MEETING OF THE BOARD OF COMMISSIONERS FOR AUGUST 19, 1974
Mid -Month Meeting The Commissioners met for the regular mid -month meeting of the Board
on August 19, 1974, in the Commissioners Room, Courthouse. Chair-
man Brock called the meeting to order at 7 :30 p.m., and the foll-
owing members were present: Commissioners Brown, Cotton and
Etheridge. County Attorney McCormick was in attendance.

Mr. Richard Wallace, FHA Representative, and Mr. Roy Spainhour
from Moore - Gardner & Associates were present regarding the Harnett
County Water System. Mr. Wallace presented the following document:
1. Letter of Conditions to be agreed upon by the Board of
Commissioners.
2. Form 442 -46, Letter of Intent to meet Conditions.
3. Form 442 -7, Initial Operating Budget.
4. Form 440 -1, Payment Authorization, stating a grant in the
amount of $489,000.
5. Form 440 -1, stating a loan of $4,500,000. at 5% interest.
6. Form 442 -47, Loan Resolution to borrow $4,500,000.
7. Form 442 -31, Association Water or Sewer System Grant Agree.
Commissioner Cotton moved to adopt the foregoing resolution and
documents as set forth, and to extend authorization to the Assist-
ant Clerk to the Board and the Chairman of the Board to execute
the documents, Commissioner Etheridge seconded the motion and the
issue passed.
James Goff, Chairman of the Extension Department, informed the
Board of Neil Conoley's resignation effective August 31, 1974, and
of Robert Rowland, possible replacement for the vacancy. Mr. Goff
presented pertinent information relating to Mr. Rowland. The
Board agreed to make a definite decision by Wednesday, August
21, 1974.
Mr. Goff mentioned the vacancy created by the resignation of Mrs.
Hall, and indicated that Mrs. Lorena Jackson had been recommend-
ed to fill the vacancy. The Board offered no objections.
;NEW BUILDING
REPORT Mr. Brock gave a progress report on the building and the furnish-
ings. He said the blinds are expected to be installed by Sept-
ember 1, 1974, and a few minor problems to be corrected also by
that time. The Commissioners decided to set a moving date at their
September 3, 1974 meeting.

BID OPENING
Mr. Brock informed the Board that the Cook, Gladys Walker, and Mrs:
Sturgill were both exceeding the prescribed 40 -hour work week.
The Board agreed to take the matter up at the September meeting,
after having received time cards from the two persons, and
render a decision at that time.
At precisely 8:30 p.m., the Chairman declared the time for opening
the bids for the furnishing of Microfilm for the Register of Deeds
Office. The Chairman informed the Board that this was the second
letting of the bid for microfilm, for the first bid opening an
insufficient number of bids were received, therefore allowing some
flexibility in the second opening. The bid for microfilm was from
Eastman Kodak Company , in the amount of $20,619.87 including tax, .
bid bond $991.34, bid under seal, delivery within 15 to 45 days
and one -year warranty for equipment and labor. The bid was de-
clared to be in accordance with the county proposal.
Commissioner Cotton moved the bid from Eastman Kodak Company be
accepted and awarded this date, August 19, 1974, and that author-
ization to execute the contract be granted to the Assistant Clerk
to the Board and the Chairman of the Board. Commissioner Etheridge
seconded the move and it passed unanimously.
METAL BUILDING
BIDS The bids for the metal buildings were opened next and are ?_recorded
as follows:
Snead & Hatcher, Rockingham, $26,852. Sealed Bid - Bid Bond Included
No bid on electricity, plumbing or heating.
Metal Building System of North Carolina, Inc. $31,973. Sealed Bid,
Bid Bond Included.
No bid on electricity, plumbing or heating.
Ellis Construction Company, Inc., $37,270. Sealed Bid - Bid Bond
Included.
No bid on electricity, plumbing or heating.
Commissioner Etheridge moved that Snead & Hatchers' bid be accepted

