SOUTH CENTRAL WATER AND SEWER DISTRICT MEETING, JUNE 16, 1986

CALL TO ORDER
The Harnett County Board of Commissioners sitting as the governing body of the South
Central Water and Sewer District of Harnett County met in special session on Monday,
July 16, 1986, in the Commissioners Room, County Office Building, Lillington, North
Carolina, with the following members present: Lloyd G. Stewart, Bill Shaw, Rudy Colli
and Chairman Jesse Alphin presiding. Commissioner Jack Brock was absent. Others
present were Vanessa W. Young, Clerk to the Board; John M. Phelps, II, representing
the County Attorney's Office; Dallas Pope, Assistant County Manager; and Hollie J. Wade
Recording Secretary.
Chairman Jesse Alphin stated that as pursuant to the various notices given to him and
the Harnett County Board of Commissioners as provided by law, he called to order the
meeting of the Harnett County Board of Commissioners sitting as the governing body of
the South Central Water and Sewer District of Harnett County at 9:15 p.m.
RESOLUTION RE: Attorney John M. Phelps presented to the Board for consideration a resolution author -
USER AGREEMENTS izing the execution of the Water User Agreements and other agreements as necessary to
obtain water customers for the South Central Water and Sewer District. Following a
discussion, Commissioner Shaw made a motion that the following resolution be approved;
Commissioner Stewart seconded the motion and it carried with a unanimous vote:
RESOLUTION REGARDING WATER USER
AGREEMENTS FOR THE SOUTH CENTRAL
WATER AND SEWER DISTRICT OF HARNETT COUNTY
Whereas, the South Central Water and Sewer District of Harnett County (hereinafter
"District ") must obtain an adequate number of water customers to assure the feasibility
of constructing a water distribution system in the District and to meet certain con-
ditions set forth by the Farmers Home Administration; and
Whereas, in order to obtain said water customers the management of the District
has found it necessary to enter into agreements with individuals and /or business
entities (hereinafter, "Owners ") which own properties upon which ten or more water
customers are located; and
Whereas, said agreements provide for reimbursement to said Owners by the District
for certain portions of existing water systems, and for the sign up of said water
customers; and
Whereas, said agreements are subject to the final funding of and completion of
the water distribution facilities in the District; and
Whereas, several such agreements have been entered into by the District and
others are being drawn at this time; and
Whereas, the Harnett County Board of Commissioners, sitting as the governing
body of the District, now desires to authorize the District to enter into all such
agreements, both prospectively and retrospectively.
NOW, THEREFORE, BE IT RESOLVED BY THE HARENTT COUNTY BOARD OF COMMISSIONERS,
SITTING AS THE GOVERNING BODY OF THE SOUTH CENTRAL WATER AND SEWER DISTRICT OF
HARNETT COUNTY that:
1. All "Agreements" and "Water Users Agreements" heretofore entered into by the
District with various owners are hereby authorized and ratified.
2. The District, its officers, agents, attorneys and representatives are hereby
authorized to negotiate, enter into and execute such other "Agreements" and "Water
Users Agreements" as necessary to obtain water customers.
Duly adopted this 16th day of June, 1986, upon motion made by Commissioner
Shaw, seconded by Commissioner Stewart and passed by the following vote:
