Stewart, M. H. Brock, Bill Shaw, Rudy Collins, and Chairman Jesse Alphin presiding. Also present were Vanessa W. Young, Clerk to the Board, and Edward H. McCormick, County Attorney. Chairman Jesse Alphin called the meeting to order at 7:35 p.m. Commissioner Bill Shaw led the evening prayer. Authority. Penalty Severability PART 1' 9 10 This ordinance is adopted pursuant to North Carolina General Statute 153A- 275; which statute permits a County by ordinance to adopt reasonable rules and regulations to protect and regulate a public enterprise belonging to or operated by it Section 2. Purpose. The purpose of this ordinance is to establish rules and regulations which are minimum standards for fixed base operators engaging in aeronautical activities on or at the Harnett County Airport. This ordinance shall not be construed to apply to noncommercial users of the airport. Section 3. Definitions. As used in this document the following definitions shall apply: a. Aeronautical Activity- Any activity which involves, makes possible, or is required for the operation of aircraft, or which contributes to or is required for the safety of such operations. The following activities, commonly conducted on airports, are aeronautical activities within this definition: charter operations, pilot training, aircraft rental and sightseeing, aerial photography, crop dusting, - aerial advertising, and surveying, air carrier operations, aircraft sales and services, sale of aviation petroleum products whether or not conducted in conjunction with other included activities, repair and maintenance of aircraft, sale of aircraft parts; ramp services, and any other activities which because of their direct relationship`to the operation of aircraft can appropriately be regarded as an aeronautical activity. The following are examples of what are not considered aeronautical activities: ground transportation (taxis, car rentals, limousines), restaurants, barber shops, auto parking lots. b. Duly Authorized Representative of Owner - The Airport Committee appointed by the Owner.' c. A & P Mechanic - Airplane and Power Mechanic. d. FAA - Federal Aviation Administration. e. FAR - Federal Aviation Regulations. f. Fixed Base Operator - Any person, partnership, corporation, organization, or association in the business of or formed for the purpose of engaging in aeronautical activities. g. Minimum Standards - -The qualifications established by Owner as the minimum requirements to be met as a condition for the privilege to conduct an aeronautical activity on Harnett County Airport. h. Operator - Fixed Based Operator. i. Owner - Harnett County, through its duly elected Board of Commissioners. PART II MINIMUM STANDARDS FOR FIXED BASE OPERATORS Section 4. Business Hours. All fixed base operations at Harnett County Airport shall be full time, progressive business enter. prises, with manned office facility at Harnett County Airport during all regular business hours, said business hours, for the purpose of this document, to be from 8:00 a.m._to 5:00 p.m. Section 5. Performance Bond. Fixed Base Operators will be required to furnish the Owner a performance bond commensurate with the construction required under the minimum standards of services to be performed. Section 6. Design and Construction Standarda; Other Structures. All construction required herein shall be in accordance with design and construction standards established by the Owner for the facility involved, and all facilities of a like nature shall meet the same standards. No structure shall be located on airport property unless approved by the Owner or its duly authorized representative. Section 7. Lease Required. No Fixed Base Operator shall be allowed to operate on Harnett County Airport without a fully executed lease agreement with the Owner, said lease agreement to have incorporated into it this document setting forth minimum standards as if it were a part thereof. Section 8. Financial Solvency, Business Liability and Compliance with Laws and Regulations. Fixed Base Operators must show financial solvency and business ability to the satisfaction of the Owner, and agree to comply with all federal, state, local, and airport laws, rules, and regulations. Section 9. Insurance. a. Liability Insurance - The minimum liability insurance which a fixed base operator shall carry is $100,000. (One Hundred Thousand Dollars) for bodily injury and $50,000 (Fifty Thousand Dollars) for property damage. Fixed Base Operators shall also carry the minimum insurance required by the Civil Aeronautics Board and other regulatory agencies as appropriate to the aeronautical activities being performed. b. Fire, Theft and Comprehensive Insurance - Owner shall maintain necessary fire, theft and comprehensive insurance to cover its fixed assets. Property owned by operator shall be insured by him and owner has no responsibility for any loss. Section 10. Aviation Petroleum Sales. Fixed Base Operators providing sale of aviation petroleum products must meet the minimum standards as shown herein and provide all the services and meet all the requirements listed below in Paragraphs 12 (Office Lounge and Restroom Requirements) and 13 (Ramp Services). Section 11. Aviation Petroleum Sales - Special Requirements. Fixed Base Operators providing