09161985HARNETT COUNTY BOARD OF COMMISSIONERS MEETING, SEPTEMBER 16, 1985 CALL TO ORDER PRAYER MINUTES APPROVED GINGER MCLAMB HOLLERIN CHAMPION RESOLUTION EMERGENCY MEDICAL SERVICES WEEK RESOLUTION 4 -H AGENT The Harnett County Board of Commissioners met in regular session on Monday, September 16, 1985, in the Commissioners Room, County Office Building, Lillington, North Carolina, with the following members present: M. H. Brock, Lloyd G. Stewart, Rudy Collins, Bill Shaw, and Chairman Jesse Alphin presiding. Vanessa W. Young, Clerk to the Board; John Phelps, representing the County Attorney's Office, and Kay Blanchard, Recording Secretary, were also present. Chairman Jesse Alphin called the meeting to order at 7:00 p.m. Commissioner Lloyd G. Stewart led the evening prayer. The minutes from the Harnett County Board of Commissioners meeting of September 3, 1985, were approved as read. Chairman Jesse Alphin welcomed Mrs.Ginger McLamb, National "Hollerin" Champion in the Ladies Calling Division, to the Commissioners meeting. Commissioner M. H. Brock presented to Mrs. McLamb, a letter of congratulations on her recent achievement. Mrs. McLamb expressed her appreciation to the Board of Commissioners and demonstrated her "calling" that won the contest. Commissioner Brock made a motion to adopt the following resolution proclaiming the week of September 29 through October 5, 1985, as Emergency Medical Services Week. Commissioner Collins seconded the motion and it carried. WHEREAS, the Emergency Medical Services System in Harnett County provides critical life- saving medical care to its citizens; and WHEREAS, thousands of emergency medical technicians, paramedics, emergency department physicians and nurses are trained to handle life- threaten- ing injuries and illnesses; and WHEREAS, the efforts of these trained men and women have saved thousand of lives; and WHEREAS, concerned citizens and elected officials are serving on regional emergency medical services councils throughout the State to further guide the local development of a comprehensive emergency medical care system; and WHEREAS, a large number of these individuals unselfishly volunteer their time to provide this valuable service; and WHEREAS, recognition is due these individuals who serve on behalf of all North Carolinians; now THEREFORE, WE, the Harnett County Board of Commissioners, do hereby proclaim the week of September 29 through October 5, 1985, as EMERGENCY MEDICAL SERVICES WEEK in Harnett County and commend this observance to our citizens. HARNETT COUNTY BOARD OF COMMISSIONERS s /Jesse Alphin Jesse Alphin,Chairman Sue Gooden, Harnett County 4H Agent, appeared before the Board and presented for their approval, a proclamation designating the week of October 6 -12, 1985, as 4 -H Week in Harnett County. Commissioner Collins moved for the adoption of the proclamation. Commissioner Shaw seconded the motion and it carried: WHEREAS, Harnett County's 4 -H members, leaders and parents are observing National 4 -H Week, October 6 -12, 1985; and WHEREAS, in recognition of the contribution 4 -H has made in youth leadership and development and in improving the quality of life for millions of Americans in its more than 75 years of existance; and WHEREAS, 4 -H Club work is an educational program of the North Carolina Agricultural Extension Service and is supervised on the County level by the 4 -H staff along with the help of local volunteer 4 -H leaders who are outstanding men and women in their communities; and WHEREAS, this year's National Theme, "4 -H for Youth for America ", reflects the basice concept of 4 -H - -to help youth acquire knowledge and develop life skills that enable them to become self- directing, productive and contributing members and leaders of our great nation. 4 -H for Youth for America depicts the broad outreach of 4 -H to all youth and reflects the impact of the Cooperative Extension Service 4 -H program on American society; and 634 APPOINTMENTS DOMICILIARY HOME ADVISORY COMMIT - TEE APPOINTMENTS JUVENILE TASKFORCE APPOINTMENTS REGION "M" AGING ADVISORY COMMITTEE'' PUBLIC HEARING. PUBLIC HEARING" HEARING CLOSED_ REGULAR MEETING CALLED BACK TO ORDER ORDINANCE ADOPTED WHEREAS, 4- H -members working ,With learn by-doing projects put into practice new.skills and science as they strive "To Make The Best Better," the motto of 4 -H Club Work, and WHEREAS, the' citizenship and leadership training which 4-11 ceive in this program is a valuable asset to our democratic way now members re of life; THEREFORE, we the Board of Commissioners of the County of Harnett, do hereby proclaim October 6 -12, 1985, as NATIONAL 4 -H WEEK IN HARNETT COUNTY and urge all of our people to encourage and support the work of the 4 -H Clubs in Harnett County and North Carolina. HARNETT COUNTY BOARD OF COMMISSIONER s /Jesse Alphin,' Chairman Commissioner Collins made a motion to appoint Mrs. .