07051983HARNETT COUNTY BOARD OF COMMISSIONERS MEETING, JULY 5, 1983 249 The Harnett County Board of Commissioners met in regular session on Tuesday, July 5, 1983, in the Commissioners Room, County Office Building, Lillington, North Carolina, with the following members present: M. H. Brock, Bill Shaw, and Chairman Jesse Alphin presiding. Vanessa W. Young, Clerk to the Board, and Robert Morgan, County Attorney, were also present. Commissioners Lloyd G. Stewart and Rudy Collins were absent. CALL TO ORDER Chairman Jesse Alphin called the meeting to order at 9:00 a.m. PRAYER Commissioner Bill Shaw led the morning prayer. MINUTES The minutes from previous Board meetings were approved as read. DOT RESOLUTION RE: ROAD PRIORITIES 0. M. "Buck" Clark, District Engineer with the N.C. Department of Transportation, appeared before the Board and presented the Secondary Road Improvement Program for Harnett County for the F.Y. 1983 -84. A public hearing was held on the Program, at which, only one person - -Carol Dickens, Rt. 3, Lillington, NC 27546- - appeared before the Board. Ms. Dickens informed the Board that she lives on the west end of SR 1257. She explained that this road is heavily populated on that end; but further down, the property on both sides of the road is owned by two large companies and it cannot be purchased for residential construction. Ms. Dickens asked the Board if a priority could be set just for the west end of the road. Commissioner Brock made a motion that the Department of Transportation be and it is hereby requested to investigate the possibilities of setting a priority just to include the west end of SR 1257; Commissioner Shaw seconded the motion and it carried. Commissioner Shaw made a motion that the Board adopt the follow- ing resolution approving the Secondary Road Improvement Program for Harnett County Commissioner Brock seconded the motion and it carried: HARNETT COUNTY, NORTH CAROLINA. REPORT Ray Stone, Highway Maintenance Engineer with the North Carolina Department of Transportation, appeared before the Board to discuss road matters and situations in Harnett County. Vanessa W. Young, Finance Officer, presented to the Board a report on the Delin- quent Taxes for 1971 F, 72. Following a discussion of this report, Commissioner Shaw made a motion that the Finance Officer be and she is hereby authorized to charge off the delinquent taxes for the years 1971 &.72; Commissioner Brock seconded the motion and it carried. (Reference - -See Minute Book 12, Page 402) Commissioner Brock made a motion that Vanessa W. Young be reappointed as Finance Officer for Harnett County and Clerk to the Board for one year. Commissioner Shaw seconded the motion and it carried. Mrs. Young ascribed to the following oath of office: HARNETT COUNTY, NORTH CAROLINA. OATH OF OFFICE I, Vanessa W. Young, do solemnly swear (or affirm) that I will support and maintain the Constitution and laws of the United States, and the Constitution and laws of North Carolina not inconsistent therewith, and that I will faithfully discharge the duties of my offices as Finance Officer and Clerk to the Board of Harnett County, North Carolina, and that I will not allow my actions as Finance Officer and Clerk to the Board to be influenced by personal or political friendships or obligations, so help me, God. Commissioner Shaw made . a motion that Jesse Alphin be appointed as voting delegate for the North Carolina Association of County Commissioners Annual Conference and Commissioner Brock appointed as alternate voting delegate;; Commissioner Brock seconded the motion and it carried. Commissioner Brock made a motion that Dr. John Mann be reappointed to the Cardin- al Health Board as a provider and Bill Shaw be renominated to the Cardinal Health Board as a consumer; Commissioner Alphin seconded the motion and it carried. Thomas Allen Tax Administrator, appeared before the Board and presented a report on the activities of the Tax Offices for the month of June and their plans for July. SHERIFF'S DEPT. He stated that the Utilities have appealed to the Property Tax Commission and it will be as much as 18 months before the hearing. Mr. Morgan continued to state that they feel they have found - -after researching the tax records and values set for property owners in the County - -some good material to negotiate with. RESOLUTION REGARDING CONDEMNATION PROCEED- INGS- -BUIES CREEK COATS WASTEWATER DISTRICT E. Marshall Woodall, Attorney for the Buies Creek -Coats Wastewater District, presented for consideration the following resolution authorizing condemnation proceedings for property concerning the Buies Creek -Coats Wastewater District: RESOLUTION THAT WHEREAS, The Harnett County Board of Commissioners is the governing board of the Buies Creek -Coats Water and Sewer District of Harnett County; and THAT WHEREAS, The Buies Creek -Coats Water and Sewer District of Harnett County has been properly organized pursuant to General Statute 162A -86 and has authority to construct a wastewater collection system within said District; and THAT WHEREAS, The voters of said District did on the 30th day of April, 1982 overwhelmingly approve