12021985651 HARNETT COUNTY BOARD OF COMMISSIONERS MEETING, DECEMBER 2, 1985 The Harnett County Board of Commissioners met in regular session on Monday, December 2, 1985, in the Commissioners Room, County Office Building, Lillington, North Carolina, with the following members present: Lloyd G. Stewart, M. H. Brock, Bill Shaw, Rudy Collins, and Chairman Jesse Alphin presiding. Vanessa W. Young, Clerk to the Board; Bob Jones, representing the County Attorney's Office; and Hollie J. Wade, Recording Secretary were also present. CALL TO ORDER Chairman Jesse Alphin called the meeting to order at 9:15 a.m. PRAYER Commissioner Bi11 Shaw led the morning prayer. MINUTES APPROVED The minutes from the Harnett County Board of Commissioners meeting of November 18, 1985, were approved as read. DOT Ray Stone, Highway Maintenance Engineer with the North Carolina Department of Trans- portation appeared before the Board to discuss road matters and situations in Harnett County. Commissioner Brock made a motion that the Board adopt the following resolution request ing the Board of Transportation to add the access road to K. Edward Greene Development to the State System for Maintenance; Commissioner Collins seconded the motion and it carried with a unanimous vote: HARNETT COUNTY, NORTH CAROLINA. RESOLUTION BE IT RESOLVED by the proper execution of this document that the Harnett County Board of Commissioners do hereby request the North Carolina Board of Transportation to add the Access Road to K. Edward Greene Development which is located in Duke Township to the State System for Maintenance. This the Second Day of December, Nineteen Hundred and Eighty -Five. Young, Clerk Commissioner Stewart informed the Board that the County had received a petition from the property owners on SR 1313 requesting that this Secondary Road be paved. Commis- sioner Stewart made a motion that this petition be conveyed to the Board of Transpor- taion and that SR 1313 be considered for paving; Commissioner Collins seconded the motion and it carried with a unanimous vote. Commissioner Stewart also informed Mr. Stone that he had been contacted by the citizens on SR 1257 and SR 1131 concerning the conditions of these roads and requestea that the Department of Transportation service these two secondary roads. Commissioner Shaw and the Commissioners reiterated their concerns to Mr. Stone over the hazardous conditions of Highway 210. He stated that over the holidays there were two more fatalities and four serious injuries on this road. Following a lengthy discussion, it was the determination of the Board to prepare a resolution to be forwarded to the Board of Transportation expressing their concerns. PURCHASE OF LAND Rodney Tart, Director of Metro, appeared before the Board and stated that at the FOR METRO Commissioners meeting of October 22, 1985, he had requested authority to purchase a tract of land adjacent to the Metro site. At that meeting, the Board authorized Mr. Tart to enter into a ninety day option. Mr. Tart explained that his purpose for coming before the Board today was to get the Board's approval to proceed with the purchase of this land. Following a discussion, Commissioner Shaw made a motion that Mr. Tart be authorized to purchase the tract of land adjacent to the Metro site which consists of approximately nine acres from Wombles Realty for the price of $17,000; Commissioner Stewart seconded the motion and it carried with a unanimous vot BUDGET AMENDMENT Commissioner Brock made a motion that Code 8100 -074, Capital Outlay, Water Fund, be METRO increased by $17,000 for the purchase of this property; Commissioner Collins seconded the motion and it carried with a unanimous vote. Margaret Randall, Director of the Library, appeared before the Board and reported BOOKMOBILE BID that the County on November 21, 1985, received and opened bids for the purchase AWARDED TO THOMAS BUS COMPANY pod • of a new bookinobile. The County received, one. replg from the Black River Company out of Camden, ;South Carolina,.statingtheir inability to comply with the bid bond requirements and received two formal bids on a 14,000 1b. unit -- One from Thomas Bus. - Company ,out of -High Point with the base bid. of $42,718.35 and a bid from Aero Products, Inc., out of Longwood, Florida. with the base bid of $42.,491. Aero Product also submitted a bid for a smaller 10,000 lb. unit with a base bid of $39,791.51 but this unit did not imeet the required specifications. Mrs. Randall continued