RE: SR 1521 Tho Harnott County Board of Commissionorc mot in regular cession on Monday, August 1, 1988, at the County Office Building, Lillington, North Carolina, with the following members present: Bill Shaw, Rudy Collins, Mack Reid Hudson, Mayo Smith, and Chairman Lloyd G. Stewart presiding. Others present were: Dallas H. Pope, County Manager; Glenn Johnson, County Attorney; Vanessa W. Young, Clerk to the Board, and Kay S. Blanchard, Recording Secretary. Chairman Stewart called the meeting to order at 9 a.m. Commissioner Collins offered the invocation. The minutes from the regular meeting of July 18, 1988, and special meeting of July 27, 1988, were approved. Judge Edward McCormick, Chairman, Harnett Youth Planning Board, briefed the Board on programs for youthful offenders which could be alternatives to incarceration. Ray Stone, Highway Maintenance Engineer, North Carolina Department of Trans- portation, appeared before the Board to discuss road matters and situations in Harnett County. Commissioner Collins made a motion to adopt a resolution concerning realign- ment of SR 1521. Commissioner Smith seconded the motion and it passed with a unanimous vote. The resolution is copied in full at the end of these minutes dated August 1, 1988, as document No. 1. Terry Brown, General Manager, Southern Cablevision, reported on the progress of the construction of cablevision in the county. EXTEND CURRENT Jack Bryan, Director, Department of Social Services, briefed the Board on FOOD STAMP CON- status of securing a new contract for mail issuance of food stamps. TRACT Commissioner Smith made a motion to extend current contract for mail issuance of food stamps with Cost Containment, Inc. until August 31, 1988. Commis- sioner Hudson seconded the motion and it passed with a unanimous vote. AMEND. TO SEWER John M. Phelps, II, Public Utilities Attorney, presented for consideration an SYS. ORDINANCE amendment to Ordinance Regulating Sanitary Sewer Systems Operated by County of Harnett. Commissioner Smith moved for the adoption of the amendment to the ordinance. Commissioner Collins seconded the motion and it passed with a unanimous vote. The amendment to the ordinance is copied in full at the end of these minutes dated August 1, 1988, as document No. 2. TAX REFUNDS Bobby Wicker, Tax Administrator, reported on the activities of the Tax Depart- ment for the month of July and requested the following tax refunds: 1. Willie Walter Edwards, 303 West "E" St., Erwin, NC $87.84 2. World Omni Leasing, Inc., Deerfield, FL 65.24 Commissioner Smith made a motion to approve both tax refunds. Commissioner Shaw seconded the motion and it passed with a unanimous vote. The Tax Attorney's Report for the month of June was filed with the Board and is copied in full at the end of these minutes dated August 1, 1988, as document No. 3. Report for the month of June from the Library was filed with the Board. BUDGET AMENDMENTS Dallas H. Pope, County Manager, requested a budget amenament for Special Appropriations, Code 10- 8700 -168, Old Library Project, $5,000. increase for engineering costs and plans. Commissioner Hudson made a motion to approve the budget amendment. Commissioner Smith seconded the motion and it passed with a unanimous vote. Dallas H. Pope, County Manager, requested the following budget amendment for Health Department Revenues: Code 10- 3480 -020 Health Promotion $17,462. Decrease Code 10- 3480 -022 Child Health Care 25,000. Decrease Code 10- 3990 -000 Fund Balance Appropriated 42,462. Increase The budget amendment was needed to correct revenues that were budgeted incor- rectly. Commissioner Hudson made a motion to approve the budget amendment. Commissioner Shaw seconded the motion and it passed with a unanimous vote. Tom Meece, Director, Planning and Development, requested a budget amendment for Inspections, Code 10 -5600 -074, Capital Outlay- Equipment, $815. increase to purchase radio for new inspector. Commissioner Collins made a motion to approve the budget amendment. Commissioner Hudson seconded the motion and it passed with a unanimous vote. BUDGET AMENDMENTS AGREEMENT RE: MODERN MACHINE MANUFACTURING Dallas H. Pope, County Manager, . requested a budget amendment for Special Approprations, Code 10- 8700 -153, Capital Reserve - Library, $26,000. increase to close out New Library Building Project. Commissioner Collins made a motion to approve the budget amendment. Commissioner Smith seconded the motion and it passed with a unanimous vote. Rodney Tart, Director, Public Utilities, requested a budget amendment for Enterprise Fund, Code 30- 4100 -074, Capital Outlay- Equipment, $3,500. increase; and Code 30- 4100 -120, Capital Reserve, $3,500. decrease, to replace horizontal boring equipment that can not be repaired. Commissioner Collins made amotion to approve the budget amendment. Commissioner Smith seconded the motion and it passed with a unanimous vote. Gerald Smith, Director, Youth Services,requested the following budget amendment: Code 10- 7730 -003 Salaries & Wages, Part -time $11,070. Increase Code 10- 7730 -005 F.I.C.A. Tax Expense 832. Increase Code 10- 7730 -045 Contracted Services 2,000. Increase The budget amendment was needed to close out checking account incorporated for Youth Services and continuing work for part -time employee. Commissioner Hudson made a motion to approve the budget amendment. Commissioner Smith seconded the motion and it passed with a unanimous vote. Dallas H. Pope, County Manager, briefed