08061979347` HARNETT COUNTY BOARD OF COMMISSIONERS MEETING, AUGUST 6, 1979 CALL TO ORDER PRAYER CAROLINA LAKE SUBD. Blocks A, B, C, D, & E AMBULANCE SERVICE REIMBURSEMENT FOR R. A. SELLERS, JR. BUIES CREEK SEWAGE DISPOSAL PLAN Planning Advance Agreement The Harnett County Board of Commissioners met in regular session on Monday, August 6, 1979, in the Commissioners Room, County Office Building, Lillington, North Carolina, with the following members present: M. H. Brock, Lloyd G. Stewart, Rudy Collins, Bill Shaw, and Chairman Jesse Alphin presiding. H. D. Carson, Jr., Clerk to the Board, was also present. Edward H. McCormick, County Attorney, was absent. Chairman Jesse Alphin called the meeting to order at 9 a.m. Commissioner M. H. Brock led the morning prayer Commissioner Brock made a motion to approve the final plat for Blocks A, B, C, D, & E of the Carolina Lakes Subdivision in Barbecue Township. Commissioner Stewart seconded the motion and the issue carried with a unanimous vote. The Harnett County Ambulance Service provided transportation for Mrs. Emma Sellers to Lee County Hospital on March 7, 1979. The fee for these services was in the amount of $34.40, which Mr. R. A. Sellers, Jr., paid in full, Medicare reimbursed the Harnett County Ambulance Service rather than Mr. Sellers for this fee and the Ambulance Service filed a request with the Board of Commissioners to reimburse Mr. Sellers. Commissioner Stewart made a motion that the medicaid refund in the amount of $34.40, which was erroneously forwarded to Harnett County, be reimbursed to Mr. R. A. Sellers, Jr. Commissioner Collins seconded the motion and the issue carried. Commissioner Collins made a motion that Harnett County enter into the following planning Advance Agreement for Buies Creek - Regional Sewage Disposal Plan. Commissioner Shaw seconded the motion and the issue carried with a unanimous vote. Whereas, the Regional Water Supply Planning Act of 1971 and the Regional Sewage Disposal Planning Act of 1971 are Acts to encourage and promote the regionalization of Water Supply Systems and Sewage Disposal Systems, respectively; and Whereas, within each Act is established a Regional Water Supply Planning Revolving Fund or a Regional Sewage Disposal Planning Revolving Fund the purpose of which is to provide planning advances to eligible applicants for meeting the cost of advance planning and engineering work necessary or desirable for the development of a comprehensive plan for a regional water supply system or a regional sewage disposal system as defined in the Acts; and Whereas, the undersigned eligible applicant has submitted to the North Carolina Department of Administration an application and proposal for a Regional Water Supply system which has been approved by the State Board of Health and /or an application and proposal for a Regional Sewage Disposal System which has been approved by the Office of Water and Air Resources; and Whereas, the undersigned applicant is assured that there is a reasonable prospect of federal (or state) aid in the financing of the projected work if the undertaking is one that will be dependent upon federal (or State) aid; and Whereas, the undersigned applicant hereby firmly assures the North Carolina Department of Administration that the work or project, if feasible, will be undertaken; and WHEREAS, upon receipt of 201 facilities planning grant funds from the Environmental Protection Agency, they will be applied to the repayment of the Regional Sewa:e Dis.osal Planning Advance, and in any event all planning advances made pursuant to these Acts shall be repaid in full, with - ine one year of the start of construction on the projected system, or within six months after the issuance of bonds for the financing of making of the advance, whichever comes first, except when, in the judgement of the office of Water and Air Resources and /or the State Board of Health, a proposed plan for development and construction of a regional sewage disposal system and /or a regional water supply system is not feasible according to criteria pursuant to the Acts, but repayment is not excepted if the applicant decides not to proceed with construction that has been planned and which the Office of Water and Air Resources and /or the State Board of Health have declared to be feasible; and WHEREAS, the undersigned hereby fully acknowledge the purpose and intent of the Regional water Supply Planning Act of 1971 and the Regional Sewage Disposal Planning Act of 1971 and their terms and provisions and the under- signed hereby pledge agreement to said terms and provisions, the North Caro- lina Department of Administration therefore advances the sum of Three 48 ANGIER SEWER SYSTEM GRANT AMENDMENT - $19,350 U. S. Environmental Protect- on Agency Thousand Three Hundred Dollars ($3,300) to the undersigned applicant for the purposes set forth and described in the applicant's application and