to ex- plained that a special committee consisting of Commissioner Collins; Gordon Springle Chairmanof: the Library Board; and M. 11 Brock, County Manager; met to study the proposals.. Mrs Randall then recognized Mr. Springle to present to the Commission- ers the recommendation of the Committee. Mr. Springle stated that it was the :..recommendation of the Comnuttee to go with Thomas Bus Company with the base price of- $42,718.35. It was explainedthatthiswasnotthelow .bid - thatthe low bidder was Aero Products, -Inc., but their bid did not meet the reguired specs Their bid provided for a diesel engine plus the interior shelves were of alununum rather than wood. Following: a discussion, Commissioner Collins made a motion that the bid for . the bookmobile be:.awardedto Thomas Bus Company for the base price of $42,718-35 and that Mr. Brock, County Manager, be authorized -.to. sell the old bookmobile by accepting sealed bids, Commissioner Brock seconded the motion and it carried. Commissioner Brock made a motion that Code 8100-074 be amended by.`$40,000'for the purchase of the bookmobile; Commissioner Collins seconded the motion and it carried.. ORDINANCE RE: TerryL.014ade, Tax Appraiser, appeared before the Board and presented to the Com- LAND RECORDS missioners for their consideration an Ordinance to Implement the. Harnett County MODERNIZATION Land, Records- Modernization Program.. Following a discussion, Commissioner Stewart PROGRAM made a motion that the following ordinance be adopted, Commissioner Collins seconded the motion and it carried With a _unanimous - :vote. Sectioh 2: The Register of. Deeds:. shall -not accept. for registration any map or instrument affecting real property unless the grantees-mailing address is affixed on the face thereof. Section 3: The Register. of, Deeds shall not accept for - registration any deed, deed of trust, map or plat, or any other instrument containing a description.'. of the real property affected by the instrument unless the parcel` identifier numbers . of all parcels affected have been assigned and are recorded on the face of the instrument. However, until the Land Records Office becomes operational, as describe° in Section 4 below, :;the words "of all parcels affected shall raean the following:' .1.11 In a di.vision;of a tract ar tracts the- parcei:- number.(s) of the tract(s):: being - divided shall be given. A subdivision map shall be ....handled: in the same manner.. 2. Section 4: Until such time as the County Land .Records Office becomes operational with respect to creating and assigning geo-coded parcel identifier number(s), the County Tax Supervisors Office shall create parcel numbers in accordnace with the procedures 111 effect at that time When the Land Records Office assumes responsibility for maintenance and creation . of geo -coded land records, it shall do so in accordance with the county procedures manual for creating and assigning parcel identifier numbers, and sections 5 -9 herein shall become operable at such time as the Land Records Office becomes functional. . Section 5: Presentation of the instrument to the Land Records Office as herein described does not constttute f.iling the instrument for registration.. Section 6: The Land Records Office shall have exclusive authority to create and assign parcel identifier numbers and shall maintain a procedures manual for that purpose_ The procedures manual shall include provisions to insure that no two parcels of property will - be assigned the same parcel identifier number. 1 Section 7: Every Map (including a map incorporated by reference in a deed), subdivi- sion plat, or land survey plat that creates or more fully defines one or more parcels of land must have a parcel identifier number written on it before it can be registered. This requirement shall not apply to flood plain maps, annexation and municipal boundary maps, and similar maps prepared by governmental agencies. Section 8: All instruments pertaining to the same parcel or to related parcels shall be assigned parcel identifier numbers and processed according to the date and time when they were presented to the Land Records Office. Section 9: (a) Any deed, deed of trust, map or plat, or other instrument that contain a description of a parcel of parcels not previously plotted on the county large -scale cadastral maps and for which a parcel identifier number does not exist must contain a description of the parcel or parcels of suffi- cient accuracy and