02021970February 2, 1970 Regular Meeting 369 egular Meeting The regular monthly meeting of the Harnett County Board of ■ ebruary 2, 1970 Commissioners convened in the Commissioners' Room, Courthouse, Lillington, North Carolina on Monday, February 2, 1970 at 9:00 a.m. Those present were: Messrs. M. H. Brock, Chairman; D. P. Ray, Jr., Vice- Chairman; C. E. McLamb, Member; W. J. Cotton, Jr., Member; ■ and Gilbert Brown, Member. Also present: Messrs. Herbert D. Carson,Jfr. Clerk to the Board and Gerald Arnold, County Attorney. ■ ALL TO ORDER Chairman Brock called the meeting to order at 9:00 a.m and offered the morning prayer. EADING AND APPROVAL The minutes of the January 5 meeting were read and approved. F MINUTES OHNSONVILLE AREA Item 1. e: County Property Col. G. J. Hooper appeared before the Board on behalf of the ction Pending Johnsonville Ruritan Club and presented a prepared statement outlinin the views of the Club concerning the county property of which the Club had requested that the Board deed to the Johnsonville Ruritan Club at the January meeting of the Board. Col. Hooper expressed the desire of the Club to arrive at an unified position by which the Ruritan Club and the citizens could work together in the community. He indicated that the Ruritan Club was withdrawing its original request that title to the property be conveyed to the Johnsonville Ruritan Club and proposed a four citizen Trustee Board as title holders. He stated that the Johnsonville Ruritan Club still remains dedicated to supporting the community. Appearing with Col. Hooper was Mr. Fred Taylor. Mrs. Albert Stutz appeared before the Board and presented the views of the citizens group which opposes conveying title to the property to the Johnsonville Ruritan Club. Mrs. Stutz expressed the position of the group indicating their desire that the property be owned by the community and be the Johnsonville Community Center. She presented the following specific request to the Board: 1. That insurance be secured on the building. 2. That a temporary Board of Trustees be set up until a decision is reached. The following names were submitted for approval as the temporary Board of Trustees: Mr. Albert Stutz Mr. Johnny Chalmers Mr. Fred Cameron Mr. Fred Taylor 3. That a custodian be appointed and that he be in charge of the key 4. That the building be available for public use on a first come first served basis. Appearing with Mrs. Stutz: D. A. Huffines and Billy E. Cochran ACTION: Chairman Brock informed the group that the Board would take the matter of conveying the property to a Board of Trustees under consideration and advise them of the Board's decision. jIARNETT COUNTY GOOD Item 2. VISITOR: Mr. Alex Brock Item 3. Executive Secretary of Mr. Alex Brock, Executive Secretary of the State Board of the State Board of Elections was formally introduced to the Board of Commissioners by Elections Mr. Alvis Carver, Secretary of the Harnett County Board of Elections.i Mr. Brock expressed his appreciation for the work of the Board of Elections and commended Mr. McRae on his management of the office. He commended the Board of Commissioners on the new office and stated 1 that this office was probably the only one in the state with a private vault TAX COLLECTOR Mr. Earl Jones TAX SUPERVISOR Mr. Thomas Allen Chairman Brock expressed the pleasure of the Board to Mr. Brock for his attendance and extended an invitation to visit in Harnett County at any time and to attend the board meetings when possible. Item 4. Mr. Earl Jones, Tax Collector, reported to the Board on the work' of his department for the previous month. Item 5. Mr. Thomas Allen, Tax Supervisor, presented a report of his depatt- ment. The following refund was submitted for approval: Refund to: Mrs. Joseph L. B. Doucet, Dunn, N.C. For: One 1968 Buick valued at $2950 Amount: $25.25 ACTION: Upon a motion by Commissioner Cotton, upon the recommendatiot of the Tax Supervisor, above refund was approved. Motion was seconded by Commissioner Ray and carried unanimously. Extension, Listing Date: ACTION: Commissioner moved that the date for listing taxes be extended to February 15 and that a day of grace be allowed on February 16 due to the fact that the 15th falls on a Sunday. Motion was seconded by Commissioner Ray and carried unanimously. TAX & WELFARE LIEN Item 6. ATTORNEY'S REPORT The report of the Tax and Welfare Lien Attorney was presented as follows: REPORT: TAX AND WELFARE LIEN ATTORNEY February 2, 1970 COLLECTION ON TAXES: TOTAL AMT. COLLECTED FEE Curt Weathers Upper Little River 3018 $236.97 $10.00 Lathe