the issuance of "Order Authorizing $2,500,000.00 of Sanitary Sewer Bonds ", the vote of approval of the issuance of said bonds being pursuant to a construction project involving the construction of sewage and wastewater collection lines within the District; and THAT WHEREAS, The Harnett County Board of Commissioners, as governing board of said District did cause the engineering firm of Moore - Gardner and Associates to be employed for the purpose of designing the sanitary collection system for said District and that pursuant to its studies, Moore - Gardner and Associates has made report for a design of said District system and that further the engineering design for the proper gravity flow of wastewater involves the location of pump stations, roadways, electrical lines, outfall and collection lines throughout the District as is more fully shown upon a report by said engineering company and tha further the report shows that certain roadways, electrical lines and the designed 252 outfall and collection system crosses - private properties and that certain- pump stations are located on private properties; and THAT WHEREAS, The District. has accepted and adopted said design report as the wastewater collection system project of the District to be constructed; and THAT WHEREAS, The District has now received bids from various contract bidders for the construction of °.said project and that the available funds for construction are sufficient to construct the District's project; and THAT WHEREAS, It is necessary for the District to obtain the pump station sites and easement rights -of way across said private properties, said rights of way for pipe lines being a 20 foot permanent easement within which to construct and locate the outfall or wastewater collection line and a 40 foot construction easement, the centerline of said construction easement -being the identical line as the centerline of the 20 foot permanent. easement line; said rights of way for roadways and overhead electrical lines being 30 foot permanent easement within which to`build a roadway, erect overhead electrical lines and install the outfall and /or collection lines, together with a construction easement measuring 40 feet in width 'as aforesaid; and THAT WHEREAS, it is necessary that the District obtain the aforementioned pump station sites located on private properties and easement rights -of -way across said private properties for the purpose of constructing said wastewater collection system within said District for the purpose of serving the citizens living in said= District and THAT WHEREAS; North Carolina General Statute 162A -89.1 grants unto the District the power of eminent domain, to be exercised in accordance with Article Nine of Chapter 136 of the General Statutes of North Carolina; THAT WHEREAS, The District has.been unable to agree as to the purchase' price of the easement rights -of -way across certain private properties hereinafter more fully described and as a result thereof it becomes necessary for the District to now exercise its right of eminent domain to obtain the necessary easement rights -of- way for the purpose of constructing and installing the outfall and collection' lines, roadways and overhead. electrical lines for said wastewater system for the. District; and THAT WHEREAS, The District has been unable to agree as to the purchase`. price of the acquisition of a necessary pump station site as more fully herei after described and as a result thereof it becomes necessary for the District' to now exercise its' right of eminent domain to obtain the pump station site NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS: FIRST: For the reasons cited aforesaid, the Harnett County Board of Commissioners for and on behalf of the Buies Creek -Coats Water and Sewer District of Harnett County now deems it necessary that the District its.power of eminent domain as stated aforesaid and that civil actions be filed in the Superior Court of Harnett County -for the purpose of taking such lands, easements, or interest therein as necessary for the proper construction and installation of the pump station and of the wastewater collection and butfall lines the roadways and overhead electrical lines for the District's system to be built all as mentioned aforesaid. SECOND: That fee simple title to twenty (20) foot wide permanent easement rights -of -way and forty (40).foot wide construction rights-of-way, the center line of said construction rights -of -way being identical to the centerline of said permanent rights -of -way or such portions of said rights- of-way as are shown on -the hereinafter referred to survey maps, over upon and across the following, tracts and parcels of land are deemed needed as stated aforesaid and the areas of such tracts and.parcels of lands, are to be condemned and appropriated for the public use of constructing, installing using and - maintaining underground outfall and /or collection lines and pipes for the flow of water and wastewater of the Buies Creek -Coats Water and Sewer District of Harnett County, with necessary manholes and other equip- ment as needed for said system, including