Dear Mr. Brock:
This letter estblishes conditions which must be understood and
agreed to by you before further consideration may be given to
this application.
This letter is not to be considered as loan approval or as a rep-
resentation as to the availability of funds. The docket may be
completed on the basis of a loan not to exceed $4,500,000 and a
development grant not to exceed $489,000. If FmHA makes the loan,
the interest rate will be that charged by FmHA at the time of the
loan approval.
Please complete and return the attached Form FmHA 442 -46, if you
desire that further consideration be given your application.
If the conditions set forth in this letter are not met within ten
months from the date hereof, FmHA reserves the right to discontinue
the processing of the application.
1. Repayment Schedule
The insured loan will be scheduled for repayment over a peri-
od of 40 years. The first two installments will be for inter-
est only. Each installment will be due June 1 with the first
installment due the first June 1 following the date of loan
closing or delivery of the bond.
2. Interim Financing
The county will obtain temporary construction financing in
accordance with FmHA Instruction 442.1, Appendix A, SS1823.13
and North Carolina Instruction 442.1A, Appendix A, Paragraph
VI. Interim financing will be obtained through the sale of
bond anticipation notes with the assistance of the N. C. Lo-
cal Government Commission.

3. Security
Security for the loan will consist of a general obligation
water bond authorized and prepared in accordance with FmHA
Instruction 442.1, Appendix C. Farmers Home Administration
will negotiate the purchase of the bond with the applicant
and the North Carolina Local Government Commission. The
Commission reserves the right to require a public offering
of the bond.
4. Organization
The county must provide a certification concerning its or-
ganization, authority to issue bonds and compliance with spe-
cial laws and regulations in accordance with FmHA Instruction
442.1, Appendix A, 51823.10.
5. Accounting, Audits and Reports
Accounting and auditing will be established and maintained
in accordance with the requirements of North Carolina Gen-
eral Statutes. A copy of the annual audit report will be
provided FmHA in accordance with North Carolina Instruction
442.1, Appendix A, E1823.14, paragraph (f).
6. Insurance and Bonding
State Statutes and FmHA Instruction 442.1, Appendix A, 81823.9,
paragraphs (a), (b) and (c).
The amount and types of insurance should be determined by the
attorney and engineer to adequately protect the county.
7. Construction Contract Documents and Final Plans
These must be completed in accordance with the requirements
of FmHA Instruction 442.1, Appendix B.
8. Loan Resolution and Grant Agreement
The county must formally adopt Form FmHA 442 -47, Loan Resolu-
tion and Form FmHA 442 -31, Association Water or Sewer System
Grant Agreement, at a proper meeting of the governing body.
Adoption of these documents should be made a part of the of-
ficial minutes of the county.

.9. Operating Budget
A water system operating budget must be adopted by the coun-
ty after approval by Farmers Home Administration.
10. Rules and Regulations
Water system rules and regulations must be submitted to Farm -
ers Home Administration for approval prior to loan closing.
11. Evidence of Grant Offer
Evidence of the grant offer from the State of North Carolina
must be furnished FmHA prior to the start of construction.
12. Closing Instruction
The loan will be closed in accordance with instructions is-
sued by the Office of the General Counsel and applicable FmHA
at and State procedures.
13. Other Conditions
All applicable items set out in Form FmHA -NC 442 -13, Process-
ing Checklist, Public Body, apply to this project and become
a part of the Letter of Conditions.

WHEREAS, it is necessary for the COMITY OF HART ETT

(herein after called association) to raise a portion of the cost of such undertaking by issuance of its bonds in the principal amount of