proposal identified as Buies Creek - Regional Sewage Disposal Plan. In Witness Whereof, the North Carolina Department of Administration and the Applicant have executed this agreement as of the date first written: BY s/ Joseph W. Grimsley, Secretary, North Carolina Department of Administra- tion BY s/ Jesse Alphin, Chairman, Harnett County Board of Commissioners Harnett County, by letter of July 19, 1979, received a grant amendment for an additional $19,350 for Phase I - Sewer System Evaluation Survey of Angier Sewer System from the U. S. Environ- mental Protection Agency. The County previously received a grant of $45,000 for this project, plus this grant offer of $19,350, which increased the total to $64,330. Commissioner Stewart made a motion that the County accept this additional grant offer in the amount of. $19,350 for Phase I - Sewer System Evaluation Survey of the Angier Sewer System. Commissioner Collins seconded the motion and, the issue carried with a unanim- ous vote. This grant amendment is duly filed in the County Manager's Office -- Angier'Watew'ater District ANGIER SEWER DISPOSAL The N. C. Department of Natural Resources and Community Develop - SYSTEM - Offer & Accpt-ment, Division of Environmental Management, made a grant offer ance for State grant in the amount of $3,225 to the Harnett County Board of Commissior- in the amount of ers for the purpose of funding Phase I - Sewer System Evaluation $3,225 Survey for the Town of Angier. These funds were made available by the Clean Water Bond Act of 1977. Commissioner Collins made a motion that the Board.adopt the following resolution accepting the grant and makin the assurance contained therein. Commis- sioner Shaw seconded the motion; and the issue carried. WHEREAS, the County of Harnett has been .determined eligible for grant consid- eration for Statewide.Allocated Funds under the Pollution Control Account of the Clean Water Fund to aid in the PhaseI - Sewer System Evaluation Survey for the Town of Angier; and WHEREAS, the Environmental Management Commission in a meeting on July 12, 1979, assigned priority certification for State Grant Funds from Statewide Allocated Funds in the amount of $3,225 for the Angier Project. Now, Therefore, Be It Resolved by the Harnett County Board of Commissioners, that 1. The Board of Commissioners by the proper execution of this document agrees to accept state aid in the amount of $3,225 for Phase I - Sewer System Evaluation Survey for the Town of Angier; and 2. The Board of Commissioners will make the assurances contained in Section II of the Offer for State Aid for the Phase I - Sewer Evaluation Survey for the Town of Angier under the Clean Water Bond Act of 1977. Done this Sixth Day of August, 1979. DON DUPREE, DISTRICT Don Dupree, District Engineer with the N. C. Department of ENGINEER WITH DOT Transportation, appeared before the Board to discuss road matter and situations in Harnett County. ABANDONMENT OF A Commissioner Stewart moved for the adoption of the following 130 ft. Section resolution abandoning a 130 ft. section of SR 1250 from the N. of SR 1250 C. Secondary Road'i System for Maintenance. Commissioner Shaw se conded the motion and the issue carried unanimously. PAVE SR 1297 & SR 1298 BE IT RESOLVED BY THE HARNETT COUNTY BOARD OF COMMISSIONERS that the N. C. Department of Transportation be and is hereby requested by the proper execution of this document, to abandon a 130 ft. section on the end of SR 1250 from the North Carolina Secondary Road System for Maintenance. Done this Sixth Day of August, 1979. Commissioner Shaw moved for the adoption of the following resol- ution whereby the Commissioners authorized the Board of Transpor ation to use unallocated funds, which are set aside for property owner participation type projects, in to amount of $15,000 for t paving of SR 1297 and SR. 1298. The property owners are partici- pating in the amount of $8,686.40. Commissioner Stewart seconde the motion and the issue carried unanimously. • WHEREAS, the residents on SR 1297 and SR 1298, located in Lillington Township have petitioned the N. C. Department of Transportation to participate in the 34\ D ROAD IN ANGIER STATE SYSTEM GREEMENT- -PER DIEM OSTS REIMBURSED OR MAINTENANCE OF ERSONS IN JAIL construction and paving of this road; and WHEREAS, the property owners on participate in the construction $8,686.40; and SR 1297 and SR 1298 have agreed to and paving of this road in the amount of WHEREAS, the N. NOW, THEREFORE, BE IT RESOLVED BY THE HARNETT COUNTY BOARD OF COMMISSIONERS, that the N. C. Department of Transportation be authorized to use unallocated secondary road construction for Harnett County in the amount of $15,000 for the purpose of constructing and paving SR 1297 and SR 1298, located in Lil- lington Township, Harnett County , North Carolina. The Harnett County Board of Commissioners received a written request on behalf of Angier Plaza Shopping