- Phyllis Watson, P. O. Box 753, Buies Creek, NC to the Domiciliary Home Advisory Committee, and to reappoint Mrs. Bertha Bradley and Mrs. Alma Wellons. Commissioner Shaw seconded the motion' and it carried with a unanimous vote. Commissioner -Shaw "moved that the following recommended '. new members be appointed to serve a two -year term on the Harnett County Juvenile Task Force. Commissioner Stewart seconded the motion and it carried with a unanimous vote: 'Henry Cox, Gloria Lingle, Julia Powers, Earl Lamm, Cecila Coats, and Sue Goodell: Commissioner Shaw made a motion that Mrs. Ida Hinnant, Mrs. Wanda Gregory,'. and Mrs. Pearl Stroud be reappointed to. serve on the Region "M" Aging Advisory Committee;. for 1986 and that Rev. N. L. Stroud, Mrs. Maude Bost, and Mrs. - Curtis Guy be appointed as new members. Commissioner Collins seconded the motion and it carried with a unanimous vote. At 7:30 p.m., Chairman Alphin- adjourned the regular Board of Commissioners meeting and called to order a public hearing concerning An Ordinance Amend- ing and Ordinance Entitled "Subdivision Regulations for Harnett County, North Carolina" adopted April 4,'1977. Ervin Dobson, Director of Planning, explained the Ordinance. Marshall Woodall, representing the- Harnett - County Bar Association, stated that they supported this ordinance and requested that Mr. Dobson meet with surveyors and attorneys in order to make guidelines to streamline the, .Ordinance but protect the citizens. Commissioner Brock made a motion to honor Mr. Woodall' request. Commissioner Shaw seconded the motion and it carried. After no one else appeared to, speak pro or con ebncerning' the .ordinance, Chairman Jesse Alphin closed the public hearing at 7 :45 p.m. Chairman Jesse Alphin called the regular session of the Harnett County Board of Commissioners meeting back to order at 7 :45 p.m.' Commissioner Shaw made a motion to adopt the following ordinance; Commis- sioner Collins seconded the motion and it carried with a unanimous vote ORDINANCE AMENDING AN ORDINANCE ENTITLED SUBDIVISION REGULATIONS FOR HARNETT COUNTY, NORTH CAROLINA, ADOPTED APRIL 4, 1977 WHEREAS,' this Board adopted an Ordinance on April 4, 1977, entitled "Subdivision Regulations for Harnett County, North Carolina"; and WHEREAS, this Board is of the opinion that the amendments set forth below are necessary to the clear and efficient working of the Ordinance; and WHEREAS, as provided by Section 6.2 of the Ordinance, the said amend- ments have been submitted °to the Harnett County Planning Board for review and recommendation, -where they have been favorably reported; and WHEREAS, pursuant to N. C. Gen. Stat. 153A -323, after notice, as by law provided, a public hearing has been held concerning adoption of the amendments NOW,' THEREFORE, BE IT ORDAINED: 1. That Section 2.0 (17) of the Ordinance be amended by deleting Section 2.0. (17) as it is now written and substituting the following 17. Minor Subdivision means: b5 (1) Any subdivision which creates a maximum of three (3) additional lots which front on an existing public road or have permanent access or egress by easement or other approved means; or (2) Any subdivision creating five (5) lots or less fronting on an existing public road which: (a) does not involve any new public road or will not involve any new road, whether public or private, to give access to interior lots or parcels, (b) does not involve the extension of public sewage or water lines or the creation of new drainage easements by a municipality, a metropolitan water - sewage district, sanitary district or a public utility, (c) will not adversely affect the development of the remainder of of the parcel, if any, or of adjoining property, (d) will not create any new or residual parcels which do not satisfy the requirements of this ordinance or other applicable state and local controls, and (e) is not entirely or substantially located in a flood hazard area as delineated on the Harnett County Flood Boundary Map. 2. That Section 3.4 of the Ordinance be amended to read as follows: A. The subdivider shall meet all provisions of this Ordinance, except Article III, Sections 3.1 and 3.2, which are hereby waived. B. Review Process of Minor Subdivisions Minor subdivisions, as defined in Section 2.0 (17), shall be reviewed and