08151988878 HARNETT COUNTY BOARD OF COMMISSIONERS MEETING, AUGUST 15, 1988 INVOCATION The Harnett County Board of Commissioners met in regular session on Monday, August 15, 1988, at the County Office Building, Lillington, North Carolina, with the following members present: Bill Shaw, Rudy Collins, Mack Reid Hudson, Mayo Smith, and Chairman Lloyd G. Stewart presiding. Others present were: Dallas H. Pope, County Manager; Glenn Johnson, County Attorney; Vanessa W. Young, Clerk to the Board, and Kay S. Blanchard, Recording Secretary. Chairman Stewart called the meeting to order at 7 p.m. Commissioner Collins offered the invocation. The minutes from the regular meeting, August 1, 1988, were approved. CONTRACT FOR Commissioner Smith made a motion that the county enter into a contract with FOOD STAMP ISSUANCE Cost Containment, Inc , Raleigh, NC for mail issuance of food stamps service. Commissioner Collins seconded the motion and it passed with a unanimous vote. AGREEMENT RE: FOREST LANDS RESOLUTION RE: PROPOSED DUNN- AVERAS. EMER. AMB. & RES. SER. DIST. VANESSA YOUNG REAPPOINTED BOBBY WICKER REAPPOINTED DORIS SMITH REAPPOINTED OATHS OF OFFICE RESOLUTION RE: CREATION OF SOUTHEAST W & S DISTRICT RELEASE FmHA LOAN COMMITMENT LEONORE TUCK REAPPOINTED TO METRO BOARD ZONING BOARD OF ADJUSTMENTS APPOINTED Commissioner Hudson made a motion that the county enter into an agreement with the North Carolina Department of Natural. Resources and Community Development for the protection, development and improvement of forest lands in Harnett County for F.Y. 1988 -89. Commissioner Shaw seconded the motion and it passed with a unanimous vote. Glenn Johnson, County Attorney, presented a resolution concerning the proposed Dunn - Averasboro Emergency Ambulance and Rescue Service District. Commissioner Smith moved for the adoption of the resolution. Commissioner Hudson seconded the motion and it passed with a unanimous vote. The resolution is copied in full at the end of these minutes dated August 15, 1988, as document No. 1. Commissioner Collins made a motion to reappoint Vanessa W. Young to serve as. Finance Officer and Clerk to the Board for a period of one year. Commissioner Smith seconded the motion and it passed with a unanimous vote. Commissioner Smith made a motion to reappoint Bobby L. Wicker Tax Administrator, to serve as Tax Collector and Tax Assessor for a period of two years. Commissioner Shaw seconded the motion and it passed with a unanimous vote. Commissioner Hudson made a motion to reappoint Doris J. Smith to serve as Deputy Tax Collector for a period of two years. Commissioner Collins seconded the motion and it passed with a unanimous vote. Glenn Johnson, County Attorney, administered Oaths of Office to Vanessa W. Young, Bobby L. Wicker, and Doris J. Smith for their respective offices. The Oaths are copied in full at the end of these minutes dated August 15, 1988, as document No. 2. John M. Phelps, II, Public Utilities Attorney, presented a resolution concerning creation of Southeast Water & Sewer District. Couuuissioner Smith moved for the adoption of the resolution. Commissioner Hudson seconded the motion and it passed with a unanimous vote. The resolution is copied in full at the end of these minutes dated August 15, 1988, as document No. 3. Commissioner Smith made a motion to release F.H.A. loan commitment for the Buies Creek Water and Sewer District in the amount of $600,000 and that F.H.A. be appropriately notified. Commissioner Hudson seconded the motion and it passed with a unanimous vote. John M. Phelps, II, Public Utilities Attorney, presented a resolution reappointing Mrs. Leonore Tuck to serve on the District Board of the Northeast Metropolitan Water District of Harnett County. Commissioner Collins moved for the adoption of the resolution. Commissioner Smith seconded the motion and it passed with a unanimous vote. The resolution is copied in full at the end of these minutes dated August 15, 1988, as document No. 4. Dallas H. Pope presented to the Board recommended appointments to the Harnett County Zoning Ordinance Board of Adjustments. Commissioner Shaw made a motion that the following persons be appointed to serve on the Harnett County Zoning Ordinance Board of Adjustments: 1. H. L. Sorrell, Jr. 2. C. P. Tarkington 3. Blount Whiteside 4. Dan Andrews 5. Harold Allen Two year term to expire 9 -1 -90 One