04011985HARNETT COUNTY BOARD OF COMMISSIONERS MEETING, APRIL 1, 1985 568 CALL TO ORDER PRAYER MINUTES APPROVED DEPARTMENT OF TRANSPORTATION The Harnett County Board of Commissioners met in regular session on Monday, April 1, 1985, in the Commissioners Room, County Office Building, Lillington, North Carolina, withthefollowing members present: Lloyd G. Stewart, M. H. Broc Rudy Collins, and Chairman Jesse Alphin presiding. Commissioner Bill Shaw joined the Commissioners Meeting at approximately 9:45 a.m. Bob Jones and John Phelps, representing the County Attorney's office; Vanessa W. Young, Clerk to the Board, and Hollie J. Wade, Recording Secretary, were also present. Chairman Jesse Alphin called the meeting to order at 9:00 a.m. Commissioner Lloyd G. Stewart led the morning prayer. The minutes from the Harnett County Board of Commissioners meeting of March 13, 1985, were approved as read. Ray Stone, Highway Maintenance Engineer with the North Carolina Department of Transportation, appeared before the Board to discuss road matters and situations in Harnett County. INDUSTRIAL TRAINING M. H. Brock, County Manager, presented to the Board for their consideration an CENTER - -CP &L CONTRACT agreement between the County and CP &L whereby the County grants an easement to CP &L to run underground service to the Industrial Training Center on Highway 421. Commissioner Brock made a motion that this agreement between the County and CP &L be approved; Commissioner Collins seconded the motion and it carried with a unanimous vote. 4D PROGRAM M. H. Brock, County Manager, presented to the Board for their consideration a resolution whereby the County requests the State to consider the repeal of Section 76 of House Bill 80. This bill transfers the responsibility of the operation of the 4D program from the State back to the counties, effective July 1, 1985. Mr. Brock explained that the County strongly opposes this action because the program has greatly broaden its services so that it not only provides assistance to Social Services clients but also to the Court System and to the general public for a fee. These increased services have resulted in the program no longer being self- supporting and have also resulted in a need for the program to have a uniform method of administration, this would be difficult if each of the 4D programs is under the separate jurisdiction of each of the 100 counties. Following a discussion, Commissioner Brock made a motion that the following resolution concerning the operation of the 4D program be approved; Commissioner Stewart seconded the motion and it passed with a unanimous vote: HARNETT COUNTY, NORTH CAROLINA. RESOLUTION WHEREAS, the County of Harnett has for the past year had a mutual agreement with the State of North Carolina for the operation of the Paternity and Support program; and WHEREAS, this arrangement has proven to be beneficial in providing cost efficient and effective services to the eligible persons of Harnett County; and WHEREAS, past experience as well as present information indicates that Harnett County is neither able to operate such a program with the cost efficiency factor or to retain sufficient personnel to effectively operate such a program; and WHEREAS, the State of North Carolina is abandoning responsibility for continued operation of the Paternity and Support Program under the mutual agree- ment that has existed in the past year; and WHEREAS, the County of Harnett has had no opportunity to be adequately represented in decisions that impact upon the transfer of the Paternity and Support Program from the responsibility of the State of North Carolina to the County of Harnett; and WHEREAS, the County of Harnett will suffer increased financial burden by the transfer of this program to local jurisdiction; and WHEREAS, the County of Harnett cannot singly provide the level of service and quality of service to eligible program participants. NOW, THEREFORE, BE IT RESOLVED that the Board of Commissioners for the County of Harnett protests the transfer of the responsibilities of operation of the Paternity and Support Program to the County of Harnett from the State of North Carolina and further the Board of Commissioners of Harnett County requests consideration of repeal of Section 76 of House Bill 80 enacted during 1984 session of the North Carolina General Assembly. LIBRARY -- RESOLUTION RE: - SALE OF ,BOOKS NORTHEAST METROPOLITAN WATER DISTRICT Margaret Randall, Director of the Library, requestedthatthe.Board adopt a resolution authorizing her to dispose of 350 books at a public sale to be held on April 20, 1985. Commissioner Collins made a motion that the following resolution be approved; Commissioner Stewart second the motion and it carried with a unanimous vote: HARNETT COUNTY, NORTH CAROLINA. RESOLUTION THAT, WHEREAS, the Harnett County Library has 350 books which they have requested authorization to sell; and WHEREAS, these books have a value of less than $5,000; and G. S. 153A -176 and G. S. 160A -267 permits the sale of personal propert at private sale upon expiration of ten days after publication of the resolution authorizing the sale, NOW, THEREFORE, BE IT RESOLVED BY THE HARNETT COUNTY BOARD OF COMMISSIONERS THAT: A. The 350 books in the possession of the Harnett County Library are hereby declared surplus " - property; and B; Margaret Randall,, Director of the. Harnett County Library, is hereby authorized to sell the