1020198088 HARNETT COUNTY BOARD OF COMMISSIONERS MEETING, OCTOBER 20, 1980 The Harnett County Board of Commissioners met in regular ses- sion on Monday, October 20, 1980, in the Assembly Room, County Office Building, Lillington, North Carolina, with the follow- ing members present: Lloyd G. Stewart, M. H. Brock, Bill Shaw, Rudy Collins, and Chairman Jesse Alphin presiding. Edward H. McCormick, County Attorney, and H. D. Carson, Jr., Clerk to the Board, were also present. CALL TO ORDER Chairman Jesse Alphin called the meeting to order at 7:30 p.m PRAYER Commissioner Bill Shaw led the evening prayer. APPROVAL OF MINUTES The minutes from the Harnett County Board of Commissioners meeting of October 6,1980, were approved as read. CONTRACT WITH NORTHERN :.Commissioner Brock made a motion that Harnett County enter HARNETT RESCUE, INC. into the following contract and agreement with Northern Harne Rescue, Inc. Commissioner Collins seconded the motion and the issue carried with a unanimous vote. CONTRACT AND AGREEMENT NORTH CAROLINA HARNETT COUNTY CONTRACT AND AGREEMENT THIS CONTRACT AND AGREEMENT, Made and entered into this the 20th day of October, 1980, by and between the COUNTY OF HARNETT, party of the first part, also referred to as "County ", and NORTHERN HARNETT RESCUE, INC., party of the second part, also referred to as "Rescue "; WITNESSETH: THAT WHEREAS,Chapter 153A, Article 16, of the North Carolina General Statutes provides that the Board of Commissioners of a county may establish a county service district in order to finance, provide, or maintain ambu- lance and rescue service by contracting for said service; and WHEREAS, the party of the second part is a non-profit corporation organized for the purpose of providing emergency ambulance and rescue service; and WHEREAS, the party of the second part serves a county service district created by the Harnett County Board of Commissioners pursuant to a vote of the people; and WHEREAS, the County of Harnett levies and collects the taxes and is responsible for appropriating said funds for the use and benefit of the citizens in the county service district; and WHEREAS, the County desires to grant a long term contract to enable the party of the second part to make long range plans; and WHEREAS, the North Carolina General Statute 159 -13 (a) requires that the governing board of the party of the first part shall annually adopt an ordinance levying taxes and making appropriations and that North Carolina General Statute 159 -13 (b) limits in the folowitzg manner that governing board in adopting the budget ordinance: (18) No appropziation may be made from a service district to any other fund except (i) to an approprate debt service fund or (ii) to an appropriate account in a capital reserve fund unless the dis- trict has been abolished." .... NOW, THEREFORE, in consideration of the promises and the consideration of TEN DOLLARS to each the other in hand paid, the parties hereto contract. and agree as follows: 1. The party of the first part contracts and agrees that it will cause to be assessed or levied a special tax of up to seven cents per $100. valuation of all real and personal property in the Northern Harnett Rescue Service District, unless otherwise limited by law and /or a vote of the people, and will collect said tax as a part of the ad valorem taxes of the County of Harnett, provided, however, beginning with the fiscal year 1980- 1981, the amount levied annually shall be based on the needs projected in the budget estimate submitted by the party of the second part to the County and approved by the county commissioners. 2. That a special or separate fund shall be maintained by the County for funds collected as a result of said special tax. 3. That monthly collections of current taxes shall be paid to Northern Harnett Rescue, Inc. by the fifteenth day of the month following the month of collection by the County; that quarterly collections of de- linquent taxes shall be remitted by the fifteenth day of the first month after the end of each quarter. 4. The party of the second part shall provide the necessary equipment and personnel for furnishing adequate emergency ambulance and rescue ser- vice for all property located within the Northern Harnett Rescue Service District, and it will furnish said emergency ambulance and rescue service free of charge to all persons and individuals located in said District in an efficient and workmanlike manner. 5. It is expressly understood that party of the second part may pro- vide the equipment and services set forth above in paragraph four (4) by contracting for these services with Furina Rescue, Inc., a rescue squad organized in a service district of the County of Wake which is adjacent to the Northern Harnett Rescue District of the County of Harnett. 6. That all funds paid to the party of the second part by the party of the first part shall be used exclusively to provide emergency ambulance and Rescue service within said Service District and to pay other legitimate emergency ambulance and rescue expenses, including principal and interest on obligations incurred by the party of the second part in connection with the provision of said service. 7. It is agreed that the party of the first part may inspect all books and accounts for the party of the second part at any time that it shall de- sire; it is further agreed that the party of the second part will present to the county commissioners an annual audit by a certified public account- ant, which audit shall be in conformity with existing audit policies of the County. 