04181983HARNETT COUNTY BOARD OF COMMISSIONERS MEETING, APRIL.18,'1983 CALL TO ORDER PRAYER The Harentt County Board of Commissioners- met in regular session on Monday, April 18, 1983, in the:Commissioners Room, County Office Building, Lillington, North Carolina; with the following members present: M. H. Brock, Lloyd G. Stewart, Bin Shaw, Rudy Collins, and Chairman Jesse Alphin presiding. Vanessa W. Young, Clerk to the `Board, and Robert Morgan, County Attorney, were also presents Chairman Jesse Alphin called the meeting to order at 7:30 p.m. Commissioner Lloyd 0. •Stewart led the evening prayer. MINUTES APPROVED The minutes from the Harnett County Board of Commissioners meeting of April 5, 1983, were approved as read. Robert Jones, Attorney for Univision, presented the following resolut Board's consideration:" RESOLUTION RE: ASSIGNMENT OF CABLEVISION FRANCHISE A RESOLUTION AUTHORIZING ASSIGNMENT OF CABLE TELEVISION FRANCHISE FROM NORTH CAROLINA COMMUNICATIONS,' INC. TO UNIVISION CABLE SYSTEMS, INC.' ion for the WHEREAS, The Board of Commissioners of Harnett County adopted on January 4 1982,, an ordinance entitled "AN ORDINANCE GRANTING CABLE TELEVISION FRANCHISES TO FUTURE CABLEVISION OF NORTH CAROLINA AND NORTH CAROLINA COMMUNICATIONS, INC. ", which ordinance, granted a CATV cable television franchise to North Carolina Communications, Inc. in the Old Farm and Rolling Springs areas of Harnett County as shown on the map included in its application which map was incorporated in the ordinance by reference; and WHEREAS, Univision Cable Systems,' Inc. was by ordinance entitled "AN ORDIN- ANCE GRANTING.A CABLE TELEVISION FRANCHISE TO UNIVISION CABLE SYSTEMS, INC." was also;granted:a CATV cable television franchise for Harnett County on November 1, 1982, said franchise to be subject_ to the rights and privileges of the fran= chise previously - granted to the North Carolina Communications, Inc.; and WHEREAS, Univision Cable Systems, Inc. has, subject to the approval of the Board of Commissioners for Harnett County, purchased from North.Carolina Communications,; Inc. the franchise heretofore granted it as above described. NOW, THEREFORE, be it resolved that the, Board of Commissioners of Harnett County do hereby give their consent and approval to the transfer and assignment of such franchise from and by North Carolina Communications, Inc. to Univision Cable Systems, Inc. Adopted this the 18th day of April, 1983. Jesse Alphin Jesse Alphin., Chairman, Board of Commissioners Commissioner Shaw made a motion that the- foregoing resolution authorizing the assignment of cable-television franchise from North - Carolina Communications, Inc. to Univision Cable Systems, Inc., be approved; Commissioner Stewart seconded the, motion and, it carried._ RESOLUTION RE: Vernon Howell, a citizen from the Buckhorn area, appeared` before the Commissoners USE OF CENTER -FIRE and requested them to adopt a resolution prohibiting the use of center -fire rifle RIFLES in hunting on-any land without the written permission of the landowner and also prohibiting the possession of a loaded shotgun or rifle or the discharge of such firearm from, onto, or:across the right of -way of any public roadway. Mr. Howell explained that this year deer hunting was allowed in the Buckhorn area, and the citizens in the community are concerned over the use of firearms by the hunters. He continued to state that he is a deer hunter and it is not the safe hunter he worried about, but the few hunters that are careless. He stated that it is not his intent in any way to deprive persons from hunting, but just to protect the landowners and the person traveling down the roads. Following a lengthy discussion of this request and comments by Danny Smith, Wildlife Officer for Harnett County, who was asked by the County Manager to come to the meeting to answer the questions, Commissioner Collins moved for the adoption of the following resolution concerning the use of center -fire rifles; Commissioner Shaw seconded the motion and it carried: 223 COAT OF ARMS ADOPTED FOR OFFICIAL BANNER JUVENILE TASK FORCE APPOINTMENTS LEAD AGENCY FOR CHEESE $ BUTTER SUBDIVISION PLAT CLIFFORD S. THOMAS SUBDIVISION PLAT MCLAMB -LUCAS EXPENDITURE REPORT FILED BUDGET AMENDMENT PUBLIC ASSISTNACE ADJOURNMENT HARNETT COUNTY, NORTH CAROLINA. RESOLUTION BE IT RESOLVED that the Harnett County Board of Commisiioners does hereby prohibit the use of center -fire rifles in hunting on any land, or from any road adjoining such land, without the written permission of the landowner, dated with- in 12 months, and carried on persons while hunting with a center -fire rifle. Young, Clerk Commissioner Brock made a motion that the second request of Mr. Howell prohibit- ing the possession of a loaded shotgun or rifle, magazine or chamber loaded, or the discharge of any firearm from, onto, or across, the right -of -way of any public roadway be accepted by the Board for further study and research; Com- missioner Stewart seconded the motion and it carried. Mr. C. Reid Ross appeared before the Board on behalf of the 400th Anniversary Committee and requested the Board to consider the adoption of the Harnett Coat of Arms as the County's official Banner. Mr. Ed Cameron and Mr. Bob King also appeared before the Board in support of this request. Mr. King stated that he had obtained a description of the Harnett Coat of Arms from the Division of Archives and History as follows: "Harnett. Ar. a pale sa. surmounted by a saltire gu. a chief az. Crest -A hornet fly, wings elevated ppr." and would like to attest to the authenticity of the Harnett Coat of Arms as presented by Mr. Ross. Commissioner Shaw made a motion that the Harnett Coat of Arms be and it is hereby adopted as the official Harnett County Banner; Commissioner Stewart seconded the motion and it carried. M. H. Brock, County Manager, explained that the Harnett County Juvenile Task Force recommends that Mrs. Emma Lee West, Mr. Danny Cook, and Ms. Sue Thomas be appointed to serve on the Task Force. Commissioner Brock made a motion that the Board accept these recommendations and appointed Mrs. West, Mr. Cook, and Ms. Thomas to serve on the Juvenile Task Force; Commissioner Collins seconded the motion and it carried. Commissioner Collins made a motion that the Agricultural Extension Office be designated as the lead agency for coordinating the cheese and butter program; Commissioner Shaw seconded the motion and it carried. Commissioner Stewart made a motion that the subdivision plat for Clifford S. Thomas, Subdivision I, located off SR 1232, Upper Little River Township, be approved, Commissioner Collins seconded the motion and it carried. Commissioner Shaw made a motion that the plat for McLamb -Lucas Subdivision, located off SR 2033, Stewart's Creek Twonship, be approved, Commissioner Collins seconded the motion and it carried. The quarterly expenditure report for the period ending March 31, 1983, was filed with the Board.