services in Paragraphs 14 (Aircraft Maintenance and Repairs), 15 (Aircraft Sales), 16 (Flight Instruction, Charter Service and Aircraft Rental), 17 (Miscellaneous Operations) and 18 (Construction and Rental of Hangars) must meet minimum standardsas shown herein and the established standards for the given service but may not engage in sale of aviation petroleum products without first complying with Paragraph 10 (Aviation Petroleum Sales) as shown above. Section 12. Office, Lounge and Restroom Requirements. To provide for the sale of Aviation Petroleum Products, the Fixed Base Operator shall lease from the Owner or construct and maintain 400 square feet of office, lounge and restroom area at the Harnett County Airport. Section 13. Ramp Services. Ramp services shall be provided full time during regular business hours and by call at other than regular business hours, seven days a week, by the Fixed Base Operator, or in consort with other Fixed Base Operators maintaining similar business at Harnett County Airport. Section 14. Aircraft Maintenance and Repairs. The Fixed Base Operator providing this service shall lease from the Owner or construct and maintain at least a 4,000 square foot hanger properly equipped, and shall provide the services of at least one FAA certified A & P mechanic, and as many properly FAA certified personnel as may be required to perform all various aircraft maintenance and repairs in accordance with all rules and regulations and directions of the FAA and other governmental bodies having jurisdiction thereof. The hangar space referred to shall be used exclusively for maintenance activities and shall not be rented or leased to any third party. (Hangar rental to third parties shall be in accordance with Paragraph 18.) The Fixed Base Operator providing this service shall also lease from the Owner or construct and maintain at least 400 square feet of office, lounge, and restroom area. Said office, lounge, and restroom area may also be used in conjunction with other aeronautical activities engaged in by the Fixed Base Operator providing this service. Section 15. Aircraft Sales. The Fixed Base Operator providing this service shall also lease from the Owner or construct and maintain at least 400 square feet of office, lounge, and restroom area. Said office, lounge, and restroom area may also be used in conjunction with other aeronautical activities engaged in by the Fixed Base Operator providing this service. This shall be a full time progressive business operation, operating during regular business hours, and providing sales facilities and sales personnel meeting FAA regulations. Section 16. Flight Instruction, Charter Service, Aircraft Rental. A Fixed Base Operator may engage in flight instruction, charter service and /or aircraft rental (any one or all of these services), provided that the Operator shall provide a minimum of three aircraft at Harnett County Airport for the exclusive use of the Operator and the Operator must make suitable arrangements for hangaring and /or parking of his aircraft at Harnett County Airport. The Fixed Base Operator providing this service shall also lease from the Owner or construct and maintain at least 400 square feet of office, lounge, and restroom area. Said office, lounge, and restroom area may also be used in conjunction with other aeronautical activities engaged in by the Fixed Base Operator providing this service. Said service shall be provided full time during regular business hours and Operator shall provide full time office personnel during regular business hours as well. Operator must maintain the necessary classroom space properly equipped for ground school instruction commensurate with FAR requirements of a certified Pilot School or Provisional Pilot School and shall hold a current and valid Pilot School Certificate or Provisional Pilot School Certificate. The Operator must provide only properly certified instructors and pilots with ratings and qualifications as required by the FAA in the performance of all operations outlined in this paragraph. Any air taxi /commercial operations shall be performed by an Operator holding a current and valid Air Carrier Operating Certificate. Section 17. Miscellaneous Operations. Miscellaneous operations such as radio and instrument repairs, aerial advertising, crop dusting and other aeronautical activities not hereinabove provided for may be conducted by any person, firm 630 or corporation upon application to and approval of the Owner and its duly appointed representative. Reasonable terms and conditions for the privilege of engaging in these various activities will be established by the Owner and its duly appointed representative commensurate with the nature and scope of the activities involved and their safe conduct in relation to other aeronautical activities already being performed. Section 18. Construction and Rental of Hangars. Any construction of hangars shall be by lease agreement with the owner and subject to owner standards. Such hangars may be used for storage of airplanes only. Assignment of lease by user shall be subject to consent of owner, which consent shall not be unreasonably withheld. Section 19. Consideration. Consideration for the privilege to conduct aeronautical activities at Harnett County Airport