09221980A 0'17 C4 utt- HARNETT COUNTY BOARD OF COMMISSIONERS SPECIAL MEETING OF SEPTEMBER 22, 1980 PRAYER RESOLUTION RE: CALLING FOR A PUBLIC HEARING ON THE CREATION OF THE BUIES CREEK -COATS WATER AND SEWER DISTRICT The Harnett County Board of Commissioners met in special session on Monday, September 22, 1980, at 10 a.m. in the Commissioners Room, County Office Building, Lillington, North Carolina, with the following members present: Lloyd G. Stewart, M. H. Brock, Bill Shaw, Rudy Collins and Chairman Jesse Alphin presiding. Absent: None Edward H. McCormick, County Attorney, and Vanessa Young, Assistant Clerk to the Board, were also present. Commissioner Bill Shaw led the morning prayer. Edward H. McCormick, County Attorney, appeared before the Board, presented and explained to the Board members a resolution calling for a public hearing concerning the creation of the Buies Creek -Coats Water and Sewer District in Harnett County. Commissioner Rudy Collins introduced the following resolution which was read: RESOLUTION RELATING TO THE CREATION OF A WATER AND SEWER DISTRICT IN HARNETT COUNTY WHEREAS, the Board of Commissioners for the County of Harnett is considering the creation, pursuant to Article 6 of Chapter 162A of the General Statutes of North Carolina, of a county water and sewer district to be known as the "Buies Creek Coats Water and Sewer District of Harnett County" for the purposes of providing water services or sewer services or both to the residents of the territory to be included within said district, such territory having set forth in Section 2 of this resolution; and WHEREAS, before creating said district, the Board of Commissioners is required pursuant to said Article 6 to hold a public hearing to hear all persons interested in the creation of said district and to give notice of such public hearing in accordance with the provisions of said Article 6; now, therefore, BE IT RESOLVED by the Board of Commissioners for the County of Harnett: Section 1. That a public hearing will be held at 8:00 P.M. on October 20, 1980, in the County Office Building, Lillington, North Carolina, at which the Board of Commissioners shall hear all persons interested in the creation of said district. Section 2. That the Chairman of the Board of Commissioners is hereby authorized and directed to give prior notice of said public hearing by publishing such notice once a week for three weeks in a newspaper which circulates in the territory proposed to be included within said district, and by posting such notice in at least three public places within said territory, such notice to be so posted and published the first time not less than twenty (20) days before said public hearing and to be substantially in the following form: NOTICE OF PUBLIC HEARING ON THE CREATION OF THE BUIES CREEK -COATS WATER AND SEWER DISTRICT OF HARNETT COUNTY NOTICE is hereby given that a public hearing will be held by the Board of Commissioners for the County of Harnett at 8 p.m. on October 20, 1980, in the County Office Building in Lillington, North Carolina, to consider the creation, pursuant to Article 6 of Chapter 162A of the General Statutes of North Carolina, of a county water and sewer district to be known as the "Buies Creek -Coats Water and Sewer District of Harnett County ". The purposes sought to be accomplished by the creation of said district are to provide water services or sewer services or both to the residents of the territory to be included within said district. If created, said district would be vested with the powers granted to county water and sewer districts by said Article 6 The territory proposed to be included within said district is located in Harnett County, North Carolina, and the Town of Coats, North Carolina, is located in whole within such territory, and said Town may not be included in the proposed District unless the governing body of said Town agrees by resolution of said inclusion. No other city or town is located in whole or in part within such territory. The boundaries of such territory are as follows: Beginning at a point in the center line of U. S. Highway No. 421 and N. C. Highway No. 27 in Harnett County, said point being located in a westerly direction 200' frog the center line intersection of U.S. Highway No. 421 and N. C. S. R. No. 1518; (1) Thence in a northerly direction and perpendicular to U. S. Highway No. 421 for a distance of 1500' to a point; (2) Thence in an easterly direction parallel with and 1500' north of the center line of U. S. Highway No. 421 for a distance of about 2330' crossing S. R. No. 1518 and S. R. No. 1513 to a point; 0 (3) Thence in a southeasterly direction, parallel with and 400', in an easterly direction, from the center line of S. R. No 1513 for a distance of about 1180' to a point; (4) Thence in an easterly direction, parallel with and 400' north of the center line of U. S. Highway No. 421 to the center line of West Buies Creek; (5) Thence down the center line of said creek, as it meanders, about 410' ( + / -) to the centerline of U. S. No. 1519 in a northerly direction about 2400' ( + / -) crossing U. S. Highway No. 421 to a point in the Northern right of way line of U. S. Highway No. 421; (11) Thence along the northern right of way line of U. S. Highway No. 421 in an easterly direction about 1550' ( + / -) to a point in the centerline of Buies Creek; (12) Thence up the various courses of Buies Creek in a northerly direction approxi- mately 2200' ( + / -) to the intersection of Buies Creek with a small branch noted as Brach "A" leading to the Northeast. (13) Thence up the various courses of said Branch "A" in a northeasterly direction approximately 650' ( + / -) to its intersection with another small branch and noted as Branch "B" leading to the East; (14) Thence up the various courses of the Branch "B" in an easterly direction crossing Gregg Street and S. R. No. 1522, to a point in said Branch "B ", said point being 900', as measured along a line perpendicular to and in a westerly direction from the center line of S. R. No. 1532; (15) Thence in a northerly direction, parallel with and 900' west of the center line of S. R. No. 1532, crossing S. R. No. 1521, to a point approximately 200' north of the center line of S. R. No. 1521; (16) Thence in an easterly direction, parallel with and 200' north of the center line of S. R. Highway No. 27 and U. S. Highway No. 421; (49) Thence in a westerly direction, parallel to and 400' south of the center line of N. C. Highway No. 27 and U. S. Highway No. 421 and crossing S. R. No. 1513, about 4000' to a point; (50) Thence in a northerly direction, perpendicular to the center line of N. C. Highway No. 27 and U. S. Highway No. 421, 400' to said highway center line and being the point of beginning. The points referred to in the above description of the boundaries o the territory proposed to be included within said district appear on a map of such boundaries which is on file in the Office of the Clerk to Board of Commissioners for the County of Harnett, North Carolina, Room 4, County Office Building, Lillington, North Carolina, 27546. Such may be referred to for additional information concerning such boundaries but does not constitute any part of the description of such boundaries. That this resolution shall take effect upon its passage There upon motion of Commissioner Brock, seconded by Commis- sioner Stewart, the foregoing resolution entitled: "RESOLUTION RELATING TO THE CREATION OF A WATER AND SEWER DISTRICT IN HARNETT COUNTY" was passed by the following vote: Ayes: Commissioners Jesse Alphin, Lloyd G. Stewart, Bill Shaw, Rudy Collins, and M.H. Brock NOES: None Commissioner Collins made a motion that the Sheriff's budget, Code 10- 510 -27 be increased by $800 to reflect the contribution received by Carolina Lakes Corporation for the Drug Program. Commissioner Stewart seconded the motion and the issue carried. CONTRIBUTION Commissioner Stewart made a motion that Harnett County contribute TO HARNETT COUNTY $500 to the Harnett County Historical Society Foundation, Inc., HISTORICAL SOCIETY for the restoration of the old Campbell House. Commissioner Collins seconded the motion and the issue carried with a unanimous vote. BILL SHAW APPOINTED TO CARDINAL HEALTH ADJOURNMENT Commissioner Brock informed the Board that Commissioner Bill Shaw had been appointed to the Cardinal Health Agency Board of Directors.
