The Chairman, Bobby: ir Etheridge, called the meeting to order at 7 :30,P.M., with all members present, the Clerk and the Attorney. HOMAS ALLEN ax Supervisor Thomas Allen, Tax Supervisor came before the Board to request that tax listing be allowed in the various townships until. February 13, 1976, as is already official and .then 'an °'extension be granted to allow listing in the Office of the Tax Supervisor through March 1, 1976, without penalty. Commissioner Stewart moved that tax lien-mg without, penalty be, allowed from the Tax Supervisor's office from February 16, 1976 through March 1, 1976. Commissioner Cotton` seconded the motion and the issue passed. QUESTS FOR EXTENSION OF :TIME' FOR FILING ONF. INV. Mr. 'Allen presented a list of companies who had written to receive an-extension of time for filing Confidential Inventory listings through March 31, 1976. Mr. Allen presented a request for- refund from Norris Auto & Trust-, Clinic; Averasboro Township, for`listing:error on Confidential statement:, Commissioner Alphin moved the request of $229.60 be granted,' Commissioner Cotton seconded and the issue carried. Mr. Allen :presented requests -for relief' of penalty for the following persons in that late postmarking of their mail to the Tax Office subjected them to the imposition of the late listing penalty -.. FFICE OF CIVIL PREPAREDNESS BUDGET PROPOSAL Thomas Lanier, Assistant Civil-Defense :Director, presented a pro - posed budget projection'for the Harnett County Office of Civil Preparedness forthe years 1977'and 1978. This proposal is nec- 'essary'because of future planning. Commissioner Brock moved to approve'the budget as presented' subject to -the- county budget in June, for the'years 1977 and 1978. Commissioner Alphin seconded and the issue - :carried. 1' ARNETT COUNTY RECRUITMENT ROGRAM A resolution from }Ienry.T..Avants, Cape Fear-Planning Region, relative to.the..Harnett "County Recruitment'Program'as to its continuance was.presented to the Board of- Commissioners for action. :Commissioner Alphin moved' to. adopt the resolution, Com- missioner- .Brock seconded and the issue - passed. tt ;TAX ATTORNEY MASSAGE PARLORS RESOLUTION WHEREAS, a petition has been presented requesting that Saints Street, Ponderosa Subdivision, Section IV, be subjected to an investigative report by the Department of Transportation to determine if this described road met eligibility requirements to be added to the State Secondary Road System, and WHEREAS, notification has been received from E.J. Butler, Division Engineer and N. C. Blackmon, Division Staff Engineer of the North Carolina Department of Transportation, stating the road des- cribed above does meet the eligibility requirements for addition to the State Secondary Road System for Maintenance, NOW, THEREFORE, it is hereby resolved by the Harnett County Board of Commissioners, based on the recommendation of the Division Eng- ineer and the Division Staff Engineer, that the request for addition to the system for Saints Street, Ponderosa Subdivision be approved. It having appeared to the Board of Commissioners that a proposed massage parlor ordinance entitled "Ordinance of the County of Harnett" was introduced at a meeting of the Board of Commissioners held on November 3, 1975, by Commissioner W. J. Cotton, Jr., and it further having appeared to the Board that this meeting of Commissioners on January 19, 1976, is a meeting of the Board held within 100 days after introduction of the proposed massage parlor ordinance and it further appearing to the Board of Commissioners that three of its five members constitute a quorum pursuant to existing law (N.C.G.S. 153A -43), it was then moved by Commissioner W. J. Cotton, Jr., and seconded by Commissioner Jesse Alphin that the following ordinance entit- led "An Ordinance Regulating the Business of Massage and Mass- age Parlors" be adopted: ORDINANCE OF THE COUNTY OF HARNETT TITLE: AN ORDINANCE REGULATING THE BUSINESS OF MASSAGE AND MASSAGE PARLORS L. Definitions. (a) "Massagist" (either male or female). One who offers to massage another for a salary or fee. (b) "Massage parlor." Any place of business where massagists are employed to offer massage for a salary or fee. 2. Licensed health professionals excluded. Licensed health progessionals acting in the ordinary course of their profession are neither " massagists" as defined in paragraph 1(a) nor owners of "massage parlors" as defined in paragraph 1(b). 3. License required. A person may not (a) work as a massagist or (b) operate a massage parlor unless licensed. 4. Issuing of licenses, fee required. The Sheriff shall issue a license to any eligible person who pays an annual fee of $50.00, ( FIFTY - - -- Dollars) for a massagist's license or of $500.00 (FIVE HUNDRED Dollars) for a 548 massage parlor license. Such-licenses shall be valid for one year only and must be renewed annually. 5. Persons ineligib'le:for.licenses. The following persons muy not be licensed to work as a masaagist or to hold.a massage parlor.license: (a) A person who has been vonvicted.of :a crime: involving sexual mis- conduct including but not limited to those.covered by G.S. 14, Article.26 (Offenses Against Public Morality and Decency) and G.S. 14, Article 26 (Prostitution). (b) .A person under 18. (c) A person convicted 'of violating this ordinance. 6. Posting required. (a) The Sheriff shall provide a copy -of. this ordinance for posting to each massage parlor licensee upon licensing. (b) Each massage-parlor licensee shall display in 'a prominent place the license issued pursuant to this-ordinance together with a copy of this ordinance. (c) Each massagist shall'post his licenserin his work area. 7. Fingerprinting?_ required... An applicant for -'a license shall submit to fingerprinting. The fingerprints may be sent to the S.B.I., F.B.I.; or other appropriate law enforcement agencies. 