County Office Building, Lillington, North Carolina, with the following members present: Rudy Collins, Mack Reid Hudson, Mayo Smith, and Vice Chair- man Bill Shaw presiding. Chairman Stewart was absent. Others present were: Dallas H. Pope, County Manager; Glenn Johnson, County Attorney; Vanessa W. Young, Clerk to the Board; and Kay S. Blanchard, Recording Secretary. CALL TO ORDER Vice:Chairman Shaw called the meeting to order at 12:55 p.m. John M Phelps, II, Public Utilities Attorney, explained the purpose of the meeting. RESOL. AUTHOR. Commissioner Collins made a motion to adopt a resolution amending rules and regulations of the West Central Water and Sewer District,' Sections 28 and 29. Young, Cle to th1 Board RESOLUTION AUTHORIZING APPLICATION FOR LOAN OR GRANT UNDER THE N. C. CLEAN WATER REVOLVING LOAN AND GRANT ACT OF 1987 (West Central Water and Sewer District of Harnett County) WHEREAS, The North Carolina Clean Water Revolving Loan and Grant Act of 1987 has authorized the making of loans and grants to aid eligible units of government in financing the cost of construction of wastewater treatment works, wastewater collection systems, and water supply systems; and WHEREAS, The West Central Water and Sewer District of Harnett County has need for, and intends to construct a water distribution system project described as "Water Facilities Phase ICI" consisting of an elevated storage tank, booster pumping station, and approximately 91,000 linear feet of 2 -inch through 8 -inch water mains; and WHEREAS, The West Central Water and Sewer District of Harnett County intends to request State loan and grant assistance for the project and now desires to authorize the District to make appropriate application for said funding. NOW, THEREFORE, BE IT RESOLVED, by the Board of Commissioners of Harnett County, sitting as the governing body of the West Central Water and Sewer District of Harnett County that: 1. The District, its officers, agents and representatives are hereby directed and authorized to make application to the State of North Carolina for a State loan and /or grant under the N. C. Clean Water Revolving Loan and Grant Act of 1987; The District- intends to construct the above described "Water Facilities Phase II" project and in conjunction therewith 'will: (a) arrange financing for all remaining costs of the project, if approved for a State loan and grant award. (b) adopt and place into effect on or before completion of the project a schedule of fees and charges ,which will provide adequate funds for proper operation, maintenance, administration of the system, and repayment of all principal of and interest on loans. (c) provide for efficient operation and maintenance of the project on completion of construction thereof. 3. The Chairman of the governing body of the District and such other officers, agents and representatives of the District as necessary are hereby authorized to execute and file an application on behalf of the District with the State of North Carolina for a loan and grant to aid in the construction of the project described above. The appropriate officers, agents and representatives of the District are hereby authorized and directed to furnish such information as the appropriate State agency may request in connection with such application or the project; to make the assurances as contained above; and to execute such other documents and take such other action as may be required in connection with such application. The District hereby acknowledges that it has substantially complied or will substantially comply with all Federal, State, and local laws,, rules, regulations, and ordinances applicable to the project and to Federal and State granttand loans pertaining thereto. Stewart, Chairman RESOLUTION REGARDING WATER CONSERVATION PROGRAM - WEST CENTRAL WATER AND SEWER DISTRICT OF HARNETT COUNTY WHEREAS, Harnett County, through its Department of Public Utilities, manages and operates the water distribution systems of several water service districts within the county, including the West Central Water and Sewer District of Harnett County (hereinafter "District "); and WHEREAS, said Department of Public Utilities has heretofore adopted a program for water conservation, including a publicsleducation and information plan, which provides for the dissemination of pertinent data to the public through direct mailings and news releases; and WHEREAS, said Department of Public Utilities has also adopted a water loss program designed to minimize loss of water, which includes careful audits and review procedures by the Department to ascertain the consumption of water; and WHEREAS, the District. desires that such water conservation programs be implemented by the Department of Public Utilities for the District's system; and WHEREAS, the District further desires to express its intentions regarding