0721198045 HARNETT COUNTY BOARD OF COMMISSIONERS MEETING,_ JULY 21, 1980 The Harnett County Board of Commissioners met in regular session on Monday, July 21, 1980, with the following members present: M. H. Brock, Lloyd G. Stewart, Bill Shaw, Rudy Collins, and Chairman Jesse Alphin presiding. Edward H. McCormick, County Attorney, and H. D. Carson, Jr., Clerk to the Board, were also present. Chairman Jesse Alphin called the meeting to order at 7:30 p.m. Commissioner Bill Shaw led the evening prayer. The Minutes from the Harnett County Board of Commissioners Meeting of July 14, 1980, were approved as read. Chairman Jesse Alphin informed the persons present that this meetin of the Harnett County Board of Commissioners had been designated as a meeting to bring the various leaders in the County together to have an open discussion on the economic and industrial development needs of the County. Chairman Jesse Alphin welcomed everyone present and recognized the various mayors and chambers of commerce present - -Mayor Elmore of Dunn, Mayor Cecil Moore of Erwin, and the representatives from the Dunn Area Chamber of Commerce. M. H. Brock, County Manager, appeared before the group and reported on the various programs and resources the county offered toward the future industrial and economic development of the County. Representative B. R. Etheridge appeared before the group and gave a explanation of the role the state portrays in the development of the County. Mr. Etheridge stated that the purpose of the state was to provide services to the people. The initial plan of work had to be done by the county, then he would do everything he could at the state level to assist the County. Tony Tucker, Director of the Planning and Development Office appear before the group and recognized his various board members- -The Planning Board, Development Board, Airport Board, and the Industria Bond Authority. Mr. Tucker gave a brief outline of the functions each of these boards played in the development of the County. The purpose of the development board is to create jobs, bring and keep industries in the County. The Planning Board regulates an organized method of growth for the County by creating various laws to govern this growth; such as, the flood plain ordinance, the Black River drainage rpoject; zoning, control of mining operations, proposed mobile home ordinanc and the planning of a water - wastewater system. Airport Commission is self- explanatory. The purposed of this Board is to govern the construction of the county airport. The Industrial Bond Authority assist new industries with financial arrangements. Mr. Alton Gray, Superintendent of the Harnett County Board of Education, addressed the group concerning the role education in the county plays in the development of industry. Jerry Bullock, Director of HUD, spoke to the group concerning the community development programs and the proposed inspection depart- ment. Rodney Tart, Director of the Northeast Metropolitan Water District, addressed the group on Harnett County's No. 2 resource- -its abundant water supply, the Cape Fear and Little River. Joe Lucas, Director of the Deaprtment of Human Resources -- Manpower, explained to the group the vital role CETA plays in helping to supply the manpower force to operate these new industries. d 451 r WATER PURCHASE CONTRACT WITH THE BOARD OF EDUCATION Henry Thompson, Director of the Health Department, spoke briefly on the various services his department offers to the County. Harold Lloyd, assistant Extension Agricultural Agent, reported on Harnett County's No. One economy -- agriculture. Mr. Warren Culbreth, Director of Parks & Recreation, briefly reported on the recreation program in the county. Chairman Jesse Alphin thanked all the department heads for the reports they gave on the roled their agencies portrays in the Overall Development of the County. Mr. Alphin, then, opened the floor for discussion. Mayor Elmore complimented the Board on formulating this meeting and expres- sed his concern that a cover -truck ordinance needed to be implemented in the County. Commissioner Rudy Collins expressed his pleasure at the excellent representa tion from the various communities which were present at this meeting and thanked them for their participation in this discussion. Commissioner Bill Shaw commented that the county needed to have one reliabl board, composed of persons from the fields of banking, schools, recreation, property, and other facets of the county, which the prospects would be referred to. Commissioner Lloyd Stewart expressed his pleasure at the interest shown by the group present. Chairman Jesse Alphin thanked everyone fro coming and participating in this discussion. Commissioner Brock made a motion that the Board adopt the following water purchase contract, Commissioner Collins seconded the motion and the issue carried: THIS CONTRACT for the sale and purchase of water is entered into as of the First day of July, 1980, between the HARNETT COUNTY BOARD OF EDUCATION, hereinafter referred to as the "Board" and the COUNTY OF HARNETT, hereinafter referred to as the "County ". WITNESSETH: WHEREAS, the County has leased the water system of the Northeast Metropolitan Water District of Harnett County, North Carolina, and WHEREAS, the County desires to continue selling water to the Board and the Board desires to purchase water from the County upon the terms and conditions set forth herein; NOW, THEREFORE, in