Center, Inc., to construction, improve and add to the N. C. Secondary Road System a dirt street, approximately .25 miles in length, which turns off of N. C. Highway 210 in a northwesterly direction just west of th western Town Limits of Angier. The Commissioners forwarded this request to Mr. Don Dupree and asked him to investigate this pro- ject to see if this road can be added to the state system. Commissioner Brock made a motion that the County enter into the follwing agreement for reimbursement per diem costs of maintenanc of persons in Local Confinement Facilities with the N. C. Depart- ment of Corrections. Commissioner Stewart seconded the motion an the issue carried unanimously. It is hereby agreed by and between the North Carolina Department of Correction (hereinafter referred to as the Department) and the County of Harnett (herein- after referred to as the County) that the Department shall pay, and the County shall accept the sum of $10 per day, per inmate, as the per diem cost of pro- viding food, clothing, personal items, supervision and necessary ordinary medical services to those male inmates committed to the custody of the County serving sentences of 30 to 180 days. The Department shall also pay the County extraordinary medical expenses incurred by such inmates, with extraordinary medical expenses being defined as follows: A. Medical expenses incurred as a result of providing health care to inmates on an inpatient (hospitalized) basis; B. Cost of replacement of eyeglasses and dental prosthetic devices will be paid by the Department, if such eyeglasses or devices are broken while the inmate is incarcerated, provided the inmate was using the eyeglasses or devices at the time of his committment. However, the Department will not reimburse the cost if it is paid by the County to a third party with- out prior written consent from the Chief of Medical Services of the Depart ment. C. The Department will reimburse the County for medical expenses when the cost exceeds #35.00 per occurrence in providing health care to the inmate on an out - patient (non - hospitalized) basis. The County shall, on such form as the Department shall prescribe, present a monthly statement of the per diem expenses of maintaining all such persons received serving sentences of 30 to 180 days (together with a statement of any extraordinary medical expenses incurred in the maintenance of such persons) to the Department, to the attention of the Assistant Secretary for Fiscal Affairs, 840 West Morgan Street, Raleigh, North Carolina 27603. Record of the cost for maintaining all such persons shall be kept by the County, and the Department, or a representative thereof, shall have the right to inspec such records and audit the same at any time. The County agrees that the custodian of the local confinement facility of such County shall transmit any work release earnings of such person to the Department in a prompt manner. Except in the case of an emergency, the custodian of the local confinement facility shall contact the Chief of Medical Services of the Department for express authority prior to incurring extraordinary medical expenses in the course of maintaining persons for whom per diem expenses are to be paid by the Department. The Department may, at its option, receive the person in need of medical care into its custody in order to render such medical care or treatment as may be required. ROPOSAL CB SPILLS -- Joe Pell CITY OF DUNN REQUEST agreement for the peiod set forth herein and the funds hereunder are subject to the availability of funds to the agency of the State of North Carolina which may be responsible for the payment of said funds. This agreement shall become effective July 1, 1979, whether or not executed prior to that time. This agreement shall remain in effect until midnight, June 30, 1981. Don Buie with CCTI appeared before the Board and presented a proposal on behalf of Lee County to relocate a temporary classroom from Pineview Health Facility in Harnett County to Lee County, renovate the classroom, pay the County $50 a month for the lease of the building and then after 15 months relocate the classroom in Harnett County. Mr. Buie explained that CCTI was running extremely short of classroom space this year and was in desperate need of this facility. Commissioner Stewart made a motion that M. H. Brock, County Manager, be authorized to work with Don Buie on :.a suitable agreement with Lee County to utilize this classroom. Commissioner Shaw seconded the motion and the issue carried. The Commissioners expressed their sincere appreciation to Don Buie $ the staff of CCTI for the many excellent service they have offered to the citizens of Harnett County. The Board stated that many persons in the County have greatly benefited and grown because of the availability of educational services provided to them through CCTI. At 10 a.m., Commissioner Brock requested that