Books at private sale, which is to be held on Saturday, April 20, 1985, beginning at 10:00 a.m. at the - site -of the new library located on 611 N. Commissioner Collins moved for the adoption of the following resolutio reappointing Leoxore Tuck to the Northeast Metropolitan Water District Board; Commissioner Stewart seconded the motion and it carried with a unanimous vote: HARNETT COUNTY,' NORTH CAROLINA. RESOLUTION WHEREAS, Chapter 162A, Article 4, as amended, provides that the Board of Commissioners shall appoint three board members of a duly created Metropolitan Water District; and WHEREAS, the Northeast Metropolitan Water District of Harnett County, North Carolina, was duly created on April 14, 1986; and WHEREAS, the term of Leonore Tuck expires on April 14, 1985. NOW, THEREFORE,' BE IT RESOLVED BY THE HARNETT COUNTY BOARD OF COMMISSIONERS' that Leonore Tuck be and she is hereby reappointed to the District Board for a to m expiring on April 14, 1988. DULY ADOPTED THIS THE FIRST DAY OF APRIL, 1985. SUBDIVISION PLATS ErvinDobson,Director of Planning, appeared before the Board and for the Board's consideration several subdivision plats: 1. Graham Gregory Subdivision, five -lot minor final located at the intersection of:S. R..1510 and S..R. 1514 in - Neil'sCreek Town- ship. Ervin Dobson, Director of Planning, infoLmedthe Board that this plat had been approved by the Planning Board, Health Depart- ment, and the. Department of Transportation. Commissioner Collins made a motion that the subdivision plat for Graham Gregory be Commissioner Stewart seconded the motion and it carried' with a unanimous vote. ▪ Atkins and Atkins Subdivision, two -lot minor final located on N. C. S. R. 1291 in Upper Little River Township. Mr. Dobson explained that this plat had been approved by the Health Depart- ment, Planning Board, and the Department of Transportation. Com- missioner Stewart made a motion that the subdivision plat for Atkins and Atkins be approved, Commissioner Collins seconded the motion and it carried with a unanimous vote. . Gene B. Weaver Subdivision, one-lot minor final located on S. R. 1541 in Black River Township. Mr. Dobson explained that this plat has been approved by the Health Department, Planning Board, and the Department of Transportation. Commissioner Collins made a BUDGET AMENDMENTS motion that the subdivision plat for Gene Weaver be approved; Commissioner Stewart seconded the motion and it carried with a unanimous vote. 4. Ennis & Jones Subdivision, four -lot final located at the intersection of S. R. 1006 and S. R. 1505. Mr. Dobson informed the Board that when the plat was first drawn, a 50 foot right -of -way was reserved. Since then, the owner of the plat has contacted Mr. Dobson and has revised the plat to include the 50 feet which would in effect improve the lot. The revised subdivision plat has been approved by the Planning Board but Mr. Thompson has not had a chance to review the revised plat although he had approved the original plat for water and sewer. It was the decision of the Board not to approve the revised subdivision plat until it had been reviewed and signed by Mr. Thompson. 5. Buffkin - Williams Subdivision, one -lot minor final, located off Highway 27 near S. R. 1703. Mr. Dobson informed the Board that this subdivision plat had been approved by the Health Department and the Planning Board. He pointed out to the Board that only a 20 foot right -of -way had been given for the travel lane, and he had informed the owner that at no time in the future unless a right -of -way of at least 50 feet is given would the Depart- ment of Transportation pick this road up on the State System for Maintenance He explained that the owner did understand this. Mr. Dobson stated that if the Board wished he would have this exception noted on the recorded subdivision plat so that when the property is sold the proposed buyer would realize this condition exists. Following a discussion, Commissioner Brock made a motion that the subdivision plat be sent back to the Planning Board and that if possible the owner of this plat give at least a 50 foot right - of -way and if this was not feasible then it should be noted on the subdivi- sion plat that there is only a 20 foot right -of -way and that at no time in the future will the Department of Transportation be able to maintain this road; Commissioner Shaw seconded the motion and it carried with a unanimous vote. 6. Bobby Lee Lockamy Subdivision, one -lot minor final located at the intersec- tion of S. R. 1538 and S. R. 1537 in Black River Township. Mr. Dobson in- formed the Board that this plat had been approved by the Planning Board and the Health Department. Commissioner Collins made a motion that the Subdivi- sion Plat for Bobby Lee Lockamy be approved; Commissioner Shaw seconded the motion and it carried with a unanimous vote. 7. Johnnie G. Hardee Subdivision, 14 lots, located at the Intersection of S. R. 1422 and S. R. 1403 in the Buckhorn Township. Mr. Dobson informed the Board that this plat had been approved by the Health Department and the Planning Board. Mr. Alphin noted that the Health Department did not approve lot 6 for a septic tank. Commissioner Collins made a motion that this sub- division plat be approved; Commissioner Shaw seconded the motion and it carried with a unanimous vote. 8. C. L. Byrd Subdivision, eleven lots, located at the intersection of S. R. 1422 and S. R. 1403 on the Old