04191982HARNETT COUNTY BOARD OF COMMISSIONERS MEETING, APRIL 19, 1982 CALL, TO ORDER PRAYER MIN[JTES APPROVED REPORT ON BENHAVEN AMBULANCE AND RESCUE SERVICE RESOLUTION AUTHORIZING HEARING'' ON BENHAVEN AMBULANCE AND RESCUE DISTRICT The Harnett County Board of Commissioners met in special session on Monday,, April: 19, 1982, in the Commissioners Room, County Office Building, Lillington, North Carolina, with the following-members . present: Lloyd G. Stewart, Bill Shaw, Rudy Collins, and Chairman Jesse Alphin presiding. Vanessa W. Young, Clerk to the Board, and EdwardIL McCormick, County Attorney, were also present. Commissioner M. R. Brock was absent. Chairman Jesse Alphin called the meeting to order at 7:05 p.m., Reverend J. Waldo Dodson led the evening prayer. The minutes from the Harnett County Board of Commissioners meetingsof April 5, and April 16, 1982, were approved as read. Reverend J. Dodson, Chairperson of the Board of Directors of Benhaven Emergency Services, appeared before the Board and expressed the community's appreciation to the Board of Commissioners and to the County Attorney for their efforts and hard work in preparing the reports on the Benhaven Ambulance' and Rescue Service District and the Benhaven Fire Protection Service District. Rev. Dodson stressed the serious need in this area for fire district and rescue district which was evident by the damaging fires Western Harnett had recently suffered a- couple of weekends ago. The Board thanked Reverend Dodson and the community and commended them for the actions they are taking to create these districts. Upon motion of Commissioner Stewart, seconded by Commissioner Collins, the following resolution authorizing the public hearing on the creation of the Benhaven Ambulance and Rescue Service District passed upon the following vote: Ayes, 4 , Noes 0 Abstained 0 Absent 1 RESOLUTION AUTHORIZING PUBIC HEARING ON CREATION OF BENHAVEN AMBULANCE AND RESCUE SERVICE DISTRICT Resolved that the report on.Benhaven Ambulance Rescue Service District be filed with the clerk to the board this date and that a public hearing be and the same is hereby set for June 9, 1982 at 8:00 p.m. at the Benhaven School Auditorium on S.R. #1205 near Olivia; and that notice of said hearing be sent to each owner of property in the proposed district as shown by the County tax records as of January 1, 1982 at least four (4) weeks prior to the hearing by the tax supervisor;': that notice of the hearing be published in the Harnett County News at least once not less than one week prior to the hearing; further that the Clerk to the Board obtain as Affidavit of Publication from the editor.of said paper and that the tax supervisor certify to the Board of County Commissioners of Harnett County on or before said hearing that this mailing to owners of property in said district has been completed. The Form of said Notice shall be as follows: NORTH CAROLINA' HARNETT COUNTY NOTICE TO OWNERS OF PROPERTY IN THE BARBECUE AND JOHNSONVILLE TOWNSHIPS WHO ARE WITHIN THE BOUNDARIES OF THE PROPOSED BENHAVEN AMBULANCE AND RESCUE SERVICE DISTRICT. Take notice that a hearing will be held on the 9th day of June, 1982 at 8 o'clock p.m. at the Benhaven School Auditorium on S.R. #1205 in Olivia, for the purpose of hearing matters relevant to the creation of an ambulance and rescue service district. A map of the proposed district is attached or appended to this Notice. The boundaries of the proposed Benhaven Ambulance and Rescue Service District encompasses the` entire area of the Barbecue and Johnsonville Townships. A report entitled "Report: Benhaven Ambulance and Rescue Service District was filed with the Board of Commissioners of Harnett County, on the 19th day of April, 1982 and is available for public inspection at the Office of the Clerk to the Board of Commissioners. The boundaries of the proposed Benhaven Fire Protection Service District encompass the Benhaven Fire District, consisting of the Barbecue Township less the areas in that Township which are already included in the Spout Springs and Anderson Creek Fire Districts and including that northern area of Johnsonville Township, southwest of Olivia, and more particularly described as follows: Starting at Point A on the Lee - Harnett County line near U.S. 87 and proceeding southwest along the Lee - Harnett County line to a Point B at the intersection of S.R. #1001 with the county line and proceeding from Point B in a southeasterly direction to a Point C at the juncture of S.R. #1201 with the Spout Springs Fire District line and proceeding from Point C in a northeasterly direction along the Spout Springs District line to a Point D near U.S. #87 .5 miles north of its intersection with S.R. #1113, and proceeding from Point D in a northerly direction along the Johnsonville Barbecue Township line to Point A. A report entitled "Report: Benhaven Fire Protection Service District" was filed with the Board of Commissioners of Harnett County, on the 19th day of April, 1982 and is available for public inspection at the Office of the Clerk to the Board of Commissioners. HARNETT COUNTY BOARD OF COMMISSIONERS By: s/ Jesse Alphin Jesse Alphin, Chairman Guy Cayton, President of the Board of Directors of Anderson Creek Fire and Rescue, Inc., appeared before the Board and presented the report on the Anderson Creek Ambulance and Rescue Service District. Mr. Cayton explained that the Anderson Creek Fire and Rescue District is now a volunteer unit, but the emergency needs of the community are greatly increasing because of the rapid growth this area is currently experiencing. Mr. Cayton stated that the vehicle needed to be replaced, a facility constructed to house the unit, and additional equipment is necessary in order to provide efficient services to the citizens in the Anderson Creek area. Mr. Cayton stated that the only way to provide these services is to create a taxed service district. Mr. Cayton thanked the Commissioners for the support they have shown this community and their help in preparing this report. Upon motion of Commissioner Shaw, seconded by Commissioner Collins the following resolution authorizing a public hearing on the creation of Anderson Creek Ambulance and Rescue Service District passed upon the following vote: Ayes 4 ; Noes 0 Abstained 0 ;, Absent 1 ':RESOLUTION AUTHORIZING PUBLIC HEARING ON CREATION OF ANDERSON CREEK AMBULANCE AND RESCUE SERVICE' DISTRICT Resolved that the report on the Anderson Creek Ambulance and Rescue Service District be filed with the Clerk to the Board this date and that a public hearing be and the same is hereby set for June'. 