shall be based upon a percentage of gross revenues for all services provided by Operator. The minimum consideration shall be specified in lease agreement between Owner and Operator and shall be a fair and equitable amount for the activities proposed and shall be based on reasonable terms and conditions. However, each Operator conducting aeronautical activities of a like nature shall provide the same consideration to Owner. Section 20. Use for Benefit of the Public; Rate, Charges, Etc. Operator shall operate for the use and benefit of the public and to make available to the public on fair and reasonable terms all leased airport facilities and furnish all service on a fair, equal and not unjustly discriminatory basis to all users thereof and to charge fair, reasonable and not unjustly discriminatory prices for each unit or service. Rates and charges for such activities and services shall be fixed by the Operator subject to Owner concurrence and approval of such rates and charges as to reasonableness. In the event of disputes as to such reasonableness, final deter- mination will be reserved to the Owner. All services offered by the Operator shall be performed with promptness and courtesy. Section 21. Discrimination Prohibited. The Operator, in his operation and use of said Airport, will not on the grounds of race, color, or national origin, discriminate or permit discrimination against any person or group of persons in any manner prohibited by Part 21 of the Department of Transportation Regulations. PART III TERMINATION Section 22. Termination of Rights of Fixed Base Operator. The owner may immediately terminate lease of Fixed Base Operator if it finds that Operator is knowingly in noncompliance with minimum standards set forth in this ordinance or with any provision in the Lease between owners and operator. PART IV MISCELLANEOUS Section 23. Rights Not Exclusive. Exclusive rights to provide aeronautical activities within the meaning of Section 308(a) of the Federal Aviation Act of 1958, as amended, shall not be granted by owner to anyone. Section 24. Amendments. These minimum standards established in this ordinance for fixed base operations at Harnett County Airport may be amended or changed as by law provided. Section 25. Clause Headings. The clause headings and index appearing in this ordinance have been inserted for the purpose of convenience and ready reference. They do not purport to, and shall not be deemed to, define, limit to extend the scope or intent of the clauses to which they appertain. Section 26. Penalty If any person shall violate any provision, rule or regulation of this Ordinance, he shall be guilty of a misdemeanor and upon conviction punished as prescribed by North Carolina General Statute 14 -4. Each day that a person shall continue to do any act in violation of such provision, rule or regulation shall constitute a distinct and separate offense. Further, this ordinance may be enforced by injunction and order of abatement as provided for in N. C. G. S. 153A -123. Section 27., Severability. If any section, sentence, clause or phrase of this Ordinance is for any reason held to be invalid, such decision shall not affect the validity of the remaining portions of this Ordinance. ORDINANCE REGARDING FIXED BASE OPERATOR ORDINANCE REGARDING ALARM SYSTEM BIDS FOR EQUIPMENT FOR INDUSTRIAL TRAINING CENTER PROCLAMATION RE- GARDING SHRINE HOSPITAL WEEKEND H. D. Mabe, Appointment To Lee - Harnett Mental Health PUBLIC HEARING The Ordinance was presented by Attorney Edward H. MCCormick. Dotes Holmes and Gene Stewart of the Harnett County Airport Ccnnittee assisted in the presentation and made comments. Commissioner Brock made a motion that the Ordinance Establishing Minimum Standards for Fixed Base Operators of Harnett County be adopted. Commissioner Collins seconded the motion and it passed upon a unanimous vote. Those voting for the Ordinance were: Lloyd G. Stewart, M. H. Brock, Bill Shaw, Rudy Collins and Chairman Jesse Alphin. "An Ordinance Regulating Alarm System Usage when Usage involves Auto- matic Signal Transmissions to Law Enforcement Agencies And Requiring Registration of Alarm System Companies" passed upon a first reading at the meeting of the Board on the 7th day of July, 1981, was read and considered a second time. Upon motion of Commissioner Lloyd G. Stewart, seconded by Commissioner Rudy Collins and the Ordinance was unanimously adopted. Don Buie appeared before the Board with a list of the Machine Shop Equipment needed for the Industrial Training Center, and to ask that the Harnett County Board of Commissioners start reviewing sealed bids for the purchase of this equipment. Commissioner Bill Shaw made a motion to grant permission to allow bids to be taken Friday, August 7, 1981, in the Commissioners Room, County Office Building in Lillington. At that time, the sealed bids were publicly opened. Commissioner Brock seconded the motion and the issue passed upon the following vote; Ayes 5 Noes 0 Absent 0 Abstained 0 Commissioner M. H. Brock made a motion to adopt the following Proclamation declaring July 24 and 25 as Shrine Hospital Weekend. Commissioner Stewart seconded the motion and the issue carried. PROCLAMATION WHEREAS, the members of Sudan Temple, over 11,300 strong, annually help support 