Commissioner Collins seconded the motion and the issue carried. Commissioner Shaw made a motion that the Board consider giving all county employees a 5 percent cost of living increase. Commissioner Stewart seconded the motion and the issue carried It' was the decision of the Board not to act on the 1/3 merit increments for all county employees until after they had studied the matter more closely. CALL TO ORDER PRAYER AMENDMENT -- HOUSING ASSISTANCE PLAN HUD The Harnett County Board of Commissioners met in regular ses- sion on Monday, May 21, 1979, in the Commissioners Room, County Office Building, Lillington, North Carolina, with the following members present: M. H. Brock, Lloyd G. Stewart, Bill Shaw, Rudy Collins, and Chairman Jesse Alphin presiding. Edward H. McCormick, County Attorney, was also present. H. D. Carson, Jr., Clerk to the Board,was absent. Chairman Jesse Alphin called the meeting to order at 7:30 p. Commissioner Bill Shaw led the evening prayer. Jerry Bullock, Director of the Harnett County Housing and Ur- ban Development Office, appeared before the Board and distri- buted copies of a resolution requesting the Board to amend the Housing Assistance Plan. Commissioner Shaw made a motion that the Board adopt the following resolution concerning the Housing Assistance Plan. Commissioner Stewart seconded the motion and the issue carried unanimously. WHEREAS, the County of Harnett prepared, and submitted to the Department of Housing and Urban Development, revision to the Housing Assistance Plan on October 10, 1978; and WHEREAS, said Housing Assistance Plan established a need for additional rental housing units; however, set forth no goals for such units; and WHEREAS, the Department of Housing and Urban Development distributed a Notification of Proposed Fund Availability allowing private owners to submit proposals for the construction of units under the Section 8 Housing Assistance Payments Program; and WHEREAS, certain private owners have indicated a desire to submit proposal for the construction of such units; and WHEREAS, the Director of Community Development, Harnett County, recommends that newly constructed units should be included as a goal for the Housing Assistance Plan, enhancing the attainment of the goals described in the h. 325 RESOLUTION: PAY 1979 -80 EXPENSES Harnett County Housing Element. Now, Therefore, Be it resolved by the Harnett County Board of Commissioners, as follows: Section I: That Part III, Lines 8, 9, and 10 of the Housing Assistance Plan (Form HUD -7087, 6 -78) be amended to include 120 new construction units, providing for 20 units for elderly and handicapped households; 70 units for small families and 30 units for large families. SECTION 2. This resolution shall take effect immediately. Commissioner Collins seconded the motion and the issue carried unanimously. WHEREAS, it appears that the several budgets of the General Fund of Harnett County will be overexpended during the budget year of 1978 -79, and WHEREAS, it will be necessary to overspend these budgets in the due process of operation of the several departments NOW, THEREFORE, BE IT ORDERED by the Harnett County Board of Commissioners that the County Auditor is hereby authorized to pay any and all necessary expenses of the several departments in the operation of their office. Done this twenty -first day of May, 1979. s/ Jesse Alphin, Chairman AMENDMENT TO SUB- Commissioner Shaw made a motion that it be and is hereby recorded DIVISION ORDINANCE that the following amendment to the Harnett County Subdivision Ordinance was introduced to the Harnett County Board of Commis- sioners on this date, the twenty -first day of May, 1979. Commis- sioners Collins seconded the motion and the issue carried unanim- ously. PLANNED RESIDENTIAL DEVELOPMENTS GROUP DEVELOPMENTS 1. General Where topography or other existing physical conditions are such that com- pliance with the requirements of this ordinance would cause an unusual and unnecessary hardship on the subdivider the Harnett County Planning Board may vary the minimum requirements set forth herein, provided that such variation will not have the effect of nullifying the interest and purpose of these regulations. Where a variation is accepted the reasons for such shall be noted in the minutes of the Planning Board. 2. Exceptions for Planned Developments The purpose of this Article is to provide desirable open space in commonly owned areas, tree cover, recreation area, scenic viestas, and variety in development by allowing certain variations in lot sizes and design require- ments, and the establishment of townhouses and condominiums. In no case shall the overall density of dwelling units be greater than that permitted by the applicable county regulations. Subject to the approval of the Harnett County Planning Board, the design standards as set forth in this ordinance may be modified by the Planning Board in the case of a plan and program for a planned development which may consist of offices, institutions stores, industries, townhouses, and residences or any desirable combination of these establishments which meet the requirements of the applicable county regulations. Proposed ownership of planned developments may be by one individual, partnership, corporation, cooperative, condominium or any desirable combination. A preliminary and final plat of a planned development shall be submitted pursuant to the provisions of this Article in conformity with the following: 2.01 Common Areas All planned developments shall contain commonly owned area equal in area to 20% of the entire development. Common areas shall not be less than 2 acres in size and shall be held in non - profit corporate ownership by the owners of lots within the development In consideration of the purpose served by a planned development, the title to such common areas or property shall be preserved to 26 the perpetual benefit of the private properties in the development and sha be restricted against private ownership for any other purpose. If the corporation desires, improvements may be made within the common areas provided that maximum coverage of such;. improvements shall not exceed 25 percent of the entire common property. The developer shall submit and aft approval by the Harnett County Planning Board, record a declaration of the covenants and restrictions . that will govern the ownership, management, and maintenance of the common areas. =2.02 Density Individual lot size may be varied, but the overall density of a planned development shall not exceed that permitted by the applicable county regulations. All remaining land not shown as lots shall be designated as common areas. 