10251989BUIES CREEK -COATS WATER AND SEWER DISTRICT SPECIAL MEETING, OCTOBER 25, 1989 HARNETT COUNTY BOARD OF COMMISSIONERS SPECIAL MEETING, OCTOBER 25, 1989 677 PUBLIC HEARING RE: BOND ORDER The Harnett County Board of Commissioners met in special session on Wednesday, October 25, 1989, at 7 p.m. in the County Office Building, Lillington, North Carolina, with the following members present: Rudy Collins, Mack Reid Hudson, Mayo Smith and Chairman Lloyd G. Stewart presiding. Commissioner Bill Shaw was absent. Others present were Dallas H. Pope, County Manager; W. Glenn Johnson, County Attorney; Vanessa W. Young, Clerk to the Board; and Kay S. Blanchard, Recording Secretary. The first order of business was a special meeting of the Buies Creek -Coats Water and Sewer District. Chairman Stewart called to order the special meeting of the Harnett County Board of Commissioners sitting as the governing body of the Buies Creek -Coats Water and Sewer District of Harnett County at 7 p.m. Commissioner Collins offered the invocation. The Clerk of the Board of Commissioners and of the District reported to the Board of Commissioners of the County of Harnett, sitting as the governing body of Sulam Creek - Coats Water and Sewer District of Harnett County, that the bond order entitled, 'Bond Order Authorizing the issuance of $1,794,000 Sanitary Sewer Refunding Bonds of Buies Creek - Coats Water and Sewer District of Harnett County,' which had been introduced on October 16, 1989, had been published on October 111_, 1989, with notice that the Board of Commissioners, sitting as the governing body of Buies Creek - Coats Water and Sewer District of Harnett County, would hold a public hearing thereon on October 25, 1989, at 7:0Q o'clock, p.M. The Clerk of the Board of Commissioners and of the District also reported that the District's Finance Officer had filed in the Clerk's office a statement of debt complying with the provisions of The Local Government Bond Act, and such statement as filed showed the net indebtedness of the District to be 5.2% of the appraised valuation of property in the District subject to taxation. Commissioner Collins moved that the Board of Com- missioners, sitting as the governing body of Buies Creek - Coats Water and sewer District of Harnett County, proceed to hold a public hearing on the refunding bond order. The motion was seconded by Commissioner Hudson and was unanimously adopted. At 7:15 o'clock, P .M., the Chairman of the governing body of the District announced that the Board of Commissioners, sitting as the governing body of Buies Creek - Coats Water and Sewer District of Harnett County, would hear anyone who wished to be heard on the questions of the validity of the refunding bond order and the advisability of issuing the refunding bonds. At the direction of the governing body of the District, the Clerk of the Board of Commissioners and of the District read the refunding bond order and the published notice of hearing. After the Board of Commissioners, sitting as the governing body of Buies Creek - Coats Water and Sewer District of Harnett County, had heard all persons who requested to be heard in connection with the foregoing questions, Commissioner Hudson moved that the public hearing be closed. The motion was seconded by Commissioner Smith and was unanimously adopted. Commissioner Hudson moved that the Board of Commissioners of the County of Harnett, sitting as the governing body of Buies Creek - Coats Water and Sewer District of Harnett County, adopt and direct the Clerk of the Board of Commissioners 678 ADJOURNMENT OF BC /COATS and of the District to publish as prescribed by The Local Government Bond Act the bond order entitled, "Bond Order Authorizing the Issuance of $1,794,000 Sanitary Sewer Refunding Bonds of Buies Creek — Coats Water and Sewer District of Harnett County," introduced at the meeting of the Board of Commissioners, of the County of Harnett, sitting as the governing body of Buies Creek - Coats Water and Sewer District of Harnett County, held on October 16, 1989. The motion was seconded by Commissioner Smith and was adopted by the following vote: AYES: 4 NAYS: 0 ABSENT: 1 Chairman Stewart adjourned the Buies Creek -Coats Water and Sewer District special meeting at 7:30 p.m. SOCIAL SERV. Jack Bryan, Director of Social Services, and Jane Smith, Family and Children BRIEFING Services Supervisor, briefed the Board on current program of protective services for children and additional manpower needs for the program. The Board will consider the matter at the next regular Board meeting. EXE. SESSION Commissioner Collins made a motion that the Board go into executive session. Commissioner Hudson seconded the motion and it passed with a unanimous vote. CONSENT DECREE RE: ELECTIONS PROCESS AOTION ADJOURNMENT Commissioner Collins made a motion that the Board session. Commissioner Hudson seconded the motion unanimous vote. come out of executive and it passed with a W. Glenn Johnson, County Attorney, briefed the Board on status of the County Elections process case and read proposed. Consent Decree between the plaintiffs and the Harnett County Board of Commissioners and Harnett County Board of Education. Commissioner Hudson moved that the County Attorney be authorized and directed to execute on behalf of the County of Harnett the proposed joint motion for entry of Consent Decree and Consent Decree as presented by the County Attorney at such time as said motion and Consent Decree are approved by the Harnett County Board of Education. Commissioner Smith seconded the motion and it passed with the following vote: Ayes: Commissioners Stewart, Hudson, and Smith Noes: Commissioner Collins Absent: Commissioner Shaw There being no further business, the Harnett County Board of Commissioners special meeting of October 25, 1989, duly adjourned at 9 p.m. G.
