1107198858 HARNETT COUNTY BOARD OF COMMISSIONERS MEETING, NOVEMBER 7, 1988 The Harnett County Board of Commissioners met in regular session on Monday, November 7, 1988, at the County Office Building, Lillington, North Carolina, with the following members present: Rudy Collins, Bill Shaw, Mack Reid Hudson, Mayo Smith, and Chairman Lloyd G. Stewart presiding. Others present were: Dallas H. Pope, County Manager; Glenn Johnson, County Attorney; Vanessa W. Young, Clerk to the Board, and Kay S. Blanchard, Recording Secretary. Chairman Stewart called the meeting to order at 9 a.m. Commissioner Mack Reid Hudson offered the invocation. The minutes from the regular meeting, October 17, 1988, and the special meetings, October 24, 1988, and October 26, 1988, were approved. Ray Stone, Highway Maintenance Engineer, North Carolina Department of Trans- portation, appeared before the Board to discuss road matters and situations in Harnett County. BRIEFING CONC. Glenn Johnson, County Attorney, presented an evaluation of items previously BLACK CAUCAS presented to the Harnett County Board of Commissioners by the Black Caucus ITEMS group concerning revisions to the current method of electing county coumus- sioners. The following items were briefed in detail concerning the Black, Caucus group request: 1. Current method of election of county commissioners 2. North Carolina General Statute associated with the method of election of county commissioners 3. Federal laws concerning election process 4. Current approval by U.S. Department of Justice for Harnett County election process 5. Comparison between current number of county commissioners and Black Caucus group requested number of county commissioners 6. Comparison of current districts in relation to increasing districts whereby two districts would have 65% black voting population. The Board of Commissioners discussed at length the presentation made by the county attorney as related to the Black Caucus request which had been pre- viously presented to the Board. The Chairman advised the Board to consider the information presented in association with the Black Caucus request for changes to the method of election for county couuuissioners and to be prepared to consider providing a response to the Black Caucus group at the next regular Board meeting. WILLIE M" Dallas H. Pope, County Manager, presented request from Lee - Harnett Mental FACILITY TRANS. Health Authority to transfer "Willie M" facility from Lutheran Family Services to Lee - Harnett Mental Health Authority. Commissioner Hudson moved that the "Willie M" facility be transferred to Lee - Harnett Mental Health. Commissioner Shaw seconded the motion and it passed with a unanimous vote. Commissioner Smith made a motion to grant request from Dunn Area Chamber of Commerce for funds to support the N.C. Board of Economic Development. Commissioner Shaw seconded the motion and it passed with a unanimous vote. BUDGET AMEND. Dallas H. Pope, County Manager, requested a budget amendment for Planning and Development, Code 10- 7200 -026, Advertising, $800. increase, for Harnett County support for N.C. Board of Economic Development. Commissioner Smith made a motion to approve the budget amendment. Commissioner Shaw seconded the motion and it passed with a unanimous vote. RESOLUTION RE: Dallas H. Pope, County Manager, presented a resolution from Region "M" con - REGION "M" cerning release of state funds. Commissioner Shaw moved for the adoption of the resolution. Commissioner Smith seconded the motion and it passed with a unanimous vote. The resolution is copied in full at the end of these minutes dated November 7, 1988, as document No. 1. Damon and appoint CCCC ADV. COMM. Mrs. Joe (Addie) McLean to the Central Carolina Community College Harnett County Advisory Committee for 3 -year terms. Commissioner Collins seconded the motion and it passed with a unanimous vote. APPOINTMENT TO DOMICILIARY HOME ADV. COMM. HOLIDAY SCHED. REPORTS BUDGET AMEND. Commissioner Shaw made a motion to reappoint H. Donald Clark to the Domici- liary Home Community Advisory Committee for a three -year term. Commissioner Smith seconded the motion and it passed with a unanimous vote. Commissioner Smith made a motion to adopt the Harnett County 1989 Holiday Schedule. Commissioner Hudson seconded the motion and it passed with a unanimous vote. The Holiday Schedule is copied in full at the end of these minutes dated November 7, 1988, as document No. 2. Reports for the month of October, 1988, were filed with the Board from the Sheriff's Department, Tax Department, Veterans Service Office, Emergency Medical Services, and Inspections. Dallas H. Pope, County Manager, presented the Tax Attorney's Report for the month of October which is copied in full at the end of these minutes dated November 7, 1988, as document No. 3. James Goff, Director, Agriculture Extension, requested the following budget amendment for Family Violence Prevention: Code 10- 7301 -014 Travel & Meetings $ 1,700. Increase Code 10- 7301 -033 Materials & Supplies 6,237. Increase Code 10- 7301 -045 Contracted Services 13,000. Increase Code 10- 7301 -074 Capital Outlay - Equip. 1,900. Increase Commissioner Smith made a motion to approve the budget amendment. Commis- sioner Collins seconded the motion and it passed with a unanimous vote. Dallas H. Pope, County Manager, requested a budget amendment for Non - Departmental, Code 10- 8600 -033, Materials & Supplies, $5,000 increase, for additional stock of supplies in Procurement Office. Commissioner Hudson made a motion to approve the budget amendment. Commissioner Shaw seconded the motion and it passed with a unanimous vote. Dallas H. Pope, County Manager, requested the following budget amendment for the Tax Department: Code 10- 4500 -003 Salaries & Wages, Part -time $14,000. Increase Code 10- 4500 -014 Travel & Meetings 2,500. Increase Code 10- 4500 -074 Capital Outlay- Equipment 8,000. Increase Code 10- 4500 -045 Contracted Services 24,500. Decrease The budget amendment is needed for remodeling of office, sending staff to school