090619490 5317 T8p Board of Commissioners of Harnett County met in regular session on Tuesday, Sept. 6th at 10: A M. All members being present except Commissioner Paul E. Tysinger Also present was the County Attorney, the auditor and the Clerk to the Board. The report of Howard Godwin,C.S.C. was approved and ordered filed. The report of Inez Harrington Register of Deeds was approved and ordered filed. The report of D P Ray Jr, Tax Collector was approved and ordered filed. The report of L B McLean Veteran Service Officer was approved and ordered filed. The board approved the bond of D P Ray,Jr. Tax Collector in the amount of $35,000 and ordered the same filed with the Clerk of Superior Court. MARYLAND CASUALTY COMPANY BOND #885726 BALTIMORE KNOW ALL MEN BY THESE PRESENTS, That D P Ray,Jr., Lillington,N.C. as Principal, (hereinafter called Principal) and the Maryland Casualty Co., a corporation of the State of Maryland, having its principal office in the City cf Baltimore, Maryland, as Surety, (hereinafter called the Surety) are held and firmly bourd unto the Board of Commissioners of Harnett County,N.C. (hereinafter called Obligee) in the penalty of Thirty five thousand and nc /100 Dollars($35,000.) to the payment whereof, well and truly to be made and done, the said Principal binds himself, his heirs, executors and administrators, and the said surety binds itsels, its successors and assigns, jointly and severally firmly by these presents. THE CONDITION OF fiE AFOREGOING OBLIGATION IS SUCH, that WHEREAS, the said Principal was elected or appointed Harnett County Tax Collector for the term beginning on the 15th day of August 1949, and ending on the 30th day of June 1950 NOW THEREFORE, if the said Principal shall, during the term of this bond, well and faithfully perform and singular the duties incumbent upon him by reason os his election or appointment to said office, except as hereinafter limited, and honestly account for all moneys coming into his hands, according to law, then this obligation shall be null and void; it is otherwise to be and remain in full fore* and virtue. THIS BOND is executed by the Surety upon the following express conditions, which shall be conditions precedent to the right of recovery hereunder: IT IS MUTUALLY UNDERSTOOD AM AGREED BETWEEN ALL PARTIES HERETO, that if the Surety shall so elect, this bond may be cancelled by giving thirty (30) days' notice in writing to the said Obligee and this bond shall be deemed cancelled at the expiration of said thirty (30) days, the said Surety remaining liable for all or any act or acts covered by this bond which may have been committed by the Principal up to the date of such cancellation, under the terms, conditions and provisions of this bond, and the Surety shall, upon surrender of this bond and its release from all liability thereunder, refund the premium paid, less a pro rata part thereof, for the time this bond shall have been in force. AND IT IS FURTHER MUTUALLY UNDERSTOOD AND AGREED BETWEEN ALL PARTIES HERETO, that the Surety shall not be liable to the said Obligee for fray loss or losses resulting by reason of the failure of the said Principal to collect any portion or all taxes which he may be chargeable to collect by reason of his election or appointment to said office and that said surety shall not be liable for failure of the said principal to take any legal action to collect such taxes. Carson Gregory moved seconded by Fields that a $5.00 food order be allowed per month to Mrs Betty Tew, Coats,N.C. Motion carried. It is ordered that $10 per month be allowed as a general relief to Colon M. Stephens on,Dunn.N.C. Box 244. Carson Gregory moved seconded by C.G. Fields that the above order be given. Motion carried. The Board ordered D P Ray Jr Tax Collector to make a daily deposit of the taxes collected in the First Citizens Bk & Tr Co.,Dunn,N.C. '5_32 C G Fields moved seconded by John Aaron Senter that 14 lots of the M L Jackson property near the negro High School building in the Town of Dunn be sold at public auction for cash, 'provided that Max Mcleod, who has acquired.the interest of the town of Dunn in this property agrees that his interest may be sold in the same manner. Motion carried. C. G. Fields moved seconded by Carson Gregory that the Board authorize IT A Johnson County Attorney to enter a consent Judgment with respect to one 'half of . the Grady property in the Town of Dunn acquired by the County a tax foreclosure entitled "Harnett County vs Mary Grady et als," Judgesifit #A1051, for reasons that the owners thereof were not made a party to the foreclosure suit. The following road petitions were approved and the Clerk to the Board was ordered to forward the same to the State Highway & Public Works Commission.' (1) That the said road from Cools Sprir s Church to Highway No. 421. at Joe Knight's residence, be re+gorked and allwx�6 iff hard urfaced. A distance of 6.6 miles and known as the . "Dee Dee Road" in Upper ittle River Township. (2) To hard surface that portion of road in Grove Township, Harnett County commonly known as the Sorrell aril Tnrlington road, which connects Highway #55 running North and South from Erwin with the Benson and Erwin Road, consisting of approximately one and nine tenths miles. W That certain road in Averasboro Township running from Highway #301 to the state worked highway at Mrs Julia Jernigan Warren's Home and known as the Dickey and Alphin Road a distance of 1 mile be improved or constructed. " 4} That road in Averasboro Township which runs from the Fair Ground Road to Paul Neighbors home a distance of 1'mile be thrown up and graveled. (5) That Road in Stewart's Creek and Anderson Creek and runs from the old Fire Road at W P Dickey's Farm to- thead-ore McLamb's fare a distance of two and one half miles be made an all weather road. (6) That that part of the road over which U S Mail route No. 1 runs from the residence of Theodore McLamb to the Old wire road in Anderson Creek an& Stewart's Creek ownships be improved so that the same may be passable at all times. (7) That that road in Grove Township running from Coats to T Williams home and known as the Williams Road a distance of .4 miles.be_ opened up the connect with the Turlington road. (8) To lay off, open up, and "prepare for travel a.public road beginning at a point .on the old State of Tale graph, road in Harnett County and at or near the point where the nfts Bbah @@d road enters or ; intersects the said Stage road, and a short distance north of the residence of Herman Fish, and thence easterly and as of near the said neighborhood road over the lands °of Cameron parties Ezell Partin,'Milred Partin Carl Partin Corinna Partin, Jeff Woodall B S Adams at als. (9) To take over that part of the old Dunn Lillington Road in Averasboro Township and add to.the State Hi -ghway System the length 'being 1.1 miles.
