12151976MINUTES OF THE PUBLIC HEARING HELD ON DECEMBER 15, 1976 PUBLIC HEARING The public hearing for the purpose of hearing discussion for and against and in addition to the stipulations, rules and regulations contained in the booklet, "Harnett County Subdivision Regulations. Chairman Alphin called the hearing to order at the appropriate time, 7:30 P.M., as advertised and all commissioners were present: Commissioners Shaw, Cotton, Brock and Stewart. PRAYER Commissioner Brock led the evening prayer. PURPOSE JIM DAUGHERTY CHARLIE MOYERS CHARLIE JOHNSON COMMISSIONER SHAW Chairman Alphin issued greetings to those present and informed them of the purpose of the hearing, that of considering publicly the Subdivision Ordinance Rules and Regulations. He then opened the meeting for discussion. Jim Daugherty from the Fayetteville Office of the Department of Natural and Economic Resources, briefed the group on the contents of the booklet by reading the purpose of the ordinance contained on page 3, and then be defining the meaning of 'subdivision' as it applies in this instance. questioned the stipulations of the ordinance relating it to mobile home instalations. His question was answered by Mr. Daugherty to the effect that this ordinance is not designed to control mobile home subdivisions. referred to the construction of apartment buildings and asked how the ordinance would affect such construction. The answer was that this ordinance was designed to control single dwelling units, but that zoning ordinances, when adopted, would control such structures. discussed existing roads of substandard nature, connecting roads of standard construction and how these would be added to the state system for maintenance. RONNIE ADAMS mentioned "R" Classifications of building .lots. ELIJAH WEAVER mentioned land that rendered different type results on the perk tests, and the effect the test results have on potential home owners. COMMISSIONER BROCK spoke of the size of the lots for building homes as mentioned in the booklet. For example, if a lot was served by public sewerage and water facilities, then the lots should not be required to exceed 10,000 square feet, because of the additional cost in purchasing a larger lot. ELIJAH WEAVER said he thought it would be an injustice to the citizens to allow lot sizes to be less than 15,000 square feet. COMMISSIONER SHAW GENERAL ACTION MEETING CONTINUED mentioned that a developer might desire to develop a plot of land but not register his intentions with the Planning Board. The answer to this question was that the ordinance provides the impos- ition of a penalty, and that the Planning Board must approve all developments within the county. Others joined in the discussion as to the flexibility of the sec- tion pertaining to streets, both dedicated and private, variance that would be determined by the Planning Board, and the Chairman expressed the discussion as spirited and informative. Commissioner Cotton moved that the entire ordinance booklet be referred back to the Planning Board for revision and that the matter be brought back to the floor at the mid -month meeting of January 17, 1977. Commissioner Brock seconded the motion and the issue passed.