2.03 North Carolina Unit Ownership Act Before a declaration establishing a condominium or unit ownership develop- ment may be recorded the declaration and plans shall be approved by the Planning Board and the Harnett County Board of Commissioners as a prelimi- nary and final plat. 2.04 Site Plan Site plans for all planned development shall show the location of the buildings, streets, alleys, walks, parking areas, recreation areas, tree covers, and planting. The site plan shall number and show the dimensions of all building sites and all streets and utility easements to be dedi- cated to the public. All areas on the site plan other than streets, easements or private building sites shall be shown and designated as common areas. 2.05 Public Access, Easements and Private Party Walls Building lots may abut or be provided with frontage on common areas, properly restricted through a property owners association to assure adequate access, if in the opinion of the Harnett County Planning Board a street is within an acceptable distrance and would allow adequate community services. Easements over the common areas for access, ingress, and egress from and to streets and walkways and easements for enjoyment of the common areas, as well as for parking shall be granted to each owner of a residential site. All common walls between individual residences shall be party walls and provisions for the maintenance thereo and restoration in the event of destruction or damage shall be establishe 2.06 Utilities and Improvements Required All planned developments shallinclude public water and sewer utilities and any other improvements considered necessary-by the Harnett County Planning Board. 1UBLIC HEARING DATE Commissioner Collins made a motion that M. Brock, County Manage SET FOR SUBDIVISION be authorized to give notice that a public hearing would be held ORDINANCE on June 11, 1979, at 7:30 p.m. to discuss matters relevant to the amendment of the Harnett County Subdivision Ordinance. HARNETT COUNTY PERSONNEL POLICIES STATEMENT OF INVEST- MENTS WARREN CULBRETH, PARKS & REC. DIRECT. SUBDIVISION, PLAT Oak Ridge Villa M. H. Brock, County Manager, presented and introduced the proposed personnel policies for Harnett County to the Board for considera- tion. It was the decision of the Board to defer consideration of the proposed personnel policies until the next regular scheduled meeting of the Board. M. H. Brock, County Manager, presented the Statement of Investment for the month of April, 1979, for the pleasure of the Board. Commissioner Brock moved for the appointment of Warren Culbreth to serve as director of the Harnett County Parks & Recreation Program. Commissioner Shaw seconded the motion and the issue carried unanimously. Commissioner Collins made a motion that the final plat for the Oak Ridge Villa, owned by Virginia C. McLeod, located in Hector's Creek Township, be approved. This subdivision has been inspected and approved for water supply and sewage disposal by Henry Thompson, Harnett County "Health Director, and has also been approved by the Harnett County Planning Board. H. Brock, Lloyd G. Stewart, Bill Shaw, Rudy Collins, and Chairman Jesse Alphin presiding. Edward H. McCormic County Attorney, and H. D. Carson, Jr., Clerk to the Board, were also present. Chairman Jesse Alphin called the meeting to order at 9 a.m. Commissioner Bill Shaw led the morning prayer. Mr. Taylor with the North Carolina Department of Transportation appeared before the Board to discuss road conditions and situa- tions in Harnett County. Commissioner Brock moved for the adoption of the following reso- lution adding a dirt street east of SR 1265, on which the Boone Trail Medical Center will be located, to the North Carolina State System for maintenance. Commissioner Stewart seconded the motion and the issue carried unanimously. BE IT RESOLVED BY THE HARNETT COUNTY BOARD OF COMMISSIONERS that the dirt street immediately east of SR 1265 off of 421, which is approximately 415 ft. in length, be added to the state system and paved, and that this project be funded out of the secondary road funds for Harnett County. Representative Bob Etheridge appeared before the Board and provided the Board with a report on current legislative activities. APPOINTMENT TO LEE- HARNEIT Commissioner Stewart made a motion that R. H. Brown, Rt. 6, Sanford, MENTAL HEALTH BOARD. N.C., be appointed to serve on the Lee - Harnett Mental Health Area Board. Commissioner Collins seconded the motion and the iss carried unanimously. SHERRILL COATS APPOINTED FIREARMS TRAINING OFFICER EARL JONES, TAX COLLECTOR TAX SUPERVISOR Refunds Sheriff Lewis Rosser appeared before the Board and requested that Sherrill Thomas Coats be appointed as the Firearms Training Officer to conduct a 24 -hour course for the Harnett County Deput- ies. Commissioner Collins moved for the appointment of Sherrill Thomas Coats as the Firearms Training Officer under the super- vision of the Harnett County Sheriff's Department. Commissioner Shaw seconded the motion and the issue carried with a unanimous vote. Earl Jones, Tax Collector, appeared before the Board and reported on the activities of his department for the month of May, 1979, and his plans for the month of June, 1979. Thomas Allen, Tax Supervisor, appeared before the Board and re- quested the following refunds: 1. Refund to American Lease Plans, Charlotte, N. C., in the amour of $55.50. A trailer valued at $5,000 was erroneously listed in Harnett County but is located in Sampson County. 2. Refund to Nat Evans, Black River Township, in the amount of $29.44, error in charging late listing penalty for 1978. ie t
