The Harnett County Board of Commissioners met in regular session on Tuesday,
January 3, 1984, in the Commissioners Room, County Office Building, Lillington,
North Carolina, with the following members present: M. H. Brock, Lloyd G. Stewart,
Rudy Collins, Bill Shaw, and Chairman Jesse Alphin presiding.
Chairman Jesse Alphin called the meeting to order at 9:17 a.m.
Reverend Neil Smith led the morning prayer.
The minutes from the Harnett County Board of Commissioners meeting of December 19,
1983, were approved as read.
Ray Stone, Highway Maintenance Engineer with the North Carolina Department of
Transportation, appeared before the Board to discuss road matters and situations in
Harnett County.
M. H. Brock, County Manager, presented a petition to Mr. Stone requesting that a
road located off Highway 82 in Duke Township be added to the State System for
Maintenance. Commissioner Brock made a motion that the Board approve this petition;
Commissioner Shaw seconded the motion and it carried.
Reverend Neil E. Smith, Pastor of Erwin United Methodist Church, appeared before
the Board and informed the Commissioners that the Trustees of the Methodist Home
for Children located in Raleigh made a decision to offer its youth services to the
Fayetteville District, which is comprised of churches within Cumberland, Sampson,
Harnett, and Hoke counties. Reverend Smith explained that this means that one youth
home would be located in this District. He continued to explain that the Adminis-
trative Board of the Erwin United Methodist Church endorses this home and would
like to see ; first of all, it locate in Harnett County; and secondly, in the
Erwin area. He stated that he will go before the Advisory Council for the Trustees
of the Methodist Home for Children and request that a home be located in Erwin, and
he would like to get the endorsement of the Board of Commissioners for this Home.
He informed the Board that as a further endorsement from the Erwin United Methodist
Church, they have given as a gift one acre of prime property for the construction
of this home in Erwin. Following a discussion, Commissioner Brock made a motion
that the Harnett County Board of Commissioners hereby endorse the location of a
Children's Home in Erwin; Commissioner Stewart seconded the motion and it carried.
BOARD OF HEALTH Henry Thompson, Director of the Harnett County Health Department, appeared before
APPOINTMENTS/ the Board and informed the Commissioners that the North Carolina Legislature in its
REAPPOINTMENTS 1983 session rewrote the Public Health laws. Chapter 130A -35(b) changed the Local
Board of Health from nine members to eleven members, and the composition to include
one licensed optometrist, one licensed veterinarian, and one registered nurse. This
action also reduces the members of the general public from five to four. Mr. Thomps
recommended that the Board appoint the following new members: Veterinarian- -
Dr. Frank G. Parker, 408 S. Powell St., Dunn, NC 28334; Optometrist -- Dr. Kenneth
M. Talley, P. 0. Box 518, Lillington, NC 27546; and Registered Nurse - -Mrs. Kathy
Weeks, P. 0. Box 882, Coats, NC 27521. Mr. Thompson also informed the Commissioner
that the first three -year terms of Mr. Herman Lynch, pharmacist; and Mr. Lloyd G.
Stewart, commissioner, had expired. Commissioner Collins made a motion that Dr.
Parker, Dr. Talley, and Mrs. Weeks be appointed to the Health Board and Mr. Lynch
and Mr. Stewart be reappointed to the Health Board; Commissioner Shaw seconded the
motion and it carried. All these appointment /reappointments are for three -year
terms.
SOCIAL SERVICES Helen Crews, Director of Social Services, requested that her budget be amended by
BUDGET AMENDMENT $27,940 for the crisis intervention program. She stated that this is federal
funding and does not require any county match. Commissioner Stewart made a motion
that Code 611 -188, Crisis Intervention Funding, be increased by $27,940;
Commissioner Shaw seconded the motion and it carried.
AMBULANCE SERVICE Dan Gardner, Captain of the Harnett County Ambulance Service, requested the Board
BUDGET AMENDMENT to transfer $2,500 from his Capital Outlay -- Equipment, Code 10- 640 -074, to Medical
Supplies, Code, 10- 640 -034. Commissioner Collins made a motion that this request
be approved; Commissioner Shaw seconded the motion and it carried.
Commissioner Shaw reported to the Board that the County is in the process of
reroofing the Courthouse. Also, the County has let the bids for the work on the
Industrial Training Center and construction should start in the next few days.
Commissioner Shaw also informed the Board that he has been receiving several calls
about the mini sites, people dumping large boxes and items in the containers which
should be carried to the landfill sites or flating out the boxes so one load will
not fill up the containers; trucks transporting trash, not covering the loads
and the trash blowing o'.t along the roadside; etc. Commissioner Shaw stated that
he felt something needed to be done to educate the citizens of the County concerning
the use of the mini sites. It was also discussed that the laws governing the
hauling of trash should be enforced more strictly, so that the trucks would have
covers. Mr. Brock stated that he would get with the Sheriff to see if they
couldn't help with this.