approved by the following process: (1) Consultation with County Planning Staff - -Any person who proposes a minor subdivision should first consult with the County Planner or designated staff to ensure that he understands the requirements for the approval of a record plat. (2) Recording /Approval (a) After consultation with the Palnner or staff, the subdivider shall file a record plat with the County Planning Office and after complying with Sections 3.4 (B)(2)(b) -(e) herein shall file said plat with the Register of Deeds prior to obtaining any permit issued by a county or state agency. (3) (b) The record plat shall be in the form and shall include the information required by Sections 3.3 -A and B of the Harnett County Subdivision Regulations. (c) It shall have the approval and signature of the Harnett County Manager. In the absence of the County Manager, a County Commission- er shall sign and approve the record plat. (d) It shall have the necessary approval of any other agencies, as may be provided by state law and /or local ordinance. (e) The Planning Director may approve the record plat or disapprove it if the subdivision is not a minor subdivision or if the record plat does not contain the required information. The Planning Director may also refer the record plat to the Planning Board if he is unsure the plat meets requirements of this ordinance. Final Approval - If the Planning Director approves the record plat, he shall enter the following certificate thereon: I hereby certify that this record plat complies with the Subdivision Reg- ulations of Harnett County, North Carolina; and that this plat has been approved for recording in the Register of Deeds of Harnett County. Commissioner Stewart seconded the motion and it carried. Commissioner Shaw made a motion to approve a subdivision plat-for Pine Ridge Estates; 49 lots located in the Anderson Creek area ,at the intersecti of SR 1120 and SR 1156. Commissioner Collins seconded the motion and it carried Commissioner Collins made a motion to approve a. subdivision plat for C. L. Byrd; a.:7-lot subdivision located at the intersection of HWY. 55 and SR 1006 Commissioner Shaw seconded the motion and it carried. Federick Wagstaff Commissioner Collins made °a motion to approve a subdivision plat for Federick Wagstaff; 5 lots located in the Duncan area on SR 1406. Commissioner -Shaw seconded the motion and it carried. LIBRARY Mrs.. Margaret Randall appeared before the Board and requested permission BOOKMOBILE to advertise for bids for a new bookmobile. After a.discussion, the Commissioners decided-to table the matter for further study. SOUTH CENTRAL WATER PROJECT Commissioner Shaw reported on the results -of the South Central Water and Sewer Referendum. On Commissioner Shaw's request, Chairman Alphin ordered that the Certificate of Canvass be duly recorded in its entirety in the minutes. CERTIFICATE OF CANVASS OF THE - HARNETT COUNTY BOARD OF ELECTIONS FOR THE SPECIAL ELECTION OF THE SOUTH CENTRAL WATER AND SEWER DISTRICT ON THE 10TH DAY OF SEPTEMBER, 1985. WE, the undersigned Chairman and Members-of the Harnett County Board of Elections, DO HEREBY CERTIFY that we met on September 12, 1985, at the hour of 11:00 "a:m., in the office of the Board of Elections in Lillington, North to canvass the returns of the special election held in the South Central Water and Sewer District on September 10, 1985; and that :the result of such canvass is as follows 1. The total number of voters who voted "YES" in answer to the questions, "SHALL the order authorizing $3,000,000 of bonds secured by a pledge of the faith and credit of the South Central Water and Sewer District to pay capital costs of providing a sanitary sewer system, including the acquisition and construction of a collection system, interceptors and - pumping stations -and including the acquisition and installation of machinery and equipment and the acquisition of land or rights-in- land required therefor, and a tax to be levied for the payment thereof, be approved?", was 244. The total number of voters who voted "NO" in answer to such question was 40. 2. The total number of voters who voted "YES" in answer to the question, "SHALL the order authorizing $4,000,000 of bonds secured by a pledge of the faith and credit of the South Central Water and Sewer District to pay capital costs of providing a water system, including the acquisition and construction of water mains, distribution lines, storage facilities and a pumping station and meters and including the acquisition and installation of necessary_ machinery and equipment and the acquisition of land or right -in- land required therefor, and a tax to be levied for the payment thereof, be approved ? ", was 250. The total number of voters who voted "NO" in answer to such question was 36.