the implementation of an effective means for conserving water to the State of North Carolina as part of its application for a State Loan or Grant under the N. C. Clean Water Revolving Loan and Grant Act of 1987; NOW, 'THEREFORE, BE IT RESOLVED, by the Harnett County Board of Comniissioners, sitting as the governing body of the West Central Water and Sewer District of Harnett County that: • 1. The District hereby adopts a continuing program of water conservation, education, and information, the same to be instituted as part of the organization, operation and administration of its water distribution system; 2. The District. hereby adopts a water loss prevention and correction program, the same to be instituted as part of the organization,- operation and administration of its water distribution system; and 3. The District acknowledges that the State Plumbing Code has been adopted for use within Harnett County, (which includes the District), and that said code will be effectively enforced. RESOLUTION AMENDING RULES AND REGULATIONS OF THE WEST CENTRAL WATER AND SEWER DISTRICT OF HARNETT COUNTY - SECTIONS 28 AND 29 WHEREAS, the Harnett County Board of Commissioners, sitting as the governing body of the West Central Water and Sewer District of Harnett County (hereinafter the "Board ") has heretofore, by resolution duly adopted on February 15, 1988, established Rules and Regulations for the operation of the District's water distribution system; and WHEREAS, the Board, upon recommendation of the Harnett County Department of Public Utilities, now desires to amend said Rules and Regulations as hereafter set forth, said amendments to become effective upon adoption; NOW, THEREFORE, BE IT RESOLVED by the Harnett County Board of Commissioners, sitting as the governing body of the West Central Water and Sewer District of Harnett County, that: 1. Section 28 of said Rules and Regulations as it is now written is deleted; and the following Section 28 is substituted in lieu thereof: Section 28. Classifications, Rates, Fees and Charges. (a) Classification of Service. All services are classified under two categories to include residential or multi -unit services. A residential service is a service which provides water to a `single family residence and the buildings appurtenant thereto. A multi -unit service is a service which provides water to more that one single family residence or more that one user unit. (b)" Rate Schedules (1) Residential Services: Water Schedule First 2,000 gallons (minimum) Monthly Rate $12.00. All water used over $2.50 per 1,000 2,000 gallons gallons (2) Multi -Unit Services: The minimum amount of $12.00 per unit or the amount equal to the cost of the number of gallons used through the multi -unit service at the rate of $2.50 per 1,000 gallons, whichever amount is greater. (c) Tap -On -Fee. (To become effective after completion of initial sign up period) (1) Residential: If water laterals are installed by the County or County's contractor, the tap -on -fee is $500.00. This fee shall apply to three - fourths inch meter size residential services only. All other residential connection tap -on -fees shall be the cost of installation and materials, plus twenty (20) percent. (2) Multi -Unit: The cost of installation and materials, plus twenty (20) percent. (d) Fire Protection Charges Services Standby Fire Plugs Charges $5.00 /month each added to water billing, plus cost of installation and materials 6" Sprinkler Connection $10.00 /month, plus cost of installation and materials 8" Sprinkler Connection $25.00 /month, plus cost of installation and materials 12" Sprinkler Connection $100.00 /month, plus cost of • installation and materials Others Negotiated (e)---.Rates for-persons living outside the District. Rates for persons living outside the West Central. Water and Sewer District of Harnett County shall be equal to rates, for persons living inside the District so long as no tax is levied within the District for support of the system; if a tax is levied on users inside the water District for the purpose of supporting the water system, then the users outside the District shall pay an increased rate as established by the County from time to time. In setting such increased rate-, the County will take into consideration the rate paid by persons inside the District plus taxes levied on them for support of the water system. 2. A new Section 29 is added to said Rules and Regulations and reads as follows: Section 29 In the event the District desires to connect its water distribution system to previously existing systems, all such systems must have the approval of Division of Health Services, of the North Carolina Department of Human Resources before such connection may take place and all previously existing sources of water must be completely abandoned and rendered incapable of future water production.