WHEREAS; the association intends to obtain assistance from the Farmers Horne Administration, United States Department of
Agriculture, (herein called. the Government) acting under the provisions of the consolidated Farmers Home Administration Act of
1961', as amended( 7 U.S.t. 1921 et seq.) in the planning, financing, and supervision of such undertaking and to purchase the
bonds lawfully issued, in the event that no other acceptable purchaser for such bonds is found by the association:
NOW THEREFORE, in consideration of the premises the association hereby resolves:
^' t. 1. To have prepared on its behalf and to adopt an ordinance or resolution for the issuance of its bonds and containing such
items and in such forms as are required by STATE statutes and as arc agreeable and acceptable to the Government.
2.. To provide for a public sale after due advertisement of such bonds in a manner consistent with applicable State statutes
and acceptable to the Government.
3. To refinance the unpaid balance, in whole or in part, of its bonds upon the request of the Government if at any time
""" it shall appear to the Government that the association is able to refinance its bonds by obtaining a loan for such purposes
from responsible cooperative or private sources at reasonable rates and terms for loans for similar purposes and periods of
time as required by section 333 (c) of said Consolidated Farm and Rural Development Act ( 7. U.S.C. 1983(c)).
4. To provide for, execute, and comply with Form FHA 4004, "Nondiscrimination Agreement ": and Form FHA 400 -1,'
"Equal Opportunity Agreement ", including an "Equal Opportunity Clause ", which clause is to be incorporated in, or
attached as a rider to, each construction contract and subcontract involving in excess of 510,000.
5. To indemnify the Government for any payments made or losses suffered by the Government on behalf of the association.
6. That upon default in the payments of any principal and accrued interest on the bonds or in the performance of any
covenant or agreement contained herein or in the instruments incident to making or insuring the loan, the Government,
at its option may (a) declare the entire principal amount then outstanding and accured interest immediately due and
payable, (b) for the account of the association incur and pay reasonable expenses for repair, maintenance, and operation
of the system and such other reasonable expenses as may be necessary to cure the cause of default, and/or (c) take
possession of the system, repair, maintain, and operate or rent it. Default under the provisions of this Resolution or any
instrument incident to the making or insuring of the loan may be construed by the Government to constitute default
under any other instrument held by the Government and executed or assumed by the association, and default under any
such instrument may be construed by the Government to constitute default hereunder.
7. Not to sell, transfer, lease, or otherwise encumber the system or any portion thereof, or interest therein, nor permit others
to do so, without the prior written consent of the Government.
8. Not to borrow any money from any source, enter into any contract or agreement, or incur any other liabilities in
connection with making enlargements, improvements or extensions to, or for any other purpose in connection, with, the
system (exclusive of normal maintenance) without the prior written consent of the Government.
9. To place the proceeds of the bonds on deposit in an account, in a bank, and in a manner approved by the Government.

10..' To comply with all applicable State and Federal laws and regulations and to continually operate and maintain the system
in good condition.
To provide for the receipt of adequate revenues to meet the requirements of debt service, operation and maintenance,
and the establishment of adequate reserves: No free service or use of the system will be permitted.
i2. To acquire and maintain such insurance coverage including fidelity bonds as may be required by the Government.
13. To establish and maintain such books and records relating to the operation of the system and its financial affairs and to
provide for the annual audit thereof in such a manner as may be required by the Government, to provide the. Government
without its request copy of each such audit, and to make and forward to the Government such additional information
and reports as it may from time to time require.
34. To provide the Government at all reasonable times access to all books and records relating to the system and access to
the property of the system so that the Government may ascertain that . the association is complying with the provisions
hereof and' of the instruments incident to the making or insuring of the loan.
15. To serve any applicant within the service area who desires service and can be feasibly and legally served, and to obtain
the concurrence of the Farmers Home Administration prior to refusing service to such applicant.
The - provisions hereof and the provisions of all instruments incident to the making or the insuring of the loan unless otherwise
specifically provided by the terms of such instruments, shall be binding upon the association as long as the bonds are held or insured
by the Government. The provisions of sections 7 through 13 hereof may be provided for in more specific detail in the bond
resolution or ordinances to the. extent that the provisions contained in such bond resolution or ordinance should be found to be
inconsistent with the provisions hereof, these provisions shall be construed as controlling as between the association and the
Government.