the right to clear and keep clear all trees, undergrowth and other obstructions within said permanent easement and the right to clear trees, undergrowth and other obstructions within the construction easement which easement shall cease to exist after construction has been completed, and together with the right of ingress and egress over and upon said permanent rights -of -way to inspect, maintain,.' repair and replace lines and pipes and to do and perform all matters and things the District shall be authorized -by law to do within said right -of- way; said rights-of-way and the lands upon which the same are located being more fully described as follows, to wit: ,) „ ti a a Easement No. One: That certain area(s) of permanent and /or construction right(s) of way over, upon and across the lands of Robert Harold Dixon and wife, Dana P. Marshall Woodall, Attorney for Bui.es'Creek -Coats Wastewater District, presented the following documment regarding Campbell University and Harnett County: 25 j RESOLUTION THAT WHEREAS, The County of Harnett did heretofore enter into an agreement with Campbell Universit relative to the treatment plant for wastewater at Buies Creek, North Carolina, said contract being dated January 17, 1983 and recorded in Book 744 page 157 Harnett County Registry; and THAT WHEREAS, since said time the public utility department of the County of Harnett has been operating and maintaining the treatment plant which is presently treating wastewater from the Campbell University system (including Keith Hills Subdivision) as its sole customer pursuant to charges set forth in said agreement. THAT WHEREAS, The Harnett County Board of Commissioners for and on behalf of Buies Creek -Coats Water and Sewer District of Harnett County has been negotiating and dealing with Campbell University relative to easement rights of way, street encroachments, and purchase of pump station sites for and on behalf of said District, the same being necessary for the construction and installation of a wastewater collections system for said District; and THAT WHEREAS, as a result of the negotiations between the parties, it is agreed that the original contract entered into between the parties as it relates to wastewater treatment charges for wastewater from Campbell's system be modified as herein provided and an agreement relative to the execution and delivery of a deed for easement rights of way, street encroachments agreement, deed of conveyance for pump station sites and other matters be entered into between the parties. NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS: FIRST: That the Chairman and Clerk of the Harnett County Board of Commissioners be and they are hereby authorized to enter into an agreement with Campbell University for the purpose of setting forth those things and matters necessary to be done to carry out the negotiated agreement between the parties, said agreement to contain the terms and conditions hereinafter set forth. SECOND: That the agreement to be entered into shall contain the following provisions relative to the matter and things the County shall obligate itself to do, to wit: (1) Allow Campbell University a period of 12 months from the date of the agreement within which Campbell University shall conduct studies, make tests of its collection system, and make necessary repairs to its collection system to prevent surface water from infiltrating therein and that during said 12 months period of time, the County shall not charge for more than 95,000 gallons of wastewater flow during any one day. (2) Agree to execute a deed of conveyance transferring at no charge the wastewater carrier line owned by the County and now serving Campbell University collection system together with the the 20 foot right -of -way, said line and right -of -way being located immediately north of the treatment plant situate on Buies Creek and extending in a northernly direction to the connection with the Campbell University's collection system, provided, however, that the County shall have the right to encroach within said right -of -way to install its own water and /or wastewater line or such lines for the District, within, upon and /or across said easement and by passing over and across said right -of -way in such manner as shall not interfere with the use of said right -of -way and the wastewater carrier line that is presently located therein; provided further that the County or the District shall be responsible for any damage caused to the present carrier line by the County or District relative to its encroach- ment rights therein. THIRD: That the agreement to be entered into shall contain the following provisions relative to the matters and things Campbell University shall obligate itself to do, to wit; (1) Give unto the District at no charge or fee easement deeds for the necessary rights -of -way for line construction within the District as shall cross Campbell University lands as shown by the plans heretofore submitted by Moore - Gardner and Associates. (2) Give to the District at no charge or fee an encroachment agreement providing for the right of the District to install lines