Burns Johnsonville 3195 631.26 10.09 Report on old tax cases: $868.23 $20.09 An investigation has been made into the McCormick Heirs case (SD 2368{ Judgment NO. A -1327) for taxes during the years 1927 through 1937; the taxes in question were levied on an alleged 75 acre tract of land described as the old "Thompson Hole" tract, and being all the lands of the late Rebecca S. McCormick, which was not divided in the division of her estate. This alleged land was foreclosed in the afore- said lawsuit (SD 2368) and subsequently sold to the County of Harnett (deed recorded in Book 247, Page 230, Harnett County Registry). After checking the records which I have seen, it is my impression that the alleged 75 acres of land does not exist; this reason is probably why the tax matter was not pushed by past County Attorneys. However, I have a reference to some additional deeds that need to be checked before any action be taken by you. I also feel that some discussion with an elderly person familiar with the McCormick lands needs to be made by our office or the tax supervisor or tax collector. I shall look after this matter. In conclusion, I feel that in most of these old tax cases an investigation will show that the accounts outstanding are uncollectable. However, I could not, at this time, recommend that you should write these old tax accounts off before some investigation is made to discover the facts relating to each case. Regular Meeting - February 2, 1970 _____,:__ ax & Welfare, con'td Mr. Carson has requested that all these cases be terminated in some fashion before the end of this fiscal year. I feel that we will be able to investigate these cases and, at least, terminate the uncollectable ones by that time. EPORT: Item 7. ommissioner Commissioner McLamb briefed the Board on the following matters: cLamb 1. The status of the Raven Rock Project. 2. Mr. McLamb reported that 28 projects had been approved by the Highway Commission for Harnett County since 1 July. 3. County participation in federal grants. Mr. McLamb briefed the Board on funds for educable children and the possibility of such schooling and /or training for Harnett County. UILDING AND GROUNDS Item 8. r. Ray & Mr. Brown Commissioners Ray and Brown, Building and Grounds Committee members reported the following: OAD PETITIONS 1. Repair on the welfare building has been negotiated. 2. The flooring has been installed in the Board of Elections office. 3. Furnishings for the ladies lounge in the courthouse will be secured by the committee. 4. The roof on the Harnett County Library has been repaired. Item 9. Mr. Earnest C. Carter appeared before the Board requesting assistance with a problem of drainage onto his property. Commissioner McLamb will contact the Highway Commission and take care of this matter. OUNTY ATTORNEY'S Item 9. EPORT Mr. Gerald Arnold, County Attorney, reported on the following matters: lisposition of 1. Harnett County versus R. D. Hamilton, et al. 1amilton case. HAIRMAN'S REPORT ACTION: Commissioner Brown moved "that upon the recommendation of the County Attorney, Mr. Arnold, the Board accept the $50 check tendered by Mr. Hamilton and take a direct verdict of non -suit in the case of Harnett County versus R. D. Hamilton, et al." Motion was seconded by Commissioner Cotton and carried unanimousl 2. Harnett County Livestock & Poultry Cooperative, Inc. ACTION: The Board instructed Mr. Arnold to proceed with filing an answer to this suit. Item 11. Chairman Brock reported the following matters to the Board: 1. Mental Health Building: A change order for the contract completio date on the Mental Health Building was presented as following resoluti states: ACTION: Commissioner Ray moved the adoption of the following resolutio RESOLVED, That the Harnett County Board of Commissioners hereby approves change orders numbers M -2, E -2 and P -1 for the contract completion date of the Harnett County Mental Health Building from December 19, 1969 to February 17, 1970 in view of the fact that the North Carolina Medical Care Commission approves this action; be it further resolved that this Board will not entertain any further request for extension of time on the completion date of this project. Motion was seconded by Commission McLamb and carried unanimously. 2. Chairman Brock read a note of appreciation from the family of Mr. Henry Strickland (deceased). 3. Chairman Brock reported that a meeting with the Board and department heads will be held during the coming week to discuss programs and projects of the departments. n n:' 372 Regular Meeting- February 2, 1970 4.