Stage Road and Highway 55. Mr. Dobson explained that this plat had been approved by the Health Department and Planning Board. Commissioner Collins made a motion that the subdivision plat for C. L. Byrd be approved; Commissioner Shaw seconded the motion and it carried with a unanimous vote. Several budget amendments were presented to the Board for their consideration. Following a discussion of these amendments, Commissioner Collins made a motion that the following budget amendments be approved; Commissioner Shaw seconded the motion and it carried with a unanimous vote: 1. Social Services Budget Code 7710 -151, Crisis Intervention Fund, be increased by $15.00 Code 7710 -151, Crisis Intervention Fund,be increased by $723.00 This budget amendment reflects additional funds received as a citizen's contribution and Carolina Power & Light's Share of the Crisis Interevention Program 2. A letter was presented to the Board from William McKay Johnston requesting that consideration be given to him relieving him and his mother, Lucille Spears Johnson from a late listing penalty for the year, 1985. The letter explained to the Board that he had been sick with the flu and was not able to come to Lillington until March 7, 1985, and one of the first things he did was go to the tax office and list all of the taxes for himself as well as his mother, at which time he realized that a penalty would be charged for the two days he was late listing. He continued to explained that in the over twenty -five years that he has listed his county taxes for himself as well as for his family, he had not been late. Following a discussion, Commissioner Brock made a motion that Thomas Allen, Tax Supervisor, be and he is hereby authorized to relieve the 1985 late listing penalty charged to William McKay Johnston and his mother, Lucille Spears Johnson, Commissioner Stewart seconded the motion and it carried with a unanimous vote. A letter was also presented to the Board from Doris A. Harms, who has recently moved to this State and has purchased property in Harnett County, requesting that she be relieved of the late listing penalty charged her for 1985. She explain- ed in her letter that when she first listed her taxes, she was sent a form on which to list her personal and real estate tax and she thought this same procedure would be followed this year. She explained that by being a new resident of this State she did not realize that she had to go list her taxes, she thought that an abstract would be sent to her by mail annually on which to list her taxes. Following a discussion of Ms. Harms' request, Commissioner Brock made a motion that Ms. Harms' be relieved from this late listing penalty, Commissioner Stewart seconded the motion and it carried with a unanimous vote. Thomas Allen, Tax Supervisor, appeared before the Board and requested the following tax refunds: 1. Thomas L. Sanders, 7045 Ray Road, Spring Lake, NC 28390, in the amount of $90.79. Mr. Allen explained that a truck was listed for the year 1984 to Mr. Sanders and it was not bought until April, 1984, and should not have been list- ed until the next year. 2. Alvin Ray McArtan, Rt. 2, Box 234, Linden, NC 28356, in the amount of $70.66 for property that was listed in Flat Branch Fire District, but the property was not located within the District. 3. Sallie M. Allgood, Rt. 1, Box 182, Bunnlevel, NC 28323, in the amount of $4.12 for an error made on deferred tax for the years, 1982, 1983, and 1984. 4. George W. Wright, P. 0. Box 372, Angier, NC 27501, in the amount of $45.33 for the year, 1984, for exemption for elderly persons with limited income on one lot and house on Railroad Street in Black River Township. 574 ACTION ON REQUESTS FOR TAX REFUNDS TAX COLLECTOR, RES- OLUTION AUTHORIZING ADVERTISEMENT OF TAX LIENS ADJOURNMENT Commissioner Shaw made a motion that the foregoing tax refunds, be approved; Commissioner Stewart seconded the motion and it carried with a unanimous vote. Commissioner Stewart made a motion that the Board adopt the following resolution amending -a resolution adopted on February 4, 1985, whereby the Board authorizes Mr. Allen to begin the advertisement of said tax liens during the first week of April, 1985, rather than beginning on Monday, April 1, 1985; Couuuissioner Brock seconded the motion and it carried with a unanimous ,vote: NORTH CAROLINA, HARNETT COUNTY. RESOLUTION WHEREAS, on February 4, 1985, in accordance with N. C. General Statute 105-369 (a), W Thomas Allen, Harnett County Tax Collector, reported to the Harnett County Board of Commissioners the unpaid taxes for the current fiscal yea- that constituted liens on real, property in Harnett County; and WHEREAS, on February 4, 1985, the Harnett County Board of Commissioners adopted a resolution ordering the said W. Thomas Allen to advertise said tax liens, beginning the First Monday In April, 1985; and WHEREAS, it has been determined that it would be more appropriate to better notify the taxpayers involved if said advertisements were published during the week of April 1 through April 5, 1985. NOW, THEREFORE, BE IT RESOLVED by the Harnett County Board of Commissioners that: Pursuant to the authority vested in this Board by N. C. General Statute 105 -369, W. Thomas Allen, Tax Collector, is hereby ordered to advertise said tax liens according to law, said advertisement to begin during the week of April 1, 1985: Duly adopted this the First Day of April, 1985.