year term to expire 9 -1 -89 One year term to expire 9 -1 -89 Two year term to expire 9 -1 -90 Three year term to expire 9 -1 -91 Commissioner Collins seconded the motion and it passed with a unanimous vote. JOHN SHAW APPOINT- Commissioner Smith made a motion to appoint John Shaw of Dunn to the Harnett MENT TO DEV. COMM. Development Commission to replace Delmon Williamson. Commissioner Hudson 67J RESOL. TRANSFER - ING ZONING AUTHORITY TO TOWN OF ERWIN REPORTS seconded the motion and it passed with a unanimous vote. Dallas H. Pope, County Manager, briefed the Board on request from the Town of win for transfer of zoning and planning for area south of town. Commissioner Hudson moved for the adoption of a resolution granting transfer of zoning authority to the Town of Erwin. Commissioner Smith seconded the motion and it passed with a unanimous vote. The resolution is copied in full at the end of these minutes dated August 15, 1988, as document No. 5. Reports for the month of July from the Sheriff's Department, Emergency Medical Services, Inspections, Social Services, and the Health Department were filed with the Board. BUDGET AMENDMENT Rodney Tart, Director, Public Utilities, requested a budget amendment to Code 30- 4100 -016, Maintenance & Repair - Equipment, $38,900. increase for sandblasting and repainting Metro tank # 1. Commissioner Smith made a motion to approve the budget amendment. Commissioner Collins seconded the motion and it passed with a unanimous vote. EXECUTIVE SESSION ADJOURNMENT 1 Dallas H. Pope, County Manager, requested a budget amendment for Parks & Recreation, Code 10- 8200 -074, Capital Outlay - Equipment, $2,600. increase to replace pick -up truck. Commissioner Smith made a motion to approve the budget amendment. Commissioner Shaw seconded the motion and it passed with a unanimous vote. Dallas H. Pope, County Manager, requested a budget amendment for the Jail, Code 10 -5120 -074, Capital Outlay - Equipment, $2,500. increase to purchase van from State Surplus. Commissioner Collins made a motion to approve the budget amendment. Commissioner Smith seconded the motion and it passed with a unanimous vote. Dallas H. Pope, County Manager, requested a budget amendment for Transportation /Procurement, Code 10 -5550 -074, Capital Outlay - Equipment, $5,000. increase to purchase three vehicles from State Surplus. Commissioner Collins made a motion to approve the budget amendment. Commissioner Smith seconded the motion and it passed with a unanimous vote. Connie Wester, Land Resources Division, N.C. State Natural Resources and Community Development, gave the Board an overview of proposed agreement between Harnett County and Ragsdale Consultants for professional services concerning the county's Land Records Management Program. The agreement will be brought to the Board for consideration on August 22, 1988. Commissioner Hudson made a motion to go into executive session concerning land acquisition and personnel. Commissioner Collins seconded the motion and it passed with a unanimous vote. Commissioner Hudson made a motion to come out of executive session. Commissioner Shaw seconded the motion and it passed with a unanimous vote. R E S O L U T I O N THAT WHEREAS, the Harnett County Board of ,Commissioners has heretofore received information regarding a proposal to establish an emergency ambulance and rescue district within a portion of Harnett County which encompasses all of Averasboro Township.; and WHEREAS, the Harnett County Board of Commissioners has . determined that there is support for the establishment of such an Emergency Ambulance and Rescue Service District pursuant to the provisions of Article 16, Chapter 153A of the General Statutes of the State of North Carolina; and WHEREAS, it has heretofore been the policy of the Harnett County Board of. Commissioners to submit to the qualified voters of such a proposed district the issue of whether or not a property tax should be imposed pursuant to the provisions of said statute for the support of emergency ambulance and rescue service within said district; and WHEREAS, the Harnett County Board of Commissioners has determined that a referendum on such issue should be held at which the qualified voters of such proposed district should vote upon the following question, to wit: "Should Harnett County be authorized to levy annually a property tax at an