18 Shriners Hospitals for Crippled Children and 3 Burn Institutes in North America; and WHEREAS, the Shriners have never charged anyone for services in these institu- tions; and WHEREAS, the members of the Harnett County Shrine Club and Dunn Shrine Club aid this cause locally each year; and WHEREAS, Sudan Temple is holding its THIRD ANNUAL SHRINE NEWSPAPER SALE to benefit these institutions; and WHEREAS, the Harnett County Shrine Club and the Dunn Shrine Club will sell these newspapers on July 24th and 25th in our County for this worthy cause; NOW, THEREFORE, I, Jesse Alphin, Chairman of the Harnett County Commissioners, declare that July 24 and 25th be known as SHRINE HOSPITAL WEEKEND in our commun= ities, and urge the citizens of Harnett County to support this cause. This the 20th day of July, 1981. Chairman, Harnett County Commissioners Commissioner M. H. Brock, made a motion to appoint Dr. H. D. Mabe, to serve on the Lee - Harnett Mental Health Board. Commissioner Collins seconded the motion and it carried. PUBLIC HEARING: A Public Hearing was called to order at 8:00 p.m., as scheduled, to hear the public on the issue of whether or not to create the Boone Trail Emergency District. After the hearing at which 42 persons from the proposed District were present, Commissioner Lloyd Stewart introduced the following Resolution: RESOLUTION THAT, WHEREAS, a report concerning a proposed Fire Protection and Rescue Service District for the area of Harnett County known as the Upper Little River Township (exclusive of areas in this Township already included in the Flat Branch and Summverville Fire Districts) was filed with the Board of Commissioners of Harnett County on May 18, 1981; and WHEREAS, the Board of Commissioners of Harnett County called a public hearing to be held on July 20, 1981 at 8:00 p.m. at the County Office Building on First and Front Streets in Lillington, North Carolina; and WHEREAS, the Commissioners directed the Clerk to publish a copy of the Notice of such hearing in the HARNETT COUNTY NEWS at least one week prior to the hearing date; that an affidavit from the editor of the Harnett County News has been filed with the Clerk to the Board of Commissioners showing that such notice was duly given; and 632 WHEREAS, Thomas Allen was directed to mail a copy to all property owners within the boundaries of the proposed district as shown on the county tax records as of January 1, 1981 and he has filed his certificate of service with the board; and WHEREAS, the hearing was held at the stated time and place and the follow ing persons appeared and spoke for the proposed district :: Dr. Eldon Sloan, Harrington Morrison, Carl Clayton, Georgia Lee Brown, Rev. Charles Blackwell, Raymond Atkins, Bill Moore, Baxley Thomas, and Thomas Thorne and WHEREAS, there was no opposition voiced to the proposal; and WHEREAS, the Commissioners having fully considered the views of those who appeared at the hearing and having duly considered the facts presented in the report filed with the Board on May 18, 1981 regarding the establishment of a proposed Fire Protection and Rescue District and having specifically consider- ed those facts - setforth in Part II of the report regarding standards, the Board finds and concludes that: 1. There is a demonstrable need for providing fire protection, rescue and ambulance service in the area of Harnett County known and defined as the Upper Little River Township. 2... It is impossible or impractible to provide rescue service on a county wide basis under the proposed system of volunteers who have a primary interest in their community. 3. It is economically feasibleto provide the proposed services for the proposed district without unreasonable or burdensome annual tax levies, it being projected that the annual levy will not exceed $.15 per $100.00 of valuation. 4. -There is a demonstrable demand for the special district by persons residing in the district. NOW, THEREFORE, be it resolved by the Board of Commissioners of Harnett County that: 1. A Fire Protection and Rescue Service District is hereby establ ished and defined as follows: A. Boundary or Area to be Served. The area to be served by Fire Pro- tection and Rescue District shall be that area of Harnett County now described and defined as the Upper Little River Township exclusive of areas in the Upper Little River. Township already included in the Flat Branch and Summerville Fire District. B. Name of the Service District. The service district shall be known as "Boone Trail Emergency Services District ". C. Specific - Servicesto be provided. The services shall be limited to the following: Fire Protection and Rescue Services. D. Plan. The plan for providing such services shall be in accordance with plan set forth in the report dated May 18, 1981 heretofore filed on May 18, 1981 with the Clerk to the Board of Commissioners by Boone Trail Emergency Service. Commissioner Lloyd Stewart moved the passage of the foregoing Resolution. The motion was seconded by Commissioner Rudy Collins. It passed upon a unanimous vote of the following Commissioners. Commissioners for the County of Harnett Section 1: A special property tax referendum is hereby called to be held between 6:30 a.m. and. 7:30 p.m. . -on Tuesday, September 15, 1981, at which time there