8. The party of the second part agrees to comply with County budget- ing procedures and other procedures provided for by state law and agrees to submit budget estimates to the Harnett County Board of Commissioners on the standard forms used by county departments; the party of the second part also agrees to use standard line items for accounting devised or consented to by the county accountant from time to time. 9. The period of this contract shall be until the 31st day of July, 1981 and this contract may not be transferred or assigned without consent of the County. At the expiration of this period this agreement shall be ex- tended on a year basis unless notice is given as hereafter stated. Either party may cancel the contract at the close of any contract year by giving thirty (30) days written notice to the other party. 10. It is expressly agreed by the parties hereto that the party of the second part shall be entitled to the exclusive use, possession, and control of all rescue equipment owned by the County of Harnett which is acquired by said County for the purpose of providing emergency ambulance and rescue service to the residents of the Northern Harnett Rescue Service District. It is further agreed that the party of the second part shall retain this right to exclusive use, possession, and control of said equipment so long as it shall remain contractually obligated to provide emergency ambulance and rescue service in said district. 11. The party of the second part further agrees to file with the County Manager a true copy of the Articles of Incorporation, existing By-Laws, and any changes made thereto from time to time; further, the party of the seconi part agrees to adopt By -Laws which meet all minimim legal requirements and which By -Laws, in addition thereto, have reasonable provisions enabling all residents of the community eighteen years of age or more who pay ad valorem taxes to participate in the affairs of the corpor- ation, at least an annual meeting, and vesting in a Board of Directors the authority to manage the affairs of the party of the second part without a vote of the membership to the extent permitted by North Carolina G. S. 55A, the North Carolina Non - Profit Corporation Act. 12. That nothing contained in this contract shall be construed to pro- hibit the party of the second part from entering into mutual aid pacts with other groups providing the same or similar services or doing any other act in furtherance of its duties as an emergency ambulance and rescue ser- vices; nor shall any requirement stated herein cause the County to be liable for any acts or obligations of the party of the second part and its members. Nothing contained in this contract shall be construed to restrict the party of the second part from entering into contracts to provide simi- lar services to other county service districts or municipalities, provided, however, such additional contractual relations with other districts or 490 municipalities do not affect the services to Northern Harnett Rescue Service District. IN TESTIMONY WHEREOF, the party of the first part has caused this instrument to be executed by the Chairman of the Harnett County Board of Commissioners and attested by the Clerk of the Harnett County Board of Commissioners; and the party of the second part has caused this instument to be signed in its name by its President, attested by its Secretary, and its corporate seal hereto affixed, all by order of its Board of Directors duly given, the day and year first above written. Commissioner Collins seconded the motion and the issue carried with a unanimous vote. PUBLIC HEARING: CREATION Chairman Jesse Alphin recessed the regular meeting of the OF BUIES CREEK -COATS WATER Harnett County Board of Commissioners for the purpose of AND SEWER DISTRICT holding a public hearing on the creation of the Buies Creek -Coats Water and Sewer District of Harnett County. Chairman Jesse Alphin declared the public hearing open at 8:00 p.m. pursuant to notice duly posted and published. RONALD COATS LEONORE TUCK HERBERT JOHNSON RONNIE FOWLER Thereupon,-Chairman Jesse Alphin announced that the Board of Commissioners would immediately hear all persons who are interested in the creation of said district. Ronald Coats, Mayor of Coats, appeared before the Board and stated that sewage disposal was a major problem in Coats. He presented a resolution to the Board of Commis- sioners, which had been adopted by the Town Council, approving the inclusion of the Town of Coats within the boundaries of the Buies Creek -Coats Water and Sewer Dis- trict. Leonore Tuck, appeared before the Board on behalf of the Concerned Citizens Committee for the Sanitary Improvement of Buies Creek, and stated that this group was in full support of the Creation of the Buies Creek -Coats Water and Sewer District. Herbert Johnson, a realtor and farmer from the Coats community, appeared before the Board and stated that Coats was in desperate need of sewer services. Ronnie Fowler, residing at Coats, who appeared in person and stated that a: sewer system aaas badlyneeded,_.He strongly- urgeduthat the Commissioners do what they could to help Coats out. M. 0. PHILLIPS PUBLIC HEARING CLOSED REGULAR MEETING RE- CONVENED RESOLUTION REGARDING CREATION OF THE BUIES CREEK - COATS WATER AND SEWER DISTRICT M. 0. Phillips, a resident of Coats, appeared before the Board and stated that he was in support