effective rate not in excess of five cents ($.05) on the One Hundred Dollars ($100.00) valuation in the proposed Dunn- Averasboro Emergency Ambulance and Rescue Service District for the purpose of providing emergency ambulance and rescue service? "; and WHEREAS, in order to conduct such a referendum the boundaries of such proposed district must be verified, those owning property therein must be determined from the tax records maintained by the County of Harnett, proper notice must be given and other requrirements must be met; NOW THEREFORE, BE IT RESOLVED by the Harnett County Board of Commissioners that the County of Harnett, and its officials and employees, shall be and they are duly author- ized and directed to take all action necessary in order to verify the boundaries of the proposed Dunn- Averasboro Emergency Ambulance and Rescue Service District, to determine the identities of individuals owning property therein as appear from the tax records maintained by the County of Harnett, and to conduct a special property tax referendum at which the above set forth issue shall be submitted to the qualified voters of said district as required and provided by law. RESOLUTION CREATING THE SOUTHEAST WATER AND SEWER DISTRICT OF HARNETT COUNTY WHEREAS, the Harnett County Board of Commissioners (hereinafter "the Hoard ") at its regular meeting on July 5, 1988, resolved that a public hearing be held, pursuant to N. C. Gen. Stat. § 162A- 86'et. seq., to consider creation of the Southeast Water and Sewer District of Harnett County; and WHEREAS, the Board further resolved that the said Public Hearing should be held on Tuesday, August 2, 1988 and directed the appropriate representatives of the County to take the necessary actions to hold the Public Hearing; and WHEREAS, pursuant to N. C. Gen. Stat. § 162A -86, a Notice of Public Hearing was prepared stating the date, hour and place of the hearing and its subject and setting forth a description of the territory to be included within the proposed Southeast Water and Sewer District of Harnett County;. and, WHEREAS, pursuant to said N. C. Gen. Stat. § 162A -86, the Notice of Public Hearing was published once a week for three weeks (plus once during one additional week) in a newspaper that circulates in the proposed district and posted in at least three public places in the district. The Notices of Public Hearing were posted and published the first time not less that twenty days before the hearing; and, WHEREAS, a public hearing was held at 7:00 p.m. on August 2, 1988, in the Courtroom located in the Dunn City Hall, Dunn, North Carolina at which time taxpayers and all other interested persons appeared and were heard concerning the question of creating the. Southeast Water Sewer District of Harnett County; and WHEREAS, the Hoard, following the public hearing, finds that: (1) There is a demonstrable need for providing in the district water services, or sewer services, or both; (2) The residents of all the territory to be included in the district will benefit from the district's creation; and (3) It is economically feasible to provide the proposed service or services in the district without unreasonable or burdensome annual tax levies; and, WHEREAS, the Board recognizes that vital matters to be considered in creating the district are the availability of federal funding and the successful issuance of bonds and /or notes for the purpose of providing funding to provide water and /or sewer to the district, or portions thereof, and the number of users who contract to purchase water and /or sewer; and, WHEREAS, the. Hoard finds that the district shall be defined as set forth in the Notices of Public Hearing and, WHEREAS, the. Board now desires to create the Southeast Water and Sewer District of Harnett County. 