shall be submitted to the qualified voters of Boone Trail Emergency Service District (the boundaries of which are identical to the Upper Little River Township exclusive of areas in the Upper Little River Township which are already included in the Flat Branch and Summerville Fire Districts) the question stated in the Notice of Special Property Tax Referendum set forth in section three of this resolution. - Section 2: For said referendum, (i) the regular registration books for elections in Upper Little River I Precinct and Upper Little River II Precinct, Harnett County shall be used and the registration books, process or records shall be used and the resgistration books, process or records shall be open for the registration of qualified persons and for public inspection in the manner, under the conditions and at the times and places as provided in said notice set forth in Section 3 of this resolution, (ii) the registrars, judges, and other officers of elections appointed by the County Board of Elections of Harnett County for said precincts and voting places in said precincts shall be the election officers for such precincts and voting places, and (iii) the precincts and voting places shall be the ones fixed by said County Board of Elections as provided in said notice set forth in Section 3 of this resolution, subject to change as provided by law. Section 3: The County Auditor be published in the Harnett County N Tuesday, August 18, 1981 (being the said referendum) and once again not and ex- officio Clerk shall cause a notice to ews once at least fourteen days before last day in which persons may register for less than seven days before said day, such notice to read substantially as follows: NOTICE OF SPECIAL PROPERTY TAX REFERENDUM IN THE BOONE TRAIL EMERGENCY SERVICES DISTRICT (the boundries of which are identical to the Upper Little River Township exclusive of areas in that Township already included in the Flat Branch and Summerville Fire Districts). A special property tax referendum will be held in the Boone Trail Emergency Service District (the boundaries of which are identical to the Upper Little River Township exclusive of areas in that Township already included in the Flat Branch and Summerville Fire Districts), Harnett County, North Carolina between 6:30 a.m. and 7:30 p.m. on Tuesday, September 15, 1981, at which time there will be sub- mitted to the qualified voters of said district the following questions: "Shall Harnett County be authorized to levy annually a property tax at an effective rate not in excess of fifteen cents ($.15) on the One Hundred Dollars ($100.00) value in the Boone Trail Emergency Service District for the purpose of providing fire protection and rescue service ?" For said referendum the regular registration books for elections in the Upper Little River I & II precincts, County of Harnett will be used and the re- gistration books, process or records will continue to be open for the acceptance of registration applications and the registration of qualified persons between the hours of 8:00 a.m. and 5:00 p.m. on Monday to Friday, inclusive, of each week at the Office of the County Board of Elections of Harnett County located at the Agriculture Building, 19 East Front Street, in Lillington, North Carolina. In addition, registration applications will be accepted and qualified persons may register with the registrar and judges for the precincts of Upper Little River I & II in Harnett County at their homes and qualified persons may also contact the County Board of Elections at the Office of said Board mentioned above telephone number (919) 893 -4495. The last day for new registration of those not now registered under Harnett County's permanent registration system is Tuesday, August 18, 1981. The last day on which registered voters who have changed residence from one precinct to another may transfer registration is Tuesday, August 18, 1981. Any qualified voter of the District who is qualified to vote by absentee ballot under the provisions of the General Statutes of North Carolina particu- larly Article 20 of Chapter 163, in a statewide primary or general election is authorized to vote an absentee ballot in said special property tax referendum in accordance with said provisions of the General Statutes relating to absentee voting. Any qualified voter of the District who is qualified to vote by absentee ballot in said special property tax referendum may apply for an absentee ballot not earlier than sixty days prior to said special property tax referendum and not later than 5:00 p.m., Thursday, September 10, 1981 at the Office of the County Board of Elections mentioned above. Qualified voters who are not certain whether they are registered or quali- fied to vote by absentee ballot should contact the County Board of Elections at the Office of said Board mentioned above. The regisration books for elections in Harnett County will be open to in- spection by any registered voter of the County during the normal business hours of the County Board of Elections on the days when the office of said Board is open, and such days are Challenge Days. 634 The precincts and the voting places for said property tax referendum, subject to change as provided by law, are as follows: Upper Little River I Precinct'.
