0925194319 September 255 1943� The Board of Commissioners met in a call session on Saturday September 25, 1943 at 10:00 o'clock with J.B.Ennis,Chairman, R.L. Pate, Ferd D. Jackson, L.R.Byrd and A.A.Cameron. Also present were H.S. Freeman, H.C. Strickland,W.D.Harrington and Clerk to the Board. _ The two lots in Coats, each 25 by 100 feet, on Ida Street, formerly owned by Grove Township Road Commission and to Which the County of Harnett succeeded in i title, having been advertised n Dunn Dispatch and otherwise as provided by law, in keeping with the order of the Board of Commissioners of Harnett County, and having been offerred for sale at public auction for cash to the highest bidder on Monday, September 20,1943, at the courthouse door in Lillington,N.C., at 12 o'clock Noon when and where W.E.Nichols, through M.O. Lee, his agent, became the highest bidder at the price of $70.00 are hereby ordered conveyed to said W.E.Nichols upon receipt of the sum of $70.00 and the Chairman of the board of Commissioners is authorized and directed to execute deed to the purchaser for same in the name of the County of Harnett, and the Clerk to the Board will attest the sane and affix corporate seal thereto. The Board approved the Bond of W.D.Harrington and ordered same recorded on minutes of this meeting and filed with Clerk of Superior Court. MARYLAND CASUALTY COMPANY -- BALTIMORE KNOW ALL'MEN BY THESE PRESENTS, That William Dalrymple Harrington, Lillington, N.C. as Principal, (hereinafter called Principal) and the Maryland Casualty Company, a corporation of the State of Maryland, having its principal office in the City of Baltimore, Maryland, as Surety, (hereinafter called the Surety) are held and firmly bound unto the State of North Carolina, For Benefit of Board of Commissioners, Harnett County,N.C. in the penalty of Thirty Five Thousand & No /100 Dollars ($35,000.00) to the payment whereof, well and truly to be made and done, the said Principal binds himself, his heirs, executors and administrators, and the said Surety binds itself, its successors and assigns, jointly and severally, firmly by these presents. - THE CONDITION OF THE AFOREGOING OBLIGATION IS SUCH, that WHEREAS, the said Principal was appo'nted Harnett County Tax Collector for the term beginning on t he 15th day of September 1943, and ending on the 15th day of September,1944. NOW, THEREFORE, if the said Principal shall, during the term of this bond, well and faithfully perform all and singular the duties incumbent upon him by reason of his election ar appointment as said Harnett County Tax Collector, except as hereinafter limited, and honestly account for all moneys coming into his hands as said Harnett County Tax Collector obligation shall be null and void; it is otherwise to be and remain in full force and virtue. THIS BOND is executed by the Surety upon the following express cni3itiong which shall be conditions precedent to the right of recovery hereunder: IT IS MUTUALLY UNDERSTOOD AND AGREED BETWEEN ALL PARTIES HERETO, that if the Surety shall so elect, this bond may be cancelled by giving-tlirty (30) days' notice in writing to the said Board of Commissioners, Harnett County,N.C. and this bond shall be deemed cancelled at the expiration of said thirty (30) days, the said Surety remaining liable for all or any act or acts covered by this bond which may have been committed by the rrincipal up to the date of such cancellation, under the terms, conditions and provisions of this bond, and the Surety shall, upon surrender of this bond and its release from all liability thereunder, refund the premium paid, less a pro rata part thereof, ro the time this bond shall have been in force. AND IT IS FURTHER MUTUALLY UNDERSTOOD AND AGREED BETWEEN ALL PARTIES HERETO, that the Surety shall not be liable to said Board of Commissioners, Harnett County for any loss or lesses resulting by reason of the failure of the said Principal to collect any portion or all taxes which he may be chargeable to collect by reason of his election or appointment as said Harnett County Tax Collector and that said Surety shall not be liable for failure of the said principal to tale any legal action to collect suck taxes. AND IT IS FURTHER MUTUALLY UNDERSTOOD AND AGREED BETWEEN ALL THE PARTIES HERETO, that the said Surety shall not be liable to said Board of Commissioners, Harnett County,N.C. for any losses resulting to said Board of Commissioners, Harnett County,N.C. by reason of any public moneys being now on general or special deposit or hereafter placed on general or special deposit by the said Principal, with any bank, depository, or depositories, or by reason of the allowance to or accpetance by said Principal of any in erest thereon, any Law, Decision or Statute of the State of North Carolina or Ordinance of the said Board of Commissioners, Harnett County,N.C. to the contrary notwithstanding. Harrington be and he hereby is appointed Tax Collector for the County of Harnett for the tax year beginning September 15,1943, and ending Sept. 15,1944. 2. That the official bond of W.D.Harrington, the duly appointed Tax Collector of Harnett County, in the sum of $35,000.00, with Maryland Casualty Company as Sunety 1 44, be the bereperiod acceptedeand approved.to and including Sept. 15, s 3' 3. That the compensation of the said W.D.Harrington as Tax Collector be and the same hereby is fixed at the su$ of 'i 31.25 per month, payable monthly, together with travel expense allowance of (125.00 per month, payable monthly; and he shall also be paid and receive all lawful levy and garnishee fees allowed by..law, together with such sums for land sales as shall be allowed and fixed by the Board of County Commissioners; and the expenses in connection with the maintenance of his clerical force, assistants and incidental expenses, will be paid by the County of ,Harnett within the limitations of law and as declared in a resolution adopted by the Board of Commissioners of Harnett County on July 5,1943. 