16, 1982 at 8:00 p n at the Anderson Creek Fire Station on S.R.' #1121 in the Anderson Creek Community, and that notice of said hearing be sent to each owner of property in the proposed district as shown by the County tax records as of January 1, 1982 at least four (4) weeks prior to the hearing by the tax supervisor, that notice of the hearing be published in the Harnett County News at least once not less than one week prior to the hearing; further that the Clerk to the Board obtain an Affidavit of Publication from the editor of said paper and that the tax supervisor certify to the Board of County Commissioners of Harnett County on or before said hearing that this mailing to owners of property in said district has been completed. Upon motion of Commissioner Stewart, seconded by Commissioner Collins, the following resolution authorizing, a public hearing on the creation of Western Harnett Fire Protection Service District passed upon the following vote: Ayes 4 Noes 0 ; Abstained 0 ; Absent 1 RESOLUTION AUTHORIZING' PUBLIC HEARING ON CREATION OF WESTERN HARNETT FIRE PROTECTION SERVICE DISTRICT Resolved that the report on Western Harnett Fire Protection Service District be filed with the clerk to, the board this date and that a public hearing be and the same is hereby set for June 8, 1982 at 8:00 p.m. at the Community Building of the Cypress Creek Church located' at the intersection of S.R. #1103 and #1107; and that notice of said hearing be sent to each owner of property in the proposed District_ as shown by the County tax records as of January 1, 1982 at least four (4) weeks prior to the hearing by the tax supervisor; that notice of the hearing be published in the Harnett County News at least once not less than one week prior to the hearing; further that the Clerk to the Board obtain an Affidavit of Publication from the Editor of said paper and that the tax supervisor certify to the Board of County Commissioners., of Harnett County on or before said hearing that this mailing to owners of CERTIFICATION ON AVERASBORO DISTRICT BUDGET AMENEI4ENT LIBRARY property in said District has been completed. Take notice that a hearing will be held on the 8th day of June, 1982 at 8 o'clock p.m. at the Community Building of the Cypress Creek Church at the intersection of S.R. #1103 and 1107 for the purpose of hearing matters relevant to the creation of a fire protection service district. A map of the proposed district is attached or appended to this Notice. The boundaries of the proposed Western Harnett Fire Protection Service District encompasses all of Western Harnett Township except for the areas in the Township within the Spout Springs Fire District and the proposed Benhaven Fire District. A report entitled "Report on Western Harnett Fire Protection Service District" was filed with the Board of Commissioners of Harnett County, on the 19th day of April, 1982 and is available for public inspection at the Office of the Clerk to the Board of Commissioners. HARNETT COUNTY BOARD OF COMMISSIONERS By: s/ Jesse Alphin Jesse Alphin, Chairman Thomas Allen, Tax Supervisor, appeared before the Board and presented the following certification: HARNETT COUNTY NORTH CAROLINA CERTIFICATION I, Thomas Allen, Tax Supervisor for the County of Harnett, do hereby certify to the best of my knowledge that notices were mailed by March 31, 1982, to the owners of property in Averasboro Township who are within the boundaries of the proposed Averasboro Fire Protection Service District stating that a public hearing will be held on April 28 for the purpose of hearing matters relevant to the creation of a fire protection service district. Done this the 19th day of April, 1982. s/ Thomas Allen Thomas Allen, Tax Supervisor Commissioner Collins made a motion that the following budget amendment to the Library be approved; Conanissioner Shaw seconded the motion and it carried: Code 630 -030, Periodicals and Microforms, decrease by $800 Code 630 -050, Audio Visuals, increase by $800 SUBDIVISION PLAT- Commissioner Collins made a motion that the Subdivision Property JACKSON PROPERTY of Runnell S. Jackson located on S.R. 1532, between Buies Creek and Angier, in Neills Creek Township, be approved. Commissioner Shaw seconded the motion and it carried. This plat had been approved by the Planning Board and Health Department. RESOLUTION Commissioner Stewart moved for the adoption of the following CONCERNING resolution concerning a water line to Burlington Industries, BURLINGTON Commissioner Collins seconded the motion and it carried. INDUSTRIES ADJOURNMENT' HARNETT COUNTY NORTH CAROLINA RESOLUTION Whereas, the Harnett County Board of Commissioners adopted a resolution on December -'7, 1981, agreeing to participate in the construction of 1,950 L.F. of 16'I water main from the Town Limits of Erwin to the new Burlington Industries Plant located on N. C. Highway 217, and Whereas, Harnett County's share for this project will be $55,160.84; and Whereas, an application has been made -for Harriett County to receive a clean water bond grant in the amount of $13,766.23 for this project. NOW, THEREFORE,'BE IT RESOLVED BY THE HARNETT COUNTY BOARD OF COMMISSIONERS that Code "690 -106;' Special Appropriations, 201 Planning, be amended by $55,160.84 and that Vanessa W.