the Board on request from Lee - Harnett Mental Health to transfer "Willie M" facility from Lutheran Family Services to Lee - Harnett Mental Health.. The Board tabled the request. Tom Meece, Director, Planning and Development, presented a proposed agreeemnt for Industrial Building Renovation Funds for Modern Machine Manufacturing in Coats. Commissioner Hudson moved that the County Manager and the Board of Commissioners Chairman be authorized to execute the agreement. Commissioner Collins seconded the motion and it passed with a unanimous vote. CORRECTIONS TO Dallas H. Pope, County Manager, requested the following corrections be made MINUTES - to the April 18, 1988, Board of Commissioners Meeting minutes: . Book 16 - Page 582 - 7th paragraph - 2nd line The word "December" should be "March" 2. Book 16 - Page 583 - 1st paragraph - 2nd line and 3rd line The amount "$5,300." should be "$8,400 ". Commissioner Collins made a motion to approve the corrections. Commissioner Shaw seconded the motion and it passed with a unanimous vote. Stewart, Chairman Amendment to Ordinance Regulating Sanitary Sewer System Operated by the County of Harnett (Part B, Paragraph 3) W I T N E S S E T N: The Board of Commissioners of Harnett County (hereinafter "the Board ") on August 6, 1984 adopted an ordinance entitled "Ordinance Regulating Sanitary Sewer System Operated By the County of Harnett ". The Board now desires to amend the Ordinance by establishing therein a structure for the determination of connection charges or fees. The Board finds that a fair and reasonable fee to be charged to individuals or businesses connecting to County owned or operated sewage collection lines should be based on two considerations. The first is the cost to the County for the installation of service laterals, including costs for labor, materials and related administrative matters. The second consideration is the effect of additional customers on the existing facilities, including the use of current plant capacity and depreciation of the system and the consequential need arising therefrom to expand facilities, and to replace lines and equipment when necessary. The Board has made inquiry relative to the costs associated with the first consideration mentioned and has been advised that the cost of installing a sewer service lateral, including those items mentioned above is Two Hundred Dollars ($200.00). As to the second consideration, the Board has been advised that the effect of additional customers on existing facilities may be, expressed (in terms of money) by calculating an amount equalling the estimated daily sewage flow for the particular type of property to be connected, multiplied by the estimated cost per gallon of sewer treatment facilities. With respect to standards for estimated daily sewage flows, the County has flow data available, based on water use, which provides the necessary information for residential units and has such data for numerous types of establishments as provided by the North Carolina Department of Human Resources, Division of Health. Services in Section .1949(b) Table 1 of the Laws and Rules for Sanitary Sewage Collection, Treatment and Disposal of the North Carolina. Administrative Code Title 10, Department of Human Resources, Chapter 10, Health Services, Environmental Health Subchapter 10A Sanitation. In addition, the Board has been informed that at the present time Two Dollars ($2.00) per gallon is the generally recognized cost of constructing sewer treatment facilities. The Board finds that the standards set forth are reasonable and based upon the best information available. In order to promote the continued public health, welfare and safety of the citizens of Harnett County, the Board desires to provide for a sewer connection fee which reflects the dual considerations described above and finds that a fee which is the aggregate of (1) the estimated cost of the installation of sewer laterals, and (2) the amount of Two Dollars ($2.00) multiplied by the daily sewage flow from the type of property to be connected is a fair and reasonable fee to be charged persons and businesses for the connection of their properties to County owned or operated sewer collection lines. NOW, THEREFORE, BE IT ORDAINED BY THE HARNETT. COUNTY BOARD OF COMMISSIONERS that Part B, Paragraph 3 of the "Ordinance Regulating Sanitary Sewer System Operated by the County of Harnett" entitled "Tap on fees" shall be deleted in its entirety, and in lieu thereof, the following shall be and hereby is inserted: 3. Sewer connection fee: a. A sewer connection fee shall be charged to any and all persons prior to the connection of their properties to a county owned or operated sewage collection line. The amount of such connection fee shall be the aggregate of the following: (1) The sum of Two Hundred ($200.00) Dollars plus (2) The sum as calculated pursuant to subsection 3(b) herein. b. The Superintendent is directed to administratively prepare, and amend from time to time, as necessary, an application or form indicating the information required to make such calculation. d. The unit or type of establishment which is to connect to a county owned or operated sewage collection line shall be inspected by the Superintendent or his representative to verify the information provided pursuant to subsection 3(c). e. Upon payment of the sewer connection fee, and completion of all other requirements provided in this ordinance, the sewer connection shall be completed.