8. Prohibitions and limitations. (a) Minimum Age: (1) No person in the business of massage -may massage a person under 18 except under the direction of or by order of a licensed health-professional. (2) No person may employ one under 18 to work as- a`massagist. • (b) -Limitation *on hours of operation. Massage parlors may operate only between. the •hours of 8o *clock a.m.. and 10 o'clock p.m. (c) Limitation on scope of massage. No massagist may in the course of business massage the penis, scrotum, mons veneris, vulva, or vaginal area of another. (d) Inducement to:violate •ordinances or provisions of General Statutes relating to sexual misconduct. `No-person may induce a' licensee or :employee.or agent thereof to violate this ordinance or'.any, provision of the General Statutes of North Carolina pertaining to sexual misconduct including butnot limited to that covered by G.S. 14, Article 26 :(Offenses Against Public Morality and Decemcy), and G.S. 14, Article 27 (Prostitution). (e) Licensee required tosupervise: Massage parlor licensees shall supervise the conduct of massagists in their employ.- Failure to suppress illegal activity is grounds -for revocation of.a license. 9. Massage parlors :subject to inspection. The Sheriff or any member of his. department may ' inspect :massage,business.premises during the hours that they are ..open for business. 8 10. REVOCATION. DUE iPROCESS .HEARING. (a) The Board of Commissioners of Harnett County shall revoke the license of any licensee who has been convicted of: (1) a crime in- volving sexual: misconduct including but not limited to those- :.covered by G.S. 14, Article 26 (Offenses Against Public Morality and Decency) and G.S. 14, Article 27 (Prostitution), or (2) this ordinance. (b) Any revocation shall be made only after written notice of the grounds for revocation has been given to the licensee and he has had an opportunity to answer the charges in a hearing before the Board of Commissioners. (c) At a license revocation hearing conducted pursuant to § 10(a) the Board shall consider only a licensee's final conviction of (1) a crime involving sexual misconduct including but not limited to those covered by G.S. 14, Article 26 (Offenses Against Public Morality and Decency) and G.S. 14, Article 27 (Prostitution), or (2) this ordinance. (d) The Board of Commissioners may revoke the license of any licensee who is found to have failed to supervise the conduct of massagists in his employ as provided for in § 8(e). (e) At a license revocation hearing conducted pursuant to § 10(d) the Board shall consider any competent evidence. 11. Violation a Misdemeanor. Violation of this ordinance is punishable by a fine of not more than $50.00 (Fifty Dollars) or imprisonment for not more than 30 (thirty) days. 12. Injunctive relief available. This ordinance may be enforced by any appropriate equitable remedy as authorized by G.S. 153A -123. § 13. SEVERABILITY. If any provision of this ordinance or its application to any person or circumstances is held invalid, such invalidy shall not affect other provisions or applications of the ordinance which can be given effect without the invalid provision or application, and to this end the provisions of this ordinance are declared to be severable. § 14. EFFECTIVE DATE. (a) This ordinance is effective from its adoption and so long as any part of the ordinance entitled AN ORDINANCE REGULATING THE BUSINESS OF MASSAGE AND MASSAGE PARLORS adopted August 4, 1975, is held to be invalid by any court of competent jurisdiction. (b) Nothing herein shall be construed to repeal the ordinance entitled AN ORDINANCE REGULATING THE BUSINESS OF MASSAGE AND MASSAGE PARLORS adopted August 4, 1975, or to abandon any right to appeal from any determination of invalidity of that ordinance by any court of competent jurisdiction. That ordinance is expressly declared to remain in full force and effect. (c) This ordinance shall be in full force and effect only for such time as the County or its officers are judicially restrained from enforcing the ordinance adopted August 4, 1975. (d) Upon a judicial determination that the ordinance of August 4, 1975, is not invalid or a lifting of restraints against its enforcement, this ordinance shall be void. 550 ACTION The-foregoing.ordinance entitled "An:Ordinance Regulating the business of Massage and'Massage'Parlors" was adopted by a vote of :5 to 0. The Commissioners, voting for the adoption of: the ordinance on this 19th day of January, 1976, were: Commissioners Jesse Alphin, W. J. Cotton, Jr., M. H. Brock, Lloyd.G..'Stewart and Chairman -Etheridge. POLICY ON COLLECTING AND REFUNDING FEES Commissioner Brock made the, following motion relating to the Policy°:on Collecting and .Refunding': 'I Move that the Policy on,Collectina and'Refunding fees for Massagist License and Massage Parlor_ Licensing.. adopted :by the Board on September .15, 1975, continue in effect with respect to the Ordinance Regulating the Business °of`Massage and Massage Parlors adopted this date and that the application form for Massagists and Massage Parlor Operators approved on Sept- ember :15, 1975, be used as the approved application form. Commissioner .Alphin seconded the motion and those voting in favor were Commissioners Brock, Alphin, Cotton, Stewart, and the Chairman. Those voting.against :were none. ANNOUNCEMENT The following announcement was then made by the Board for the benefit of the news media and the group in attendance. "The ordinance, by its terms, is effective immediately. I understand from the Sheriff, however, that he plans to allow 30 days for completing the license, application process. He has the necessary forms to issue license immediately." DRAFT FOR SUBDIVISION. REGULATIONS The County Manager presented the. Board with a draft study for - subdivision regulations. SPACE NEEDS Regarding space :needs,.after general :discussion, the Board agreedto meet on Wednesday, January 21, 1976, 7:30 P.M. for -a working session to deal with space needs and problems. RE PUBLIC HEARING FOR AIRPORT The Chairman gave a letter to the members from John Talbert, Consulting Engineers regarding a, public hearing for the proposed Harnett County Airport. Commissioner Cotton moved that the Department of Transportation be contacted to determine the date of the public hearing and to deter- mine the advertising of the hearing.
