be null and void; it is otherwise to be and remain in full force and virtue. This bond is executed by the Surety upon the following express conditions, which shall be a condition precedent to the right of recovery hereunder; It is mutually understood and agreed between all parties hereto that if the Surety shall so elect, this bond may be cancelled by giving thirty (30) days notice in writing to the said W.D.Harrington, Tax Collector, Harnett County, N.C. and this bond shall be deemed cancelled at the expiration of said thirty (30) days, the said Surety remaining liable for all or any act or acts covered by this bond, which may have been committed by the Principal up to the date of such cancellation, under the terms, conditions, and provisions of this bond, and the Surety shall, upon surrender of this bond and its release from all liability thereunder, refund the premium paid, less a pro rata part thereof, for the time this bond shall have been in force.