anyone present who had bids for the electric voting machines for Harnett County to please submit them to the Board. Mr. Brock informed those present that the County had advertis for bids for the electric voting machines twice, after only receiving one bid on the original proposed bid opening date, July 2, 1979. Only two bids were received by the Board at this time, one from Computer Election System and one from Valted Commissioner Shaw made a motion to refer the bids to a committee consisting of M. H. Brock, Bill Shaw, and Bill Randall, Chairman of the Harnett County Board of Elections, to -study these bids and submit its recommendation to the Board of Commissioners. Commissioner Stewart made a motion that M. H. Brock be designated voting delegate and Rudy Collins alternate voting delegate for Harnett County at the 72nd Annual Conference of the North Carolina Association of County Commissioners to be held in Raleigh, Commissioner Shaw seconded the motion and the issue carried. Henry Thompson, Director of the Harnett County Health Department appeared before the Board and requested a budget amendment in the amount of $17,143 to employ a Nurse Practitioner I for the High Risk InfanttTracking Program. Commissioner Brock made a motion to approve the budget amendment to Code 10 -590 in the amount of $17,143 to employ a Nurse Practitioner I and that Mr. Thompson file a six -month progress report on the Maternal and Child Health Program for Harnett County with the Board of Commissioners at its regular scheduled meeting held in February, 1980. Commissioner Stewart seconded the motion and the issue carried unanimously. Thomas Allen, Tax Supervisor, appeared before the Board and requested a refund for Homer J. $ Angelina Ennis, Rt. 4, Dunn, N. C. In the amount of $130.92 for an error in pricing the footage of their home. Commissioner Brock made a motion that the Board approve the refund to Mr. Homer U. Ennis in the amount of $130.92. Commissioner Collins seconded the motion an the issue carried. e3 Rolin Choate, Service Sales Engineer, with Johnson Controls, Inc., presented a proposal to the Board to furnish and install automatic summer set -up/ winter set -back systems for five of the county buildings -- County Office Building, Social Services Building, Library, Mental Health Building, and County Courthouse. Commissioner Shaw made a motion to authorize a committee consisting of M. H. Brock, Johnnie Taylor, Maintenance Supervisor for the County; and Bill Shaw to study this proposal and award the bid, if it met all the required conditions,to Johnson Controls, Inc., Commissioner Stewart seconded the motion and the issue carried. Mr. Joe Pell with the N. C. Division of Crime Control and Public Safety appeared before the Board to discuss the possiblity of storing PCB soil from Harnett County roads in the Dunn - Erwin' -Coats Landfill Site. Commis- sioner Brock explained to Mr. Pell that the County leases this property from Mc. Paul Johnson. Mr. Brock had contacted Mr. Johnson concerning the storage of PCB on his land and Mr. Johnson informed Mr. Brock that he did not wish to have the PCB stored on his property. Commissioner Brock suggested that the State use the land which they own for sand $ gravel pits in the County for the storage of PCB. Commissioner Alphin suggested that the state leave the PCB where it is and save the taxpayers the approximate $65,000 it would cost to move the contaminated soil. 35]_ 12" Water Main Carolina Wood Turnings, Inc. TAX COLLECTOR REPORT REVENUE RECEIVED FROM N. C. DEPARTMENT OF TRANSPORTATION FOR AIRPORT A written request was filed by the City of Dunn with the Board of Commis- sioners asking the County to participate in the construction of a 12" water main to serve a new industry in Dunn known as Carolina Wood Turnings, Inc. Dunn asked the County to participate on a 50 -50 basis toward any additional costs incurred on the project, which are not funded by the Farmers Home Asministration. Commissioner Brock made a motion that the Board refer this project to the Harnett County Planning Board for their review and recommendation. Commissioner Shaw seconded the motion and the issue carrie with a unanimous vote. Earl Jones, Tax Collector, appeared before the Board and presented the report on the activities of his department for the month of July and his plans for the month of August, 1979. Commissioner Brock informed the Board that the County had received a warrant from the N. C. Department of Transportation in the amount of $71,500 which represented the State's share of funding for the land acquisition, site preparation, and associated engineering for the Harnett County Airport. STATEMENT OF INVESTEMENTS Commissioner Brock presented the Statement of Investments report as of August 3, 1979, to the Board. EXPENDITURE REPORT Commissioner Brock filed a copy of the Quarterly Revenue $ Expenditure Report for June 30, 1979, with the Board.