NOW, THEREFORE, In consideration of said grant by Grantor to Grantee, to be made pursuant to section 306 (a) of the
Consolidated Farmers Home Administration Act of 1961 for the purpose only of defraying a part not to exceed
percent of the development costs, as defined by applicable Farmers Home Administration instructions:
Grantee agrees that Grantee will
1. Cause said project to be constructed within the total sums available to it, including said grant, in accordance with
the project plans and specifications and any necessary modifications thereof prepared by Grantee and approved by
Grantor.
2. Permit periodic inspection of the construction by a designated representative of Grantor during construction.
3. Manage, operate and maintain the system, including this project if less than the whole of said system, continuously
in an efficient and economical meaner.
4. Make the services of said system available within .its capacity to all persons in Grantee's service area without
discrimination as to race, color, religion, or national origin, at reasonable charges, including assessments, taxes,
or fees in accordance with a schedule of such charges, whether for one or more classes of service, adopted by
resolution dated. August 19___-- _---- _- - - - - -_ , 19- �4!_ - -.- , as may be modified from time to time by Grantee.
The initial rate schedule must be approved by Grantor. Thereafter Grantee may make such modifications to the rate
schedule as Grantee deems necessary to efficiently and economically provide for the financial requirements of the
system as long as the rate schedule remains reasonable and nondiscriminatory.
5. Adjust its operating costs and service charges from time to time to provide for adequate operation and maintenance,
emergency repair reserves, obsolescence reserves, debt service and debt service reserves.
6. Expand its system from time to time to meet reasonably anticipated growth or service requirements in the area within
its jurisdiction.
7. Not transfer or dispose of the system, or any part thereof, being constructed or improved with such grant funds without
the written consent of Grantor, and not encumber the project for a period of five years from the date hereof without
the written consent of the Grantor,
& Provide Grantor with such periodic reports as it may require and permit periodic inspection of its operations by a
designated representative of the Grantor.

9. To execute Form FHA. 400-1, "Equal Opportunity Agreement," to which is annexed a Form FHA 400-2, "Equal
Opportunity Clause," and to incorporate in or attach as a rider to each construction contract for the project
involving. $10,000 or more a Form FHA 400-2; to execute Form FHA 400-4, "Nondiscrimination Agreement," and
to execute any other agreements required by Grantor which Grantee is legally authorized to execute. If any such
Form has been executed by Grantee as a result of a loan being made to Grantee by Grantor contemporaneously with
the making of this grant, another Form of the same type need not be executed in connection with this grant.
10. Upon any default under its representations or agreements set forth in this instrument, Grantee, at the option and
demand of Grantor, -will, to the extent legally permissible, repay to Grantor forthwith the original principal amount
of the grant stated hereinabove, with interest at the rate. of 5 percentum per annum from the date of the default. The
provisions of this Grant. Agreement may be enforced by Grantor, at its option and without regard to prior waivers by
it of previous defaults of Grantee, by judicial proceedings to require specific :. performance of the ternis of this Grant
Agreement or by such other proceedings in law or equity, in either Federal or State courts, as may be deemed
necessary by Grantor to assure compliance with the provisions of this Grant Agreement and the laws and regulations
Grantor agrees that twill:
1. Make available to Grantee fox the purpose of this agreement not to exceed $ 'bB93000.09 which 4,
will advance:. to Grantee to meet not to exceed e .5 .._ percent of the development costs of the project itt
accordance with the actual needs of Grantee as determined by Grantor.
Any grant funds actnaily advanced and not needed by Grantee for approved purposes shall be returned immediately to
Grantor, as required by the regulations of .Grantee.
2,.Assist Grantee, within avaflable appropriations, with such technical assistance as Grantor deems appropriate in
planning the project and coordinating the plan with local official comprehensive plans for sewer and water and with
any State or area plans for the area in which the project is located.
3. In its sole d4'scretion, Grantor may at any time give any consent, deferment, subordination, release, satisfaction, or
termination of any or all of Grantee's grant obligations, with or without valuable consideration, upon such terms
and conditions as Grantor may determine to be (a) advisable to further the purposes of the grant or to protect
Grantor's financial interest therein and (b) consistent with both the statutory purposes of the grant and the limita-
tions of the statutory authority under which it is made.

Keep such records and submit to the Government such timely, complete, and accurate compliance reports at such
times and in such form and containing such information as the Government may determine to be necessary to ascertain
Recipient's compliance with this agreement and the regulations; and
(b) permit access by authorized employees of the Farmers Home Administration or the Department during normal business
hours to such of Recipient's books, records, accounts, and other sources of information and its facilities as may
be pertinent to ascertaining such compliance; and
(c) make available to users, participants, beneficiaries, and other interested persons such information regarding the
provisions of this agreement and the regulations, and in such manner, as the Farmers Home Administration or the
Department finds necessary to inform such persons of the protection assured them against discrimination.
4. The obligations of this agreement shall continue — —
(a) As to any real property, including any structure, provided with the aid of the loan or advance, so long as such
real property is used for a purpose for which the loan or advance is made or which affords similar services or
benefits.
(b) As to any personal property provided with the aid of the loan or advance, so long as Recipient retains ownership
or pcssession of the property.
(c) As to any other aided facility or activity, until the last advance of funds under the loan or advance has been made.