683 NOW, THEREFORE, BE IT RESOLVED by the Harnett County Board of Commissioners as follows: 1. It is hereby found that: (a) There is a demonstrable need for providing in the district water services, or sewer services, or both; (b) The residents of all the territory to be included in the district will benefit from the district's creation; and (c) It is economically feasible to provide the proposed service or services in the district without unreasonable or burdensome annual tax levies; and, 2. The Southeast Water and Sewer District of Harnett County is hereby created as provided above and the said District is hereby described as follows: BEGINNING at the point where the eastern bank of the Cape Fear River intersects with the Harnett County - Cumberland County line and runs thence from said beginning point in a northerly and northwesterly direction along and with the said eastern bank of the Cape Fear River to the point on said bank where the dividing line between Duke and Grove Townships meets said bank; and runs thence along, with and as the dividing line between Duke and Grove Townships in an easterly direction to the point where the dividing lines between Duke, Grove and Averasboro Townships intersect; and runs thence along, with and as the dividing line between Averasboro and Grove Townships in a northeasterly direction to the point where said dividing line meets the Harnett County- Johnston County line; and runs thence in a south, southeasterly direction along, with and as the Harnett County, Johnston County line to the point where the Harnett County, Johnston County and Sampson County line intersect; and runs thence along, with and as the Harnett County - Sampson County line in a southwesterly direction to the point where the Harnett County, Sampson County and Cumberland County lines intersect; and runs thence in a westerly direction along, with and as the Harnett County - Cumberland County line to the point and place of beginning. EXCEPTED AND EXCLUDED from the above description is that portion thereof which is located within the existing corporate limits of the City of Dunn and the Town of Erwin. 3. The Clerk to the Board is hereby authorized and directed to cause this Resolution to be published once in each of two successive weeks in the newspaper in which the Notices of Public Hearing were published, and in addition thereto cause to be published with the resolution a notice as provided in N. C. Gen. Stat. 5 162A -87 (b). The County, and its officers, agents and attorneys are hereby directed to take any further action as may be required by the laws of the State of North Carolina to perform the matters and things directed by this Resolution. RESOLUTION :WHEREAS, the Northeast Metropolitan Water District of Harnett County, North Carolina was duly created on April 14, 1976; and WHEREAS, Chapter 162A, Article 4 of the North Carolina General Statutes,.as- amended, provides that the Harnett County Board of Commissioners shall appoint three - individuals to serve on the... governing' body of such a district which governing body is known as the District-Board of the Northeast-Metropolitan Water District of Harnett County, and WHEREAS, it is now necessary for Leonore Tuck to be reappointed to said governing .body; NOW, THEREFORE, BE IT RESOLVED BY THE HARNETT COUNTY BOARD OF :COMMISSIONERS that Leonore Tuck be and she is hereby reappointed to the said District Board for a term expiring on April 14, 1991. Young, Cle RESOLUTION GRANTING TRANSFER OF ZONING AUTHORITY WHEREAS, the Board of Commissioners of the Town of Erwin adopted an ordinance extending its extraterritorial zoning boundaries to become effective September 1, 1988. WHEREAS, on July 18, 1988, the Harnett County Board of Commissioners enacted zoning regulations for the area of Harnett County North of the Cape Fear River, including in this area some of the land designated by Erwin in their extraterritorial Jurisdiction as of September 1, 1988. WHEREAS, the area to be included into the Erwin one mile extraterritorial jurisdiction is designated on Maps Number 0596 and 1506.of the Harnett County Official Zoning Maps. WHEREAS, the Maps 0596 and 1506 planning authority be relinquished to Harnett County Commissioners adopted Zoning with the stipulation that the zoning and for the area so designated on these maps would the Town of Erwin on September 1, 1988. WHEREAS, the Erwin Board of Commissioners have adopted a resolution requesting Harnett County to transfer zoning _and planning authority of the area which - includes portions of S.R. 1774; S.R. 1775; S.R. 1776; and S.R. 1778 to the Town of Erwin effective' September 1, 1988. NOW, THEREFORE BE IT RESOLVED, by the Harnett County Board of Commissioners that effective September 1, 1988 we transfer zoning and planning authority in the area designated on Zoning Maps 0596 - and. 1506 .. as being in the September 1,. 1988 extraterritorial jurisdiction of Erwin to the Town of Erwin.