9. In addition, the Requesting Agency agrees to hold harmless the Assisting Agency
for any damage to the property of the Requesting Agency incurred in the -course
and scope of the temporarily assigned officer's duties. Further, the
Assisting Agency agrees to hold the Requesting Agency harmless for any damage
to the property of the Assisting Agency occasioned by such act. This agreement
shall not be construed as a bar to any other rights or claims, either direct
or by subrogation, which either agency shall have against any other party.
10. While on duty with the Requesting Agency the temporarily assigned officer of
the Assisting Agency shall have the same jurisdiction, powers, rights, privi-
leges, benefits and immunities as the officers of the Requesting Agency in
addition to those which he normally possesses.

Robert Morgan, County Attorney, reported to the Board on the County's Public
Liability Insurance. He stated that in 1979, the County purchased public liability
coverage from the James F. Jackson company through an insurance program made
available by the N. C. Public Officers and Employees Liability Insurance' Commission.'
This commission was created by Governor. Hunt, N. C. League of Municipalities,
and the North Carolina Association of County Commissioners to help municipalities
and counties obtain and keep professional liability insurance for law enforcement
officers and public officials, Prior to the creation of this Commission, the cost
of this insurance was prohibitive if counties could even find a company willing
to write the coverage. When the Commission first accepted bids for this coverage,
it awarded a three-year contract to James F. Jackson, agents for Republic Insurance.
After this first three -year contract, the Commission accepted new proposals for
the insurance coverage- and awarded the second three -year contract to The Hunt
Agency, agents for National Union Insurance.' The main difference in the Republic
Insurance and the National Insurance is that the Republic had only claims -made
coverage, which means that a claim will only be covered if it is reported to
the company during the policy period whereas the National Union Insurance offered
through the Hunt Agency has the occurrence form which means it covers any act
transpiring during the policy period and there is no restriction for reporting the
claim to the company, even if discovered 30 years later from the date of occurrence,
it will still be covered. Mr. Morgan explained that the problem that has occurred
in the transition from the Republic claims made policy to the National Union
occurrence form is a gap in coverage for the years the County had the Republic claims
made policy. Mr. Morgan continued to explain thatthe County can purchase a
retroactive coverage policy from the Hunt Agency which would provide complete
protection for Harnett County from all claims not barred by the Statute of Limita-
tions. 'Mr. Morgan stated that this would be a one time only purchase. Commissioner
Collins made a motion that the County purchase this retroactive coverage for
two years from the Hunt Agency at a one -time premium of $3,274.43; Commissioner Shawl
seconded the motion and it carried.
ADJOURNMENT There being no further business, the Harnett•County -Board of Commissioners meeting
of December 19, 1983, duly adjourned at 8:55. p.m.

Robert Morgan, County Attorney, reported that the County has received a new Letter
of Credit extending the Letter of Credit for Univision Cable Systems, Inc.
The new Letter of Credit will expire on December 29, 1984.
Mr. Brock reported to the Board that the County has received from its engineers,
Moore, Gardner, g Associates, the necessary documents to make application to FHA for
the construction of the water facility projects west of Lillington and along
NCSR 1769 (Old Wire Road). Commissioner Shaw made a motion that this application
be approved by the County and forwarded to FmHA; Commissioner Stewart seconded the
motion and it carried.
Larry Knott, Operations Officer, presented the Sheriff's report for the month of
December to the Board.
Terry Wade with the Tax Supervisor's Office appeared before the Board and presented
the following two requests for refunds:
1. Donald Spence, Rt. 2, Box 302, Lillington, NC 27546, in the amount of $16.73,
Upper Little River Township, value of $11,150 was charged in Boone Trail
Emergency District and should have been charged in Flat Branch Fire District.
2. Artis Spence, Rt. 2, Box 302, Lillington, NC 27546, in the amount of $16.73,
Upper Little River Township, Values of $11,150 was charged in Boone Trail
Emergency District and should have been charged in Flat Branch Fire District.
Commissioner Stewart made a motion that the foregoing refunds be approved;
Commissioner Collins seconded the motion and it carried.
SPECIAL DISTRICTS Robert Morgan, County Attorney, reported to the Board that a problem had arose
INCORPORATION concerning the Cypress Creek Fire District as to whether or not it should be
incorporated. The Law states that when a special district is created, it should
not be incorporated. However, you do incorporate the Fire Department and then the
special district enters into a contract with the fire department. He stated that
his office is straightening out this problem with Cypress Creek.