detail that the Land Records Office is able to locate and plot the parcel or parcels on the county maps from the description standing alone, or with the aid of supporting maps or other documents furnished by the person presenting the instrument. (b) The description contained in any map or plat that is to be registere and that creates or more fully defines a parcel or parcels not previously plotted on the county large -scale cadastral maps and for which a parcel identifier number does not exist must be sufficiently precise to create a consistent closed parcel boundary within a plotting accurancy of 1/40 (one- fortieth) of an inch. Section 10: This ordinance shall become effective January 1, 1986. M. H. Brock, County Manager, informed the Board that the County has received written notification from the Department of Natural Resources that Harnett County has been offered an award of $16,000 in matching funds under the North Carolina Land Records Management Program for our land records improvement program. Following a discussion, Commissioner Brock made a motion that the County accept the grant award of $16,000; Commissioner Shaw seconded the motion and it carried with a unanimous vote. TAX COLLECTOR's Thomas Allen, Tax Collector, appeared before the Board and reported on the activities REPORT of his department for the month of November and his plans for December, 1985. TAX REFUND Thomas Allen, Tax Supervisor, appeared before the Board and requested a Tax Refund to ,JOHN DEER LEASING John Deer Leasing Company in the amount of $469.79 for a tractor which was listed on IICOMPANY the Jerome Langdon Farm. This farm is located in Johnston County but the tractor was listed as being in Harnett County. Commissioner Collins made a motion that the tax refund to John Deer Leasing in the amount of $469.79 be approved; Commissioner Shaw seconded the motion and it carried with a unanimous vote. The Board welcomed Bobby Wicker who was employed with the Tax Supervisor's Office as a Tax Appraiser. Mr. Wicker expressed his appreciation to the Board for giving him an opportunity to work with the County. Reports on the Sheriff's Department, Ambulance Service, and the Inspections department were filed with the Board. REGULAR MEETING Chairman Jesse Alphin duly adjourned the regular meeting of the Board at 11 :00 a.m. ADJOURNED LREORGANIZATION ''OF THE BOARD At 11 :15 a.m., Vanessa W. Young, Clerk to the Board, called the meeting to order. Commissioner Brock reported that the purpose of the executive session was to discuss the upcoming appointments. Vanessa W. Young, Clerk to the Board, asked that business be carried on and opened the floor to nominations for Chairman of the Board. Commissioner Collins made a motion that Jesse Alphin be nominated as Chairman; Commissioner Stewart seconded the motion that Jesse Alphin be nominated as Chairman. Commissioner Shaw made a motion that nominations for Chairman be closed and that Jesse Alphin be elected as Chairman by acclamation; Commissioner Brock seconded the motion and it passed with a unanimous vote. Mrs. Young officially declared Jesse Alphin as the Chairman of the Harnett Commissioners. Mrs. Young and the Board congratulated Mr. Alphin on his reappointment as Chairman. With Chairman Alphin presiding, he opened the floor to nominations of Vice - Chairman of the Harnett County Board of Commissioners. Commissioner Shaw made a motion that Lloyd G. Stewart be nominated as vice - chairman; Commissioner Collins seconded the motion that Mr. Stewart be nominated as vice - chairman. Commissioner Brock made a motion that nominations for vice - chairman be closed and that Mr. Stewart be elected by acclamation as vice - chairman of the Harnett County Board of Commissioners; Commis- sioner Shaw seconded the motion and it carried with a unanimous vote. The Board congratulated Commissioner Stewart on being elected as vice- chairman. Commissioner Brock made a motion that the following appointments for one year be approved: The law firm of Bryan, Jones, Johnson, & Snow appointed as the County 654 Attorney; E. Marshall Woodall reappointed as Tax Attorney; Jean Irvin reappointed as Veteran's Service Officer; and Thomas Allen reappointed as Tax Collector; Commis sioner Shaw seconded the motion and it carried with a unanimous vote. Deadline in the Office is February 28, 1986. Penalty begins on March 3, 1986. Extensions which are requested in writing prior to February 28, 1986, will be extended through April 15, 1986.