within streets on those lands now owned by Campbell Universit, or which were heretofore subdivided by Campbell University and /or lands owned by Campbell University which adjoin certain streets. Give to the District at no charge or fee a deed of conveyance conveying to the District (with fee determinable title for sewer use) for two pump station sites as shown by the plans hereto- fore delivered to the District by Moore- Gardner and Associates. (4) Pay to the District the anticipated assessment charge for those Campbell University which are to be connected to the District's and pursuant to the established schedule of charges made to all (5) Agree to release and convey unto the County at no charge all its and to all items of personal property located on the premises of time the County's public utility department took over possession ment plant. Loving Co. of Goldsboro, -North Carolina, had been ruled ineligible as a bidder on_the District's project for the reason that FmHA had barred the Company from bidding on FmHA connected, projects for violations of criminal statutes relative to its construction work. The ineligible bidder was low bidder on Contract III. Mr. Marziano and Mr. Woodall discussed the matter at length with the Commissioners and related that each had discussed the matter with FmHA state officials and were, informed that FmHA would not concur in an to T. A. Loving Co; and would not participate in the project if an award was made to the bidder; therefore, T.A. Loving Co. would not be a responsible bidder for the District on this particular project. A Mr. Marziano stated that the project was well advertised to the construction industry and the bids received are the best that can be expected at this time. Mr. Marziano discussed each lower bidder and the amount of his bid and answered several questions of the Board and the County Attorney relative to the low bidders and procedure of bidding. He also discussed the available funds and the project costs of construction, fees, charges, construction interest and contingencies and advised that, in his opinion, the project could be built with the available funding. On behalf of the consulting engeineering firm, Mr. Marziano recommended that the Board of Commissioners award, subject to FmHA concurrence, the construction contracts for the project to the contractors who submitted the lowest responsible bids (one which could be accepted) on the six (6) contract proposals as discussed with the Commissioners. RESOLUTION RE: Following a discussion of the bids and the Wastewater project, Mr. Marziano BIDS presented the following resolution for the Board's consideration: WHEREAS, the Harnett County Board of Commissioners as governing Board of the Buies Creek -Coats Water and Sewer District of Harnett County, has received the results of the contract proposals on the District's wastewater facilities project from Moore - Gardner and Associates, the consulting engineer, the various bids on contract proposals being entered in the minutes of the meeting of said Board held on July 5, 1983; and WHEREAS, the bidder, T. A. Loving Co., has been declared by FmHA to be barred from bidding on projects funded by FmHA and as such it appears to the Board of Commissioners that the bidder is not a responsible bidder and its bid is not subject to be accepted by the District; and WHEREAS, said consulting engineer has studied said contract proposals and the successful bidders who are qualified to bid on said project, and has recommended that said bids and bidders are responsbile and has further recommended award of the contracts to the low qualified bidders of the project based upon acceptance of the proposal that will result in the best pricing available to the District and be acceptable to Farmers Home Administration; and WHEREAS, the Board of Commissioners as governing body of said District considers it in the best interest of the District to proceed with construction of the project by acceptance of the contract proposals as recommended by the engineer. NOW, THEREFORE, BE IT RESOLVED that contracts forthe District's wastewater facilities project be and same are hereby awarded, subject only to the concurrence in these awards by Famers Home Administration, to the following contractors for the amounts shown, wit: 1. Contract I - East Coats AWARD TO: Hawley Construction, Inc., Rt. 3, Kenly, NC 27542 in accordance with the proposal at a total unit price contract amount of $1,083,808.00. 2. Contract II - West Coats AWARD TO: Ritchie Construction Co., Inc., P. 0. Box 9453, Charleston, SC 29410 in accordance with the proposal at a total unit price contract amount of $761,426.50. 3. Contract III - East Buies Creek AWARD TO: Myrick Construction Company, P. 0. Box 7, Star, NC 27356 in accordance with the proposal at a total unit price contract amount of $1,129,930.60. 4. Contract IV - West Buies Creek AWARD TO: Ramey, Inc. P. 0. Box 2818 Winston - Salem, NC 27102 in accordance with the proposal at a total unit price contract amount of $703,314.50 5. Contract V - Pump Stations $ Treatment Plant Modifications AWARD TO: R. E. Hayes General Contractor, Inc. P. 0.