5. Upon any breach or violation of this agreement the Government may, at its - option — . .
(a) Terminate or refuse to render or continue financial assistance to Recipient or for the aid of the property, facility,
project, service, or activity.
;: (b) In case of a loan, accelerate the maturity of the indebtedness.
(c) Appoint a receiver, or have a receiver :appointed, to take possession of and administer the aided facility or activity
in order to secure compliance with this agreement and the regulations. For this purpose Recipient hereby appoints.
the Government its agent and attorney -in -fact with power, in . event of such breach or violation, so to take possession
of and administer or to appoint such receiver. This appointment is coupled with an interest and shall be irrevocable
while the obligations of this agreement continue. -:
(d) Enforce this agreement by suit for specific performance or by any other available remedy under the laws of the
United States or the State in which the breach or violation occurs.
Rights and remedies provided for under this agreement shall be cumulative.

authorized officers and its seal affixed hereto, or if a natural person, has hereunto set Recipient's hand and seal.

Agriculture, pursuant to the rules and regulations of the Secretary of Labor (herein called the `Secretary') issued under the
authority of Executive Order 11246, as amended, witnesseth:
In consideration of financial assistance (whether by a loan, grant, loan guaranty, or other form of financial assistance)
made or to be made by the Farmers Home Administration to Recipient, Recipient hereby agrees, if the cash cost of construction
work performed by Recipient or a construction contract financed with such financial assistance exceeds $10,000 —unless
exempted by rules, regulations or orders of the Secretary of Labor issued persuant to Section 204 of Executive Order 11246 of
September 24, 1965.
1. To incorporate or cause to be incorporated into any contract for construction work, or modification thereof, subject
to the relevant rules, regulations, and orders of the Secretary or of any prior authority that remain in effect, which is paid
for in whole or in part with the aid of such financial assistance, the following "Equal Opportunity Clause ":
During the performance of this contract, the contractor agrees as follows:
(a)Mte kbktialctioe will not discriminate against any employee or applicant for employment because of race, color,

(e) The contractor will furnish all information and reports required by Executive Order 11246 of September 24, 1965,
rules, regulations, and orders, or pursuant thereto, and will permit access to his books, records, and accounts by the
Farmers Home Administration, Office of Equal Opportunity, U. S. Department of Agriculture, and the Secretary of
Labor for purposes of investigation to ascertain compliance with such rules, regulations, and orders.
(f) In the event of the contractor's noncompliance with the Equal Opportunity (Federally Assisted Construction) clause
or with any of the said rules, regulations, or orders, this contract may be cancelled, terminated, or suspended in
whole or in part and the contractor may be declared ineligible for further Government Contracts or Federally Assisted
construction contracts in accordance with procedures authorized in Executive Order No. 11246 of September 24, 1965,
and such other sanctions may be imposed and remedies invoked as provided in Executive Order No. 11246 of
September 24, 1965, or by rule, regulation or order of the Secretary of Labor, or as provided by Law.
(g) The contractor will include the provisions of this Equal Opportunity (Federally Assisted Construction) clause in
every subcontract or purchase order, unless exempted by the rules, regulations, or orders of the Secretary of Labor
issued pursuant to Section 204 of Executive Order No 11246 of September 24, 1965, so that such provisions will
be binding upon each such subcontractor or vendor. The contractor will take such action with respect to any
'subcontract or purchase order as the. Farmers Home Administration may direct as a means of enforcing such
provisions, including sanctions for noncompliance: Provided, however that in the event the contractor becomes
involved in, or is threatened with, litigation with a subcontractor or vendor as a result of such direction by the
Farmers Home Administration, the contractor may request the United States to enter into such litigation to protect
the interest of the United States.