4. That the deisgnations by the Tax Collector of IvaJ.Sloan as his assitant, and.of Lottie Patterson as his cler]A be and the same are hereby approved. 5. That W.D.Harrington,Harnett County Tax Collector, shall deposit daily all amounts collected by him in the Firs Citizens Bank and Trust Company of Dann, N.C. to the credit of Harnett County Tax distribution Account, and that the said depository shall issue dal ley to said Tax Collector a receipt for such deposits, which said receipts shall thereupon be delivered daily to the Harnett County accountant; and that upon compliance with these instructions, the said Tax Collector and his surety on his official bond, shall be relieved of further liability for such amounts or sums as may be depsoited in said depository. 6. That First Citizens Bank & Trust Company of Dunn, N.C., be and the same hereby is designated as the official depository of the County of Harnett for all funds of said County, including all such funds which may be collected by the said W.D.Harrington as Harnett ounty Tax Collector; and the said First Citizens Bank and Truste Company, Depository, shall make bond in keeping with the provisions of law to secure All deposits of the County of Harnett which may be deposited in said Bank, in a sum of not less than $75,000.00 to be increased and fixed from time to time as the amounts of deposits at any one time may require, said bond at all times to be in a principal amount aggregating more than the total deposits of the County of Harnett on any given date; and in lieu of said bond, said depository may place in trust with Wachovia Bank and Trust Company of Raleigh, N.C., Trustee or Central Hanover Bank & Trust Co.,N.Y. acceptable securities approved by the County Accountant, for the purpose of securing all the deposits of Harnett County in said First Citizens Bank and Trust Company, the aggregate, amount of such securities to be a sum notless than the bond required by law. 7. That the following order and command be and the same hereby is ordered delivered to W.D.Harrington, the duly appointed Tax Collector of Harnett County for the year beginning Sept. 15,1943 and ending Sept. 15,1944; "To Hon. W.D.Harrington, Tax Collector of Harnett County: You are hereby ordered and commanded to forthwith proceed with the collection of the 1943 county tax levy made by the County of Harnett, North Carolina. RESOLUTION WHEREAS, W.D.Harrington was appointed and duly qualified as Harnett County Tax Collector for the levy of 1942 county taxes; and WHEREAS, by virtue of a resolution heretofore adopted by the Board of Commissoners of Harnett County, the said W.D.Harrington, as County Tax Collector, was charged With t he d uty of collecting all delinquent taxes and revenues due the County of Harnett, beginning and as of August 1,1943; and WHEREAS, the said W.D.Harrington, as Harnett County Tax Collector for the 1942 county tax levy, has submitted his official insolvent list of persons charged with the payment of taxes to Harnett County for the 1942 county levy, and has made settlement as provided- by law of all items with which he was charged in connection with the 1942 levy of Harnett County taxes; and the said Tax Collector has made full settlement with the County of Harnett for all delinquent taxes collected by him through Septembe 11,1943: NOW, THEREFORE' be it resolved by the Board of Commissioners of Harnett County as follows: • 1. That the list submitted by W.D.Harrington,Harnett County Tax Collector for the county levy of 1942, of insolvents in his final settlement in connection with said levy, be and the same hereby is accepted and approved. 2. That the final settlement of said W.D.Harrington,Harnett County Tax Collector -for the county levy of 1942, having.been examined and found correct, be and the same hereby is accepted and approved. 3. That the accounts and settlement of W.D.Harrington, Harnett County Tax Collector, relating to taxes and revenues other than items in connection with the County tax levy of 1942, particularly including delinquent taxes which became due to the County of Harnett prior to the levy of 1942, having been examined and found correct as of the close of the day on September 11,1943, is hereby accepted and spewed. 4. That subject to the provisions of law, W.D.Harrington, Harnett County Tax Collector for the county levy of 1942, and as the collector of delinquent taxes due Harnett County, for the period ending at the close of Setpember 11,1943, together with the surety on his official bonds covering liability for the 1942 county tax levy and the collection of delinquent taxes from August 1,1943, to and including September 11,1943, to wit, Maryland Casualty Company of Baltimore, Maryland, be and they are hereby relieved of liability during said periods. 5. That Lottie Patterson, who during the collection of taxes due the County of Harnett under the 1942 county t ax levy served as assistant to W.D.Harrington, Tax Collector, and Maryland Casualty Company, Surety on her official bond,in connection with said levy, be and they hereby are relieved and released of liability, subject to the provisions of law, her accounts having been audited and found correct. 6. That W.D.Harrington,Harnett County Tax Collector for the year 1942 county tax levy, be and he hereby is allowed the sum of $1.20 for each and every land sale made by him in connection with the county levy of 1942 taxes, and salary up to Oct. 1,1943; provided the said W.D.Harrington shall from the compensation herein allowed for land sales, pay all expenses in connection with said land sales, including the account of newspapers for publication of land sale notices. 7. That this resolution be recorded in the Minutes of the Board of Commissioners of Harnett County. - Adopted and Done by order of the'Board of Commissioners of Harnett County, all members of said Board being present and voting for adoption, this 25 day of Sept., 1943.