- 3. All persons voting at -said election were required to use ballots or ballot labels setting forth each; question to be voted upon in the form prescribed by the Board of Commissioners of Harnett County,' sitting as the governing body of South Central Water and Sewer District. 4. Only the persons who had been duly registered were permitted to vote at said election. The total number of voters who were registered and qualified to vote: -at said election was 1,438, 63! 1 BUDGET AMENDMENTS TOWN OF ERWIN NAMING OF STREETS SURPLUS PROPERTY 1981 PLYMOUTH 5. The polls for said election were opened at the polling place in the District, on September 10, 1985, at the hour of 6:30 o'clock a.m., and were closed at the hour of 7:30 o'clock, p.m. on that day. IN WITNESS WHEREOF, we have set our hands for the purpose of certifying the result of the special election held for the South Central Water and Sewer District on September 10, 1985, to the Board of Commissioners of Harnett County, sitting as the governing body of said District, this 12th day of September, 1985. s/ Jackie Elmore Chairman, Board of Elections s/ Buel Cook Member, Board of Elections s/ W. H. Randall Member, Board of Elections County Manager, M. H. Brock, explained the following budget amendments: 1. Library, Code 10- 8100 -072, Capital Outlay -- Buildings, Increase by $1,432, for architect fees for new library 2. Special Appropriations, Code 10- 8700 -154, Law Enforcement Center, Increase by $221,000, the County received the above amount of funds from the one- half cent sales tax distribution and was earmarked for this project. 3. Special Appriations, Code 10- 8700 -10, Rescue Squads, Increase in the amount of $2,295. This year the County Board of Commissioners voted to purchase a jaws -of -life rescue tool for the Boone Trail Rescue Unit. The purchase - price of this tool exceeded the annual contribution of $5,000 by the amound of the requested budget amendment. 4. Administration, Code 10- 4200 -033, Materials & Supplies, Increase by $500, as a result of getting on computer and having to order special forms. 5. Harnett County Public Utilities, Water Fund, Code 30- 8100 -011, Telephone & Postage, Increase by $10,000; Utilities, Code 30- 8100 -013, Utilities, Decrease by $10,000. In the preparation of the budget, the money for the telephone was put in the utilities line item in error. This amendment is to correct that error. Commissioner Brock made a motion to approve the above - mentioned budget amend- ments. Commissioner Stewart seconded the motion and it carried with a unanimous vote. Commissioner Brock moved that the Board honor a request from the Town of Erwin to name three streets in South Erwin that are outside the town limits, but inside the planning jurisdicition. The names of the streets are Mason Drive, Porter Street, and Wrench Street. Commissioner Stewart seconded the motion and it carried. County Manager, M. H. Brock, stated that the County has one 1981 Plymouth which is in need of extensive repair and the County had planned to sell it at its annual surplus sale this fall. The Town of Coats has indicated that they wish to purchase this vehicle. Mr. Brock explained that G. S. 160A -274 authorizes governmental units to sell property to each other on a negotiated basis and requested that in accordance with this statute that this vehicle be declared surplus property and that he be authorized to negotiate with the Town of Coats regarding this sale of this vehicle. Commissioner Collins made a motion that the Board honor Mr. Brock's request. Commissioner Shaw seconded the motion and it passed with a unanimous vote. RESOURCE RECOVERY PRO- Commissioner Stewart made a motion that the Board appoint County Manager, JECT STEERING COMMITTEE M. H. Brock, and Commissioner Bill Shaw to serve on the Resource Recovery Project Steering Committee. This committee includes representatives from Hoke, Harnett, and Moore Counties and these counties are represented by their County Manager and one Commissioner. These representatives shall serve in a non - voting liason capacity. Commissioner Collins seconded Commissioner Stewart's motion and it carried with a unanimous vote. RESOLUTIONS FOR ELECTIONS BOARD Copies of resolutions presented to Edward H. Matthews and Patricia D. Jenkins by the Harnett County Board of Elections were received by the Board and are duly filed in the Office of the County Manager.