Nonsegregated Facilities, to submit the Monthly Manpower Utilization Report, Optional Form 66, as required and such other
information as they may require for, the supervision of such compliance, and to otherwise assist the Farmers Horne
Administration in the discharge of its primary responsibility for securing compliance. ',
6. To refrain from entering into any contract,. or extension or other modification of a contract, subject to such Executive
Order with a contractor debarred from Government contracts or federally assisted construction contracts pursuant. to Part II,
Subpart D, of such Executive-Order or to prior authority; and to carry out such'sanctions and penalties for violation of the
provisions of the EquaI;' Opportunity Clause as may be imposed upon contractors and subcontractors by the Fanners Home
Administration or the Secretary pursuant to such Subpart D.
7. That if. Recipient fails or refuses to comply with.. these undertakings, the Farmers Home Administration may take any
or all of the following actions:. (a) cancel, terminate, or suspend said financial assistance in whole or in part; (b) refrain

pending review by the Buildings & Grounds Committee and after their
review, if there be no objections, the basic contract for the build-
ing sized 40 x 80 x 20, be awarded to Snead & Hatcher, with
specifications set forth in the contract, and that authorization be
extended to the Assistant Clerk and the Chairman to execute the
contract. Commissioner Brown seconded the move. The issue passed.
The following bid was sent out on an informal basis, in that it was
anticipated that the total cost of the construction would be less
than $10,000.
Building sized 30 x 50 x 12.
Snead & Hatcher $13,500.
Metal Buildings of N. C. $12,902.
Ellis Construction Co., Inc. $14,700.
The foregoing bids were rejected for the reason that they were bid
informally and each bid amount exceeded the amount allowed for an
informal bid.
PAYROLL POLICY
ELECTED OFFICIALS
Regarding the payroll policy as it relates to the salaries of
elected officials and to elected officials performing duties
of appointive nature, the following resolution was offered to the
Board for consideration:
POLICY RELATING TO SALARIES OF ELECTED OFFICIALS AND TO ELECTED OFFICIALS
PERFORMING APPOINTIVE DUTIES.
WHEREAS, salaries of elected officials and the salaries of elected
officials performing appointive duties were heretofore set by resolution;
and
WHEREAS, the fiscal year 1974 -75, the Commissioners established a
budgeting procedure recommended by the Local Government Commission; and
WHEREAS, by such procedure, salaries by position were listed in the
budget proposal; and
WHEREAS, after adoption of the budget ordinance, an operating budget
is prepared in which salaries for these positions reflect changes made
prior to the adoption of the budget ordinance; and
WHEREAS, the former procedure of specifically setting salaries in
a resolution is no longer needed to officially inform the public of
such salaries.
NOW, THEREFORE BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS,
that,
1. Salaries for Elected Officials. Salaries for elected officials and any
other positions held by an elected official shall be that sum finally approved
byt he Commissioners in the budget.
2. Travel and Other Expenses. That each elected official shall receive
an amount for travel and other expenses in keeping witht he county travel
policy.
3. Repealer. That all resolutions, policies and ordinances in conflict
with the provisions of this policy are hereby repealed.

PEOPLES GOALS AND NEEDS IN NORTH CAROLINA - SUMMARY
Introduction
What are the needs, concerns, priorities and goals of the public
in North Carolina? This is a continually perplexing problem for policy
{ makers, program planners and community leaders. Economic indices are
i available but little is known about the personal concerns, priorities,
and goal of North Carolinians.
The need for an assessment of social well being and the need for
citizen input to the decision - making process has long been acknowledged
at both the State and local level in North Carolina. Both Governor James
Holshouser and his predecessor Governor Robert Scott, repeatedly stated
the need for citizen input. This approach is consistent in philosophy
with the position taken in the recent social report to the Nation by the
National Goals Research Staff. They state that "participation by all
citizens in the analysis and decision of public issues is needed in
Ei the forming of societal goals. "1 The attention or lack of attention which
policy makers give to the attitudes and values held by substantial
segments of society is likely to be reflected in the acceptance accorded
to local and State programs. However, a disparity now exists between
the desire to take into consideration the public's sentiment and the
availability of systematically collected data with which to do it.