of the creation of the Buies Creek - Coats Sewer and Water District. No one appeared before the Board to speak in opposition of the creation of the Buies Creek -Coats Water and Sewer District. All the foregoing statements were duly considered by the Board of Commissioners. Chairman Jesse Alphin declared the public hearing closed at 8:20 p.m. Chairman Jesse Alphin reconvened the regular scheduled meeting of the Harnett County Board of Commissioners at 8 :21 p.m. Thereupon Commissioner Brock introduced the following resolution which was read: RESOLUTION CONCERNING THE CREATION OF THE BUIES CREEK -COATS WATER AND SEWER DISTRICT OF HARNETT COUNTY BE IT RESOLVED by the Board of Commissioners for the County of Harnett: Section 1. The Board of Commissioners has been considering the creation, pursuant to Article 6 of Chapter 162A of General Statutes of North Carolina, of a county water and sewer district for the purposes of providing water services or sewer services or both to the residents of the territory to be included within said district, such territory having the boundaries described in Section 3 of this resolution and, in accordance with the provisions of said Article 6, the Board of Commissioners posted and published notice of a public hearing to be held on October 20, 1980 to hear all persons interested in the creation of said district and held such public hearing. Section 2. The Board of Commissioners does hereby find, determine and declare: (a) That there is a demonstrable need for providing in said district water services or sewer services or both. (b) That the residents of all of the territory to be included in said district will benefit from said district's creation. (c) That is economically feasible to provide the proposed water services or sewer services or both in said district without unreasonable or burdensome annual tax levies. Section 3. The Board of Commissioners does hereby create a county water and sewer district in Harnett County to be known as the "Buies Creek -Coats Wate. and Sewer District of Harnett County" pursuant to Article 6 of Chapter 162A of the General Statutes of North Carolina. Said District is created for the pur- poses of providing water services or sewer services or both to the residents of the territory included within said District. Said District is also vested with the powers set forth in said Article 6. The territory to be included within said District is the territory described in said notice of public hearing. The Town of Coats is located entirely within such territory, and the governing body of said Town has approved its inclusion within the District. Said District is hereby defined to include all of the territory within the boundaries of said District which are described to be as follows: Beginning at a point in the center line of U. S. Highway No. 421 and N. C. Highway No. 27 in Harnett County said point being located in a westerly direc- tion 200' from the center line intersection of U. S. Highway No. 421 and N.C.S.R 1518; (1) Thence in a northerly direction and perpendicular to U. S. Highway No. 421 for a distance of 1500' to a point; (2) Thence in an easterly direction parallel with and 1500' north of the center line of U. S. Highway No. 421 for a distance of about 2330' crossing S.R. No. 1518 and S.R. No. 1513 to a point; (3) Thence in a southeasterly direction, parallel with and 400', in an easterly direction, from the center line of S.R. The points referred to in the above description of the bound- aries of the territory to be included within the Buies Creek -Coats Water and Sewer District of Harnett County appear on a map of such boundaries which is on file in the office of the Clerk to the Board of Commissioners for the County of Harnett, North Carolina,Harnett County Office Building, East Front Street, Lillington, North `... Carolina. Such map may be referred to for additional information concerning such boundaries but does not constitu$a any part of the description of such boundaries. Section 4. This resolution shall take effect immediately upon its passage. Thereupon, upon motion of Commissioner Brock, seconded by Commissioner. Collins and carried, the foregoing resolution entitled: "RESOLUTION CONCERNING THE CREATION OF THE BUIES CREEK -COATS WATER AND SEWER DISTRICT OF HARNETT COUNTY" was placed upon its passage. The vote upon the passage of said resolution was: Ayes: Commissioner Jesse Alphin, Lloyd G. Stewart, M. H. Brock Bill Shaw, and Rudy Collins. Noes: None The Chairman then announed that the resolution entitled: "RESOLUTION CONCERNING THE CREATION OF THE BUIES CREEK -COATS WATER AND SEWER DISTRICT OF HARNETT COUNTY" had been passed. The Clerk to the Board of Commissioners was thereupon directed . to publish Said resolution, together with the appended notice as required by Article 6 of Chapter 162A of the General Statutes of North Carolina, once in each of two successive weeks in The Daily Record. The Clerk to the Board of Commissioners was thereupon directed, pursuant to Section 163 -288.1 of Article 23 of Chapter 163 of the General Statutes of North Carolina, to cause a map of the limits of the Buies Creek-Coats Water and Sewer District of Harnett County to be prepared from the boundary description of said District in the resolution entitled: "RESOLUTION CONCERNING THE CREATION OF THE BUIES CREEK -COATS WATER AND SEWER DISTRICT OF HARNETT COUNTY" heretofore passed and to cause such map to be delivered to the County Board of Elections of Harnett County.