consideration of the foregoing and the mutual agreements herein- after set forth. A. The County Agrees: 1. (Quality and Quantity) To furnish the Board at the point of delivery hereinafter specified, during the term of this contract or any renewal or extension thereof, potable treated water meeting applicable purity standards of the NC Department of Human Resources, Raleigh, North Carolina, in such quantity as may be required by the Board but not less than 528,000 gallons per month(24,000 gal/ day.) 2. (Point of Delivery and Pressure) That water will be furnished at a reasonably constant pressure calculated at 40 p.s.i. from an 8" main located along NC Highway no. 210 from Angier to the Central Harnett High School on NCSR No. 1513. If a greater pressure than that normally available at the point of delivery is required by the Board, the cost of providing such greater pressure shall be borne by the Board. Emergency failures of pressure or supply due to main supply line breaks, power failure, flood, fire and use of water to fight fire, earthquake or other catastrophe shall excuse the County from this provision for such reasonable period of time as may be necessary to restore service. 3. (Metering Equipment) To operate, and maintain at its own expense at point of delivery, the necessary equipment, including a meter house or pit, and required devices of standard type for properly measuring the quantity of water delivered to the Board. A meter registering not more than two percent (2 %) above or below the test result shall be deemed to be accurate. The previous readings of any meter disclosed by test to be inaccurate shall be corrected for purchase made in immediate preceeding six months period to such test in accordance with the perventage of inaccuracy found by such tests. If any meter fails to register for any period, the amount of water furnished during such period shall be deemed to be the amount of water delivered in the corresponding period immediately prior to the failure, unless County and Board shall agree upon a different amount. The metering equipment shall be read on a monthly basis. 452 4. (Billing Procedure) To furnish the Board at its address not later than the 10th day of each month, with a statement of the amount of water furnished the Board during the preceding month. B. The Board Agrees: 1. (Rates and Payment Date) To pay the County, not later than the 20th day of each month, for water delivered in accordance with the duly adopted following schedule of rates: 1.a. $360.00 for the first 528,000 gallons, which amount shall also be the minimum rate per month. 1.b. All above the minimum of 528,000 gallons shall be furnished at $0.50 per 1,000 gallons for water in excess of said minimum usage and payment. C. It is further mutually agreed between the County and the Board as follows: 1. (Term of Contract) That this contract shall extend until June 1, 2017, and, thereafter may be renewed or extended for such term; or terms, as may be agreed upon by the County and the Board. 2. (Failure to Deliver) That the County will, at all times, operate and maintain its system in an efficient manner and will take such action as may be necessary to furnish the Board with quantities of water required by the Board. Temporary or partial failures to deliver water shall be remedied with all possible dispatch. In the event of an extended shortage of water, or the supply of water available to the County is otherwise diminished over an extended period of time, the supply of water to Board's consumers shall be reduced or diminished in the same ratio or proportion as the supply to County is reduced or diminished. 3. (Modification of Contract) That the provisions of this contract pertaining to the schedule of rates to be paid by the Board for water delivered are subject to modifica- tion by the County at the end of every fiscal year period. Any increase or decrease in rates shall be based on a demonstrable increase or decrease in the costs of performance hereunder, but such costs shall not include increased capitalization of the water system leased by the County. Other provisions of this contract may be modi- fied or altered by mutual agreement. 4. (Regulatory Agencies) That this contract is subject to such rules, regulations, or laws as may be applicable to similar agreements in this State and the County and Board will collaborate in obtaining such permits, certificates, or the like, as may be required bo comply therewith. 5. (Successor to the County) That in the event of any occurence rendering the County incapable of performing under this contract, any successor of the County, whether the result of legal process, assignment, or otherwise, shall succeed to the rights of the county hereunder. 6. (Effective Date) This contract shall become effective on July 1, 1980, if the County of Harnett has finalized its lease of the water system from the Northeast Metropolitan Water District of Harnett County, N.C.; if said lease has not been finalized as of July 1, 1980, then this agreement shall become effective on such date thereafter as said lease between the Northeast Metropolitan Water District of Harnett County, North Carolina, and the County shall become effective. IN WITNESS WHEREOF, the parties hereto, acting under authority of their respective governing bodies, have caused this contract to be duly executed in two counterparts, each of which shall constitute an original.
