11161987 (2)433 SOUTH CENTRAL WATER $ SEWER DISTRICT, NOVEMBER 16, 1987 CALL TO ORDER RATE SCHEDULE TABLED The Harnett County Board of Commissioners sitting as the governing body of South Central Water and Sewer District met November 16, 1987, in the County Office Building, Lillington, North Carolina, with the following members present: Rudy Collins,Bill Shaw, Mack Reid Hudson, Mayo Smith, and Chairman Lloyd G. Stewart presiding. Others present were: Vanessa W. Young, Clerk to the Board; Dallas H. Pope, County Manager; Glenn Johnson, County Attorney, and Kay S. Blanchard, Recording Secretary. Chairman Stewart called the meeting to order at 9:30 p.m. Rodney Tart, Director, Public Utilities, presented a resolution approving rules and regulations relating to rate schedule for the South Central Water and Sewer District of Harnett County. After discussion, the Board tabled the matter. RESOL. RE: PURCHASE John Phelps, Public Utilities Attorney, presented a resolution regarding OF TANK SITE option to purchase office and tank site for South Central Water and Sewer District. Commissioner Shaw made a motion to approve the resolution. Commissioner Smith seconded the motion and it passed with a unanimous vote. The resolution is copied in full at the end of these minutes dated November 16, 1987, as document No. 1. RESOL. RE: CONST. OF PHASE II ADJOURNMENT DOCUMENT NO, 1. John Phelps, Public Utilities Attorney, presented a resolution implementing procedures relating to construction of phase II of the water distribution system for the South Central Water and Sewer District of Harnett County. Commissioner Shaw made a motion to approve the resolution. Commissioner Hudson seconded the motion and it passed with a unanimous vote. The resolution is copied in full at the end of these minutes dated November 16, 1987, as doucument No. 2. Young, cf. la�c{ Kay Blanchardhard, , Recording Secretary RESOLUTION REGARDING OPTION TO PURCHASE OFFICE AND TANK SITE WHEREAS, the South Central Water and Sewer District of Harnett County (hereinafter "the District ") is now constructing water distribution lines in portions of the District and will soon be delivering and selling water to customers; and WHEREAS, the Harnett County Board of Commissioners, sitting as the governing body of the District (hereinafter "the Board ") has determined that a site will be needed by the District for an operations and maintenance office and that a site may also be needed for a water storage tank; and WHEREAS, the District has the opportunity to enter into an "Option to Purchase" a certain 3.5 acre tract of real estate within the District which is located along S.R. 1120 adjacent to the Anderson Creek Medical Center, and WHEREAS, the site above described is of sufficient size to accommodate an operations and maintenance office as well as a water storage tank, and is physically located at a point which is hydraulically suitable for said tanks; and WHEREAS, the above mentioned tract is currently owned by Charles W. Godfrey and E. Craig Wall, Jr. of Conway, South Carolina, as Agents and Attorneys in Fact for Canal Land Limited Partnership and the Gibson -Wall Company as set'forth in that certain Power of Attorney 440 recorded in Book 827, Page 430 of the Harnett County Registry and that certain Agreement for Appointment of Agent recorded in Book 827, Page 434 of the Harnett County Registry and the said owners have agreed to grant to the District the option to purchase said real estate for the sum of $2,000.00; said option to extend until June 1, 1988; and WHEREAS, it has been agreed that the arnount of the option money stated above, upon exercise of the option, shall be applied towards the total sales price of said real estate, which total sales price is $25,000.00; and WHEREAS, the said Owners have agreed that upon exercise of the option and payment of the-remaining sales price, that. said Owners shall convey the real estate described to the District by good and sufficient deed, free and clear of all liens and encumbrances; and WHEREAS, the Board now desires to authorize the District to enter into said "Option to Purchase" as set forth herein. NOW THEREFORE, BE IT RESOLVED by the Harnett County Board of Commissioners sitting as the governing body of the District that: 1. That the District is hereby authorized to enter into an "Option to Purchase Real Estate" with the aforementioned Owners for the tract herein described, upon the terms set forth herein. 2. That the District, its officers, agents and attorneys are hereby authorized to documents in order to enter into the said "Option to Estate" Duly adopted this 16th day of November, 1987, upon take such actions and execute the necessary. RESOLUTION IMPLEMENTING PROCEDURES RELATING TO CONSTRUCTION OF PHASE II OF THE WATER DISTRIBUTION SYSTEM FOR THE SOUTH - CENTRAL WATER AND SEWER DISTRICT OF HARNETT COUNTY W I T N E S S E T H: The Harnett County Board of Commissioners, sitting as the governing body of the South Central Water and Sewer District of Harnett County (hereinafter "the Board ") in planning and studying the water distribution system for the District determined that it was necessary to construct the initial system therein in phases. Phase I of the system is now under construction, and the Board now desires to implement the necessary studies and application processes to move forward towards the potential construction of Phase II of the project. THEREFORE, BE IT RESOLVED by the Harnett County Board of Commissioners sitting as the governing body of the District that: 1. The District, its officers, agents and attorneys are hereby directed to take such action as necessary to apply to the appropriate federal and /or state agencies and departments for funds to construct Phase II of the District system; 2. The District, it officers, agents and attorneys are directed to take such action as necessary to employ Black & Veatch Consulting Engineers to amend the previously written preliminary engineering report as required to implement the funding application described above.