for updating, and hiring of additional part -time employees. Commis- sioner Collins made a motion to approve the budget amendment. Commissioner Shaw seconded the motion and it passed with a unanimous vote. Dallas H. Pope, County Manager, requested a budget amendment for Governing Body, Code 10 -41 -006, Group Insurance Payable, $5,575. increase. Commissioner Hudson made a motion to approve the budget amendment. Commissioner Smith seconded the motion and it passed with a unanimous vote. Dallas H. Pope, County Manager, requested a budget amendment for South Central Construction, Code 36- 4100 -020, Legal & Administration, $14,000. increase; and Code 36- 4100 -080, Contingency, $14,000. decrease. The budget amendment is needed to cover legal fees for bond counsel. Commissioner Shaw made a motion to approve the budget amendment. Commissioner Smith seconded the motion and it passed with a unanimous vote. Dallas H. Insurance Retirement Telephone & Postage Capital Outlay $11,404. Increase 6,643. Increase 7,382. Increase 3,445. Increase 1,000. Increase 1,851. Increase The budget amendment reflects administrative funds allotted to the WIC Program based on allocation of additional case load. Commissioner Smith made a motion to approve the budget amendment. Commissioner Hudson seconded the motion and it passed with a unanimous vote. Dallas H. Pope, County Manager, requested a budget amendment for Special Appropriations, Code 10- 8700 -105, Harnett County Public Utilities, $26,000',. increase, for Economic and Industrial Development Wastewater Project. Commis- sioner Shaw made a motion to approve the budget amendment. Commissioner Collins seconded the motion and it passed with a unanimous vote. MODERN MACHINE The Board next considered the proposal by Mr. Tom Meece to provide a loan to MACHINE MANE.. Modern Machine Manufacturing Company in the amount of $30,000. The funds COMPANY which would be loaned to this company under Mr. Meece's proposal would come from the North Carolina Department of Commerce as a part of a development program. CHARGE TO TAX COLLECTOR ADJOURNMENT The matter had previously been discussed with the Board of Commissioners at a prior meeting. Mr. Meece reported that at that meeting he informed the Board of Commissioners that the County would have no obligation to repay the $30,000. amount received from the State of North Carolina and then loaned to Modern Machine Manufacturing Company in the event Modern Machine Manufacturing Company defaulted on its payments. Mr. Meece further advised the Board that since such meeting the County Attorney had investigated the matter and deter- mined that the North Carolina Department of Commerce takes the position that such loan amount would be repayable in the event of a default by Modern Machine Manufacturing Company. Mr. Meece advised the Board that his office had received a proposed indemnity and security agreement which would grant to the County of Harnett a junior encumbrance on certain personal property and assets of Modern Machine Manufacturing Company. After substantial discussion, and upon motion made by Commissioner Hudson and seconded by Commissioner Smith, which motion was unanimously passed, and after consideration of the above set forth additional information from Mr. Meece, the Harnett County Board of Commissioners approved the loaning of said $30,000. amount to be received from the State of North Carolina to Modern Machine Manufacturing Company, Inc., pursuant to the terms and conditions of the program in accordance with which such funds were made available by the State of North Carolina, with such indebtedness to be evidenced by the promissory note of Modern Machine Manufacturing Company, Inc., providing for quarterly payments of principal and interest at the rate of 2% per annum, and proper execution of the indemnity and security agreement after such instru- ments have been reviewed in final form and approved by the Office of Planning and Development and the Office of County Attorney, and the Chairman of Hartnett County Board of Commissioners was duly empowered pursuant to such motion to execute any and all documents required in connection with such transaction. Vanessa W. Young, Clerk to the Board, charged Bobby Wicker, Tax Collector, for collection of 1988 taxes. RESOLUTION WHEREAS, in North Carolina the Lead Regional Organizations, as voluntary organizations serving municipal and county governments, have established productive working relationships with the cities and counties across this state; and WHEREAS, many counties and cities need assistance in pursuing economic and community development opportunities, but federal assistance in the form of intergovernmental revenues has been severely curtailed in recent years; and WHEREAS, the 1988 General Assembly recognized this need through the appropriation of $990,000 to help the Lead Regional Organizations assist local governments with grant applications, economic development, community development, and to support local industrial development activities and other activities as deemed appropriate by their local governments; and WHEREAS, these funds are not intended to be used for payment of member dues or assessments to a Lead Regional Organization or to supplant funds appropriated by the member governments; and WHEREAS, in the event that a request is not made by the County of Harnett for release of these funds to our Regional Council, the available funds will revert to the State's General Fund; and WHEREAS, in Region "M ", funds in the amount of $55,000 will be used for assisting member governments with grant applications, economic development, community development, and other activities as deemed appropriate by member governments of the Region "M" Council of Governments. NOW, THEREFORE BE IT RESOLVED, that the Harnett County Board of Commissioners requests the release of its share of these funds, $9653.42, to the Region "M" Council of Governments at the earliest possible time in accordance with the provisions of Chapter 830 of the 1987 Session Laws (HB 1515).
